DECREE OF THE MINISTER OF FINANCE
NO. 451/KMK.07/2001 DATED JULY 7, 2001
THE STIPULATION OF DETAILS OF CONTINGENCY FUNDS FOR ASSISTANCE TO
REGIONAL ADMINISTRATIONS RECORDING MARGINAL SURPLUSES AFTER
THE TRANSFER OF PERSONNEL, EQUIPMENT, FINANCING AND DOCUMENTS (P3D)
AND REGIONS REQUIRING SPECIAL TREATMENT ASSISTANCE
THE MINISTER OF FINANCE ,
Considering :
That in order to follow up the agreement with the Budgetary Committee of the House of Representatives
of the Republic of Indonesia on the allocation of the remainder of contingency funds in accordance with
Presidential Decree No. 39/2001 on the use of contingency funds as the assistance of the transfer of personnel,
equipment, financing and documents (P3D) to regional administrations, it is necessary to stipulate a decree of
the Minister of Finance on details of amounts of assistance to regional administrations recording marginal
surpluses after the transfer of P3D and to regions needing special treatment assistance.
In view of :
1. Law No. 22/1999 on the regional administration (Statute Book of 1999 No. 60, Supplement to Statute Book
No. 3839);
2. Law No. 25/1999 on the financial equilibrium between the central government and regions (Statute Book of
1999 No. 72, Supplement to Statute Book No. 3848);
3. Law No. 35/2000 on the state budget of revenue and expenditure for the fiscal year of 2000 (Statute Book of
2000 No. 250, Supplement to Statute Book No. 4052);
4. Government Regulation No. 104/2000 on the equilibrium fund (Statute Book of 2000 No. 202, Supplement
to Statute Book No. 4021);
5. Government Regulation No. 105/2000 on the management and accountability of regional finance (Statute
Book of 2000 No. 203, Supplement to Statute Book No. 2022);
6. Presidential Decree No. 157/2000 on the Central Working Team for the Implementation of Law No.
22/1999 on the regional administration and Law No. 25/1999 on the financial equilibrium between the
central government and regions;
7. Presidential Decree No. 181/2000 on general allocation funds of provinces and regencies and cities in the
fiscal year of 2001 (Statute Book of 2000 No. 268);
8. Presidential Decree No. 39/2001 on the use of contingency funds for assistance of the transfer of personnel,
equipment, financing and documents (P3D) to regional administrations;
9. Decree of the Minister of Finance No. 192/KMK.02/2001 on procedures and mechanism of distribution of
contingency funds for assistance of the transfer of personnel, equipment, financing and documents (P3D) to
regional administrations;
10. Decree of the Minister of Finance No. 382/KMK.07/2001 on the stipulation of details of contingency funds
for assistance of the transfer of personnel, equipment, financing and documents (P3D) to regional
administrations.
Observing :
Results of the consultative meeting between the Minister of Finance and the Budgetary Committee of
the House of Representatives of the Republic of Indonesia on July 18, 2001.
DECIDES :
To stipulate :
THE DECREE OF THE MINISTER OF FINANCE ON THE STIPULATION OF DETAILS OF
CONTINGENCY FUNDS FOR ASSISTANCE TO REGIONAL ADMINISTRATIONS RECORDING
MARGINAL SURPLUSES AFTER THE TRANSFER OF PERSONNEL, EQUIPMENT, FINANCING AND
DOCUMENTS (P3D) AND REGIONS REQUIRING SPECIAL TREATMENT ASSISTANCE.
Article 1
(1). Assistance funds granted to regions shall be funds which only can be used for financing personnel and
non-personnel expenses.
(2). Assistance granted to regions shall come from contingency funds in the disbursement of routine
expenditure of the State Budget of Revenue and Expenditure (RAPBN) for 2001.
(3). The granted assistance shall not be the addition to the General Allocation Funds for 2001 as already
stipulated in Presidential Decree No. 181/2000.
Article 2
(1). The amount of assistance to the respective provinces and regencies/cities shall be stipulated by using the
formula according to the provision in Article 3 of Presidential Decree No. 39/2001.
(2). Regions obtaining assistance shall be marginal regions being smaller than Rp. 250 billion in the case of
provinces and Rp. 75 billion in the case of regencies/cities.
(3). The amount of assistance to the respective provinces and regencies/cities shall be 7.5% of the total
personnel expense in 2001.
(4). The number of regions and the amount of assistance shall be as follows :
a. Provinces totaling 27, with the assistance value of Rp. 294.228.129.000,00,b. Regencies totaling 167, with the assistance value of Rp. 1.134.946.342.000,00,c. Cities totaling 52, with the assistance value of Rp. 294.402.029.000,00,(5). Details of amounts of assistance to the respective recipient regions shall be as contained in the Attachment
to this decree.
Article 3
(1). Special treatment assistance shall be granted to several provinces with considerations as follows :
a. Regions bearing additional burdens as a result of natural disasters, riots and settlement of refugees as
well as due to other imminent needs and priorities;
b. Regions lacking transport facilities so that travel/transport cost becomes expensive.
(2). The regions as meant in paragraph (1) shall be Irian Jaya, Aceh Special Region, Maluku, North Maluku,
East NusaTenggara, West Kalimantan, Central Kalimantan and Gorontalo.
(3). The amount of assistance to the respective regions securing the special treatment assistance shall be as
contained in the Attachment to this decree.
Article 4
(1). Criteria for placement/distribution of special treatment assistance shall be as follows :
a. Assistance is provided for the need of non-personnel routine expenditure;
b. Assistance is channeled through provinces for the need of provinces/regencies/cities;
c. Assistance is stipulated on the basis of decisions of governors based on agreements between governors,
regencies and mayors.
Article 5
(1). The assistance as meant in Articles 2 paragraph (2) and Article 3 paragraph (3) shall be provided for
assistance recipient regions as from July 2001 through the issuance of Decisions on Authorization (SKO).
(2). The distribution of contingency fund assistance shall be done in accordance with the procedures already
stipulated in the Decree of the Minister of Finance No. 192/KMK.02/2001 dated April 16, 2001 on
procedures for and mechanism of distribution of contingency funds for assistance of the transfer of
personnel, equipment, financing and documents (P3D) to regional administrations.
Article 6
The assistance as meant in Article 2 paragraph (2) and Article 3 paragraph (2) shall only be effective for
the fiscal year of 2001.
Article 7
Every region receiving the assistance shall be obliged to report the use of the assistance to the Minister
of Finance with a copy made available to the Minister of Home Affairs and Regional Autonomy.
Article 8
This decree shall come into force as from the date of stipulation.

Considering :

CONTINGENCY FUNDS FOR ASSISTANCE TO REGIONAL ADMINISTRATIONS RECORDING
MARGINAL SURPLUSES AFTER THE TRANSFER OF PERSONNEL, EQUIPMENT, FINANCING AND
DOCUMENTS (P3D) AND REGIONS REQUIRING SPECIAL TREATMENT ASSISTANCE.
Article 1
(1). Assistance funds granted to regions shall be funds which only can be used for financing personnel and
non-personnel expenses.
(2). Assistance granted to regions shall come from contingency funds in the disbursement of routine
expenditure of the State Budget of Revenue and Expenditure (RAPBN) for 2001.
(3). The granted assistance shall not be the addition to the General Allocation Funds for 2001 as already
stipulated in Presidential Decree No. 181/2000.
Article 2
(1). The amount of assistance to the respective provinces and regencies/cities shall be stipulated by using the
formula according to the provision in Article 3 of Presidential Decree No. 39/2001.
(2). Regions obtaining assistance shall be marginal regions being smaller than Rp. 250 billion in the case of
provinces and Rp. 75 billion in the case of regencies/cities.
(3). The amount of assistance to the respective provinces and regencies/cities shall be 7.5% of the total
personnel expense in 2001.
(4). The number of regions and the amount of assistance shall be as follows :
a. Provinces totaling 27, with the assistance value of Rp. 294.228.129.000,00,b. Regencies totaling 167, with the assistance value of Rp. 1.134.946.342.000,00,c. Cities totaling 52, with the assistance value of Rp. 294.402.029.000,00,(5). Details of amounts of assistance to the respective recipient regions shall be as contained in the Attachment
to this decree.
Article 3
(1). Special treatment assistance shall be granted to several provinces with considerations as follows :
a. Regions bearing additional burdens as a result of natural disasters, riots and settlement of refugees as
well as due to other imminent needs and priorities;
b. Regions lacking transport facilities so that travel/transport cost becomes expensive.
(2). The regions as meant in paragraph (1) shall be Irian Jaya, Aceh Special Region, Maluku, North Maluku,
East NusaTenggara, West Kalimantan, Central Kalimantan and Gorontalo.
(3). The amount of assistance to the respective regions securing the special treatment assistance shall be as
contained in the Attachment to this decree.
Article 4
(1). Criteria for placement/distribution of special treatment assistance shall be as follows :
a. Assistance is provided for the need of non-personnel routine expenditure;
b. Assistance is channeled through provinces for the need of provinces/regencies/cities;
c. Assistance is stipulated on the basis of decisions of governors based on agreements between governors,
regencies and mayors.
Article 5
(1). The assistance as meant in Articles 2 paragraph (2) and Article 3 paragraph (3) shall be provided for
assistance recipient regions as from July 2001 through the issuance of Decisions on Authorization (SKO).
(2). The distribution of contingency fund assistance shall be done in accordance with the procedures already
stipulated in the Decree of the Minister of Finance No. 192/KMK.02/2001 dated April 16, 2001 on
procedures for and mechanism of distribution of contingency funds for assistance of the transfer of
personnel, equipment, financing and documents (P3D) to regional administrations.
Article 6
The assistance as meant in Article 2 paragraph (2) and Article 3 paragraph (2) shall only be effective for
the fiscal year of 2001.
Article 7
Every region receiving the assistance shall be obliged to report the use of the assistance to the Minister
of Finance with a copy made available to the Minister of Home Affairs and Regional Autonomy.
Article 8
This decree shall come into force as from the date of stipulation.
