PENUTUP IMIGRASI PAKSA WARGA SIPIL PALESTINA OLEH MILITER ISRAEL TAHUN 1948 SEBAGAI SUATU PELANGGARAN TERHADAP HUKUM INTERNASIONAL YANG BERKAITAN DENGAN KEADAAN KONFLIK BERSENJATA.

PENUTUP

A. Kesimpulan

Berdasarkan penjabaran dalam penulisan hukum ini, maka dapat disimpulkan bahwa memang terdapat indikasi-indikasi yang mengarah kepada pelanggaran terhadap asas-asas yang melandasi hukum humaniter internasional secara umum, sebagaimana telah dijabarkan dalam Bab II poin A penulisan ini, dalam pelaksanaan Rencana Dalet melalui operasi-operasi militer pasukan Israel yang diarahkan kepada Kombatan yang terlibat dalam Perang Arab-Israel maupun Penduduk Sipil Palestina, yang dijabarkan dalam Bab II poin C penulisan ini. Lebih jauh, dalam pelaksanaan operasi-operasi militer Israel yang dilaksanakan sepanjang tahun 1948-1949 sebagaimana dijabarkan dalam penulisan hukum ini, ditemukan indikasi-indikasi yang membutuhkan penyelidikan lebih jauh, yang mengarah kepada:

a) Pelanggaran-pelanggaran terhadap aturan-aturan Hukum Perang sebagaimana diatur dalam Konvensi-konvensi den Haag maupun Konvensi-konvensi Jenewa 1949 berikut dengan Protokol-protokol Tambahan terhadap Konvensi Jenewa 1949.

b) Pelanggaran-pelanggaran terhadap aspek perlindungan yang seharusnya diterapkan baik kepada Kombatan dan Tawanan Perang, maupun kepada Penduduk Sipil berikut Populasi Sipil

beserta Objek-objek yang dilindungi, menurut Konvensi-konvensi Jenewa 1949 berikut Protoko-protokol Tambahan terhadap Konvensi Jenewa 1949.

c) Tindakan deportasi yang melawan hukum (unla wful deportation) sebagaimana diatur dalam Konvensi Jenewa (IV) tahun 1949. d) Kejahatan terhadap Kemanusiaan (pembunuhan Kombatan Hors de

Combat dan Penduduk Sipil) menurut Pasal 7 Ayat 1-3 Statuta Roma tahun 1998 tentang Mahkamah Pidana Internasional.

e) Kejahatan Genosida sebagaimana diatur dalam Pasal 6 Statuta Roma tahun 1998 tentang Mahkamah Pidana Internasional.

f) Kejahatan Perang menurut Pasal 8 Ayat 1-3 Statuta Roma tahun 1998 tentang Mahkamah Pidana Internasional.

B. Saran

Berdasarkan penjabaran dalam penulisan hukum ini dan kesimpulan-kesimpulan berkaitan dengan indikasi yang ditemukan dalam operasi militer Israel tahun 1948-1949 yang dilakukan terhadap penduduk sipil Palestina, dalam rangka untuk memberikan solusi menuju perdamaian abadi antara Israel-Palestina, maka disarankan untuk:

a) Melakukan peninjauan ulang terhadap Resolusi 181 (II) tahun 1947 tentang Future Government of Palestine khususnya berkaitan dengan konsep pemisahan wilayah Palestina.

b) Melakukan repatriasi tanpa syarat, sebagaimana pernah diajukan oleh Count Folke Bernadotte selaku mediator PBB, terhadap pengungsi Palestina akibat operasi militer Israel tahun 1948-1949 dan akibat konflik-konflik bersenjata antar kedua belah pihak yang terjadi setelahnya.

c) Melakukan perombakan dalam Keanggotaan Tetap dan mekanisme Hak Veto dalam Dewan Keamanan PBB, dengan tujuan untuk memberikan suatu solusi yang tegas terhadap kasus-kasus yang berkaitan dengan konflik Israel-Palestina.

d) Melakukan penyelidikan menyeluruh terhadap operasi-operasi militer Israel yang dilakukan terhadap penduduk sipil Palestina sepanjang tahun 1948-1949, dengan tujuan untuk mengadakan peradilan internasional, sebagaimana pernah dilakukan terhadap para perwira NAZI dan perwira Angkatan Bersenjata Jepang pasca-Perang Dunia Kedua.
