AGENCY FOR AGRICULTURAL RESEARCH 1\ND


DEVELOPHENT

GENERAL

1. THIS MEMORANDUM expresses the understandings of the
Government of Australia and the Government of the
Republ ic of Indonesia concerning the responsibilities
and contributions respectively of the two Governments
in regard to the joint cooperation project on research
development in the veterinary sciences at LPPH,
hereinafter referred to as the Project.

This Project

is intended to contribute to research and training in
the veterninary sciences as further described and
detailed in Annex 1 to this t-temorandum.

AUTHORITIES

2. The Executing Authorities for this Project will be
For the Indonesian Government : The Agency for
Agricultural Research and Development of the Department of Agriculture .
For the Australian Government : The Australian
Development Assistance Bureau of the Department of
Foreign Affairs.
The Australian Development Assistance Bureau may
nominate suitably qualified agents to undertake
any part of its functions on its behalf.

DURATION

3. This Memorandum will take effect from the date of its
signature and the Project will be deemed to have
commenced from that date.
The Australian contribution to the Project and all
undertakings given herein will cease 5 years after
the date of signature of this Memorandum or on such

other date as may subsequently be arranged betwen
the two Governments .
PROJECT

4.

ORGANIZATION

Responsibility for development and direction of the
Project will be vested in a Project Co-ordinating

Board, whose chairman will be appointed by the
Indonesian Government .

Membership of this Board

will include both the Indonesian Project Manager
and the Australian Co-Project Manager .
The Australian Co-Project Manager is to be appointed
by the Australian Government and agreed upon by the
Indonesian Government,

Membership of the Board will

also include representatives of the Indonesian
Government Department referred to in Clause 2 above,
or nominated at the discretion of the Indonesian
Government, as well as a nominee designated by the
Australian Embassy, Jakarta.

This board will meet


not less than twice per year .
FUNCTIONS OF THE

PROJECT CO- ORDINATING

Functions of the Board will include :
(a)

co-ordinating policy for the Project;

(b)

co-ordinating operation of the Project team;

(c)

co- ordinating the disposition of the Project


BOARD

personnel;
(d)

reviewing and reporting on progress to the
two Governments;

(e)

recommending to the b.ro Governments changes
in program, budget and future development.

RESPONSIBILITY

6.

Overall responsibility for this Project will rest
with the Indonesian Government .


The final authority

for decisions on the implementation of the agreed
works program will rest with the Head of the Agency

for Agricultural Research and Development after
considering the consultation between the Indonesian
Project Manager and the Australian Co-Project
Manager.
CONTRIBUTIONS

7.


The contributions of the Indonesian and Australian
Governments are detailed in Annex 1 and are estimated
to value Rp 1,500 million and $A 4 . 6 million
repectively.

Disbursement of Indonesian and

Australian contributions will be subject to the
normal annual Parliamentary approval of Appropriations.
EVALUATION

8.

An

evaluation of progress of the Project may be

made at times arranged between and mutually
convenient to, the Indonesi an and Australian
Governments.


Such an evaluation would be undertaken

by a joint team appointed by the

and independent of staff involved in the project .
PERSONNEL

9.

For the purposes of this Project , the Indonesian
Government will, in accordance with the existing
l aws and regul ations , facilitate the employment by
the Australian Government or its agent of personnel
as required for the Project and established between
the two Governments by :
(a)


granting exemption from income or other taxes
on project salaries and allowances ;

(b)

granting exemption from import and other duties
on personal and household effects subject to
their re- exportation after the completion of
the assignment;

(c)

granting to Australian project personnel all
rights and entitlements accorded to the aid
personnel of any other donor country;

expediting the issue of all documentation required
for the entry of and performance of work by,
project personnel .

SUPPLIES

10.

(a)

The Indonesian Government will, in accordance
with the existing laws and regulations,exempt
from import duties and other taxes (or pay such
duties thereon) all goods supplied by Australia
for the established purposes of the project as
set out in Annex 1 .

(b)

The Indonesian Government will facilitate
movement of project supplies by providing
appropriate customs and wharfage facilities in
the port closest to the project site and will be
responsible for the expeditious transport of such
supplies to site .

(c)

Project supplies provided by Australia shall be
available for the unrestricted use of the Project
and shall not be withdrawn from such use without
the consent of the Project co-ordinating Board .
The Australian Co- Project Manager in consultation
with the Indonesian Project Manager shall exercise
administrative control over such supplies for the
duration of the Project.

LIABILITY

11.

The Indonesian Government shall be responsible for
dealing with claims which may be brought by third
parties against Australia or an executing agency,
their officials or other persons performing services
on their behalf, and shall hold them harmless in
respect of claims or liabilities arising from
operations under this Memorandum.

This provision

shall not relieve any person from liability for any

criminal, grossly negligent or fraudulent act .

SECURITY

12 .

The Indonesian Government will arrange for any
protection deemed necessary to ensure the safety
of Australian personnel, project and personnel
equipment both at the project location, in transit
and on any other official representational activity
in Indonesia .

The Australian Government will take reasonable
precautions to ensure that Australian personnel
have due regard to the local traditions and customs.
SETTLEMENT OF

13 .

DIFFERENCES

Any disputes arising out of the interpretation or
implementation of this Memorandum shall be settled
amicably by consultation or negotiation between
the two Governments .

14.

AMENDMENTS

Amendments to this Memorandum may be made at any
time by an Exchange of Letters between the two
Governments,

ANNEX 1 to this Memorandum forms an integral part of it.

THE ANIMAL DISEASE RESEARCH INSTITUTE, BOGOR,
AGENCY FOR AGRICULTURAL RESEARCH

A.

OBJECTIVES
This Proj ect seeks to upgrade the current level of research into

diagnostic methods and to promote the application of existing advanced
technology to veterinary problems .

The immediate aim of the Project is to

improve the capability of LPPH in the fields of bacteriology, virology,
parasitology, mycology, toxicology and veterinary pathology .
The Project aims to assist LPPH to perform the two roles designated
by the Indonesian Ministry of Agriculture.

The first of these roles is to

act as a central reference laboratory, offering a highly skilled laboratory
and consultative service to other veterinary laboratories in Indonesia.
The second role is as a research institute carrying out investigations on

animal health problems of national importance and in helping regional
laboratories in the investigation of diseases of local significance.
B.

AUSTRALIAN CONTRIBUTION
Australia will make contributions totalling an estimated $A 4,600,000

to the Project over the next five years.
1.

Australia will provide :

accommodation and remuneration for all Australian personnel
assigned to the Project, namely:
(a)

resident scientists in the Departments of Pathology,
Bacteriology, Virology, Parasitology and Toxicology, one of
whom is to be the Australian Co-Proj ect Manager; .

(b)

consuLtant scientific experts who will make a number of short
visits;

(c)

other specialists for visits as required;

(d)

technical staff to be appointed to each of the areas served
by a resident scientist; and

(e)

an Administrative Officer, to assist in developing systems
of inventory control and stores management .

a comprehensive training program, namely :
(a)

approximately ten project training awards to be undertaken
in Australia.

Providing suitable LPPH personnel are avail-

able, training will be provided towards Ph.D and Masters
degrees;
(b)

on- the- job technician training under the guidance of
Australian technicians; and

(c)

approximately ten short term familiarisation visits to
Australia by senior Indonesian LPPH staff .

vehicles to assist the Project staff, both Indonesian and
Australian, to make field investigations into disease outbreaks,
carry out surveys and implement research programs.

It is

envisaged these will comprise :

(d)

C.

INDONESIAN CONTRIBUTION

Indonesia will supply all buildings and maintain them and meet
the annual operating costs of LPPH.
Specific Indonesian inputs relevant to this project are :
(a)

basic services (electricity, gas and water);

(b)

laboratory animals;

(c)

experimental animals;

(d)

feeding and accommodation of animals;

(e)

travelling expenses for Indonesian staff;

(f)

local purchase of chemicals, expendables and office supplies;

(g)

purchase of survey materials from abbattoirs;

(h)

operating cost of vehicles, including cost of petrol, oil
and lubricants, and maintenance;

(i)

handling cost of research equipments, including customs
wharfage and expeditous transport;

(j)

maintenance of research equipments; and

(k)

operating fees for personnel involved in the project;

totalling an estimated Rp 1 . 500 . 000 . 000, - over the next five years .
