EXECUTIVE SUMMARY
1 Project background. The Neighborhood Upgrading and Shelter Project Phase 2 (NUSP-
2) is a community driven development project included in the National Medium-Term
Development Plan (known as RPJMN) 2015 - 2019 of the Government of Republic of Indonesia.
The key objectives of the NUSP- 2 are to achieve the “Cities without Slums Program” and address
ongoing issues related to rapid urbanization in growing cities of Indonesia. Further, this project is
expected to contribute towards meeting the Millennium Development Goals, particularly in
improving the lives of slum dwellers and reducing (by half) the proportion of households without
sustainable access to safe drinking water and basic sanitation. The NUSP-2 is being implemented
in 20 cities throughout Indonesia, by the Directorate General of Human Settlements (DGHS) - the
Ministry of Public Works and Housing (MPWH) and financed by the Asian Development Bank
(ADB).
2 Kapuas District is one of districts in Central Kalimantan Province. This district encounters
rapid urbanization and high population growth of about 6.49% per annum. These conditions have
resulted that the low-income families are forced to settle in slum areas without basic sanitation
and infrastructure. The slum areas in this district have reached about 331.72 Hectares, and
disburse in 10 neighborhoods (kelurahan). The existence of these area is confirmed through the
Head of Kapuas District Decree No. 772/PU/2014 (8 September 2014) on Determination of Slum
Areas Project of the Neighborhood Upgrading and Shelter Project Phase 2 Program in Kapuas
District.
3 Environmental safeguards. ADB will finance the construction of facility and infrastructure
for the Handil Berkat Makmur New Site Development (NSD) in Selat Utara Kelurahan of Kapuas
District; and therefore this construction should comply with the ADB’s Safeguard Policy Statement
(ADB SPS 2009) in which the Initial Environmental Examination (IEE) for this Category B Project
is required. In addition, the Handil Berkat Makmur NSD has secured: the approval for the
environmental management and monitoring effort (known as UKL-UPL) document from the
Environmental Agency of Kapuas District on 18 October 2017; and the corresponding
Environmental Permit from the Head of Kapuas District on 29 December 2017 to comply with the
requirements of Government Regulation No. 27/2012 on Environmental Permitting. This IEE and
UKL-UPL are the environmental safeguard documents that should be complied by the Project
Executing Agency during the project implementation.
4 Existing development at Handil Berkat Makmur NSD. The local government (Kapuas
District) has provided approximately 3.17-hectare land in Kelurahan Selat Utara for the NSD. This
site has been designated as a permanent housing area according to Statement Letter No.
600/1367/DPUPRPKP/2017 (dated January 2017) issued by the Head of Kapuas District
confirming that the area designated for the Handil Berkat Makmur NSD aligns with the mentioned
spatial plan. The existing activity at the Handil Berkat Makmur NSD is land clearing financed by
the local government of Kapuas District.
5 Planned development at Handil Berkat Makmur NSD. The Handil Berkat Makmur NSD
plans to construct the facility and infrastructure for the neighborhood in 2018 followed by a 6-
month maintenance period. Subsequently, the maintenance and operation of the Handil Berkat
Makmur NSD will be handed over to the local government (Kapuas District) and managed by the
Handil Berkat Makmur NSD management (Badan Pengelola) of the Public Work Agency of
viiiKapuas District. The construction activity will be funded by ADB.
6 The construction and/or installation of key facility and infrastructure that will be required for

7 Prior to commencing the construction at the Handil Berkat Makmur NSD, the PMU requires
the government of Kapuas District to carry out the dissemination on the project, including its
anticipated impacts as well as corresponding migration measures; and to establish a Grievance
Redress Mechanism (GRM). The construction phase will include: recruitment of construction
labors; mobilization of equipment and construction materials; and construction of facility and
infrastructure itself as presented in the above table. Upon completion of the construction, the
Contractor will maintain the facility and infrastructure for 6-month period. ix
8 Environmental and social baseline conditions. The Handil Berkat Makmur NSD has an
elevation of approximately 0- 5 meters above sea level, and a slope of 0-8%. From 2009 to 2011,
the highest rainfall was about 4,192 mm in 2010 whereas the lowest rainfall was about 57 mm in
2009.
9 The baseline ambient air quality in and outside the Handil Berkat Makmur NSD is
considered relatively good, as the analytical results issued by the Laboratory of the Environmental
Agency of Kapuas District in November 2017 indicated that the concentration of Sulphur dioxide
and nitrogen dioxide are well below the threshold values stipulated by Government Regulation
No. 41/1999 on Air Pollution Control. The noise level at the NSD neighborhood is measured a
little bit over 55 dB(A) which is the threshold value stipulated by the Ministry of Environment
Decree No. 48/1996 on Noise Level Standard. The ambient of noise level measurement has been
taken at two points (inside and outside) of the Handil Berkat Makmur NSD in November 2017.
The noise level measured inside the Handil Berkat Makmur NSD is 62.7 dB and outside is 58.4
dB.
10 The clean water supply at Handil Berkat Makmur NSD is supported by the PDAM Kapuas.
Based on the water quality test on PDAM, the result still relatively good as the key parameters
analyzed (i.e. pH, iron, manganese, chloride, free chlorine, nitrate, nitrit, E-colli and coliform) are
below the threshold values stipulated in the Ministry of Health Regulation No. 416/1990, on Clean
Water Quality Standard.
11 There are no flora and fauna species identified at the Handil Berkat Makmur NSD
categorized as endemic, rare, protected or other conservation status .
12 According to the statistical data of “Kapuas in Number Year 2017 (Kapuas Dalam Angka
Tahun 2017)”, published by the local government (Kapuas District), the total population of Kapuas
District is 351,043 people. Five of these 10 kelurahans are the target of NSD, and the population
of these 5 target kelurahan is 27,497 people or 7,969 households in which 663 of the households
living in squatter areas . The dominant source of income is from private and informal sector such
as fishermen, daily labors and farmers.
13 Anticipated environmental impacts and planned mitigation measures. The pre-
construction, construction and maintenance/operation activities will generate relatively minimal
environmental impacts limited within the Handil Berkat Makmur NSD site. If well managed, these
impacts are unlikely to be encountered beyond the perimeter of the site. The impacts of this type
of neighborhood development are anticipated on: public perception and attitude towards the
project and contractors; ambient air quality and noise level; sedimentation and surface water
quality; work and business opportunities; and occupational health, safety and hygiene.
14 Corresponding measures that should be implemented to mitigate the environmental impacts
mentioned earlier are, among others: Conduct dissemination about the project and planned activity prior to the construction phase and during maintenance period; Establish a Grievance Redress Mechanism to manage complaints and concerns raised by the community and other stakeholders in a structured manner; Conduct water spraying of the construction sites as well as along the main road leading to the Handil Berkat Makmur NSD construction at least once per day or more frequent during dusty road condition; x
Construct and maintain a temporary drainage channel and settling ponds to manage runoff and siltation during the construction period;
Conduct induction for labors on occupational health, safety and hygiene; HIV/AIDS and other infectious diseases; and the use of personnel protective equipment (PPE) as the requirement to work as construction labor; Provide and maintain adequate toilet, bathing and washing facilities for construction workers at the construction site.
15 The mitigation measures and monitoring requirements are detailed in the Environmental
Management Plan (EMP) of this IEE, including the distribution of responsibilities of the Contractor,
District Satker and Local Coordinating Office within the Kapuas District, and Project Management
Unit- – the Directorate General of Housing Settlements. The project has estimated a cost of USD
11,790 will be required for implementing the mitigation measures and monitoring requirements
defined in the EMP.
16 As part of the project disclosure, the IEE and UKL-UPL documents of Handil Berkat Makmur
NSD including its periodic monitoring reports will be made available to the public. The IEE and its
update, if any, and quarterly monitoring report will be p osted at ADB’s website. The informationof regarding NUSP-2 will be provided at the Municipality Satker Office (Public Work Agency of
Kapuas District) and the office of NSD management board (Badan Pengelola) in form of document
copies, leaflet, booklets and short movie where appropriate. xi
CHAPTER 1
INTRODUCTION1.1 Project Background
17 The Neighborhood Upgrading and Shelter Project Phase 2 (NUSP-2) is a community driven
development project stated in the 2015 - 2019 National Medium-Term Development Plan of
Indonesian Government. Implementation of the NUSP-2 project is underway to achieve the “Citieswithout Slums Program” and address ongoing issues on slum settlements related to rapid
urbanization. The project will be implemented in 20 cities, supported by the Asian Development
Bank (ADB) and executed by the Ministry of Public Works and Housing (MPWH), particularly the
Directorate General of Human Settlements (DGHS) as the key Project Executing Agency (EA).
The main tasks of the DGHS are to develop and implement inclusive pro-poor District
development plans and improve living conditions in slum areas.
18 The NUSP-2 project is implemented through collaborative works involving: the DGHS to
construct infrastructure; the Directorate General of Housing Provision (DGHP) to construct the
houses; and the selected local government (regency/District) to provide at least 2-hectare vacant
land ready for the establishment of new site development. This project is expected to contribute
towards meeting the Millennium Development Goals (MDG), particularly to improve the lives of
slum dwellers and to reduce (by half) the proportion of households without sustainable access to
safe drinking water and basic sanitation. The outputs of the project are:
Institutional capacities for managing pro-poor urban development strengthened;
Infrastructure in slum neighborhoods upgraded; and New settlements for poor families established.
19 Kapuas District is located in Central Kalimantan Province, and selected as one of the NSD
sites of NUSP-2 project. Like other urban development in Indonesia, the district encounters rapid
urbanization and high population growth of about 6.49% per annum, forcing the low-income
families to settle in slum areas. These neighborhoods usually lack of basic sanitation facility and
infrastructure. In Kapuas District, these slum settlements are located along the riverbanks. The
district government of Kapuas has indicated that the slum settlements have reached about 331.72
hectares, distributed in 10 neighborhoods (kelurahans). The existence of these slum settlements
isconfirmed through the Head of District’s Decree No. 772/PU/2014 (dated September 8, 2014)
on Determination of Slum Areas Project of the Neighborhood Upgrading and Shelter Project
Phase 2 Program in Kapuas District.
20 Based on the condition described earlier, the district government of Kapuas has developed
a Slum Improvement Action Plan (SIAP) in 2016 as the basis to implement the NUSP-2 project,
particularly the construction of facilities and infrastructure at the Handil Berkat Makmur NSD site.
This Initial Environmental Examination (IEE) describes the scope of the mention construction
projects, including its anticipated impacts and corresponding mitigation measures as well as those
responsible for implementing these measures.1.2 Objective of Initial Environmental Examination
21 ADB will support the construction of facilities and infrastructure for the Handil Berkat

Makmur NSD in Kapuas District; and therefore, as part of ADB's Safeguard Policy Statement
(ADB SPS 2009) on Environment, an IEE for this scope of work should be developed. The IEE
development is mandated in the Environmental Assessment and Review Framework document
(EARF) prepared by the DGHS for the NUSP Phase 2 Project (January 2014). This IEE is
prepared by district government of Kapuas, as integral part of the Handil Berkat Makmur NSD
proposal for subsequent endorsement by the DGHS and ADB.
22 The IEE is the reference document for assessing anticipated environmental impacts,
defining the mitigation measures to be done, and monitoring these measures. All of these are set
in the Environmental Management Plan (EMP), which also includes the key indicators,
responsible parties for implementation and monitoring, and the scheduled timeline. This IEE
should be used by the Executing Agencies at the national, provincial and district levels (with their
respective functions) to make sure of environmental safeguard during the pre-construction,
construction and operation phases in implementing the Handil Berkat Makmur NSD.23 This IEE does not replace the Environmental Management Effort
- – Environmental
Monitoring Effort document (UKL-UPL) that has been prepared and approved by the
Environmental Agency of Kapuas District in October 2017, and therefore the requirements of both
IEE and UKL-UPL should be implemented by the Project Executing Agency and/or its appointed
local authorities.
24 The contents of the IEE include: executive summary; introduction; applicable environmental
legal and administrative frameworks; project description; environmental and social baseline;
anticipated environmental impacts and mitigation; information disclosure and stakeholder
consultation/participation; grievance redress mechanism; environmental management plan;
conclusions and recommendations and references used.2
CHAPTER 2
ENVIRONMENTAL POLICY LEGAL AND ADMINISTRATIVE FRAMEWORK2.1 ADB Environmental Safeguard Policy
25 ADB requires environmental safeguard measures in all aspects of ADB operations, in
accordance with ADB SPS 2009, which states that ADB requires an environmental assessment
of all activity loans, program loans, sectoral loans, loan sector development programs, and loans
involving financial agent, and private sector loans. The type of environmental assessment
required depends on the nature, magnitude, significance, and sensitivity of environmental impact
of the project. ADB uses the following categorization to screen expected environmental impacts
of a project: Category A: Projects could have significant and adverse environmental impacts that are irreversible, diverse, or unprecedented. These impacts may affect an area larger than the sites or facilities subject to physical works. An Environmental Impact Assessment (EIA) is required for the category A project.
Category B: Projects could have some adverse environmental impacts, but of less degree or significance than those of category A. These impacts are site-specific and can be readily addressed through common mitigation measures. An IEE is required for the category B project.
Category C: Projects are likely to have minimal or no adverse environmental impacts.
No environmental assessment is required although environmental implications need to be reviewed. Category Financial Intermediary (FI): Projects involves a credit line through financial intermediary or an equity investment. The FI must apply for an environmental management system.
26 The Handil Berkat Makmur NSD development in Kapuas District, including the construction
or upgrading of its infrastructure, will improve the welfare of its community, and is expected to
generate typical impacts associated with relatively small-scale building and infrastructure
construction activities. These impacts, which neither adverse nor significance, can be readily
mitigated with common mitigation measures. Therefore, the IEE is required for the mentioned
NSD development as the environmental safeguard document required by ADB.2.2 Requirements of Government of Indonesia
27 Government of Indonesia has environmental protection and management policy and legal framework stipulated through Environmental Protection and Management Act No. 32/2009.
Subsequently, the Government Regulation (GR/Peraturan Pemerintah) No. 27/2012 on
Environmental Permit is stipulated as one of the implementing regulation, requiring that every
business and/or activity that will generate significant environmental impacts must have an AMDAL
(Procedures of Environmental Impact Assessment), whereas those that do not generate
significant impacts must have an Environmental Management Effort and Environmental
Monitoring Effort (UKL-UPL) document. These documents are subject to approval by the Ministry
of Environment and Forestry or local governments (i.e. provincial and regency/District) depending
on the nature, scope, and administrative location of the business and/or activity. Based on the

AMDAL or UKL-UPL approval, the mentioned GR 27/2012 requires that the business and/or
activity apply for the Environmental Permit (Izin Lingkungan) to the same government authority
granting the AMDAL and UKL-UPL approval.
28 Other key regulations related to the environmental assessment that are adhered to by the
Handil Berkat Makmur NSD development are as follows: (i) Minister of Environment Regulation No. 5/2012 on Type of Business and/or ActivityRequiring AMDAL; (ii) Minister of Environment Regulation No. 16/2012 on Guidelines for the Preparation of Environmental Documents; and (iii) Minister of Public Works Regulation No. 10/PRT/M/2008 on Types of Business and/or Activity in Public Works Sector Requiring UKL-UPL.
29 Based on the Indonesian environmental laws and regulations described earlier, the Handil
Berkat Makmur NSD has developed the required UKL-UPL and secured its approval based on
the Decree of Head of Environmental Agency of Kapuas District No. 660/364/DLH/X/2017 (dated
18 October 2017) on Approval of the NSD Kapuas’s UKL-UPL Document (Appendix 1), and
subsequently the required Environmental Permit No. 627/DPMPTSP year 2017 (dated 29
December 2017) from Head of Kapuas District (Appendix 2).4
CHAPTER 3
PROJECT DESCRIPTION3.1 The Need for NSD Implementation
30 The district government of Kapuas has undertaken assessment of potential beneficiaries to
be resettled in the Handil Berkat Makmur NSD. They are low-income families who are squatting
along the riverbanks of Kapuas and Sei Selat rivers, scattered around in 5 kelurahans, namely
Selat Hulu, Selat Tengah, Selat Dalam, Selat Hilir and Pulau Telo. These areas were actually
designated for green belt and inspection road.
31 Neighborhood roads, clean water supply system, waste water system and drainage system
are some of public facilities and infrastructure that will be constructed at the Handil Berkat Makmur
NSD funded by ADB as part of the NUSP-2 project in 2018 (see details in Table 1). These
infrastructures are important for the would-be residents of Handil Berkat Makmur NSD, as they
will provide safe mobility, social interaction, affordable access to basic sanitation and housing
facilities.
32 In addition, on the Handil Berkat Makmur NSD site, the district government of Kapuas will
provide electricity network, piping system for clean water supply which connected to the city main
pipeline (PDAM) and landscape, as well as social and public facilities such as multi-purpose
building and mosque. The following sub-section describe the existing and the future development
of the NSD.3.2 Land Status and Existing Development
33 For the NSD site, the district government of Kapuas has provided approximately 3.174
hectare of land in Kelurahan Selat Utara. This land is owned by the district government based on
the Land Title (Sertifikat Tanah) No. 15.02.01.03.4.00015 issued in 14 March 1996 by the National
Land Agency of Kapuas District (Appendix 3). This site is knowned as Handil Berkat Makmur.
34 The land allocated for the Handil Berkat Makmur NSD has been designated as a permanent
housing area according to Statement Letter No. 600/1367/DPUPRPKP/2017 (dated January
2017) issued by the Head of Kapuas District confirming that the area designated for the Handil
Berkat Makmur NSD aligns with the mentioned spatial plan (Appendix 4). The location of Handil
Berkat Makmur NSD within the mentioned RTRW of Kapuas District is shown in Figure 1.
35 Figure 2 presents the aerial view of the existing site of Handil Berkat Makmur NSD. The
200 housing units in Handil Berkat Makmur NSD will be developed and financed by DGHP.
36 Land Clearing. The actual condition of the NSD site is vacant. The land clearing activity
includes leveling (adjusting land contour) of 3.17-Ha area was being carried out by the local
government in 2018.5

3.3 Future Development
37 DGHP will fund the construction of 200 housing units at the site of Handil Berkat Makmur

NSD and conduct the house development in two phases i.e. 100 units to be constructed in 2018
and 100 units in 2019. The facilities and infrastructure, which will be constructed as part of the
NUSP-2, are funded by ADB including: Construction of neighborhood roads, drainage system and piping system for clean water supply, waste water system, fishing pond, and retaining wall (talud). Provision of facility and equipment to support solid waste management within the housing complex; Provision of electricity network and green open space.
The details of this planned facility and infrastructure mentioned earlier are presented in Table 1.
The project development phases of the facilities and infrastructure are described in subsequent
sections of this IEE.

3.3.1 Pre-construction Phase
38 Activities completed in 2017 - 2018. The UKL-UPL document for Handil Berkat Makmur
NSD was completed and approved by the Environmental Agency of Kapuas District based on the
Letter No. 660/364/DLH/X/2017 (dated 18 October 2017). Subsequently, the corresponding
Environmental Permit has been secured by Decree of Head of Kapuas District No. 627/DPMPTSP
year 2017 (dated 29 December 2017) for the Handil Berkat Makmur NSD has also been secured
from the same authority
39 A dissemination meeting was held on 27 April 2018 at the office of Kelurahan Selat Utara
attended by the Head of Kelurahan Selat Utara, the Head of Sub-District Selat, staff of Housing
and Settlement Agency of Kapuas District, some community members of Selat Utara and the
contractor firm (Figure 3). The meeting was aimed to disseminate information on the NSD plan.
At this event, 5 out of 35 participants were woman who actively involved in the discussion. The
response of the participants of this meeting was generally positive. The minutes of this meeting
is included in Appendix 5, and the list of participants is provided in Appendix 6.

40 Dissemination of Construction Activity at Handil Berkat Makmur NSD. Another public
consultation or dissemination event will be required to be held by the district government of
Kapuas prior to the commencement of the construction of the Handil Berkat Makmur NSD site in
2018. This event should invite representatives of the local government and related agencies, the
contractors and nearby communities of Selat sub-district. The main agenda of this dissemination
is to provide transparent information about the construction activities to be undertaken at the
Handil Berkat Makmur NSD site (including local business and employment opportunities that may
be generated from such construction activities); to establish a Grievance Redress Mechanism
(GRM); and to accommodate questions or concerns from the invitees. This dissemination event
is expected to take place at the office of Kelurahan Selat Utara.3.3.2 Construction Phase
41 Recruitment of construction labors. The construction of facilities and infrastructure for
the Handil Berkat Makmur NSD requires skilled and unskilled labors consisting of drivers, heavy
equipment operators, project supervisor/foremen, stone-men, carpenters, electricians, and daily
labors. It is expected that the need of most labors will be recruited from the local community
around the Kelurahan Selat Utara. Skilled labors that cannot be supplied from this kelurahan will
be recruited from elsewhere. It is estimated that the total number of labors required for the
construction activities is up to 80 people, but this number will be reduced as the work gradually
completed. The labors from outside the area will be accommodated in a temporary labor
basecamp to be constructed within the Handil Berkat Makmur NSD.
42 Mobilization of equipment and construction materials. The mobilization of equipment
will include small to medium-sized excavators for earthworks and small tonnage of dump trucks
for transportation of construction materials. Construction materials to be mobilized are soils,
rock/stones, sand, cement, bricks, steels and woods from Kapuas area.
