THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
(hereinafter referred to as "Indonesia")
Concerning Phase II of the Samarinda Forestry Vocational Training
Centre, formerly called the Forestry Central Training Centre :
WHEREAS the Loan Agreement dated the 11th day of August 1975 has
been executed by Canada and Indonesia; and
WHEREAS the aforesaid Loan Agreement was in the amount of two
million Canadian dollars ($ 2,000,000.00)
and
WHEREAS the Loan Agreement requires modification in order to
change the amount of the Loan and to add certain requirements
with respect to the description of Phase II and to the procurement
of goods for Phase II financed under addition to the Loan :
NOW THEREFORE
Canada and Indonesia agree to amend the Loan Agree-
ment as follows :

To be changed to incorporate the increased amount of the
Loan with the paragraph to read :

Description of the Project
For the purposes of this Amendment the Project is described
as the financing of the equipment to be supplied for Phase
II of the development of the Forestry Vocational Training
Centre being constructed at Samarinda, Kalimantan, Indonesia.
2.0
Purpose of the Loan
(a) Without limiting the generality of this Amendment,
Canada shall provide a Loan of one million five hundred
thousand Canadian dollars ($ 1,500,000.00) for the
purchases of materials and equipment required to provide
equipment and teaching aids for instruction in the
following courses :
1.
Sawdoctoring - including
- band saws
- swedgrag, shoping, grinding tools
- tension benches
- welding tools
- mobile filing room
2.
Millwrighting - including
- hydraulic and pneumatic repair equipment

PROCEDURES
FOR THE PROCUREMENT OF EQUIPMENT
AND MATERIALS FOR PHASE II OF THE
SAMARINDA FORESTRY VOCATIONAL
TRAINING CENTRE
With reference to the Loan Agreement signed August 11,
1975 between the Government of the Republic of Indonesia
(hereinafter referred to as "Indonesia") and the Government
of Canada (hereinafter referred to as "Canada'') for
the
Samarinda Forestry Vocational Training Centre, formerly called
the Forestry Central Training Centre and (hereinafter referred
to as the "Project"), Indonesia agrees
that Canada shall
designate the Ministry of Education, of the Province of British
Columbia (B.C.M.E.) as the Project Manage r for the Phase II
Project under a full management contract with CIDA.

Procurement Services
The Procurement Agent shall employ the services of
the Purchasing Commission of the Government of the Province of British Columbia which will use its best efforts
to obtain fair and reasonable prices for the goods and
services provided.
Invoices shall be certified and the paid by the B.C.M.E.
and then submitted to CIDA for reimbursement.
Advances
will be paid to B.C.M.E. to expedite equipment procurement
in accordance with Canadian Government financial practices.
(2)
Solicitation of Firms
(a) Prices to the extent practicable shall be obtained
through fair compettion.

The Procurement Agent's invitations to tender will
be issued to approved Canadian firms and to
any
other firms recomended by Indonesia and agreed to
by Canada.
(b) The Procurement Agent will accept (normally) the
lowest tender meeting the specifications unless
otherwise directed by Indonesia and agreed to by
Canada.
(3)
Prices
(a) Prices will be in Canadian dollars, FOB plant or FAS
East of West Coast Canadian Port exclusive of any
amount representing Federal of Provincial sales taxes
or refundable excise taxes.
(b) Prices are
normally firm for a period
of 75 days
from date of tender unless otherwise specified.
(c) Prices will include the cost of packing, packaging
and preservation suitable for export shipment in
accordance with standard commercial practise, unless
otherwise agreed to by Indonesia.
(4)
Administration Fees
No charges or fees shall be made to the Loan funds
or to Indonesia for the Procurement Agent's administrative and inspection services.
(5)
Terms and Conditions
Government of Canada regulation concerning Canadian
content (Article II, Section 2.02 of the Loan Agreement)
shall apply to all contracts placed
by the Procurement
Agent, unless otherwise agreed to by Canada.

Contract Administration
The Procurement Agent shall adminster

all
contracts and provide periodic reports showing the
status of ordersplaced
and shipments made to
Indonesia accompanied by the attachment of Contract
concerned.
(7)
Transportation
The services of the Procurement Agent shall include
arrangements for transport and werehousing prior to
shipping and for ocean fraight and other means of transport as required.
Ocean freight charges are normally
prepaid by the Procurement Agent and billed as a separate
item for each shipment and payable from
Loan funds.
The Procurement Agent shall not charge to Loan fund s of
Indonesia any fee for these services.
(8)
Insurance
The Procurement Agent is res ponsible for arranging
any insurance in accordance with its normal practice.
Premiums will be prepaid by the Procurement Agent and
billed separately for each shipment on the same basis
as (7) above.
(9)
Documentation
(a) Export permits and customs clearance documentation
will be arranged by the Procurement Agent.
(b) Import permits, custcmsclearance, consular documents,
etc. will be arranged by Indonesia.
(10)
Shipping of Documents
(a) For Sea Shipments
To be despatched by registered air mail on departure
of the vessel :

Invoicing and Payment Instruction
(a) Invoices from Canadian firms for equipment
and mate-
rials supplied shall be audited and payment

against these invoices by the Procurement Agent with
recovery to be made from the Loan funds.

rement Agent will submit its recoverable ±nvoices
to the Canadian International Development Agency
(CIDA) with the following supporting documentation :
For Commodities
- 5 copies of Supplier's Invoice

3 copies of Inspection Report if required by terms
of the contract
- 2 copies of Dock Receipt, Ocean Bill of Lading or
Airway Bill as applicable
For Insurance Costs
- 1 original and 1 copy of Insurance Certificate
- 5 copies of Premium Invoice
For Ocean or Air Freight Charges
- 5 copies of Agent's Ocean or Air Freight Accounts.
(b) Should the contract with the Canadian supplier provide
for progress payments, they shall be

(b) Canada will prepare and forward to Indonesia
monthly statements providing an
accounting of all
payments made during each month and also reflecting
the cumulative Loan withdrawals and the current

arising from disputes, defaults,
latent defects, warranties, patent infringements, etc.
will be the responsibility of the Procurement Agent.
(13)
Changes
These Procedures may be amended through subsequent
mutual agreement by Indonesia and Canada, provided
such amendment is evidenced by an exchange of correspondence expressly stating that the parties are amending
these Procedures and signed by duly authorized officials.
