Compliance Function
Pelaksanaan aspek kepatuhan merupakan kewajiban bagi semua pihak internal tanpa terkecuali. Bagi setiap staf dan karyawan dari jabatan tertinggi hingga terendah tidak akanditoleransiapabilamelanggaraspekkepatuhan.Hal ini telah menjadi kebijakan dan komitmen perusahaan secara berkelanjutan.
Dalam rangka memantau pelaksanaan aspek kepatuhan dimaksud maka Direktur Kepatuhan beserta Compliance Officer yang berada dalam Compliance Division secara terus menerus menjalankan fungsi dan tugasnya secara independen. Aspek kepatuhan yang menjadi fokus kerja Compliance Division meliputi kepatuhan secara umum dan kepatuhan syariah.
Dalam menjalankan tugasnya, direktur kepatuhan beserta jajarannya yang saat ini berjumlah 14 orang termasukdivisionheaddarisebelumnya(posisiakhirJuni 2009)sebanyak8orang,selaluberpegangteguhpada prinsip syariah dan peraturan serta perundang-undangan yang berlaku, selain berpedoman kepada Kebijakan dan Prosedur Kepatuhan yang telah diberlakukan sejak tanggal 1 April 2010.
Dengan demikian diharapkan dapat memberikan masukan dan memastikan bahwa manajemen dan bank telah memenuhi seluruh ketentuan syariah, Bank Indonesia,sertaperaturandanperundang-undangan.Hal ini menunjukkan perhatian dan kesungguhan manajemen untuk lebih meningkatkan peran dan tanggung jawab compliance division ke depan, dalam membantu pelaksanaan tugas direktur kepatuhan.
Pelaksanaan kepatuhan dalam hal prinsip/aspek syariah dilakukan dengan cara antara lain memberikan opini syariah terhadap permasalahan operasional dan pembiayaan terkait dengan kepatuhan syariah, memonitor produk atau aktivitas baru dari aspek syariah, dan melakukan review terhadap berbagai produk.
Pelaksanaan prinsip kehati-hatian dilakukan melalui fungsi ex-ante yaitu keterlibatan compliance officer/ staff sebelum kebijakan tersebut dilaksanakan dan atau berhak memberikan masukan unit kerja lainnya bila ada kebijakan mengandung risiko yang cukup signifikan atau
Fulfillment of the compliance aspect is required of all parties at Bank Muamalat Indonesia without compromise. All staff and employees from the highest rank to the lowest will not be tolerated for non compliance. This has become the policy and commitment of the Bank on a continuous basis.
In monitoring the implementation of this compliance aspect, the Compliance Director together with the Compliance Officers from the Compliance Division continuously carry out their roles and responsibilities independently. The compliance aspects that are the focus of the Compliance Division covering compliance in general and compliance to the principles of sharia.
In discharging his duties, the Compliance Director and his teamof14personnelincludingtheDivisionHead(from the previous eight personnel as of June 2009), adheres fully and at all times to the sharia principles and prevailing laws and regulations, in addition to being guided by the Compliance Policy and Procedure that have been made effective since 1 April 2010.
As such, it is expected that the Compliance Division can provide inputs and ensure that the Management and the Bank have complied with the tenets of sharia, Bank Indonesia regulations as well as all prevailing laws and regulations. This shows both the concern and commitment of Management to further enhance the roles of the Compliance Division going forward, in assisting the Director of Compliance in the discharge of his duties.
Theimplementationofcomplianceontheaspect/principles of sharia is undertaken in a separate manner: providing
a sharia opinion on the issues of operations and related financing vis-à-vis the sharia compliance, monitoring new products or activities from the perspective of sharia, and reviewing all products of the Bank.
Supporting the implementation of prudent banking practices, the Compliance unit plays an ex-ante role by providing thought leadership and guidance to other business units in determining whether a proposed activity or policy contains significant risks or viewed as potentially

Selama tahun 2009 fokus pengamatan dan perhatian dari fungsi compliance masih tetap pada pelaksanaan prinsip kehati-hatian dibidang pembiayaan, tanpa mengabaikan pelaksanaan prinsip kehati-hatian dibidang lainnya. Jika terdapat pembiayaan yang dianggap belum sejalan denganregulasi/kebijakaninternalataueksternal,maka akan disampaikan opini tertulis kepada unit kerja terkait sebagai bahan masukan dan pertimbangan. Apabila dipandang perlu, maka compliance officer bekerja sama dengan Financing Support Division, melakukan peninjauan langsung ke nasabah untuk mengetahui kondisi di lapangan.
Dari pemantauan yang dilakukan terhadap pembiayaan yang diberikan kepada pihak terkait selama tahun 2009, tidak terdapat pembiayaan yang melampaui ataupun melanggar peraturan Batas Maksimum Pemberian Kredit (BMPK)BankIndonesia.
PENERAPAN PROGRAM ANTI PENCUCIAN UANG DAN PENCEGAHAN PENDANAAN TERORISME (APU & PPT) SERTA UNDANG-UNDANG TINDAK PIDANA PENCUCIAN UANG
Sejak dikeluarkannya Peraturan Bank Indonesia Nomor 11/28/PBI/2009 tanggal 1 Juli 2009 tentang Penerapan Program Anti Pencucian Uang dan Pencegahan Pendanaan Terorisme(APU&PPT)bagiBankUmumsebagaipengganti PBI Nomor 5/21/PBI/2003 tanggal 17 Oktober 2003 tentang Perubahan Kedua Atas Peraturan Bank Indonesia Nomor3/10/PBI/2001tentangPenerapanPrinsipMengenal Nasabah(KnowYourCustomerPrinciples),SuratEdaran BankIndonesiaNomor11/31/DPnPtanggal30November 2009 tentang Pedoman Standar Penerapan Program Anti Pencucian Uang dan Pencegahan Pendanaan Terorisme bagi Bank Umum serta Undang-undang Nomor 15 tahun 2002tentangTindakPidanaPencucianUang(TPPU)yang telah diamandemen menjadi Undang-undang Nomor 25 tahun 2003, Bank Muamalat telah menerapkan program APU & PPT dimaksud pada seluruh kantor di Indonesia, hingga saat ini upaya untuk sosialisasi terhadap program APU & PPT tersebut terus dilakukan. Throughout 2009, the main focus of this compliance unit was to ensure that the Bank’s financing activities had been carried out by adhering fully to the principles of prudential banking in financing, without disregarding adherence to prudential practices in other areas. In cases where there isfinancingthatfailstoconformwithregulation/internal or external policies, a written opinion will be issued to the respective business or operating units as a form of input for consideration. If deemed necessary, the Compliance Officer working in tandem with the Financing Support Division can be called upon to conduct on-the-spot verifications of the customer to ascertain the matter first hand.
Based on observations on financing that were provided to affiliated parties throughout 2009, there were no financing that exceeded or contravened the Legal Lending Limit(LLL)regulationofBankIndonesia.
ANTI MONEY LAUNDERING AND PREVENTION OF TERRORISM FUNDING (APU&PPT) PROGRAM AND THE CRIMINAL ACT LAW ON MONEY LAUNDERING
Since the enactment of Bank Indonesia Regulation No.11/28/PBI/2009of1July2009ontheImplementation of Anti Money Laundering and Prevention of Terrorism Funding (APU&PPT) for the Commercial Bank in place of PBI No.5/21/PBI/2003 of 17 October 2003 on the Second Amendment of PBI No.3/10/PBI/2001 on the ImplementationofthePrinciplesofKnowYourCustomer (KYC), Bank Indonesia Circular Letter No.11/31/DpnP on 30 November 2009 on the Standard Guideline for the Implementation of Anti Money Laundering and Prevention of Terrorism Funding for the Commercial Bank and the Law No. 15 of 2002 on the Criminal Act of Money Laundering that has been amended to Law No.25 of 2003, Bank Muamalat has implemented the said APU&PPTinallbranchoffice/sub-branchofficeandcash outlets in Indonesia, and to date continues to socialize the APU&PPT program. Implementation of the APU&PPT program is carried out by the special APU&PPT task force under the supervision of the Compliance Director, and in general, is in line with the guidelines and regulations
