REGARDING
AMENDMENT OF GOVERNMENT REGULATION
NUMBER 11 YEAR 1962 REGARDING
TRADE OF GOODS UNDER SUPERVISION

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering:
a. That operational guidelines of Law Number 8 prp Year 1962 regarding Trade of Goods under Supervision
needs to be revised to conform the recent condition;
b. That implementation of Provisions of Goods under Supervision shall involve interdepartmental agencies so
that supervision which is currently governed by Minister in charge of trade is considered not effective;
c. That considering the above mentioned point a and b, it is deemed necessary to amend Government
Regulation Number 11 Year 1962 regarding Trade of Goods under Supervision;
In view of:
1. Article 5 paragraph (1) and article 33 of Constitution 1945 as amended with the fourth amendment of the
Constitution 1945;
2. Law Number 8 prp Year 1962 regarding Trade of Goods under Supervision (State Gazette of The Republic
of Indonesia Year 1962 Number 42, additional to State Gazette Number 2469);

3. Law Number 10 Year 1995 regarding Custom Provision (State Gazette of The Republic of Indonesia Year
1995 Number 75, additional to State Gazette Number 3612);
4. Government Regulation Number 11 Year 1962 regarding Trade of Goods under Supervision (State Gazette
of The Republic of Indonesia Year 1962 Number 46, additional to State Gazette Number 2473);
DECIDE:
Stipulate:
GOVERNMENT REGULATION REGARDING AMENDMENT OF GOVERNMENT REGULATION
NUMBER 11 YEAR 1962 REGARDING TRADE OF GOODS UNDER SUPERVISION
Article I
Amend several provisions in Government Regulation Number 11 Year 1962 regarding Trade of Goods under
Supervision as follows:
1. Change provision of article 1 so that entire article 1 shall be read as follows:
“Article 1”: Stipulation of goods under supervision shall be made trough Presidential Decree.
2. Change provision of article 2 so that the entire article 2 shall be read as follows:
“Article 2”
Presidential Decree referred to in article 1 shall govern:
a. Procedure, including licensing procedure, of trade of goods under supervision;

b. Action and administrative sanctions imposed on violation of procedures referred to in point a;
c. Other provisions required for governing trade of goods under supervision;

Omit Provision of article 5
Change provision of article 6 so that the entire article 6 shall be read as follows:
“Article 6”

“In the framework of implementing provision of article 2, government can assign legal apparatus in accordance
with the prevailing regulations”.
7. Change provision of article 8, so that the entire article 8 shall be read as follows:

“Article 8”
Any provisions needed for the implementation of this government regulation shall be stipulated by the
President.
Article II

With the enactment of this decree, stipulation of goods as goods under supervision which is governed by
Minister responsible for trade and the license obtained before the stipulation of this Government Regulation,
shall continue to apply as long as it is not altered by this Government Regulation.
Article III
This government Regulation shall come into force on the date of stipulation.

For everybody to be aware of it, this decree is ordered to be announced by placing it in the State Gazette of the
Republic of Indonesia.

TRADE OF GOODS UNDER SUPERVISION

GENERAL EXPLANATION
Pursuant to Government Regulation Number 11 Year 1962 regarding Trade of Goods under Supervision,
Minister in charge of trade affairs shall be responsible for supervising trade of goods under supervision. In
handling his task, Minister in charge of trade affairs shall coordinate with other ministers/ head of government
institution and hand over responsibilities relating the duty and authority of ministers/ head of government
institutions to the respected ministers/ head of government institutions. The coordination between Minister in
charge of trade and other ministers/ head of government institution is aimed at achieving synchronization of
policy and authority to ensure proper implementation of trade policy.
But, in its development, coordination for implementation of provision of trade of goods under supervision is
seen as not effective, therefore it is necessary to govern it with Government Regulation.
With the change of provision of trade of goods under supervision, it is expected that coordination among
ministries/ institutions related to trade of goods under supervision can be achieved so that it can give certainty

and create conducive situation in trade sector.
