a. Companies possessing API are obligied to report the following matters to Heads of
Regional Offices of the Ministry of Industry and Trade :
(1) Business activities for every year;
(2) Any change in names, form of business entities, executives and addresses of
companies;
(3) The closure of companies or termination of import activities accompanied by the
returning of original API.
b. API are frozen in the case of companies which own API :
(1) Being investigated in sessions of the court because they are charged with
committing economic crimes and/or other actions connected with their business
activities and/or;
(2) Failing to fulfill the obligations as meant in letter a points (1) and (2);
c. API already frozen as meant in letter b can cleared in the case of the holders :
(1) Being declared not guilty/freed from all legal suits already having permanent
legal power by attaching decisions of the court and/or;
(2) Already fulfilling the obligations as meant in letter a points (1) and (2).
d. API are revoked in the case of the holders :
(1) Being declared guilty by the court and already securing permanent legal power,
and/or
(2) Failing to fulfill the obligations as meant in letter a points (1) and (2) not later
than 30 (thirty) working days as from the date of revocation;
(3) Failing to fulfill the obligation as meant in letter a point (1) twice.
e. The freezing, clearance and revocation of API :
(1) as meant in letters b, c and d are done by Heads of Regional Offices of the
Ministry of Industry and Trade where API are issued;
(2) as meant in letters b, c and d must be conveyed to the relevant companies in
writing, with copies made available to the Director of Imports.
