1HE GOVERNMENT OF JAPAN
ON SCIENTIFIC AND TECHNOLOGICAL CO-OPERATION

The Government of the Republic of Indonesia and the Government
of Japan,
Desiring to further promote the close and friendly relations
existing between the Republic of Indonesia and Japan,
Recalling that Article VII of the Treaty of Amity and Connnerce
between the Republic of Indonesia and Japan, signed at Tokyo on
July 1, 1961, envisages that the two countries shall co-operate in
scientific and technological fields,
Recognizing the benefits to be derived f rom such co-operation,
Considering their connnon interest in further promoting
scientific and technological

for peaceful purposes and for their nrutual benefit, and
Aiming at further strengthening such

Have agreed as follows :

Article
1.

I


The two Governments shall, on the principle of equality and

mutual benefit, promote scientific and technological co-operation
between them.
2.

Such co-operation may be undertaken in the following areas
(a)

Marine sciences;

(b)

Energy;

(c)

Medicine;


(d)

Agriculture;

(e)

Geosciences;

(f)

Architecture and Civil Engineering;

(g)

Space;

(h)

Meteorology;


(i)

Teleconnnunication;

(j)

Science and technology suitable to provide a basis
for industrial development;

(k)

Processing system of scientific information; and

(1)

Other areas as may be mutually agreed.

activities under this Agreement

may include
(a)

Exchange of information;

(b)

Visits and exchanges of scientists and other experts or
technical personnel;

(c)

Meetings of various. fonns, such as those of experts;

(d)

Execution of joint or co-ordinated projects and
prograrrnnes;

(e)

Provision of necessary materials and equipment; and

(f)

Other forms of co-operation as may be mutually agreed.


Article
1.

III

Implementing arrangements setting forth the details and

procedures of the $p eci f ic co-operative activities under this
Agreement may be made between the two Goverrunents or their agencies,
whichever is appropriate.
2.

The implementing arrangements may include provisions with

respect to
(a)

Sharing of the costs of the co-operative activities;

(b)


Handling of industrial property arising from the cooperative activities;

(c)

Access to and transmittal of the information arising
from the co-operative activities;

(d)

Access to and transmittal of connnercially valuable
information obtained from third parties; and

(e)

Liability for damages brought (;!.bout i n t he course of the
co-operative activities.

For the achievement of the aim of this Agreement, the two
Governments shall have meetings at mutually agreed times and at

places in Indonesia or Japan in order to :
(a)

discuss major policy issues relating to the implementation
of this Agreement; and

(b)

r eview activities and accomplishments under this Agreement.


Article

V

The provisions of this Agreement shall be applied in accordance
with the laws and regulations in force in Indonesia and Japan.

Article

VI

Nothing in this Agreement shall be construed to prejudice
other arrangements for co-operation between the two Govenunents,
existing at the date of signature of this Agreement or concluded
thereafter.

Article VII
1.


For the purposes of this Agreement, the term " Indonesia

comprises the territory of the Republic of Indonesia as defined in
its laws and parts of the continental shelf and adj acent seas, over
which the Republic of Indonesia has sovereignty, sovereign rights
or other rights in accordance with international law.
2.

For the purposes of this Agreement, the term " Japan "

means the territory of Japan, and the continental shelf and adjacent

seas over which Japan has jurisdiction in accordance with international
law.

Article VIII
1.

This Agreement shall enter into force on the date of receipt

by the Government of Japan of a written notice from the Government
of the Republic of Indonesia stating that necessary constitutional
procedures for the entry into force of this Agreement have been
completed. It shall remain in force for two years and shall continue
in force thereafter until terminated in accordance with the provisions
of paragraph 2 below.
2.

Either Government may, by giving a written notice of three

months to the other Government, tenninate this Agreement at the end
of the initial period of two years or at any time thereafter.

In connection with the Agreement between the Government of
the Republic of Indonesia and the Government of Japan on Scientific
and Technological Co-operation which was signed today, the
representatives of the Government of the Republic of Indonesia and
the Government of Japan wish to record the following :
With regard to the implementing arrangements under the said
Agreement, it is confirmed that prevailing administrative
procedures in each country will be followed pursuant to Article V
of the said Agreement.
