may only have a double position as a DPS member in no more than 4 other sharia financial institutions.
Sharia Banking Committee As mandated in the Act No. 21 year 2008 concerning
Sharia Banking, in order to assist BI in embodying sharia principles in the form of sharia banking regulations,
aside from developing sharia banking in general, BI has formed a Sharia Banking Committee KPS. The said
KPS which was formed initially in year 2011, shall have members of experts in the sharia muamalat ield and
or experts in economic, inances, and banking with representatives from BI, Ministry of Religion and other
community elements with a balance composition and with a total member of no more than 11 people.
6. Foreign Workers Utilization and Transfer of Knowledge Program in Banking Sector
Banks may utilize Foreign Workers TKA in running their operations by complying with BI regulation. Utilization of
Foreign Workers by banks must consider the availability of Indonesian workforce. Banks may only utilize a TKA for
the following positions or equivalent: a. Member of Board of Commissioners and Board of
Directors; b. Executive Oicer; and or
c. ExpertsConsultant. Banks are not allowed to utilize Foreign Workers in the
departments of human resources and compliance. Banks must request BI approval prior to appointing
any TKA to ill the position as a member of the Board of Commissioners, Board of Directors andor an Executive
Oicer, must submit to BI the plan for utilizing foreign workers which should be stated in the Bank Business
Plan, must guarantee the realization of transfer of knowledge in the utilization of any TKA. The obligation in
the transfer of knowledge shall be performed through:
a. The Appointment of 2 Indonesian assistants for every 1 person of TKA
b. Education and job training for the related assistants in accordance with the qualiication of positions

held by the TKA. c. Implementation of training or teaching by the
TKA within a certain period especially for bank employees, studentscollege students, andor the
general public.
7.
Fit and Proper Test in Conventional Commercial Banks and Rural Banks
Fit and proper test shall be conducted by BI toward: a. Candidates for Controlling Shareholders PSP,
candidates of members of Board of Commissioners and Board of Directors;
b. PSP, the members of Board of Commissioners, Board of Directors and Executive Oicers; and
c. Parties, who are no longer held the position or no longer served as parties referred to in letter b, yet the
persons in question are suspected to be involved in or responsible for any conduct or act, which is in
the process of it and proper test in the Bank or the Representative Oice of Foreign Bank.
Parties going through a legal process andor through a it and proper test process in a bank may not be proposed
to be the candidates for PSP, members of Board of Commissioners or members of Board of Directors.
