MERUJUK Memorandum Saling Pengertian antara Pemerintah lridonesia da '
Pemerintah Mongolia di bidang Kerjasama Ekonomi dan Teknik yan ｾﾷ＠
ditandatangani di Jakarta pada tanggal 6 Mei 1994;
MENGHORMATI prinsip-prinsip kesetaraan dan manfaat bersama;
BERKEINGINAN untuk mengintensifkan kerjasama ekonomi , teknis, teknolog ,I•.
industri, riset dan perdagangan antara kedua negara;
MENGAKUI bahwa dukungan bagi pembangunan pertanian kedua negara dapa
difasilitasi melalui proses kerjasama institusional antara institusi dari sektor publi
yang mendukung dan meningkatkan sektor pertanian ;
MENGAKUI pentingnya menyusun program bersama di bidang pertanian untu ,
efektifitas pengelolaan sumber daya kedua negara di bidang pertanian, terutam a
mempertimbangkan potensi yang dimiliki oleh kedua negara;
SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku c i
negara masing-masing;
TELAH MENCAPAI kesepakatan sebagai berikut:

PASAL1
TUJUAN
Tujuan dari Memorandum Saling Pengertian 1n1 adalah untuk
mempromosikan kerjasama alih teknologi, perdagangan, pelatihan dan
ilmu pengetahuan dan teknologi dibidang pertanian antara Para Pihak,
dengan tidak mengindahkan area kerjasama lainnya yang dapat
dilakukan di waktu yang akan datang.
PASAL 2
LINGKUP KERJA SAMA
Otoritas yang berwenang wajib, berdasarkan hukum dan peraturan yang
berlaku di kedua negara berusaha untuk mendukung dan memfasilitasi
pelaksanaan program bersama pembangunan pertanian, dengan
mempertimbangkan potensi kedua negara.
PASAL 3
AREA KERJA SAMA
Kerjasama akan dilaksanakan dalam area sebagai berikut:

Pertukaran informasi tentang dokumen kebijakan di bidang pertanian;
Produksi tanaman pangan, terutama produksi benih tanaman pangan,
Perbaikan dan sistem irigasi;
Peternakan, terutama pembibitan hewan dan ternak;
lndustri pemrosesan makanan, ketahanan pangan;
Ekspor produk-produk pertanian;
Mekanisasi pertanian;
Kerjasama pendidikan dan pelatihan di bidang pertanian;
Pembangunan dan pengembangan metodologi manajemen ekonomi
dalam sektor pertanian;
Area kerjasama lainnya yang disepakati secara bersama-sama oleh
Para Pihak.
PASAL4
IMPLEMENTASI
Para Pihak wajib menyusun pengaturan khusus dalam rangka pelaksanaan
area kerja sama pada Pasal 3 yang didalamnya wajib memuat antara lain
isu-isu mengenai Hak atas Kekayaan lntelektual , Sumber Daya Genetik dan
Pengetahuan Tradisional dan Perjanjian Alih Material .
PASAL 5
KELOMPOK KERJA PERTANIAN
1. Untuk memastikan pelaksanaan Memorandum Saling Pengertian ini,
Para Pihak sepakat selanjutnya membentuk Kelompok Kerja Bersama
Pertanian (selanjutnya disebut KKBP);
2. KKBP wajib dipimpin oleh pejabat setingkat Direktur Jenderal dari
masing-masing Pihak;
3. Pertemuan KKBP akan diselegarakan secara bergantian di Indonesia
dan Mongolia sekali dalam dua (2) tahun. Tanggal, lokasi dan agenda
dari masing-masing pertemuan KKBP akan diputuskan secara bersama
melalui komunikasi tertulis lewat jalur-jalur diplomatik;
4. Negara tuan rumah KKBP akan menyediakan bantuan administatif untuk
pertemuan tersebut sesuai dengan peraturan perundangan masingmasing negara;
5. KKBP wajib meninjau kembali perkembangan dari kerja sama yang
dilakukan dan membahas kerja sama yang dapat dilakukan di masa yang
akan datang termasuk isu-isu mengenai Hak atas Kekayaan lntelektual,
Sumber Daya Genetik dan Pengetahuan Tradisional dan Perjanjian Alih
Material.
PASAL 6
KEWAJIBAN KEUANGAN
1. Para Pihak wajib melaksanakan area kerjasama yang tercantum dalam
Pasal 3 disesuaikan dengan kemampuan dan ketersediaan dana
masing-masing Pihak;
2. Berd asarkan kesepakatan bersama, Para Pihak diperbolehkan mencari
sumber pendanaan lain dalam kerangka bilateral atau multilateral untuk
pelaksanaan kerjasama atau program bersama.
PASAL 7
PENYELESAIAN PERBEDAAN
Setiap perbedaan yang muncul terkait interpretasi dan pelaksanaan
Memorandum Saling Pengertian ini akan diselesaikan secara damai
melalui konsultasi atau negosiasi antara Para Pihak.
PASAL8
AMAN DE MEN
Amandemen atas Memorandum Saling Pengertian ini dapat hanya dapat
dibuat setelah melalui konsultasi secara tertulis. Amandemen tersebut
merupakan bagian yang tidak terpisahkan dari Memorandum Saling
Pengertian ini dan berlaku pada saat ditandatangani.
PASAL 9
MULAI BERLAKU, MASA BERLAKU DAN PENGAKHIRAN
1. M emorandum Saling Pengertian ini akan mulai berlaku pada tanggal
penandatanganan;
2. M emorandum Saling Pengertian ini akan berlaku efektif untuk jangka
waktu lima (5) tahun dan dapat diperpanjang secara otomatis untuk
jangka waktu tambahan selama lima (5) tahun, kecuali salah satu pihak
menyatakan keinginannya untuk menghentikan Memorandum Saling
Pengertian ini 6 (enam) bulan sebelum Memorandum Saling Pengertian
ini berakhir;
3. Salah satu Pihak setiap saat dapat menghentikan Memorandum Saling
Pengertian ini dengan memberikan pemberitahuan secara tertulis dalam
waktu 60 (enam pulu h) hari sebelumnya kepada Pihak lainnya melalui
saluran diplomatik sebelum tanggal penghentian yang diinginkan
terse but.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE MINISTRY OF AGRICULTURE OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF INDUSTRY AND AGRICULTURE OF MONGOLIA
ON FOOD AND AGRICULTURAL COOPERATION
The Ministry of Agriculture of Republic of Indonesia and The Ministry of
Industry and Agriculture of Mongolia (to individually as a "Party") and
(hereinafter referred to as the "Parties");
REFERRING to the Agreement between the Government of Mongolia and
the Government of the Republic of Indonesia on Economic and Technical
Cooperation signed on 6 May 1994;
RESPECTING the principles of equality and mutual benefit;
DESIRING to intensify economic, technical, technological,
research and trade cooperation between tl1e two countries;
industrial,
CONFIRMING that the support of agricultural development in the two
countries could be facilitated by a process of institutional cooperation
between entities of the public sectors that embrace and foster the
agricultural sector;
RECOGNISING the importance of drawing agricultural development
program for the effective utilization of resources of both countries in the
agricultural field, considering especially the potential of the two countries;
PURSUANT to the prevailing laws and regulations of their respective
countries;
HEREBY AGREED AS FOLLOWS :
Article 1
Objective
The objective of this Memorandum is to promote technology transfer, trade,
scientific and technical cooperation in the field of agriculture between the
Parties, without prejudicing other fields of cooperation that may be
considered in the future.
Article 2
Scope of cooperation
The competent authorities shall, subject to the laws and regulations
prevailing in their respective countries, endeavor to support and facilitate the
implementation of joint agricultural development programs, taking into
consideration the potential of both countries.
Article 3
Areas of cooperation
Cooperation shall be implemented in the following areas:
(a) Exchange of information on policy documents on agriculture;
(b) Crop production, particularly seed production of agricultural crops;
(c) Melioration, irrigation and water harvesting;
(d) Livestock, particularly animal health, veterinary and animal breeding;
(e) Food processing industries and food security;
(f) Export of agricultural products;
(g) Agricultural mechanization;
(h) Cooperation in agricultural education and training;
(i) Development and improvement of methods of economic management
in the agricultural sector;
U) Other areas of cooperation can be included by mutual agreement of
the Parties.
Article 4
Implementation
The Parties shall conclude specific arrangement for the implementation of
the areas of cooperation in this Article, which shall include among others
issues of Intellectual Property Rights (IPR), Genetic Resources and
Traditional Knowledge (GRTK) and Material Transfer Agreement (MTA).
Article 5
Joint Agricultural Working Group
(1) To ensure the implementation of this Memorandum of Understanding,
Parties agree to establish Joint Agricultural Working Group
(hereinafter referred to as "the JAWG");
(2) The JAWG shall be co-chaired by Director-General level officials;
(3) The JAWG meetings shall be held alternately in Mongolia and
Indonesia once in two years. The date, location and agenda of each
JAWG meeting will be jointly decided by the Parties in writing and will
be communicated through diplomatic channels;
(4) Host country of the JAWG shall provide administrative support for
such meetings to the extent permitted by its national laws and
regulations;
(5) The JAWG shall review the progress of its cooperation and discuss
future cooperative activities, including the issues of IPR, GRTK and
MTA.
Article 6
Financial obligations
(1) Parties shall implement the areas of cooperation stipulated in the
Article 3 within their liabilities and financial capacities;
(2) Subject to their mutual consent, the Parties may seek other financing
resources within their bilateral or multilateral framework for the
implementation of the activities or programs.
Article 7
Settlement of differences
Any differences arising out of the interpretation and/or the implementation of
this Memorandum of Understanding shall be settled amicably through
consultations and/or negotiations between Parties.
Article 8
Amendment
The Amendment of this Memorandum of Understanding can only be made
after consultations by the mutual written consent of Parties. Such
amendments shall form an integral part of this Memorandum of
Understanding and will enter into force on the date of its signing.
Article 9
Entry into force, duration and termination
1. This Memorandum of Understanding shall enter into force on the
date of signing;
2. This Memorandum of Understanding shall remain into force for
initial period of 5 (five) years, and shall automatically be extended
for period of 5 (five) years unless either Party notifies the other of
its intention to terminate this Memorandum of Understanding 6
(six) months in advance prior to its expiry;
3. Either Party at any time may terminate this Memorandum of
Understanding by giving 60 (sixty) days written notice in advance
to the other Party through diplomatic channels prior to the intended
date of termination .
IN WITNESS W HEREOF, the undersigned, have signed this Memorandum
of Understanding.
DONE in Ulaanbaatar, on the 61h day of September, 2012 in two original
copies in Mongolian, Indonesian and English languages. All texts are
equally authentic. In case of any divergence of interpretation , the English
text shall prevail.

TUJUAN
Tujuan dari Memorandum Saling Pengertian 1n1 adalah untuk
mempromosikan kerjasama alih teknologi, perdagangan, pelatihan dan
ilmu pengetahuan dan teknologi dibidang pertanian antara Para Pihak,
dengan tidak mengindahkan area kerjasama lainnya yang dapat
dilakukan di waktu yang akan datang.
PASAL 2
LINGKUP KERJA SAMA
Otoritas yang berwenang wajib, berdasarkan hukum dan peraturan yang
berlaku di kedua negara berusaha untuk mendukung dan memfasilitasi
pelaksanaan program bersama pembangunan pertanian, dengan
mempertimbangkan potensi kedua negara.
PASAL 3
AREA KERJA SAMA
Kerjasama akan dilaksanakan dalam area sebagai berikut:

Pertukaran informasi tentang dokumen kebijakan di bidang pertanian;
Produksi tanaman pangan, terutama produksi benih tanaman pangan,
Perbaikan dan sistem irigasi;
Peternakan, terutama pembibitan hewan dan ternak;
lndustri pemrosesan makanan, ketahanan pangan;
Ekspor produk-produk pertanian;
Mekanisasi pertanian;
Kerjasama pendidikan dan pelatihan di bidang pertanian;
Pembangunan dan pengembangan metodologi manajemen ekonomi
dalam sektor pertanian;
Area kerjasama lainnya yang disepakati secara bersama-sama oleh
Para Pihak.
PASAL4
IMPLEMENTASI
Para Pihak wajib menyusun pengaturan khusus dalam rangka pelaksanaan
area kerja sama pada Pasal 3 yang didalamnya wajib memuat antara lain
isu-isu mengenai Hak atas Kekayaan lntelektual , Sumber Daya Genetik dan
Pengetahuan Tradisional dan Perjanjian Alih Material .
PASAL 5
KELOMPOK KERJA PERTANIAN
1. Untuk memastikan pelaksanaan Memorandum Saling Pengertian ini,
Para Pihak sepakat selanjutnya membentuk Kelompok Kerja Bersama
Pertanian (selanjutnya disebut KKBP);
2. KKBP wajib dipimpin oleh pejabat setingkat Direktur Jenderal dari
masing-masing Pihak;
3. Pertemuan KKBP akan diselegarakan secara bergantian di Indonesia
dan Mongolia sekali dalam dua (2) tahun. Tanggal, lokasi dan agenda
dari masing-masing pertemuan KKBP akan diputuskan secara bersama
melalui komunikasi tertulis lewat jalur-jalur diplomatik;
4. Negara tuan rumah KKBP akan menyediakan bantuan administatif untuk
pertemuan tersebut sesuai dengan peraturan perundangan masingmasing negara;
5. KKBP wajib meninjau kembali perkembangan dari kerja sama yang
dilakukan dan membahas kerja sama yang dapat dilakukan di masa yang
akan datang termasuk isu-isu mengenai Hak atas Kekayaan lntelektual,
Sumber Daya Genetik dan Pengetahuan Tradisional dan Perjanjian Alih
Material.
PASAL 6
KEWAJIBAN KEUANGAN
1. Para Pihak wajib melaksanakan area kerjasama yang tercantum dalam
Pasal 3 disesuaikan dengan kemampuan dan ketersediaan dana
masing-masing Pihak;
2. Berd asarkan kesepakatan bersama, Para Pihak diperbolehkan mencari
sumber pendanaan lain dalam kerangka bilateral atau multilateral untuk
pelaksanaan kerjasama atau program bersama.
PASAL 7
PENYELESAIAN PERBEDAAN
Setiap perbedaan yang muncul terkait interpretasi dan pelaksanaan
Memorandum Saling Pengertian ini akan diselesaikan secara damai
melalui konsultasi atau negosiasi antara Para Pihak.
PASAL8
AMAN DE MEN
Amandemen atas Memorandum Saling Pengertian ini dapat hanya dapat
dibuat setelah melalui konsultasi secara tertulis. Amandemen tersebut
merupakan bagian yang tidak terpisahkan dari Memorandum Saling
Pengertian ini dan berlaku pada saat ditandatangani.
PASAL 9
MULAI BERLAKU, MASA BERLAKU DAN PENGAKHIRAN
1. M emorandum Saling Pengertian ini akan mulai berlaku pada tanggal
penandatanganan;
2. M emorandum Saling Pengertian ini akan berlaku efektif untuk jangka
waktu lima (5) tahun dan dapat diperpanjang secara otomatis untuk
jangka waktu tambahan selama lima (5) tahun, kecuali salah satu pihak
menyatakan keinginannya untuk menghentikan Memorandum Saling
Pengertian ini 6 (enam) bulan sebelum Memorandum Saling Pengertian
ini berakhir;
3. Salah satu Pihak setiap saat dapat menghentikan Memorandum Saling
Pengertian ini dengan memberikan pemberitahuan secara tertulis dalam
waktu 60 (enam pulu h) hari sebelumnya kepada Pihak lainnya melalui
saluran diplomatik sebelum tanggal penghentian yang diinginkan

REPUBLIK INDONESIA
MEMORANDUM OF UNDERSTANDING
BETWEEN
THE MINISTRY OF AGRICULTURE OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF INDUSTRY AND AGRICULTURE OF MONGOLIA
ON FOOD AND AGRICULTURAL COOPERATION
The Ministry of Agriculture of Republic of Indonesia and The Ministry of
Industry and Agriculture of Mongolia (to individually as a "Party") and
(hereinafter referred to as the "Parties");
REFERRING to the Agreement between the Government of Mongolia and
the Government of the Republic of Indonesia on Economic and Technical
Cooperation signed on 6 May 1994;
RESPECTING the principles of equality and mutual benefit;
DESIRING to intensify economic, technical, technological,
research and trade cooperation between tl1e two countries;
industrial,
CONFIRMING that the support of agricultural development in the two
countries could be facilitated by a process of institutional cooperation
between entities of the public sectors that embrace and foster the
agricultural sector;
RECOGNISING the importance of drawing agricultural development
program for the effective utilization of resources of both countries in the
agricultural field, considering especially the potential of the two countries;
PURSUANT to the prevailing laws and regulations of their respective
countries;
HEREBY AGREED AS FOLLOWS :
Article 1
Objective
The objective of this Memorandum is to promote technology transfer, trade,
scientific and technical cooperation in the field of agriculture between the
Parties, without prejudicing other fields of cooperation that may be
considered in the future.
Article 2
Scope of cooperation
The competent authorities shall, subject to the laws and regulations
prevailing in their respective countries, endeavor to support and facilitate the
implementation of joint agricultural development programs, taking into
consideration the potential of both countries.
Article 3
Areas of cooperation
Cooperation shall be implemented in the following areas:
(a) Exchange of information on policy documents on agriculture;
(b) Crop production, particularly seed production of agricultural crops;
(c) Melioration, irrigation and water harvesting;
(d) Livestock, particularly animal health, veterinary and animal breeding;
(e) Food processing industries and food security;
(f) Export of agricultural products;
(g) Agricultural mechanization;
(h) Cooperation in agricultural education and training;
(i) Development and improvement of methods of economic management
in the agricultural sector;
U) Other areas of cooperation can be included by mutual agreement of
the Parties.
Article 4
Implementation
The Parties shall conclude specific arrangement for the implementation of
the areas of cooperation in this Article, which shall include among others
issues of Intellectual Property Rights (IPR), Genetic Resources and
Traditional Knowledge (GRTK) and Material Transfer Agreement (MTA).
Article 5
Joint Agricultural Working Group
(1) To ensure the implementation of this Memorandum of Understanding,
Parties agree to establish Joint Agricultural Working Group
(hereinafter referred to as "the JAWG");
(2) The JAWG shall be co-chaired by Director-General level officials;
(3) The JAWG meetings shall be held alternately in Mongolia and
Indonesia once in two years. The date, location and agenda of each
JAWG meeting will be jointly decided by the Parties in writing and will
be communicated through diplomatic channels;
(4) Host country of the JAWG shall provide administrative support for
such meetings to the extent permitted by its national laws and
regulations;
(5) The JAWG shall review the progress of its cooperation and discuss
future cooperative activities, including the issues of IPR, GRTK and
MTA.
Article 6
Financial obligations
(1) Parties shall implement the areas of cooperation stipulated in the
Article 3 within their liabilities and financial capacities;
(2) Subject to their mutual consent, the Parties may seek other financing
resources within their bilateral or multilateral framework for the
implementation of the activities or programs.
Article 7
Settlement of differences
Any differences arising out of the interpretation and/or the implementation of
this Memorandum of Understanding shall be settled amicably through
consultations and/or negotiations between Parties.
Article 8
Amendment
The Amendment of this Memorandum of Understanding can only be made
after consultations by the mutual written consent of Parties. Such
amendments shall form an integral part of this Memorandum of
Understanding and will enter into force on the date of its signing.
Article 9
Entry into force, duration and termination
1. This Memorandum of Understanding shall enter into force on the
date of signing;
2. This Memorandum of Understanding shall remain into force for
initial period of 5 (five) years, and shall automatically be extended
for period of 5 (five) years unless either Party notifies the other of
its intention to terminate this Memorandum of Understanding 6
(six) months in advance prior to its expiry;
3. Either Party at any time may terminate this Memorandum of
Understanding by giving 60 (sixty) days written notice in advance
to the other Party through diplomatic channels prior to the intended
date of termination .
IN WITNESS W HEREOF, the undersigned, have signed this Memorandum
of Understanding.
DONE in Ulaanbaatar, on the 61h day of September, 2012 in two original
copies in Mongolian, Indonesian and English languages. All texts are
equally authentic. In case of any divergence of interpretation , the English
text shall prevail.
