ADMINISTRATIVE ARRANGEMENT
CONCERNING
ENERGY
PROGRAMME
The Indonesian Minister of Mines and Energy , Dr . Subroto , being
the competent Indonesian
Authority for the purpose of this
Administrative Arrangement, hereinafter referred to as
"the
Indonesian Party"
and
The Netherlands Minister for Development Cooperation, Drs.E.Schoo ,
being the competent Netherlands Authority for the purpose of
this Administrative Arrangement , hereinafter referred to as
"the Netherlands Party" :
HAVI NG DECIDED to co- operate in an energy- programme, additional
to the present bilateral development co-operation programme as
described in the agreed minutes of meeting on the energy co operation programme between the representatives of both Parties
(August/September 1982)
HAVING REGARD to the provisions of Article 3 of the Agreement
concerning Technical Co- operation between the Kingdom of
the
Netherlands and the Republic of Indonesia signed at the Hague
on April 3 rd , 1964 , hereinafter referred to as "the Agreement"

ARTICLE
I
( The Programme)
1. The two Parties shall

2. The objectives of the Programme are to start and support
pilot activities directed towards integrated energy plaruUrng
and towards the provision of energy for the population of
rural areas , with special emphasi s on Java and Bali , being
the areas of major energy requirements .
3 . Activities under the

related to the regular bilateral development
co- operation
programme.
4 . The main activities to be undertaken under the energy
Pro-
gramme are :
- expert assistanceto the Indonesian Department of Mines
and Energy in assessment studies, energy planni ng
activities, formulation of energy issues and options , and
in the identification of critical issues which will be
the subject of special sub- programmes of a pilot nature
- sub- programme for assessing the question of fuelwood
consumption in the rural districts of Java/Bali , through
description of the actual situation, potential procedures
applicable for introducing improvements incluling (partial)
substitution of fuelwood by other energy sources , セゥッョ@
of the supply side on a self- sustained basis , increases of
the efficiency of utilization of fuelwood , and the social ,
economic , ecological, environmental and pricing questions

might include :
- the delineation and util ization of peat deposits;
- the utilization of agricultural, forestry and city waste;

- the transportation and the utilization of ooali .
ARTICLE
II
(The Netherl ands Contribution)
The Netherlands contribution to the Programme wil l consist of :
making availabl e qualified experts and bearing a l l expenses
on account of these experts ;
providing equipment to the Programme;
providing services to the Programme;
providi ng funds to meet related costs of the Programme;
providing funds for training for Indonesian counterparts .

III
( The Indonesian Contribution)
The Indones ian cont r ibut i on to t he Pr ogranune wi ll cons ist of qualifi ed and s uff i c i ent counterpart-staff ;
funds t o meet the running costs of the Programme;
offi ce fac i l ities for t he executi on of the Programme;
in general all measures which will facilitate t he cooper ati on between the Parties.

ARTICLE
(The Executive Authorities)
1 . The Netherlands Party shall appoint the Directorate General
for International Co-operation of the Ministry of Foreign
Affairs as the Netherlands Executive Authority in charge of
the Programme .
2 . The Indonesian Party shall appoint the Directorate General
of Power of the Department of Mines and Energy as the Indonesian Executive Authority in charge of the implementation
of the Programme .
ARTICLE
V
(Delegation)
Each of the Executive Authorities , mentioned
shall be entitled to delegate
under
its
in Article
IV ,
own responsibility ,
partly or entirely its duties in connection with the Programme
to a third Party . In doing so the Executive Authorities shall
inform
each
other in writing of
institutions delegated
the names of persons
or
and of the extent of such delegation.
ARTICLE
VI
{The Schedule of Operations)
1. The Executive Authorities shall establish in common agreement
for each
activity of the Programme a Schedule of Operations
indicating in detail :

the contribution of either Party;
the number and duties of the Netherlands staff;
their _job- descriptions and qualifications;
the duration of their stay in Indonesia ;
a description of the equipment and materials to be made
available .
The Schedules of Operations shall include a specified budget concerning each item of the contribution of either Party,
a time-table and lists of equipment and
materials to be
supplied by either Party .
2 . These Schedules of Operations shall form an integral part
of the Administrative Arrangement .
3. The Schedules of Operations may be amended in common
agreement between the Executive Authorities.
ARTICLE
VII
(Status of the Expatriate Experts)
The expatriate experts to this Programme as mentioned in
Article II above , shall enjoy the privileges mentioned in
Article 4 of the Agreement .
ARTICLE
VIII
(Status of the Netherlands equipment and materials)
1. The provisions of Article 5 of the Agreement shall be
applicable in the
importation and exportation
of the
Netherlands equipment and materials for the Programme .

2. The ownership of all equipment and materials supplied by
the Netherlands Party will be transferred to the Indonesian
Party when the co- operation between the two Parties on the
Programme has terminated , unless they are required for some
other technical co- operation
project
involving the two
Parties .
ARTICLE
IX
(Reporting)
Quarterly reports
shall be submitted
to both Ex ecutive
Authorities in the English language on the progress made in
the execution of the Programme .
On the termination of the Programme, a final report shall be
submitted to all the relevant institutions in the English
language on all the aspects to the work done in connection
with the Programme.

X
(Joint Committee)
On going activities will be assessed in periodic joint consultation through a joint committee which will consist of the
Executive Authorities of both Parties for the implementation
and review of the energy co- operation programme.

The modalities for the functioning of the joint committee
shall be described

a general Schedule
of Operations .
This general Schedule of Operations shall form an integral

ARTICLE
XI
(Settlement and disputes)
Any dispute
concerning the interpretation or implementation
of this Administrative Arrangement which
cannot be settled
in consultation between Parties shall be referred to the respective Governments in a way to be decided upon by letter .
ARTICLE XII
(Entry into force and duration)
This Administrative Arrangement shall enter into force on the
date of signature by both Parties and shall expire on the date
on which the Programme has been completed in conformity with
the provisions of this Arrangement and of the Schedule of
Operations, whichever date is the later.

At the time of signing the Administrative Arrangement on energy
co- operation , the two Parties , desirous to commence thei r
operation as soon as possible , considering

have been held and preliminary agreement has been reached ,
co- operation in an energy- assessment for West- Java ,
