that in order to increase competitiveness of national industry, it is
need to do a simplification of licensing in the fields of trade,
especially exports of industry forestry products;
that the provisions on the export of products of the forestry
industry in the Ministerial Regulation of Trade Number
97/M.DAG/PER/12/2014 on the export of Industry Forestry
Products, as amended by the Ministerial Regulation of Trade
Number 66/M-DAG/8/2015 is considered to be irrelevant;
that based on the consideration as referred to in paragraph b, it is
necessary to revoke the Ministerial Regulation of Trade Number

97/M-DAG/PER/12/2014 on Export Provisions of Industry
Forestry Products as amended by the Ministerial Regulation of
Trade Number 66/M-DAG/PER/8/2015 and re-arrange the export
provisions of Industry Forestry Products;
that based on the considerations as referred to in paragraph a,
paragraph b, and paragraph c, it is necessary to stipulate
Ministerial Regulation of Trade on Export Provisions of Industry
Forestry Products.

HAS DECIDED
To stipulate: MINISTERIAL REGULATION OF TRADE ON EXPORT PROVISION OF INDUSTRY
FORESTRY PRODUCT.
Article 1
In this Ministerial Regulation what is meant by:
1.
Forestry Industry Product is processed wood products and its derivatives as well as rattan
goods.
2.
Timber is part of trunk containing of cambium (ligno cellulose) excluding bamboo and / or
the like.
3.
V-legal document is a document stating that the timber products export timber legality
verification standards in accordance with the provisions of the law and legislation.
4.
Timber Legality Certificate, hereinafter referred to as S-LK is a certificate given to the
permit holder, management right holder, or private forest owner stating that permit
holder, management right holder, or private forest owner has met the standard of legality
of timber.

5.
Timber Legality Verification Agency, hereinafter abbreviated LVLK Indonesia are legal
entities that verify the legality of timber and has been designated by the Minister of
Environment and Forestry as publisher of V-Legal Documents.
6.
Verification or Technical is the investigation and examination of Industry Forestry
Products made by the surveyor.
7.
Surveyor is a survey company that is authorized to perform verification or technical
surveillance.
8.
Timber Legality Information System Online is an information system that serves as an
information center TLAS and media publishing V-Legal Documents.
9.
Minister is the minister who held government affairs in the field of trade.
10. Director General is the Director General of Foreign Trade, Ministry of Commerce.
Article 2

Export of Industry Forestry Products shall be limited.
Industry Forestry Products restricted exports shall be divided into Group A, Group B and
Group C as listed in Annex I, which is an integral part of this Ministerial Regulation.
Article 3

Exports of Industry Forestry Products as referred to in Article 2 may only be carried out by:
a.
Forest industry companies have Industrial Registration (TDI) or Industrial Business Permit
(IUI) and Company Registration (TDP); and
b.
Export trading company in the field of Industry Forestry Products which have a Business
Permit (SIUP) and Company Registration (TDP).

Exports of Industry Forestry Products as referred to in Article 2 paragraph (2) included in

Group A shall be equipped with a V-Legal Documents issued by LVLK.
Exports of Industry Forestry Products as referred to in Article 2 paragraph (2) included in
Group B is not equipped with a document V-legal but must be accompanied by documents
which could prove that the raw materials derived from wood obtained from providers of
raw materials that have been has S-LK or in accordance with the provisions of
management of forest products under the provisions of the legislation.
The provisions as referred to in paragraph (1) and paragraph (2) shall not apply to Group
C.
V-Legal Documents as referred to in paragraph (1) shall be used as a complementary
customs documents required for the submission of export customs declarations to the
customs office.

Products Forestry Industry are included in Annex I Group A with Tariff/HS ex.
4407.10.00.00 to ex. 4407.99.90.00, ex. 4409.10.00.00 to ex. 4409.29.00.00, ex.
4412.31.00.00, to ex. 4412.99.00.90 (special laminated block and laminated board) ex
4415.00.00 and ex 4415.20.00.00 (special pallet boxes and pallet board), Ex
4418.10.00.00 to Ex 4418.90.90.00 (except doors and shutters), and 9406.00.92.00
(special prefabricated buildings of wood) can be exported in addition to the provisions of
Article 4 (paragraph 1), must also meet the technical criteria.
Technical criteria as referred to in paragraph (1) shall be listed in Annex II, which is an
integral part of this Ministerial Regulation.
Products Forestry Industry from coconut and palm wood in the form surfaced Four Side
(S4S) or subsequent processing can be exported and shall exempted from the technical
criteria as referred to in paragraph (2).

Article 6

The Industry Forestry Products as referred to in Article 5 (1) of doubtful fulfillment of
technical criteria referred to in Article 5 (2) can be exported after being approved in a
meeting of the Coordination Team.
Coordination Team as referred to in paragraph (1) shall be determined by the Director
General on behalf of the Minister.

Each 1 (one) V-Legal Documents as referred to in Article 4 paragraph (1) may only be used
for 1 (one) time delivery of export customs notification.
V-Legal Documents as referred to in paragraph (1) shall be sent by LVLK through SILK
Online to Indonesia National Single Window (INSW) portal electronically through
http://inatrade.kemendag.go.id.
Costs incurred on services publishing activity V-legal documents as referred to in
paragraph (1) shall be charged to the exporters with the amount determined by the costbenefit principle.

The Industry Forestry Products as referred to in Article 5, paragraph 1 (a) may only be
exported after verification or technical surveillance prior to loading.
The verification or technical search as referred to in paragraph (1) shall be done by the
surveyor appointed by the Minister.
To be designated as the executor of Verification or Technical Export of Industry Forestry
Products, Surveyor must fulfill the following requirements:
a. has a Letter of Permit Survey Services (SIUJS);
b. has been accredited as Inspection Board of the National Accreditation Committee (KAN);
c. have obtained a waiver of competence as a surveyor recognized technical capacity in the
field of verification or technical surveillance of Industry Forestry Products; and
d. has an extensive branch network in Indonesia.
The verification or technical surveillance of Industry Forestry Products include:
a. administrative verification activities to:
1.
industrial Registration (TDI) or Industrial Business Permit (IUI), for the
company's forestry industry;
2.
business Permit (SIUP), for trading companies in the field of export of products of
the forestry industry;
3.
company Registration (TDP); and
4.
V-Legal Documents.
b.
physical verification activities to;
1.
number, type, brand, and package number;

quantity of goods;
type of wood;
fulfillment of technical criteria;
conformity examination between the description of goods with Tariff/HS;
supervision of loading into containers, if the shipment of containerized; and
installation of the seals on the container if all the goods in the containers are
inspected by the Surveyor.
Verification or technical surveillance as referred to in paragraph (4) shall be written in the
form of Surveyor Report (LS) to be used as customs complementary document required for
the submission of export customs declarations to the customs office.

Article 9
LS as referred to in Article 8 paragraph (5) shall include a statement of truth on the results of
verification or technical surveillance and become Surveyor's responsibility.

Surveyor
shall
convey
LS
which
had
been
issued
through
http://inatrade.kemendag.go.id portal that will be forwarded to the INSW.
For Surveyor who publishes LS in the port shall submit the mandatory LS as referred to in
paragraph (1) after LS was issued.
For the Surveyor who issues LS in addition to the mandatory port shall submit the LS as
referred to in paragraph (1) no later than 1 (one) week after the issuance.

Article 11

The Surveyor shall submit a written report on the activities of verification or technical
surveillance of the implementation of every month.
The written report as referred to in paragraph (1) shall be submitted not later than 15
(fifteen) of the following month to the Director General with a copy to the Director General
of the Ministry of Agro Industry and Director General of Sustainable Forest Management
Ministry of Environment and Forestry.

Article 12
Costs arising from the activities of verification or technical surveillance as referred to in Article
11 shall be charged to the Government.

Article 13
(1)

Company as referred to in Article 3 shall report:
a. plans and realization of annual production, and plans and realization of forestry
export for industry forestry company; or
b.

(2)

plans and realization of annual exports, for the export trading company in the field of
Industry Forestry Product.
The report as referred to in paragraph (1) shall be submitted no later than the end of
February to:
a. realization of production and exports of the previous year, and the planned production
and export of the current year, the company's forestry industry; or
b. previous year export realization and export plan of the current year, for trading
companies in the field of export of Industry Forestry Products.
The form of the report as referred to in paragraph (2) that listed in Annex III, Annex IV,
Annex V and Annex VI shall be an integral part of this Ministerial Regulation.

The report as referred to in paragraph (1) shall be submitted to the Director General of
electronically via http://inatrade.kemendag.go.id with a copy to the Director General of the
Ministry of Agro Industry and Director General of Sustainable Forest Management
Ministry of Environment and Forests.
Article 14

Companies that do not implement the obligations as referred to in Article 13, shall be
sanctioned by revocation of permits:
a.Industrial Registration Number (TDI) or Industrial Business Permit (IUI), for the
company's forestry industry.
b.
Trading Business Permit (SIUP), for trading companies in the field of export of
Industry Forestry Products.
The imposition of sanctions as referred to in paragraph (1) shall be carried out by the
official publisher of permitting based on the competent authorities of permit fostering
agency.
Article 15

Surveyor who does not carry out obligations:
a.
as referred to in Article 9 sanction of revocation of the right to receive a fee for the
Verification or Technical Export of Industry Forestry Products.
b.
as referred to in Article 10 and Article 11 sanctioned revocation determination as executors
of verification or technical surveillance of Export of Industry Forestry Products.
Article 16

To the export of Industry Forestry Products which are examples of goods, materials
research, and consumer goods exhibitions abroad shall be exempted from the provisions of
this Ministerial Regulation after obtaining the approval of the Director General.
Approval as referred to in paragraph (1) shall be issued on the recommendation of the
technical ministries.

Article 17
Exports of Industry Forestry Products as referred to in Article 2 which includes Group A in the
form of Pulp and Paper raw materials used paper and / or non-timber shall be exempted from
this Ministerial Regulation after obtaining recommendation of the Director General of AgroIndustry, Ministry of Agriculture.

Article 18
Technical manual implementation of this Ministerial Regulation shall be determined by the
Director General.
Article 19
At the time this Ministerial Regulation shall comes into force:
a.
The provisions concerning the obligation to obtain recognition as a Registered Exporter
Industry Forestry Products (ETPIK) in the Minister of Trade Number 35/M-DAG/PER/
11/2011 on the export of rattan and rattan products; and
b.
Ministerial Regulation of Trade Number 97/M-DAG/PER/ 12/2014 on Export of Industry
Forestry Product as amended by the Ministerial Regulation of Trade Number 66/MDAG/PER/8/ 2015,
shall be revoked and declared invalid.
Article 20

This Ministerial Regulation shall come into force since 30 (thirty) days from the date of
promulgation.
For public cognizance, this Ministerial Regulation shall be promulgated by placing in the State
Gazette of the Republic of Indonesia.

TECHNICAL CRITERIA USED TO DETERMINE CERTAIN INDUSTRY FORESTRY
PRODUCTS THAT CAN BE EXPORTED
1.

The size and level of processed
a. Processes timber in the form of S4S (surfaced four sides) which included
HS.4407:
Processed timber product that is levelled on four sides so that the surface
becomes flat and smooth.
- derived from merbau timber with the provisions of cross-sectional area not
exceed than 10,000 mm2.
- derived from other than merbau timber with the provisions of cross-sectional
area of not more than 4,000 mm2.
b. Processed timber in the form of E2E or E4E included HS.4409:
Processed wood products derived from S4S by curved corner on two (2) corner
(E2E) or four (4) point (E4E) with the provisions of the curved angle of at least 3
mm (R3).
- derived from merbau timber with the provisions of cross-sectional area of not
more than 10,000 mm2.
- derived from other than merbau timber with the provisions of cross-sectional
area of not more than 4,000 mm2.
c. Finger Jointed which included HS.4407:
Processed wood products are produced by connecting lumber dried and planed

least 1.5 mm.

- More than 20 mm thick s.d. 35 mm has the reeded / groove on the broad side
of at least 3 mm.
- More than 35 mm thick s.d. 45 mm has the reeded / groove on the broad side
of at least 5 mm.
When there reeded / groove at 2 (two) sides of the depth reeded / groove is the
sum of two (2) sides.
At least half the width of the surface should be reeded or by 2 (two) groove with
a distance proportional to the whole timber.
l.

Flooring for Truck, Container, Ship Deck and Wagon that included HS.4409:
In the form of a tongue and groove (lidah and alur) or shiplap, with the following
conditions:
- of merbau, keruing kempas, and bangkirai timber type;
- thickness is no exceedre than 50 mm;
- cross-sectional area is not exceed than 12 000 mm2;
- groove and tongue high and shiplap is at least 5 mm depth.
Special pole, main sill, cross sill and truck body must be submitted by an image
that contains completely technical specifications (picture sets installed) and
must be exported along with its flooring.

m. Pallet boxes and pallet board (HS.4415):
Must be in the installed form.
n. Building elements of wood which is a unit of the unity of the building (HS.4418);
Must be in the form of a set of building elements with pictures containing
complete technical specifications without changing the shape and cut.
o. Prefabricated buildings of wood (HS.9406):
Must be in the form of prefabricated buildings set along with images containing
SCARA complete technical specifications without changing the shape and cut.
p. Post and Beam shall included HS.4409:
Processed timber products in the form of E4E and is reeded/grooved, with the
following provisions:
- cross-sectional area is not exceed than 4,500 mm2, reeded/grooved on 2 (two)
sides, with a depth on each side of at least 2 mm;
- cross-sectional area is not exceed than 8,100 mm2, reeded/grooved at 4 (four)
sides, with a depth on each side of at least 2 mm.
- cross-sectional area is above 8.100 mm2 up to 14,400 mm2, reeded/grooved at
4 (four) sides, with a depth on each side of at least 4 mm.
q. Window Board which is included HS.4409:
With the following provisions:
- one of the thick side shall be shaped with bullnose profile (curved semicircle);
- thick size is not exceed than 30 mm;
- cross-sectional area is not exceed than 7.800 m2.
2. Tolerance for size and defect.
a. all sizes of exported processed timber shall be provided a size tolerance as
follows:
- thickness is not exceed than 0.5 mm;
- Width is not exceed than 1 mm;
- Length is not exceed than 50 mm.
