Republik Indonesia dan Keradjaan Thailand didorong oleh
keinginan untuk mempererat dan mengekalkan tali persahahatan jang
telah ada diantara mereka, dengan memakai aturan.. aturan resmi
jang bermaksud memperku t perhubungan-perhuhungan kerohanian,

kebudajaan dan perekonomian, telah mengambil keputusan untuk
mengadakan suatu perdjandjian pers habatan dan, untuk maksud
itu, telah menundj uk sebagai Wakil2 Berk asa Penuh

mereka,


masing2,

Jang setelah menjampaikan kepada satu sama lain kekuasaan
penu h masing-masmg dan terdapat benar serta dalam keadaan baik,
telah menjetudjui pasal-pasal berikut :-

PASAL I.
Antara Republik Indonesia dan Keradjaan T hailand dan
rakjat mereka akan terdapat perdamaian jang abach dan persahabatan

jang kekal.

PASAL II.
T iap Pihak Agung Jang Berdjandji akan menempatkan wakilwakil diplomatik didaerah Pihak 1ang lain, jang setelah diakm dan
diterima, selama ma a misi mereka masing-ma ing, atas dasar timbalbalik, akan memperoleh segala hak2, ishmewa dan kekebalan, jang
pada umumnja diakui m nurut hukum dan kebiasaan internasional.

PASAL Ill.
T i p Pihak Agung Jang Berdjandji akan berhak mengirim
kepada, dan menerima dari, ihak jang lain, Konsul2-0j.enderal,
Konsu 12 Muda dan Waki 12 Konsuler, jang diperlengkapi dengan
exequatur, atau surat pengakuan jang lain, akan d iizinkan untuk
berdiam d idaerah2 Pihak jang lain, d itempat2 jang akan disetudjui
oleh Pihak2 Agung Jang Berdjan ji.
Pegawai2 Konsuler tiap Pihak Agung Jang Berdjandji, setelah
mulai melak anakan tugas2 mereka didaerah Pihak jang lain, atas
dasar timbal-balik, akan m . mpero eh segala hak2, hak2 istimewa,
kebebasan2 dan kekebalan jang cliperuntukk n kepada pedjabat2
jang mempunjai kedudukan dan pangkat seperti mereka, sesuai
dengan azas2 hukum dan kebiasaan internasional jang umumnja

berlaku.

PASAL IV.
Warga negara d ari tiap Pihak Agung Jang Berd jandji, dengan

sjarat perlakuan timbal-ba ik, akan diizinkan untuk mempergunakan
hak2 bepergian, berdiam, mendjalankan segala matjam perusahaan
clan pekerdjaan melakukan perindustrian dan perdag ngan dan

memperoleh, mewarisi, memiliki, men jewa, menempati dan mempergunakan e uatu harta jang bergerak atau tidak bergerak, diseluruh

wilajah Pihak jang ain menurut sjarat2 jang d juga her aku bagi
warga negara dari sesuatu negara ketiga, sesuai dengan undang2 dan
,peraturan2 negara. Mereka akan memperoleh, dalam hal2 prosedure,
perla uan jang sama dengan jang d iberikan kepada warga negara
Pihak jang lain, mengenai perlind ungan dan d jaminan atas d iri dan
harta mereka dan mengenai segala ketentuan hukum, administras ·
dan lain2 ketentuan hukum.

PASAL V.
Kedua Pihak Agung Jang Berdjandji setudju untuk mengadakan selekas mungkin perd jandjian2 mengenai perdagangan dan
pelajaran, hak2 konsuler dan h k2 istimewa konsuler, hubungan
kebudajaan dan pengenjahan.

PASAL VI.
Djika ada timbul pers lisihan antara Kedua Pibak Agung Jang
Berd jandji jang tak dapat dis lesai an dengan memuaskan d engan
djalan diplomasi atau dengan melalui mediasi atau arbitrasi, maka
P ihak-Pihak it t ·dak akan mem pergunakan kekerasan untuk menjelesaikannja

tetapi


akan

memadjukan perselisihan itu

kepada

Mahkamah Agung lnternasional untuk mentj apai penjelesaian jang
terachir. Tjara ini tidak akan berlaku dalam perselisihan2 mengenai
hal2 jang dipandang oleh Republik Indonesia dan

Keradjaan

- Thailand masing2 termasuk dalam Kompetensi nasianal mereka, dan
tidak mempengaruhi berlakunja P iagam Perserikatan Bangsa.. Bangsa ..

PASAL VI I.
Perdjancl jian ini barus c1isahkan oleh Kedua Pihak Agu ng
Jang Berdjandji. menurut prosedure Undang-Undang Dasar masing2.
la akan mulai ber1aku setelab diadakan pertukaran alat 2 pengesahan,
jang mana akan dilan gsungkan di Djaka1ta d an sesuclah itu akan
terus berlaku ketjuali dan hingga dihentikan berlakunja dengan
pemberitahuan jang tertulis, setahun sebelumnja.
Perdjancljian sekarang ini clibuat clalam babasa lnclonesia,
Thai dan lnggeris, sedang teks bahasa lngge1is dianggap jang sah
cljika timbul perselisihan.

UNTUK MENJAKSIKANNJA lTU, maka Wakil2 Berkuaaa
Penuh dari Pihak Agung Jang Berdjandji telah menanda tangani
perdjandjian sekarang ini clan membubuhinja clengan meterai2
mereka.
Dibuat dalam rangkap dua di Bangkok pada hari ketiga bulan
Maret tahun seribu sembilan ratus lima puluh empat, hersamaan
dengan bar· ketiga bulan Maret tabun dua ribu empat ratus sembilan
puluh tud juh tahun Budha.

The Republic of Indonesia and the Kingdom of Thailand
animated by the desire to strengthen and perpetuate the friendly
relaf ons so happily existing between them by means of formal
provisions designed to fortify their spiritual, cultural and economic
ties, have resolved to conclude a Treaty of Friendship and, to that
e nd, have appointed as then re pective plenipotentiaries,

of th Kingdom of Thailand,
Who, aft r having commun icated to each other their respective
full powers,. found in good an d due form, have agreed upon the
following articles:-

ARTICLE I.
There shall be perpetual peace and everlasf ng amity between
the Republic of Indonesia and the Kingdom of .T hailand and their
peoples ..

ARTICLE II.
Each of the High Cont1actina Partie

shall accredit to the

Other diplomatic representatives who, after having been recognized

and accepted, shall enjoy during the term ,of their respective missions,
on the basis of reciprocity, the rights, privileges and immunitie
generally tecognized u nder international law and usage.

ARTICLE III.
Each of the H igh Contracting Parties shall have the right to
send to, an.d receive from, the Other, Consuls Genera), Consuls,,
Vice-Consuls, and Consular Agents, who being cluly provided with
exequatur or any other mode of recognition, shall be permitted to
reside in the territories of the Other in such place as may be agree d
upon by the H igh Contracting Parties..
Consular officers of each of the High Contracting Parties shall,
after entering upon their duties, enjoy reciprocally in the territory
of the Other all the rights, privileges, exemptions and immunities
which are accorded to officers of their statu s and rank in a.ccordance

with the generally accepted principles of international law and usage.

ARTICLE IV.
The nationals ッセ@

each of the H igh contracting Parties shall

be permitted to enjoy, on condition ol reciprocity, the right to travel,
to reside, to carry on all kinds of professions and occup tions, to
engage in industries and trade and, to acquire, inherit, posse ,
lease, occupy and dispose of any kind of movable o,r immovable

property, throughout the whole extent of the territories of the O ther,
under the same conditions as the nationals of any third country, in
accordance with the laws and regulations of the country.

to the national of the Oth er, with respect to the protection and
security of their persons and property and in regard to all judicial,
administrative and other legal proceedings.

ARTICLE V.
The High Contracting Patties agree to conclude as

practicable T reaties on commerce and navigation, consular rights

and privileges, cultural relations and extradition.

ARTICLE VI.
Should any d ispute arise between the two High Contracting
Parties which cannot satisfactorily be adjusted by d iplomacy, or
through mediation or arbitration, the Parties shall not use force for
settlement, b ut shall refer the dispute to the International Court
of Justice for fi nal adjudication . This undertaking shall not apply to
d isputes relatmg to matters considered respectively by the Republic
of Indonesia and the Kingdom ol T hailand as being e entially
of their national competence, and sbatl not affect the application of
the Charter of t e United

ations.

ARTICLE VII.
This T reaty shall be subject to ratification by the High
Contracting Parties in accordance with their r spective constitutional
proced ures. It shall enter into force upon the exchange of ratifications, which shall take place at Djakarta. and shall there · her
remain in force unless and until terminated by one year's written
notice.

The present Treaty is drawn up in d uplicate in the Indonesian,

Thai and English languages, the English text being, in case of dispute,
the authentic text.

IN FAITH WHEREOF, the Plenipotentia1ies of the High
Contracting Partie have signed the present Treaty and have hereunto
affixed their seal ..
