PROTOCOL AMENDING THE AGREEMENT
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM
ON ECONOMIC, SCIENTIFIC AND TECHNICAL COOPERATION
I
The Government of the Republic of Indonesia and the Government of the Socialist
Republic of Vietnam, hereinafter referred to as the Parties.
DESIRING to conclude a Protocol Amending the Agreement between the
Government of the Republic of Indonesia and the Government of the Socialist Republic of
Vietnam on Economic, Scientific and Technical Cooperation, signed at Hanoi, on
November 21, 1990.
HA VE AGREED as follows :
Article I
Paragraph
3rd
of the Preamble of Agreement shall be amended as follows :
TAKING INTO ACCOUNT of the positive results and with the objective to further
development of the aims stipulated in the Trade Agreement between the Government of
the Republic of Indonesia and the Government of the Socialist Republic of Vietnam,
signed at Hanoi, on March 23, 1995.

Article 4 of the Agreement shall be added by Article 4 bis on the Protection of the

Intellectual Property Rights, as follows :
1) The Parrie$ agree that any ｩｮｴｾｬＯ･｣ｵ｡＠
property arising ｾｮ､･ｲ＠
the implementation of
this Agreement will be jointly owned and :
a) Each Party shall be allowed to use such intellectuql property for the purposes of
maintaining, adapting and improving the relevant property.
b) In the event that the intellectual property is used by the party and/or institutions on
behalf of the Party for commercial purposes, the other Party shall entitle to obtain
equitable portion of royalty.

2) The Parties shall indemnify each other that the intellectual property brought by the
Party into the territory of the other Party for implementation of any project
party's
arrangement or activities, is not resultedfrom any infringement of third
legitimate rights.

3) The Parties shall waive each other from any claim made by third party on the
ownership and legality of 1he use of intelleclual property which is brought in by the
Party for the implemenlalion ofany project arrangemenl or activities.
Article 3
This Protocol shall be an inseparable part of the Agreement between the
Government of the Republic of Indonesia and the Government of the Socialist Republic of
Vietnam on Economic, Scientific and Technical Cooperation, signed at Hanoi, on 21st day
of November, 1990.
Article 4
This Protocol shall enter into force on the date of the receipt of the last notification
by which the Parties inform each other, through diplomatic channels, that their respective
constitutional requirements for giving effect of this Protocol have been fulfilled.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their
respective Government, have signed this Protocol.
DONE at Jakarta on the 10th day of November 2001 , in duplicate, in the English
language, all texts being equally authentic.
