Indonesia sebagai negara hukum, salah satu kewenangan konstisusional
yang diberikan kepada Mahkamah Konstitusi oleh Pasal 24 C ayat (1) UndangUndang Dasar Negara Republik Indonesia Tahun 1945 adalah mengadili pada
tingkat pertama dan terakhir yang putusannya bersifat final untuk memutus
tentang perselisihan hasil Pemilu. Secara eksplisit melalui Pasal 22E ayat (2)
Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.
Permasalahan yang dibahas dalam skripsi ini apakah yang menjadi dasar
pertimbangan hukum dengan dikeluarkannya Putusan Mahkamah Konstitusi
Republik Indonesia No.129/PHPU.D-VIII/2010, Apakah akibat hukum Putusan
Mahkamah Konstitusi Republik Indonesia No.129/PHPU.D-VIII/2010 terhadap
hak konstitusional Pemohon.
Tujuan khusus penulisan skripsi ini adalah untuk mengetahui, mengkaji
dan menganalisis bentuk sengketa Pemilukada dan bentuk pelanggaran serta
kecurangan proses Pemilukada dan untuk mengetahui, mengkaji dan menganalisis
antisipasi hukum dan tindakan hukum yang dilakukan apabila terjadi pelanggaran
dan kecurangan pada Pemilukada.
Tipe penelitian adalah yuridis normatif yaitu suatu pendekatan
berdasarkan aturan-aturan hukum yang berlaku dan kenyataaan yang ada dalam
masyarakat mengenai sesuatu yang diteliti. Pendekatan masalah menggunakan
pendekatan perundang-undangan dan pendekatan konseptual. Sumber bahan
hukumnya yaitu bahan hukum primer, sekunder dan tersier. Analisis bahan hukum
digunakan metode deskriptif kualitatif serta disimpulkan dengan metode deduktif.
Pembahasan yang dibahas dalam skripsi ini adalah dasar pertimbangan
hukum dengan dikeluarkannya Putusan Mahkamah Konstitusi Republik Indonesia
No.129/PHPU.D-VIII/2010 serta akibat hukum Putusan Mahkamah Konstitusi
