State Budget: Budgeting in
Indonesia
New legal framework for budgetingPrior to the crisis, there was no efective legal framework for budgeting in Indonesia. In fact, the process was essentially a continuation of the Dutch colonial budgeting system where the preparation of the budget was conducted internally by the Governor-General.
The process was characterised by a lack of transparency and accountability. After independence, this executive-driven legal framework was embraced by Indonesia’s very strong presidents.
A series of successive laws were adopted in the early 2000s following extensive consultations involving a multitude of stakeholders. The major laws are: ● The State Finances Law 17/2003 (UU Keuangan Negara) ● The State Treasury Law 1/2004 (UU Perbendaharaan Negara) ● The State Planning Law 25/2004. (UU Perencanaan Pembangunan Nasional) ● The Regional Governance Law 32/2004 (which replaced an earlier law from 1999).
State Budget
The State Finances Law 17/2003 details the constitutional provisions for the budget process, mandates specifc milestones and dates for the preparation and adoption of the budget, specifes general principles and authorities for the management and accountability of state fnances, and establishes the fnancial relationship between the central government and other institutions.
The State Treasury Law 1/2004 outlines the responsibilities of the Treasury and articulates the
creation of treasurers in government ministries and
agencies, together with general principles on the management and accountability of public funds.State Budget
The State Planning Law 25/2004 outlines the national
development planning process, the preparation and approval of plans, and the role of the National Development Planning Agency (BAPPENAS).The Regional Governance Law 32/2004 outlines the responsibility of regional governments for a range of public services, including education, health, public infrastructure, agriculture, industry and trade, investment, the environment, land, labour, and transport. It replaced an earlier law from 1999.

submit its reports to Parliament.

Legal persons (lat. persona iuris) are of two kinds: natural persons (also called physical persons) – people – and juridical persons (also called juridic, juristic, artificial, or fictitious persons, lat. persona ficta) Juridical persons Artificial personality, juridical personality, or juristic personality is the characteristic of a non-living entity regarded by law to have the status of personhood.
Artificial Personality allows that entity to be considered under law separately from its
individual members (for example in a company limited by shares, its shareholders). They may sue and be sued, enter contracts, incur debt, and own property. Entities with legal personality may also be subjected to certain legal obligations, such as the payment of taxes. An entity with legal personality may shield its members from personal liability.

Consideration
1. Pada hakikatnya BUMN, BUMD, atau nama lain yang sejenisnya yang seluruh atau sebagian
besar sahamnya merupakan milik negara adalah merupakan kepanjangan tangan negara, dalam hal ini Pemerintah Pusat atau Pemerintah Daerah
2. Sebagai kepanjangan tangan negara, fungsi BUMN merupakan derivasi dari penguasaan
negara atas cabang-cabang produksi yang penting bagi negara dan menguasai hajat hidup orang banyak serta sumber daya alam indonesia sebagai bagian dari fungsi dan tujuan negara dalam negara kesejahteraan (Welfare State).
3. Pemisahan kekayaan Negara tidak dapat diartikan sebagai putusnya kaitan negara dengan
BUMN, BUMD, atau nama lain sejenisnya. 4. Pemisahan kekayaan negara dilihat dari perspektif transaksi bukanlah merupakan transaksi
