‫ﺍﳊﻤﺪ ﷲ ﺍﻟﺬﻱ ﺃﻧﺰﻝ ﻋﻠﻲ ﻋﺒﺪﻩ ﺍﻟﻜﺘﺎﺏ ﻭﱂ ﳚﻌﻞ ﻟﻪ ﻋﻮﺟﺎ‪ ،‬ﻗﻴﻤﺎ ﻟﻴﱰﺭ ﺑﺄ ‪‬ﺳﺎ ﺷﺪﻳ ‪‬ﺪﺍ‬
‫ﻣﻦ ﻟﺪﻧﻪ ﻭﻳﺒﺸﺮ ﺍﳌﺆﻣﻨﲔ ﺍﻟﺬﻳﻦ ﻳﻌﻤﻠﻮﻥ ﺍﻟﺼﺎﳊﺎﺕ ﺃﻥ ﳍﻢ ﺃﺟ ‪‬ﺮﺍ ﺣﺴ‪‬ﻨﺎ‪ ،‬ﺃﲪﺪﻩ ﲪ ‪‬ﺪﺍ ﻛﺜ ‪‬ﲑﺍ ﻃﻴ‪‬ﺒﺎ‬
‫ﻣﺒﺎﺭ ﹰﻛﺎ ﻓﻴﻪ ﻛﻤﺎ ﳚﺐ ﺭﺑﺎ ﻭﻳﺮﺿﻲ‪ ،‬ﻭﺃﺷﻜﺮﻩ ﻋﻠﻲ ﻧﻌﻤﻪ ﺍﻟﻈﺎﻫﺮﺓ ﻭﺍﻟﺒﺎﻃﻨﺔ‪ ،‬ﻭﻋﻠﻲ ﺃﻥ ﻫﺪﺍﻧﺎ‬
‫ﺍﻹﺳﻼﻡ‪ ،‬ﻫﺬﺍ ﺍﻟﺪﻳﻦ ﺍﻟﺸﺎﻣﻞ ﺍﻟﻜﺎﻣﻞ ﺍﻟﺬﻱ ﺧﺘﻢ ﺑﻪ ﺍﻷﺩﻳﺎﻥ‪ ،‬ﻓﻠﻪ ﺳﺒﺤﺎﻧﻪ ﻛﻠﻪ‪ ،‬ﻭﻟﻪ ﺍﻷﻣﺮﻛﻠﻪ‪،‬‬
‫ﺏ ﺍﻟﻌﺒﺎﺩ ﻭﺧﺎﻟﻘﻬﻢ‪ ،‬ﳛﻜﻢ ﻓﻴﻬﻢ ﲝﻜﻤﻪ‪ ،‬ﻭﻳﻘﻀﻲ ﻓﻴﻬﻢ ﺑﺄﻣﺮﻩ‪ ،‬ﻻ ﻣﻌﻘﺐ ﳊﻜﻤﻪ ﻭﻻﺭﺍﺩ‬
‫ﻭﻫﻮ ﺭ ‪‬‬

‫ﻷﻣﺮﻩ‪ .‬ﻭﺍﻟﺼ‪‬ﻼﺓ ﻭﺍﻟﺴ‪‬ﻼﻡ ﻋﻠﻲ ﺧﲑ ﺧﻠﻘﻪ‪ ،‬ﻭﺧﺎﰎ ﺭﺳﻠﻪ‪ ،‬ﻧﺒﻴﻨﺎ ﳏﻤﺪ ﺻﻠﹼﻲ ﺍﷲ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﺍﺧﺘﺎﺭﻩ‬
‫ﺍﷲ ﻟﺮﺳﺎﻟﺘﻪ‪ ،‬ﻓﺄﺩﻱ ﺍﻷﻣﺎﻧﺔ ﻭﺑﻠﹼﻎ ﺍﻟﺮﺳﺎﻟﺔ‪ ،‬ﻭﺟﺎﻫﺪ ﰲ ﺍﷲ ﺣ ‪‬ﻖ ﺟﻬﺎﺩﻩ ﺣﱵ ﺃﺗﺎﻩ ﺍﻟﻴﻘﲔ‪ ،‬ﻓﺼﻠﻮﺍﺕ‬
‫ﺍﷲ ﻭﺳﻼﻣﻪ ﻋﻠﻴﻪ ﻭﻋﻠﻲ ﺃﻟﻪ ﻭﺻﺤﺒﻪ‪ ،‬ﻭﻣﻦ ﺍﻫﺘﺪﻱ ‪‬ﺪﻳﻪ‪ ،‬ﻭﺳﺎﺭ ﻋﻠﻲ ‪‬ﺠﻪ ﺇﱄ ﻳﻮﻡ ﺍﻟﺪﻳﻦ‪.‬‬
‫)ﺃﻣﺎ ﺑﻌﺪ( ﻓﻘﺪ ﺇﻧﺘﻬﻲ ﻣﺎﻣ ‪‬ﻦ ﺍﷲ ﻋﻠ ‪‬ﻲ ﻣﻦ ﻛﺘﺎﺑﺔ ﻫﺬﺍ ﺍﻟﺒﺤﺚ ﺍﳌﺘﻮﺍﺿﻊ ﲟﺎ ﻓﻴﻪ ﻣﻦ ﺗﻘﺼﲑ‬
‫ﻭﻧﻘﺼﺎﻥ‪ ،‬ﺭﺍﺟﻴﺎ ﺑﻜﻞ ﺗﻀﺮﻉ ﻭﺧﻀﻮﻉ ﻗﻠﺐ ﻣﻦ ﺍﷲ ﻋﺰﻭﺟﻞ ﺃﻥ ﻳﻨﺘﻔﻊ ﺑﻪ ﻧﻔﺴﻲ ﻭﻣﻦ ﺃﺗﺎﺡ‬
‫ﻓﺮﺻﺘﻪ ﻟﻺﻃﻼﻉ ﻋﻠﻲ ﺳﻄﻮﺡ ﻣﺒﺎﺣﺜﻪ ﻭﻗﺼﻮﺭ ﺩﺭﺍﺳﺘﻪ‪ .‬ﻭﻫﺬﺍ ﺃﻭﺍﻥ ﳛﺴﻦ ﱄ ﺃﻥ ﺃﺳﻮﻕ ﺟﺰﻳﻞ‬
‫ﺍﻟﺸﻜﺮ ﻭﺍﻟﺘﻘﺪﻳﺮ ﻭﺧﺎﻟﺺ ﺍﻟﺘﺤﻴﺔ ﻭﺍﻹﺣﺘﺮﺍﻡ ﺇﱄ ﻛﻞ ﻣﻦ ﻟﻪ ﺣﻆ ﻭﻓﲑ ﰲ ﺇﺳﺒﺎﻍ ﻋﻨﺎﻳﺔ ﺗﺎﻣﺔ‬
‫ﻭﻣﺴﺎﻋﺪﺓ ﲦﺎﻧﻴﺔ ﻭﺇﺭﺷﺎﺩﺍﺕ ﻗﻴﻤﺔ ﺣﱵ ﺃﺳﺘﻄﻴﻊ ‪‬ﺎ ﻋﻠﻲ ﺗﻘﺪﳝﻪ ﺗﻮﻓﲑﺍ ﻟﺸﺮﻭﻁ ﺍﳊﺼﻮﻝ ﻋﻠﻲ‬
‫ﺍﻟﺪﺭﺟﺔ ﺍﳉﺎﻣﻌﺔ ﺍﻷﻭﱄ‪ ،‬ﺃﺫﻛﺮ ﻣﻨﻬﻢ ﻣﻦ ﻫﻮ ﺃﻟﻴﻖ ﺑﺬﺍﻟﻚ‪ ،‬ﻭﻣﻦ ﺑﲔ ﻫﺆﻻﺀ ‪:‬‬

‫‪-١‬ﻓﻀﻴﻠﺔ ﺍﻷﺳﺘﺎﺫ ﺍﻟﺪﻛﺘﻮﺭ ﺍﳊﺞ ﳏ ‪‬ﻤﺪ ﺃﻣﲔ ﺳﻮﻣﺎ‪ ،‬ﺍﻟﻘﺎﻧﻮﱐ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪ ،‬ﻋﻤﻴﺪ ﻛﻠﻴﺔ ﺍﻟﺸﺮﻳﻌﺔ‬
‫ﻭﺍﻟﻘﺎﻧﻮﻥ ﺟﺎﻣﻌﺔ ﺷﺮﻳﻒ ﻫﺪﺍﻳﺔ ﺍﷲ ﺍﻹﺳﻼﻣﻴﺔ ﺍﳊﻜﻮﻣﻴﺔ ﺟﺎﻛﺮﺗﺎ‪ ،‬ﻭﻓﻀﻴﻠﺔ ﻭﻛﻼﺋﻪ ﺍﻟﺜﻼﺛﺔ ‪:‬‬
‫ﺍﻟﺪﻛﺘﻮﺭ ﺃﲪﺪ ﻣﻜﺮﻱ ﺃﺟﻲ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪ ،‬ﻭﺍﻟﺪﻛﺘﻮﺭ ﺯﻳﻦ ﺍﻟﻌﺎﺭﻓﲔ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪ ،‬ﻭﺍﻟﺪﻛﺘﻮﺭ‪.‬ﺝ‪.‬ﻡ‪.‬‬
‫ﻣﺴﻠﻤﲔ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪.‬‬
‫‪-٢‬ﻓﻀﻴﻠﺔ ﺍﻷﺳﺘﺎﺫﺓ ﺃ ‪‬ﻡ ﻫﻨﺎﺀ ﻳﻮﺳﻒ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑﺓ‪ ،‬ﻭﻓﻀﻴﻠﺔ ﺍﻷﺳﺘﺎﺫ ﺃﲪﺪ ﺑﺸﺮﻱ ﻋﺒﺪ ﺍﻟﺼ‪‬ﻤﺪ‪،‬‬
‫ﺍﳌﺎﺟﺴﺘﲑ‪ ،‬ﻣﺸﺮﻓﺎﻥ ﰲ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ ﺍﻟﺬﻱ ﻗﺪ ﺑﺬﻝ ﺍﳉﻬﺪ ﻹﺷﺮﺍﻑ ﺍﻟﺒﺎﺣﺚ ﻭﺇﺭﺷﺎﺩﻩ ﰲ ﻛﺘﺎﺑﺔ‬
‫ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ‪.‬‬
‫‪-٣‬ﻓﻀﻴﻠﺔ ﺍﻷﺳﺘﺎﺫ ﳏﻤ‪‬ﺪ ﺗﻮﻓﻴﻘﻲ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪،‬ﻛﺮﺋﻴﺲ ﻗﺴﻢ ﻣﻘﺎﺭﻧﺔ ﺍﳌﺬﺍﻫﺐ ﻭﺍﻟﻘﻮﺍﻧﲔ‪ .‬ﻭﻓﻀﻴﻠﺔ‬
‫ﺍﻷﺳﺘﺎﺫ ﻓﻬﻤﻲ ﳏ ‪‬ﻤﺪ ﺃﲪﺪﻱ‪ ،‬ﺍﳌﺎﺟﺴﺘﲑ‪،‬ﻛﺴﻜﺮﺗﲑ ﻗﺴﻢ ﻣﻘﺎﺭﻧﺔ ﺍﳌﺬﺍﻫﺐ ﻭﺍﻟﻘﻮﺍﻧﲔ‪.‬‬

‫‪-٤‬ﺍﻟﺴﺎﺩﺓ ﺍﳌﺪﺭ‪‬ﺳﻮﻥ ﺍﻟﻜﺮﺍﻡ ﺑﻘﺴﻢ ﻣﻘﺎﺭﻧﺔ ﺍﳌﺬﺍﻫﺐ ﻭﺍﻟﻘﻮﺍﻧﲔ ﺍﳋﺎﺹ ﺍﻟﺬﻳﻦ ﻗﺪ ﺩﺭ‪‬ﺳﻮﱐ ﻋﻠﻮﻣﺎ‬
‫ﻧﺎﻓﻌﺔ‪ ،‬ﻭﻓﻀﻞ ﻋﻈﻴﻢ ﰲ ﺇﺳﺘﻔﺮﺍﻍ ﳎﻬﻮﺩﺍ‪‬ﻢ ﰲ ﺗﻌﻠﻴﻤﻲ ﺑﺎﻟﻌﻠﻮﻡ ﻭﺍﳌﻌﺎﺭﻑ ﺍﻟﻨﺎﻓﻌﺔ‪ ،‬ﺣﱵ ﻳﺴﺘﻄﻴﻊ‬
‫ﺍﻟﺒﺎﺣﺚ ﺃﻥ ﻳﺘﻢ ﺩﺭﺍﺳﺘﻪ ﰲ ﺍﻟﻘﺴﻢ‪ .‬ﻭﺃﺳﺄﻝ ﺍﷲ ﺃﻥ ﻳﺘﻘﺒﻞ ﻣﻨﻬﻢ ﻫﺬﺍ ﺍﳉﻬﺪ ﺍﻟﻌﻈﻴﻢ‪.‬‬
‫ﺺ ﺧﺎﺻﺔ ﺷﻜﺮﻱ ﻭﺗﻘﺪﻳﺮﻱ ﻷﰊ ﺍﻷﺳﺘﺎﺫ ﺍﳊﺞ ﲪﺰﺓ ﻭﺃﻣ‪‬ﻲ ﺍﳊﺠﺔ ﳘﲑﺓ‪ ،‬ﺍﻟﺬﺍﻥ ﻗﺪ‬
‫‪ -٥‬ﺃﺧ ‪‬‬
‫ﺭﺑﻴﺎﱐ ﺗﺮﺑﻴﺔ ﺣﺴﻨﺔ‪ ،‬ﻓﻌﺴﻲ ﺍﷲ ﺃﻥ ﻳﻮﻓﻘﻬﻤﺎ ﺑﺎﻟﺼﺤ‪‬ﺔ ﻭﺍﻟﻌﺎﻓﻴﺔ ﻭﺍﻟﺴﻼﻣﺔ ﰲ ﺍﻟﺪ‪‬ﺭﻳﻦ‪ .‬ﺁﻣﲔ‬
‫‪ -٦‬ﺃﻣﲔ ﺍﳌﻜﺘﺒﺔ ﺍﳌﺮﻛﺰﻳﺔ ﺑﺎﳉﺎﻣﻌﺔ ﻭﺃﻣﲔ ﻣﻜﺘﺒﺔ ﻛﻠﻴﺔ ﺍﻟﺸﺮﻳﻌﺔ ﻭﺍﻟﻘﺎﻧﻮﻥ ﻭﻣﻮﻇﻔﻮﳘﺎ‪ ،‬ﺍﻟﺬﻳﻦ ﳍﻢ‬
‫ﺗﻜﺮﻡ ﰲ ‪‬ﻴﺘﻪ ﺍﳌﺮﺍﺟﻊ ﺍﳍﺎﻣﺔ ﻭﺇﺑﺎﺣﺔ ﺍﻹﻃﻼﻉ ﻋﻠﻴﻬﺎ‪.‬‬

‫‪-٧‬ﲨﻴﻊ ﺯﻣﻼﺋﻲ ﺑﻜﻠﻴﺔ ﺍﻟﺸﺮﻳﻌﺔ ﻭﺍﻟﻘﻮﺍﻧﲔ ﰲ ﻗﺴﻢ ﻣﻘﺎﺭﻧﺔ ﺍﳌﺬﺍﻫﺐ ﻭﺍﻟﻘﻮﺍﻧﲔ ﺍﳋﺎﺹ‪ ،‬ﻭﺯﻣﻼﺋﻲ‬
‫ﻭﺃﺻﺪﻗﺎﺋﻲ ﺍﻟﺬﹼﻳﻦ ﺳﺎﻋﺪﻭﱐ ﰲ ﻛﺘﺎﺑﺔ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ ﻭﻛﺜﺮﻭﺍ ﻣﺴﺎﻋﺪﰐ ﺑﺎﺍﳌﻨﺎﻗﺸﺔ ﻭﺗﺒﺎﺩﻝ ﺍﻵﺭﺍﺀ‪،‬‬
‫ﻭﻫﻢ ﲟﺸﻴﺌﺔ ﺍﷲ ﺗﻌﺎﱄ ﺃﻣﻨﺎﺀ ﺍﻷﻣﺔ ﻭﺭﺅﺳﺎﺀﻫﺎ‪.‬‬
‫ﻭﺃﺳﺄﻝ ﺍﷲ ﺍﻟﻌﻠﻲ ﺍﻟﻘﺪﻳﺮ ﺑﺄﲰﺎﺋﻪ ﺍﳊﺴﲏ ﻭﺻﻔﺎﺗﻪ ﺍﻟﻌﻠﻲ ﺃﻥ ﻳﺘﻘﺒﻞ ﻣﲏ ﻫﺬﺍ ﺍﻟﻌﻤﻞ ﻭﳚﻌﻠﻪ‬
‫ﺧﺎﻟﺼﺎ ﻟﻮﺟﻬﻪ ﺍﻟﻜﺮﱘ ﻭﺃﺳﺄﻝ ﺍﷲ ﺗﻌﺎﱄ ﺃﺩﻋﻮﺍ ﺃﻥ ﻳﻔﻴﺾ ﻋﻠﻴﻬﻢ ﺍﻟﻌﻨﺎﻳﺔ ﻭﺍﻟﺘﻮﻓﻴﻖ ﻭﳚﺰﻳﻬﻢ ﺃﺣﺴﻦ‬
‫ﺍﳉﺰﺍﺀ ﻭﻣﻌﻴﻨﺎ ﻟﻜﻞ ﻣﻦ ﻳﺴﻠﻚ ﻫﺬﺍ ﺍﻟﺴﺒﻴﻞ ﺇﻧﻪ ﻭﱄ ﺫﺍﻟﻚ ﻭﺍﻟﻘﺎﺩﺭ ﻋﻠﻴﻪ ﻭﺻﻠﻲ ﺍﷲ ﻭﺳﻠﻢ ﻋﻠﻲ‬
‫ﻧﺒﻴﻨﺎ ﳏﻤﺪ ﻭﻋﻠﻲ ﺁﻟﻪ ﻭﺃﺻﺤﺎﺑﻪ ﻭﻣﻦ ﺗﺒﻌﻬﻢ ﺑﺄﺣﺴﺎﻥ ﺇﱄ ﻳﻮﻡ ﺍﻟﺪﻳﻦ‪.‬‬

‫ﻓﻘﺪ ﺟﺎﺀ ﺍﻟﺪﻳﻦ ﺍﳊﻨﻴﻒ ‪‬ﺪﻑ ﺇﱄ ﲢﻘﻴﻖ ﻣﺼﺎﱀ ﺍﻟﻌﺒﺎﺩ ﻭﺩﺭﺀ ﺍﳌﻔﺎﺳﺪ ﻋﻨﻬﻢ ﻭﻟﺬﻟﻚ‬
‫ﺷﺮﻋﺖ ﺍﻟﻌﻘﻮﺑﺎﺕ ﻟﻠﻤﺠﺮﻣﲔ ﻭﺍﳌﻔﺴﺪﻳﻦ ﰲ ﺍﻷﺭﺽ ﻟﻴﺤﺼﻠﻮﺍ ﺍﻹﻃﻤﺌﻨﺎﻥ ﻭﺍﻷﻣﻦ ﻭﺍﻹﺳﺘﻘﺮﺍﺭ‬

‫ﲣﻔﻰ ﺃﺣﻜﺎﻣﻪ ﻋﻠﻰ ﻛﺜﲑ ﻣﻦ ﺍﻟﻨﺎﺱ‪ ،‬ﻟﺬﺍ ﻛﺎﻥ ﻟﺰﺍﻣﺎ ﻋﻠﻰ ﺍﳊﻜﹼﺎﻡ ﻭ ﺍﻟﺒﺎﺣﺜﲔ ﺃﻥ ﻳﺘﻌﺮﻓﻮﺍ‬

‫ﺍﻷﺳﺒﺎﺏ ﻭﻋﻠﺘﻬﺎ ﰒ ﺃﻥ ﻳﺘﻌﻤ‪‬ﻘﻮﺍ ﻭﺃﻥ ﻳﺘﻌﻠﻤﻮﺍ ﺃﺣﻜﺎﻣﻪ ﻭﻣﺒﺎﺣﺜﻪ ﰒ ﻳﻨﻘﻠﻪ ﺇﱃ ﺍﻟﻨﺎﺱ ﻟﺌﻼ ﻳﻘﻌﻮﺍ‬
‫ﰲ ﳏﻈﻮﺭ ﺃﻭ ﻳﺘﻜﻠﻤﻮﺍ ﻓﻴﻤﺎ ﻻ ﻋﻠﻢ ﳍﻢ ﺑﻪ ﻭ ﻟﻴﻔﻬﻤﻮﺍ ﻋﻠﻰ ﺑﺼﲑﺓ ﻣﻦ ﺩﻳﻨﻬﻢ ﻓﻴﻤﺎ ﳚﺐ ﻋﻠﻴﻬﻢ‬
‫ﻭﳍﻢ‪ ،‬ﻭﻣﻦ ﰒ ﺃﻛﺘﺐ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ ﺍﻟﻌﻠﻤﻴﺔ ﲢﺖ ﺍﳌﻮﺿﻮﻉ ﻋﻦ ﺃﺣﻜﺎﻡ ﺍﻟﺘﻌﺰﻳﺮ ﻋﺎﻣ ﹰﺔ ﻭ ﺍﻟﻐﺮﺍﻣﺔ‬

‫ﺍﳌﺎﻟﻴﺔ ﺧﺎﺻ ﹰﺔ ﺣﻴﺚ ﺍﻹﺧﺘﻼﻑ ﻓﻴﻬﺎ ﺃﻗﻮﻯ ﻭﺍﳊﺎﺟﺔ ﺇﱃ ﻣﻌﺮﻓﺘﻬﺎ ﺃﻛﺜﺮ‪.‬‬
‫ﻭﺇﻥ ﻣﻦ ﺃﻛﱪ ﻣﻘﺎﺻﺪ ﺍﻟﺸﺮﻳﻌﺔ ﰲ ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﻌﻘﻮﺑﺎﺕ ﻭﲞﺎﺻﺔ ﰲ ﺟﺮﺍﺋﻢ ﺍﻟﺘﻌﺎﺯﻳﺮ‬
‫ﺣﻔﻆ ﻧﻈﺎﻡ ﺍﻷﻣﺔ ﻋﻠﻲ ﺃﺳﺎﺱ ﻣﺒﺪﺃ ﺍﳊﺚ ﻋﻠﻲ ﺍﻷﻣﺮ ﺑﺎﳌﻌﺮﻭﻑ ﻭﺍﻟﻨﻬﻲ ﻋﻦ ﺍﳌﻨﻜﺮ‪ ،‬ﻭﻳﺘﺮﺗﺐ‬
‫ﻋﻠﻲ ﻫﺬﺍ ﺍﳌﺒﺪﺃ ﺃﻥ ﻳﻘﻮﻡ ﺍﻷﻓﺮﺍﺩ ﺑﺘﻮﺟﻴﻪ ﺑﻌﻀﻬﻢ ﺑﻌﻀﺎ‪ ،‬ﻭﺑﺘﻮﺟﻴﻪ ﺍﳉﻤﺎﻋﺔ ﺇﱄ ﻣﺎ ﻓﻴﻪ ﺍﳋﲑ‪،‬‬
‫ﻛﻤﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻴﻪ ﺃﻥ ﻳﻘﻮﻣﻮﺍ ﺑﺘﻘﻮﱘ ﺍﻹﻋﻮﺟﺎﺝ‪ ،‬ﻭﺍﻟﺘﻨﺒﻴﻪ ﻋﻠﻲ ﺍﻷﻓﻌﺎﻝ ﺍﳌﺸﻴﻨﺔ ﺍﻟﻘﺒﻴﺤﺔ ﺍﻟﱵ‬
‫ﺗﻔﺴﺪ ﻋﻠﻲ ﺍﻷﻓﺮﺍﺩ ﻭﺍﳉﻤﺎﻋﺎﺕ ﺣﻴﺎ‪‬ﻢ‪ ،‬ﻭﻣﻦ ﺿﻤﻨﻬﺎ ﺍﳉﺮﺍﺋﻢ ﻭﺍﳌﺨﺎﻟﻔﺎﺕ ﺑﻜﺎﻓﺔ ﺻﻮﺭﻫﺎ‬
‫ﻭﺃﻧﻮﺍﻋﻬﺎ‪ ،‬ﻭﺑﺬﺍﻟﻚ ﳚﻌﻠﻮﻥ ﺃﻧﻔﺴﻬﻢ ﺍﳊﻔﻆ ﻋﻠﻲ ﺍﻷﺧﻼﻕ ﺍﻟﻜﺮﳝﺔ‪ ،‬ﻭﻭﻗﺎﻳﺔ ﺍ‪‬ﺘﻤﻊ ﻣﻦ‬
‫ﺍﻹﺟﺮﺍﻡ‪.١‬‬

‫ﻓﻘﺪ ‪‬ﻋﺒ‪ ‬ﺮ ﺍﳊﺪﻳﺚ ﺻﺮﺍﺣﺔ ﺑﻠﻔﻆ ﺍﻟﻐﺮﺍﻣﺔ ﺍﻟﱵ ﺗﻔﻴﺪ ﺇﻟﺰﺍﻡ ﺍﶈﻜﻮﻡ ﻋﻠﻴﻪ ﺑﺒﺪﻝ ﺍﻟﻘﻴﻤﺔ ﺍﻟﱵ ﺳﺮﻗﺖ‬
‫ﻣﻦ ﺍﻟﺜﻤﺮ ﺍﳌﻌﻠﻖ ﺑﺎﻟﻐﺮﺍﻣﺔ ﺗﺴﺎﻭﻱ ﲦﻦ ﻣﺎ ﺳﺮﻕ ﻣﺮﺗﲔ‪.‬‬

‫ﻭﻣﺎ ﺭﻭﺍﻩ ‪‬ﺑ ‪‬ﻬ ‪‬ﺰ ‪‬ﺑ ‪‬ﻦ ‪‬ﺣ ِﻜ‪‬ﻴ ٍﻢ ‪‬ﻋ ‪‬ﻦ ﹶﺃِﺑ‪‬ﻴ ِﻪ ‪‬ﻋ ‪‬ﻦ ‪‬ﺟ ‪‬ﺪ ِﻩ ‪‬ﺳ ِﻤ ‪‬ﻌ ‪‬‬

‫ﺻ ﹶﻠﻲ ﺍﷲ ‪‬ﻋ ﹶﻠ ‪‬ﻴ ِﻪ ‪‬ﻭ ‪‬ﺳ ﹶﻠ ‪‬ﻢ ِﻣ ‪‬ﻨ ‪‬ﻬﺎ ‪‬ﺷ ‪‬ﻲ ٌﺀ{‪ .٤‬ﻭﺟﻪ ﺍﻟ ‪‬ﺪﻻﻟﺔ ﻣﻦ ﺍﳊﺪﻳﺚ‪ ،‬ﺃﻥ‬
‫ﺤ ‪‬ﻤ ٍﺪ ‪‬‬
‫ﺤﻞﱡ ﻵ ِﻝ ‪‬ﻣ ‪‬‬
‫‪‬ﺭِ‪‬ﺑ‪‬ﻨﺎ‪ ،‬ﹶﻻ‪‬ﻳ ِ‬
‫ﺍﻟﺮﺳﻮﻝ ﺍﷲ ﺻﻠﻲ ﺍﷲ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻗﺪ ﺃﻭﺟﺐ ﻋﻘﻮﺑﺔ ﺃﺧﺬ ﺍﳌﺎﻝ ﻋﻠﻲ ﻣﻦ ﺇﻣﺘﻨﻊ ﻋﻦ ﺃﺩﺍﺀ‬
‫ﺍﻟﺰﻛﺎﺓ‪ ،‬ﻭﺫﺍﻟﻚ ﺑﺄﺧﺬ ﺷﻄﺮ ﻣﺎﻟﻪ ﺃﻱ ﻧﺼﻒ ﻣﺎﻟﻪ ﻋﻘﻮﺑﺔ ﺗﻌﺰﻳﺮﻳﺔ ﻋﻠﻲ ﻣﻌﺼﻴﺔ ﺍﻹﻣﺘﻨﺎﻉ ﻋﻦ‬
‫ﺃﺩﺍﺀ ﺍﻟﻮﺍﺟﺐ ﻹﺧﻔﺎﺀ ﺍﳌﺎﻝ‪ ،‬ﻭﻟﻔﻆ ﺍﻟﻌﺰﺍﺋﻢ ﻣﻌﻨﺎﻫﺎ ﺍﻟﻔﺮﺍﺋﺾ‪ ،‬ﻓﻔﻴﻪ ﺩﻟﻴﻞ ﻋﻠﻲ ﺃﺧﺬ ﺫﺍﻟﻚ‬
‫ﻭﺍﺟﺐ‪.٥‬‬
‫ﺴﻨﺔ ﻗﺎﻋﺪﺓ " ﻻ ﺟﺮﳝﺔ‬
‫ﻭﻣﻦ ﺍﻟﻘﻮﺍﻋﺪ ﺍﳌﺸﻬﻮﺭﺓ ﺍﻟﱵ ﺻﺪﺭﺕ ﻣﻦ ﴰﻮﻝ ﺍﻟﻘﺮﺁﻥ ﻭﺍﻟ ‪‬‬

‫ﺺ " ﻭﻫﺬﻩ ﻗﺎﻋﺪﺓ ﺍﻟﻌﻤﻮﻣﻴﺔ ﰲ ﻣﺴﺎﺋﻞ ﺍﻟﻔﻘﻪ ﺍﳉﻨﺎﺋﻲ ﺍﻹﺳﻼﻣﻲ ﻭﻫﻲ ﻣﻦ‬

‫ﺺ ﰲ ﺟﺮﺍﺋﻢ ﺍﻟﺘﻌﺎﺯﻳﺮ‪ ،‬ﻷﻥ‬
‫ﻃﺒﻘﺖ ﺍﻟﺸﺮﻳﻌﺔ ﻗﺎﻋﺪﺓ ﺃﻥ ﻻ ﺟﺮﳝﺔ ﻭﻻ ﻋﻘﻮﺑﺔ ﺑﻼ ﻧ ‪‬‬
‫ﺍﳌﺼﻠﺤﺔ ﺍﻟﻌﺎﻣﺔ ﻭﻃﺒﻴﻌﺔ ﺍﻟﺘﻌﺰﻳﺮ ﺍﻟﺬﻱ ﺟﺎﺀ ﻋﻠﻲ ﺣﺴﺎﺏ ﺍﻟﻌﻘﻮﺑﺔ ﰲ ﺃﻏﻠﺐ ﺍﻷﺣﻮﺍﻝ‪ ،‬ﻭﻋﻠﻲ‬
‫ﺣﺴﺎﺏ ﺍﳉﺮﳝﺔ ﰲ ﺍﻟﻘﻠﻴﻞ ﺍﻟﻨﺎﺩﺭ‪ .‬ﻭﻗﺪ ﺟﺎﺀ ﰲ ﺟﺮﺍﺋﻢ ﺍﻟﺘﻌﺎﺯﻳﺮ ﺃﻥ ﻳﻜﻮﻥ ﻟﻜﻞ ﺟﺮﳝﺔ ﻋﻘﻮﺑﺔ‬
‫ﻣﻌﻴﻨﺔ ﳏﺪﺩﺓ ﻳﺘﻘﻴﺪ‪‬ﺎ ﺍﻟﻘﺎﺿﻲ‪ ،‬ﻓﻠﻠﻘﺎﺿﻲ ﺃﻥ ﳜﺘﺎﺭ ﻟﻜﻞ ﺟﺮﳝﺔ ﻭﻟﻜﻞ ﳎﺮﻡ ﺍﻟﻌﻘﻮﺑﺔ ﺍﳌﻼﺋﻤﺔ‬
‫ﻣﻦ ﳎﻤﻮﻋﺔ ﻣﻦ ﺍﻟﻌﻘﻮﺑﺎﺕ ﺷﺮﻋﺖ ﻟﻌﻘﺎﺏ ﺍﳉﺮﺍﺋﻢ ﺍﻟﺘﻌﺰﻳﺮﻳﺔ ﻛﻠﻬﺎ ﻭﻟﻠﻘﺎﺿﻲ ﺃﻥ ﳜﻔﻒ‬
‫ﺺ‪.‬‬
‫ﺸﺮﻳﻌﺔ ﺇﺫﻥ ﱂ ﲣﺮﺝ ﻋﻠﻲ ﺍﻟﻘﺎﻋﺪﺓ ﺑﺄﻥ ﻻ ﺟﺮﳝﺔ ﻭﻻ ﻋﻘﻮﺑﺔ ﺑﻼ ﻧ ‪‬‬
‫ﺍﻟﻌﻘﻮﺑﺔ ﻭﺃﻥ ﻳﻐﻠﻈﻬﺎ‪.‬ﻓﺎﻟ ‪‬‬
‫ﺸﺮﻳﻌﺔ ﺍﻹﺳﻼﻣﻴ‪‬ﺔ‬
‫ﰲ ﺳﺮﻳﺎﻥ ﺍﻟﻨﺼﻮﺹ ﺍﳉﻨﺎﺋﻴﺔ ﻋﻠﻲ ﺍﻟﺰﻣﺎﻥ‪،‬ﻛﺎﻧﺖ ﺍﻟﻘﺎﻋﺪﺓ ﺍﻟﻌﺎﻣﺔ ﰲ ﺍﻟ ‪‬‬
‫" ﻻﺭﺟﻌﻴ‪‬ﺔ ﰲ ﺍﻟﺘ‪‬ﺸﺮﻳﻊ ﺍﳉﻨﺎﺋﻲ " ﺃﻥ ﺍﻟﻨﺼﻮﺹ ﺍﳉﻨﺎﺋﻴﺔ ﻻ ﺗﺴﺮﻱ ﺇ ﹼﻻ ﺻﺪﻭﺭﻫﺎ ﻭﻋﻠﻢ ﺍﻟﻨﺎﺱ‬

‫ﺍﻟﻨﺼﻮﺹ ﺍﳉﻨﺎﺋﻴﺔ ﻟﻴﺲ ﳍﺎ ﺃﺛﺮ ﺭﺟﻌ ‪‬ﻲ‪ ،‬ﻭﺃﻥ ﺍﳉﺮﺍﺋﻢ ﻳﻌﺎﻗﺐ ﻋﻠﻴﻬﺎ ﺑﺎﻟﻨﺼﻮﺹ ﺍﳌﻌﻤﻮﻝ ‪‬ﺎ‬
‫ﻭﻗﺖ ﺇﺭﺗﻜﺎﺏ ﻫﺬﻩ ﺍﳉﺮﺍﺋﻢ‪.٦‬‬

‫ﻭﲟﺎ ﺃﻥ ﻫﻨﺎﻙ ﺍﳉﻬﻮﺩ ﰲ ﺇﻧﺪﻭﻧﻴﺴﻴﺎ ﻟﻠﺘﺤﻮﻝ ﺇﱄ ﺍﻟﻨﻈﺎﻡ ﺍﻟﺸﺮﻋﻲ ﻋﻤﻮﻣﺎ ﻭﺍﻟﺘﺸﺮﻳﻊ‬
‫ﺍﳉﻨﺎﺋﻲ ﻋﻠﻲ ﻭﺟﻪ ﺍﳋﺼﻮﺹ ﻓﺈﻧﻪ ﻣﻦ ﺍﳌﻔﻴﺪ ﺇﺑﺮﺍﺯ ﻣﻌﺎﱂ ﺍﻟﻨﻈﺎﻡ ﺍﻟ‪‬ﺘﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﰲ‬
‫ﺍﻟﻘﺎﻧﻮﻥ ﺍﻹﻧﺪﻭﻧﻴﺴﻲ ﻹﻇﻬﺎﺭ ﺇﳚﺎﺑﻴﺎ‪‬ﺎ ﻭﺳﻠﺒﻴﺎ‪‬ﺎ ﻭﺗﻄﺒﻴﻘﺎ‪‬ﺎ ﻣﻊ ﻧﻈﺎﻡ ﺍﻟ‪‬ﺘﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ‬
‫ﺍﳌﺎﻟﻴﺔ ﰲ ﺍﻟﻔﻘﻪ ﺍﻹﺳﻼﻣﻲ ﻹﺑﺮﺍﺯ ﳑﻴ‪‬ﺰﺍﺕ ﻭﺧﺼﺎﺋﺺ ﻫﺬﺍ ﺍﻟﻨﻈﺎﻡ‪ ،‬ﺍﻷﻣﺮ ﺍﻟﺬﻱ ﻳﺴﻬ‪‬ﻞ ﻋﻤﻠﻴﺔ‬
‫ﺍﻟﺘﺤﻮﻳﻞ ﺇﱄ ﺍﻷﺧﺬ ﺍﻟ‪‬ﺘﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ﺍﻟﺸﺮﻋﻴﺔ‪ ،‬ﻭﻫﻮ ﻣﻄﻠﻮﺏ‪.‬‬
‫ﺤﺮ ﻭﻟﻺﻳﻀﺎﺡ ﻋﻦ ﻫﺬﻩ ﺍﻟﻌﻘﻮﺑﺔ‪،‬‬
‫ﺑﺎﻟﻨﺴﺒﺔ ﺇﱄ ﺫﺍﻟﻚ ﺃﺭﻱ ﰲ ﻫﺬﻩ ﺍﻟﺮ‪‬ﺳﺎﻟﺔ ﺃﳘ‪‬ﻴﺔ ﻟﻠﺘﺒ ‪‬‬
‫ﻛﻴﻒ ﺃﺭﺍﺀ ﺍﻟﻔﻘﻬﺎﺀ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ ﻣﺸﺮﻭﻋﻴﺔ ﻫﺬﻩ ﺍﻟﻌﻘﻮﺑﺔ‪ ،‬ﻭﻣﺎ ﻫﻲ ﺍﻷﺩﻟﺔ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ‬
‫ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ﰲ ﺍﻟﻔﻘﻪ ﺍﻹﺳﻼﻣﻲ‪ ،‬ﻭﻛﻴﻒ ﺗﻄﺒﻴﻖ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﰲ ﺍﻟﻘﺎﻧﻮﻥ‬
‫ﺍﻹﻧﺪﻭﻧﻴﺴﻲ‪.‬‬
‫ﻓﺄﻋﺠﺒﲏ ﻫﻨﺎ ﻛﺘﺎﺑﺔ ﻫﺬﻩ ﺍﻟ ‪‬ﺮﺳﺎﻟﺔ ﲢﺖ ﺍﳌﻮﺿﻮﻉ " ﺍﻟ‪‬ﺘﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ﰲ‬
‫ﺍﻟﻔﻘﻪ ﻹﺳﻼﻣ ‪‬ﻲ ﻭﺗﻄﺒﻴﻘﻬﺎ ﰲ ﺍﻟﻘﺎﻧﻮﻥ ﻹﻧﺪﻭﻧﻴﺴﻲ " ‪.‬‬

‫ﺃﻣﺎ ﺍﳌﻄﺎﻟﻌﺎﺕ ﺍﳌﻠﺤﻮﻇﺎﺕ ﰲ ﻫﺬﻩ ﺍﻟ ‪‬ﺮﺳﺎﻟﺔ ﺗﺸﻤﻞ ﻋﻠﻲ ﺁﺭﺍﺀ ﺍﻟﻔﻘﻬﺎﺀ ﺍﻟﱵ ﺗﺪﻝ ﻋﻠﻲ‬
‫ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ‪ ،‬ﻭﺍﻷﺩﻟﺔ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ﰲ‬
‫ﺍﻟﻔﻘﻪ ﺍﻹﺳﻼﻣﻲ‪ ،‬ﻭﺗﻄﺒﻴﻖ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﰲ ﺍﻟﻘﺎﻧﻮﻥ ﺍﻹﻧﺪﻭﻧﻴﺴﻲ‪.‬‬
‫ﺇﺑﺘﺪﺍ ًﺀﺍ ﺑﺒﺴﻢ ﺍﷲ ﻭﺧﺘﺎ ‪‬ﻣﺎ ﲝﻤﺪ ﺍﷲ ﻧﺮﺟﻮ ﺍﷲ ﺍﻥ ﺗﻨﻔﻌﻨﺎ ﻭﻟﻠﺠﻤﻴﻊ ﻣﻦ ﻫﺬﻩ ﺍﻟ ‪‬ﺮﺳﺎﻟﺔ‪...‬ﺁﻣﲔ‬
‫ﺏ‪ -‬ﲢﺪﻳﺪ ﺍﻟﺒﺤﺚ‬
‫ﻭﻟﺘﻮﺿﻴﺢ ﺍﳌﺸﻜﻼﺕ ﻟﻘﺪ ﻭﺿﻊ ﺍﻟﺒﺎﺣﺚ ﺍﻷﺳﺌﻠﺔ ﺍﻷﺗﻴﺔ ﺫﻛﺮﻫﺎ ‪:‬‬
‫‪ -١‬ﻛﻴﻒ ﺁﺭﺍﺀ ﺍﻟﻔﻘﻬﺎﺀ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ؟‬
‫‪ -۲‬ﻣﺎ ﻫﻲ ﺍﻷﺩﻟﺔ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ ﰲ ﺍﻟﻔﻘﻪ ﺍﻹﺳﻼﻣﻲ ؟‬
‫‪ -٣‬ﻭﻛﻴﻒ ﺗﻄﺒﻴﻖ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﰲ ﺍﻟﻘﺎﻧﻮﻥ ﺍﻹﻧﺪﻭﻧﻴﺴﻲ ؟‬

‫‪ِ -۱‬ﻟ ‪‬ﻤ ‪‬ﻌ ‪‬ﺮﹶﻓ ِﺔ ﺁﺭﺍﺀ ﺍﻟﻔﻘﻬﺎﺀ ﺍﻟﱵ ﺗﺪ ﹼﻝ ﻋﻠﻲ ﻣﺸﺮﻭﻋﻴﺔ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ ﺑﻌﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ‪.‬‬

‫ﺩ‪ -‬ﻃﺮﻳﻘﺔ ﺍﻟﺒﺤﺚ‬
‫ﻭﺍﻟﻄﺮﻳﻘﺔ ﺍﳌﺴﺘﺨﺪﻣﺔ ﰲ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ ﺍﻟﻌﻠﻤ‪‬ﻴﺔ ﻫﻲ ﺍﻟﻄﺮﻳﻘﺔ ﺍﳌﻜﺘﺒﻴﺔ ﺣﻴﺚ ﻳﺮﺟﻊ‬
‫ﺍﻟﺒﺎﺣﺚ ﺇﱄ ﺍﳌﺼﺎﺩﺭ ﻭﺍﳌﺮﺍﺟﻊ ﺍﻟﻌﺮﺑﻴ‪‬ﺔ ﺃﻱ ﺍﻟﺘﻄﻠﹼﻊ ﻣﻦ ﺍﻟﻜﺘﺐ ﺍﻟﻔﻘﻬﻴﺔ ﺍﳉﻨﺎﺋﻴﺔ ﺍﻹﺳﻼﻣﻴﺔ‬
‫ﻭﺍﻟﻌﻘﻮﺑﺎﺕ ﰲ ﺍﻟﺸﺮﻳﻌﺔ ﺍﻹﺳﻼﻣﻴﺔ ﺍﳌﻌﺘﻤﺪﺓ ﺑﺎﳌﻮﺿﻮﻉ ﻭﺍﻟﻘﺎﻧﻮﻥ ﺍﻟﻮﺿﻌﻲ ﺍﻹﻧﺪﻭﻧﻴﺴﻲ‬
‫ﻭﺍﻟﻜﺘﺐ ﺍﻟﱵ ﺗﺘﻌﹼﻠﻖ ﺑﺎﳌﻮﺿﻮﻉ‪.‬‬
‫ﻭﺃﻣﺎ ﻛﻴﻔﻴﺔ ﻃﺮﻳﻘﺔ ﺍﻟﻜﺘﺎﺑﺔ‪ ،‬ﻓﺈﻋﺘﻤﺪ ﺍﻟﺒﺎﺣﺚ ﻋﻠﻲ ﺩﻟﻴﻞ ﻛﺘﺎﺑﺔ ﺍﻟﺮﺳﺎﻟﺔ ﺍﻟﻌﻠﻤﻴ‪‬ﺔ ﺍﻟﱵ‬
‫ﺸﺮﻳﻌﺔ ﻭﺍﻟﻘﺎﻧﻮﻥ ﺟﺎﻣﻌﺔ ﺷﺮﻳﻒ ﻫﺪﺍﻳﺔ ﺍﷲ ﺍﻹﺳﻼﻣﻴﺔ ﺍﳊﻜﻮﻣﻴﺔ ﲜﺎﻛﺮﺗﺎ‪.‬‬

‫ﻫـ‪ -‬ﺧﻄﺔ ﺍﻟﺒﺤﺚ‬
‫ﻭﺗﺴﻬﻴﻼ ﻟﻜﺘﺎﺑﺔ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ‪ ،‬ﻗﺴ ‪‬ﻤﺖ ﻫﺬﻩ ﺍﻟﺮﺳﺎﻟﺔ ﺍﻟﻌﻠﻤﻴ‪‬ﺔ ﺇﱄ ﲬﺴﺔ ﺃﺑﻮﺍﺏ ‪:‬‬

‫ﺍﳌﻌﺎﺭﺿﲔ ﻣﻦ ﺍﻟﻔﻘﻬﺎﺀ ﻭﺳﺒﺐ ﺍﻻﺧﺘﻼﻑ ﰲ ﺍﳌﺴﺄﻟﺔ ﻭﺭﺃﻱ ﺍﻟﺒﺎﺣﺚ‬
‫ﻋﻦ ﺁﺭﺍﺀ ﺍﳌﺆﻳﺪﻳﻦ ﻭﺍﳌﻌﺎﺭﺿﲔ ﻣﻦ ﺍﻟﻔﻘﻬﺎﺀ ﻋﻠﻲ ﺣﻜﻢ ﺟﻮﺍﺯ ﺍﻟﺘ‪‬ﻌﺰﻳﺮ‬

‫ﺍﻟﺒﺎﺏ ﺍﻟﺜﺎﱐ‬
‫ﻧﻈﺮﺓ ﻋﺎﻣﺔ ﻋﻦ ﻋﻘﻮﺑﺔ ﺍﻟﻐﺮﺍﻣﺔ ﺍﳌﺎﻟﻴﺔ‬
‫ﺃ‪ .‬ﺗﻌﺮﻳﻒ ﺍﻟﻐﺮﺍﻣﺔ‬
‫ﺍﻟﻐﺮﺍﻣﺔ ﻫﻲ ﻣﺎ ﻳﻠﺘﺰﻡ ﺍﻹﻧﺴﺎﻥ ﺃﺩﺍﺀﻩ ﻣﻦ ﻣﺎﻝ‪ .١٢‬ﻭﺍﻟﻐﺮﺍﻣﺔ ﰲ ﺍﻟﻠﻐﺔ ﻣﻦ ‪ :‬ﹶﻏ ِﺮ ‪‬ﻡ ‪‬ﻳ ‪‬ﻐ ‪‬ﺮ ‪‬ﻡ ُﹶﻏ ‪‬ﺮﻣ‪‬ﺎ‬
‫ﻭ ﹶﻏ ‪‬ﺮﺍﹶﻣﺔﹰ‪ ،‬ﻗﺎﻝ ﺇﺑﻦ ﻓﺎﺭﺱ ‪ :‬ﺍﻟﻐﲔ ﻭﺍﻟﺮﺍﺀ ﻭﺍﳌﻴﻢ ﺃﺻﻞ ﺻﺤﻴﺢ ﻳﺪ ﹼﻝ ﻋﻠﻲ ﻣﻼﺯﻣﺔ ﻭﻣﻼﺯ‪‬ﺓ‪.١٣‬‬
‫ﻭﺍﻟﻐﺮﻡ ﻭﺍﻟﻐﺮﺍﻣﺔ ﳍﺎ ﻋﺪﺓ ﻣﻌﺎﻥ ‪ :‬ﻓﺄﻣ‪‬ﺎ ﺍﻟﻐﺮﻡ ﻣﻌﻨﺎﻩ ‪ :‬ﺃﺩﺍﺀ ﺷﻲﺀ ﻻﺯﻡ‪.١٤‬‬
‫ﻭﻗﻴﻞ‪ :‬ﻣﺎ ﻳﻨﻮﺏ ﺍﻹﻧﺴﺎﻥ ﰲ ﻣﺎﻟﻪ ﻣﻦ ﺿﺮﺭ ﻟﻐﲑ ﺟﻨﺎﻳﺔ ﻣﻨﻪ ﺃﻭ ﺧﻴﺎﻧﺔ‪.١٥‬‬

‫ﻭﻗﻴﻞ ﺍﻟﻐﺮﺍﻣﺔ ‪ :‬ﻣﺎ ﻳﺘﺤﻤﻠﻪ ﺍﻟﻐﺮﱘ ﰲ ﻣﺎﻟﻪ ﺗﻌﻮﻳﻀﺎ ﻋﻦ ﺿﺮﺭ ﺑﻐﲑ ﺟﻨﺎﻳﺔ ﻭﻻ ﺧﻴﺎﻧﺔ‪.١٨‬‬
‫ﻭﻟﻌ ﹼﻞ ﺍﳌﻌﲏ ﺍﻷﺧﲑ ﻫﻮ ﺍﻷﻭﺿﺢ ﻭﺍﻷﻧﺴﺐ‪.‬‬
‫ﺃﻣﺎ ﺍﻟﻐﺮﺍﻣﺔ ﰲ ﻋﺮﻑ ﺇﺻﻄﻼﺡ‪ ،‬ﻓﻘﺪ ﻋﺮﻓﻬﺎ ﺍﻟﺪﻛﺘﻮﺭ ﻭﻫﺒﺔ ﺍﻟﺰﺣﻴﻠﻲ ﺑﻘﻮﻟﻪ ‪:‬‬
