ABSTRAK
Pembuatan akta kelahiran merupakan bentuk perlindungan anak.
Pembatasan waktu pembuatan akta kelahiran apabila keterlambatan waktu
satu tahun maka mengurus akta kelahiran melalui putusan pengadilan negeri
menimbulkan kerugian terhadap anak dan masyarakat merasa kesulitan
dalam segi waktu serta biaya cukup besar. Namun hal tersebut tidak
dikhawatirkan lagi karena Mahkamah Konstitusi menetapkan putusan Nomor
18/PUU-XI/2013 tentang keterlambatan pembuatan Akta Kelahiran tidak
melalui pengadilan. Penelitian ini bertujuan untuk mengetahui penerapan
Putusan Mahkamah Konstitusi di Dinas Kependudukan dan Catatan Sipil
Kabupaten Garut serta mengetahui perlindungan hukum terhadap anak
setelah adanya putusan mahkamah konstitusi
Metode penelitian yang digunakan berupa pendekatan yuridis normatif
yaitu dengan mengkaji dan menguji data sekunder. Spesifikasi penelitian
yang digunakan adalah deskriptif analitis yaitu dengan menganalisis
ketentuan hukum dan teori hukum yang berkaitan dengan permasalahan dan
menggambarkan pengaturan akta kelahiran sebelum dan sesudah adanya
Putusan Mahkamah Konstitusi dikaitkan dengan Undang-Undang
Perlindungan Anak. Tahap penelitian ini menggunakan penelitian
kepustakaan dan studi lapangan untuk menganalisis yang ada kaitannya
dengan permasalahan kemudian data yang telah terkumpul selanjutnya akan
dianalisis menggunakan analisis yuridis kualitatif.
Berdasarkan hasil penelitian yang telah dilakukan dapat disimpulkan
bahwa penerapan putusan Mahkamah Konstitusi No.18/PUU-XI/2013
mengenai keterlambatan mengurus akta kelahiran tidak melalui pengadilan
berdampak baik bagi masyarakat Kabupaten Garut, dibuktikan dengan
meningkatnya jumlah pemohon pembuatan akta kelahiran di Dinas
Kependudukan dan Catatan Sipil Kabupaten Garut. Masyarakat lebih
dimudahkan pengurusan akta tidak lagi berbelit-belit dan sangat efisien.
Selanjutnya terkait perlindungan hukum terhadap anak setelah adanya
putusan mahkamah konstitusi lebih terjamin terpenuhinya hak-hak anak
sesuai undang undang nomor 23 tahun 2002 tentang perlindungan anak.

ABSTRACT
Birth certificate is one form of child protection. The time restrictions in
making birth certificate whereby if there are delays of time one year then to
propose birth certificate must be through the district court decision caused
loss against children and the community felt difficulties in terms of time and
costs large enough. But it did not need anymore because it was feared that
the constitutional court has set the judgement No.18/PUU-XI/2013 about the
delays in the manufacture of a birth certificate that is not through the court.
This study aims to to know the application of the award the constitutional
court in the population and civil registration Kabupaten Garut and knowing
legal protection against children after the judicial the constitutional court.
Research methodology used in the form of juridical approach
normative namely by reviews and test secondary data .Research
specifications that is used is analytical descriptive namely by analyzing the
legal and the theory of laws relating to the problems and described setting a
birth certificate before and after the judicial the constitutional court associated
with the act of child protection .A research phase was used in the research
literature available and field study to analyze anything to do with the problems
then the data that has been collected then analyzed using analysis qualitative
juridical
Based on the results of research has been done we can conclude that
the adoption of the constitutional court judgement No.18/PUU-XI/2013
propose regarding delays birth certificate through a court not impact good for
the society garut district , this is proven by the increasing number of birth
certificate applicants in the department of population and civil garut district
.The community so that more lots certificate no longer tortuous and very
efficient and affordable in the economy sector .Next related legal protection
against children after the constitutional court judgement more secured with
the fulfillment rights of children appropriate invite act number 23 year 2002
regarding the protection of children.
