ABSTRACT
Article 289 of Law No 22 of 2009 on traffic and Public Transportation is
the article that requires all Indonesian people to use a safety belt while riding
in four-wheeled vehicles. But in reality there are many drivers and passengers
in addition to the city transport drivers who do not use safety belts in the city
of Bandung. Even the police who were on duty often do neglecting the
perpetrators of such violations. The purpose of this research is the first,
investigate the factors underlying the traffic police do neglecting the
perpetrators of these violations, the second, knowing the factors that affect
the low public awareness of safety belt use public transportation, third,
knowing the role of the community to tackle these problems.
The method used is the juridical approach criminological analyzed
based on the science of law and also assisted by criminology. Then tried to

examine the legal principles applicable in a society that will be taken in
dealing with the crime of violation of safety belt use by drivers and conducted
public transportation passengers.
From this research it is known that the first, neglecting Traffic Police
because of the limited number of personnel Polrestabes Bandung Traffic
Police, so that a Traffic Police prefer to give offenders speeding ticket who
cause accidents. Second, the driver and passengers do not use public
transportation because of safety belts by individual factors, means or facilities
factors, law enforcement factors and cultural factors. Third, efforts to combat
violations of safety belt use public transportation in Bandung is committed by
the law, society, and related agencies.
