ABSTRAK
Para pihak dalam kontrak pada umumnya cenderung memilih arbitrase
sebagai penyelesaian sengketa mereka dengan mencantumkan perjanjian
arbitrase. Para pihak di dalam perjanjian arbitrase merupakan pihak yang
menandatangani kontrak ataupun perjanjian arbitrase. Namun, dalam
pelaksanaan kontrak, sengketa sering kali muncul melibatkan pihak ketiga
yang merupakan pihak non-penandatangan dan memiliki peran penting di
dalam kontrak baik dalam negosiasi maupun pengakhiran kontrak. Penelitian
ini ditujukan untuk mengetahui penerapan perjanjian arbitrase terhadap pihak
ketiga dan pelaksanaan putusan arbitrase yang melibatkan pihak ketiga.
Penelitian ini bersifat deskriptif analitis dan yang menggunakan
pendekatan yuridis normatif dan tahap pengolahan dan analisis data
dilakukan secara yuridis kualitatif yang menelaah bahan pustaka primer,
sekunder, dan tersier, antara lain UNCITRAL Model Law on International

Commercial Arbitration 1985 amandemen 2006, New York Convention on
Recognition and Enforcement of An Arbitral Award 1958, dan teori-teori atau
doktrin penerapan perjanjian arbitrase terhadap pihak ketiga.
Berdasarkan hasil penelitian ini, baik UNCITRAL Model Law on
International Commercial Arbitration 1985 amandemen 2006 maupun New
York Convention on Recognition and Enforcement of An Arbitral Award 1958
belum memberikan ketentuan atau pengaturan bagaimana penerapan
perjanjian arbitrase terhadap pihak ketiga. Dapat disimpulkan bahwa
meskipun tidak ada aturan yang jelas, pihak ketiga dapat terikat dengan teori
maupun doktrin-doktrin internasional yang pemakaiannya sesuai dari
fakta-fakta yang ada. Selanjutnya, putusan arbitrase yang melibatkan pihak
ketiga tetap bisa dilaksanakan ataupun apabila tidak bertentangan dengan
hukum negara tempat putusan arbitrase tersebut akan dilaksanakan.

ABSTRACT
The parties to a contract have a tendency to choose arbitration as their
way of dispute resolution by incorporating an arbitration agreement into a
contract. The term parties refer to signatories to the contract or arbitration
agreement. However, when executing the contract, dispute often involves a
third party who is non-signatory either to the contract or to the arbitration
agreement and has an important role in the negotiation of a contract or its
termination. This study aims to find out the application of an arbitration
agreement towards a third party and its award execution involving third party.
The research method of this final project was analytical description, using
juridical normative and phase of data analysis in a manner of juridical
qualitative that analyzed based on facts of primary, secondary, and also
tertiary law, which are UNCITRAL Model Law on International Commercial
Arbitration 2006 amendment, New York Convention on Recognition and
Enforcement of An Arbitral Award 1958, and theory or doctrine of the
application of an arbitration agreement over a third party.
The result of this study showed that neither UNCITRAL Model Law on
International Commercial Arbitration 2006 amendment nor New York
Convention on Recognition and Enforcement of An Arbitral Award 1958

provide a decent provision or regulation on how arbitration agreement could
apply over a third party. It could be concluded that even if there is no decent
regulation, arbitration agreement could bind a third party by virtue of theory or
international doctrine which its usage is case by case basis. Furthermore, the
arbitral award which involves a third party could still be enforced if it is not
contrary to the law of a State where the award is sought.
