ABSTRAKSI
Ketertiban dan ketentraman merupakan kondisi yang harus diwujudkan oleh setiap Pemerintah
Daerah, begitu juga yang harus dilakukan oleh Pemerintah Kota Malang. Sebagaimana UndangUndang No. 32 tahun 2004 tentang Otonomi Daerah, dimana setiap Daerah diberi keleluasaan
untuk menjalankan pemerintahan sesuai dengan kemampuan dari daerah itu sendiri, maka dalam
usaha menciptakan ketertiban dan ketentraman dibentuklah suatu instansi guna membantu
Kepala Daerah dalam usaha pelaksanaan ketertiban tersebut dengan terbentuknya Kantor Satuan
Polisi Pamong Praja.
Untuk memberikan penjelasan tentang penelitian ini maka akan disajikan secara diskriptif
kulitatif, yaitu melukiskan atau menggambarkan sejumlah variable yang berkenaan dengan
masalah dan unit yang diteliti tanpa mempersoalkan hubungan antara variable. Selanjutnya untuk
memperjelas keterangan yang disajikan maka akan diperkuat dengan sumber-sumber data
penelitian yang terdiri dari sumber data primer yaitu kata-kata dan tindakan orang yang diamati
serta diwawancarai serta sumber data skunder yang terdiri dari hasil observasi, catatancatatan/buku bacaan, internet, majalah atau data tertulis lain dari instansi/lembaga terkait yang
mendukung peneitian ini.
Sebagaimana status dari Satuan Polisi Pamong Praja yang merupakan lembaga teknis Pemerintah
dibidang ketentraman dan ketertiban umum serta bertugas membantu Kepala Daerah, maka
untuk mewujudkan ketertiban yang diakibatkan oleh banyaknya gelandangan dan pengemis di
Kota Malang pemerintah Kota memberikan tugas kepada Satuan Polisi Pamong Praja untuk
bertidak menertibkan gelandangan dan pengemis tersebut. Selanjutnya dalam usaha penertiban
tersebut Satuan Polisi Pamong praja berpedoman pada keputusan Menteri Dalam Negeri No 26
tahun 2005 tentang Pedoman Prosedur Tetap Operasional Satuan Polisi Pamong Praja. Adapun
usaha pembinaan ketertiban yang dilukan adalah melalui empat tahap antara lain : pertama, tahap
preentif yaitu proses penertiban secara tidak langsung dengan menggunakan perantara, bias
berupa pengumuman yang ditempel atau diletakkan pada wilayah tertentu yang dianggap sebagai
zona yang dilarang terhadap kemunculan gepeng. Selain itu bisa juga memanfaatkan media
massa baik media elektronik maupun media cetak. kedua tahap prefentif yakni dengan
memberikan teguran serta penyuluhan terhadap para gelandanagan dan pengemis untuk
memahami perda yang berlaku. Ketiga, tahap refresif yaitu penangkapan terhadap gelandangan
dan pengemis yang tetap membadel setelah diberikan penjelasan tentang perda melalui tahap
prefentif. Keempat, tahap rehabilitasi yaitu menamoung sementra para gelandangan dan
pengemis yang tertangkap razia guna dibelikan pendidikan keterampilan sebelum dikembalikan
ketempat asal masing-masing.
Keberadaan Kantor Satuan Polisi Pamong Praja di Kota Malang diharapkan mampu untuk
menciptakan keadaan yang tertib dan aman, karena lembaga tersebut merupakan atribut
pemerintah yang bertugas untuk menindak masalah ketentraman dan ketertiban. Tetapi perlu
dingat bahwa segala tindakan yang dilakukan oleh Satuan polisi Pamong Praja harus benar-benar
berpedoman pada aturan yang berlaku dalam artian jangan sampai bertidak sewenang-wenang
tanpa memperhatikan hak asasi manusia serta menyimpang dengan hanya mengandalkan
kekuatan otot. Dan perlu dingat bahwa segala tugas pelaksanaan ketertiban wilayah yang
dilakukan Satuan Polisi Pamong Praja merupakan tindakan Non Yustisia sehingga tidak ada
penghakiman melalui proses peradilan.
ABSTRACT

of the region itself, so in an attempt to create order and peace established an agency to assist the

other written data from the agencies/institutions that support this research.
As the status of the Police Civil Service Unit which is a government technical institute in the
field of peace and public order as well as to assist the Regional Head, then to realize the order
caused by the number of homeless people and beggars in the city of Malang city government
gave the task to the Civil Service Police Unit for ordering acts homeless and these beggars.
Furthermore, in such enforcement efforts are guided by civil service Police Unit in the Ministry
of the Interior's decision No. 26 of 2005 on Guidelines for Operational Procedures and
Equipment Police Unit Civil Service. The order of business coaching do is through four stages
including: the first stage of the process of straightening preentif indirectly using an intermediary,

an orderly and safe condition, because these institutions are government attributes to act against
problems of Order and peace tranquility. But keep in remembered that any action taken by the
Civil Service Unit cops should really guided by the rules applicable in the sense don’t to acts
arbitrarily without regard to human rights, and deviate by only relying on muscle power. And the
need remembered task execution order that all areas of Civil Service Police Unit conducted an
act of non Yustisia so no judgments through the judicial process.
