THE CORRELATION BETWEEN LOCAL GOVERNMENT AND DPRD
(COUNCIL OF THE PEOPLE’S REPRESENTATIVES) IN MAKING THE 26
VILLAGES IN TULANG BAWANG DISTRICT

Making of the local rules No : 23, 2008 is about the forming of 26 villages in the
region of Tulang Bawang District is a process of Law Legality that involves Local
Government and DPRD (Council of the People’s Representatives). Problem of the
research is the rejection of 2(two) from 26 villages forming in that region. In this
research, the writer is very interested in observing that problem, not only from
PERDA (Local Government Rules) forming by seeing the correlation pattern between
Local Government and DPRD but also with those PERDA (Local Government Rules)
forming process.
The purpose of this research is to investigate the correlation pattern between Local
Government Institution and DPRD in making the PERDA (Local Government
Rules), and also analyzing the process of stated 26 villages in Tulang Bawang
District. The Method that is used in this research using the Qualitative Method, so
that it can describe and analyze the data and also the correlation between Variable
which oriented to result of the research in the field and references. Specifically, this
research states in analyzing and observing in the field phenomena deeply and
completely based on the research characteristics.
Result of the research stated that : (1) the correlation pattern between Local
Government and DPRD (council of the people’s representatives) had implemented
well by doing Check and Balances. This relations are influenced by the Structural
Organization of Communication and Human Resource and also between Local
Government and DPRD. (2) This PERDA (Local Government Rules) process had
appropriate with the mechanism and rule of laws. Formally, this PERDA had suitable
with rule of laws but in fact, This PERDA still has the weaknesses because it can not
implement totally.

Pembentukan Peraturan Daerah Nomor 23 tahun 2008 tentang Pembentukan 26
Kampung dalam wilayah Kabupaten Tulang Bawang merupakan proses legalitas
hukum yang melibatkan Pemerintah Daerah dan DPRD. Permasalahan dalam
penelitian ini adalah terdapat penolakan pembetukan 2 (dua) kampung dari 26
(dua puluh enam) kampung yang ada. Dalam penelitian ini penulis tertarik untuk
meneliti permasalahan yang ada tersebut dari sisi pembentukan Perda dengan
melihat pola hubungan antara Pemerintah Daerah dan DPRD dan proses
pembuatan Perda tersebut.
Tujuan penelitian ini untuk mengetahui hubungan antara Pemerintah Daerah dan
DPRD dalam pembentukan Perda dan menganalisis proses pembentukan 26
kampung dalam wilayah Kabupaten Tulang Bawang. Penelitian ini menggunakan
metode penelitian kualitatif yang berguna untuk mengambarkan dan menganalisis
data dan hubungan antar variabel dengan mengacu pada hasil pengamatan
dilapangan maupun kajian pustaka. Secara khusus penelitian ini menekankan pada
kajian dan analisis fenomena-fenomena dilapangan secara mendalam dan cermat
berdasarkan karakteristik fokus penelitian.
Hasil penelitian menunjukan bahwa ; [1] Pola hubungan antara Pemerintah
Daerah dan DPRD sudah berjalan dengan baik dengan telah dijalankannya cheks
and balances. Hubungan ini dipengaruhi pula oleh struktur organisasi, sumber
daya manusia dan komunikasi yang terjalin antara DPRD dan Pemerintah Daerah;
[2] proses pembentukan Perda Nomor 23 tahun 2008 ini telah sesuai dengan
mekanisme dan aturan perundang-undangan yang ada. Secara formal Perda ini
sudah sesuai dengan mekanisme dan aturan yang ada, namun dari asas materiil
Perda ini cacat demi hukum karena tidak dapat dijalankan secara total.
