The Government of the Republic of Indonesia and the
Government of the Kingdom of Belgium;
Considering the establishment in 1967 of an
Intergovernmental Group on Indonesia (hereafter called "the Group")
with the purpose to contribute to the economic development of the
Republic of Indonesia;
Considering that Belgium participates in the activities of
the Group since its establishment;
Considering that under the provisions of the Act dated 3rd
June, 1964, amended by the Royal Act no.75 dated the 10th November
1967, the Minister

Minister who is in charge of External Trade Relations, are given
powers to grant loans to foreign States;
Desiring that the financial assistance provided for
in the present Agreement should be made available within the
framework of the joint co-operation undertaken by the members of
the Group with a view to facilitate the implementation of the
Programme

Desiring that the financial aid will contribute to
the expansion of the trade relations between Belgium and Indonesia;
Have agreed on the following
ARTICLE 1
Payments
1. The Government of the Republic of Indonesia shall
be granted by the Government of the Kingdom of
Belgium financial assistance in the form of a
non-interestbearing loan amounting to three hundred
twenty five (325) million Belgian Francs.
2. This financial assistance shall be made available
to the Government of the Republic of Indonesia
through one payment which shall be made in Belgian
Francs into an account in the name of the Bank
Indonesia opened with the National Bank of Belgium.
This payment will be effected as soon as possible,
after the formalities as provided under Article 6
of the present Agreement have been complied with.
ARTICLE 2

Repayments
1. The loan granted under this Agreement shall be
repaid by the Government of the Republic of
Indonesia to the Government of the Kingdom of
Belgium in twenty installments, each amounting

to sixteen million two hundred fifty thousand
(16.250 . 000) Belgian Francs.
2. Such repayments shall be effected in Belgian
Francs at Brussels to the National Bank of
Belgium in its capacity as treasurer to the
Belgian State; they shall be effected annually
on the 31st December of each year and initially
on the 31st December 1988.


ARTICLE 3
Utilization ·af the .loan

The financial assistance provided under this
Agreement shall be used by the Government of the Republic of Indonesia
for the purchase of Belgian goods and services within the framework
of the Development Programme of the Republic of Indonesia.
The technical procedures for implementing the
provisions of this Article shall be determined jointly by an exchange
of letters between the Government of the Kingdom of Belgium and the
Government of the Republic of Indonesia.

ARTICLE 4

Payments effected in accordance with this Agreement
for settlement of the

shall be free of all existing or

future charges or taxes of whatever discription, for which
such payments could be liable under any legal provisions or
regulations of whatever discription of the Kingdom of Belgium
and of the Republic of Indonesia respectively.

ARTICLE 5

The National Bank of Belgium and the Bank Indonesia,
acting as agents of their respective Governments, shall by
joint Agreement take the technical measures required for the
implementation of the provisions of this Agreement.

ARTICLE . 6


The provisions of this Agreement shall become effective
at a date to be determined by an exchange of notes establishing
that the formalities required by the national legislation of
each of the Contracting Parties for the implementation of this
Agreement have been complied with.

IN WITNESS WHEREOF the undersigned, duly empowered to
this end, have affixed their signatures to this Agreement.

Excellency,
With a view to implementing the provisions of article 3 of the
Agreement reached today between the Government of the Kingdom of Belgium
and the Government of the Republic of Indonesia, I have the pleasure in
suggesting that the following technical procedure be adopted :
1.

The sums in Belgian Francs made available to article 1 (therein-

after referred to as "sums in Belgian Francs") shall be used solely for
payments in favour of persons and firm whose trading activity is located
in Belgium, for Belgian goods supplied or services rendered, effected in
compliance with contracts concluded, after the date of signature of the
above mentioned Agreement.
2.


In execution of item l the Bank Indonesia (Central Bank) or the

Indonesian Foreign Exchange Banks designated by Bank Indonesia will is5oe
"Letter of Credit11 (L.C.) on Belgian Banks in favour of persons and firm
as mentioned in item 1.
All Belgian Banks which are entitled to mediate in the payment of
export transactions of Belgian goods or services may be taken into . account
when issuing L.C.
Above mentioned L.C. shall contain i.e. the following data as well
as the conditions to be complied with :

a) supply of certificates of Belgian origin;
b) the nature of the goods supplied and also the relevant item numbers
of the customs tariff of Indonesia;
c) references of the contract or commercial invoices;
d) previous approval by the Belgian Ministry of Foreign Affairs, External
Trade and Development Cooperation, General Direction of External
Relations.
3.

The L.C. shall mention the payment terms according to which the

Belgian Banks are entitled to obtain payment from the special account
opened with the National Bank of Belgium.
To this end a separate arrangement will be concluded between
the National Bank of Belgium and the Bank Indonesia.
I should be grateful if you would kindly confirm that Your
Government agrees with these provisions.
