In do nesia. It is ch aracterized by th e existence of th e ob sta cles often faced by
bud ding entrepreneurs in d etermin in g the fo rmat of th e b usin ess to b e u ndertaken.
CV. Cho ice Plus Ind on esia is on e of the o nly fra nchises Don utbo yz. To start a
fran ch ise, sta rting with a fran ch ise a greement wh ere there are 2 (two) parties,
namely CV. Cho ice Plus In do nesia (the first or th e fra nchisor) a nd a seco nd party
or fran ch isee. Imp lemen ta tio n of th e a greement between the two sides o f cou rse
th ere a re man y o bsta cles, the a greement co uld involve or ou tside th e a greement.
This research will d iscu ss the implemen ta tio n of the righ ts an d ob lig ation s of the
parties a nd th e facto rs th at mu st be con sid ered beyo nd the ag reemen t b y using
emp irical lega l research is descrip tive an d qu alitative research app roaches. The
data collected by th e au tho rs, u sin g direct interviews, literatu re stud y o n primary
and seco nd ary d ata, an d in teractive a na lysis.
The resu lt in CV. Ch oice Plu s Ind onesia is in th e implementation
Don utbo yz fran ch ise a greement, ea ch p arty ha s the rig hts a nd o bligation s tha t
must b e imp lemented. S urely in th e implemen tation o f the a greement, is no t free
from p roblems, d espite b eing guid ed b y vario us regu latio ns fran ch ise, p ro blems
su ch a s la te delivery, late p aymen ts, delays in the delivery o f tra ining a nd la ck o f
promo tio n. Beca use of th e a bove p ro blems, it is n ecessary to set th e con tents o f
th e fra nchise ag reemen t setting a propo rtion ate a nd b ala nced for bo th parties.
While the fa ctors th at must be con sid ered beyond th e contents o f th e ag reemen t in
th e form of p recision workma nship a nd a la ck o f emplo yee un derstan ding o f
human reso urces to the con tents o f the agreemen t, th e p olitical fa ctors, socio cu ltu ra l factors, an d the fa ctors which the writer su gg ested eko no mi.S ed an gk an
su gg estio n is to Do nutb oyz should b e coordina ted with well-p la nn ed schedule so
as to b en efit b oth p arties a nd emp loyees in the promotio n should b e ad ded ag ain
in o rd er to b e do ne p ro perly a nd p la nn ed ; to th e Central Governmen t, the
regu la tory overh aul sho uld b e h eld so tha t the po sitio n o f the pa rties' fran ch ise in
