FINANCIAL PROTOCOL
relating to French credits for the financing of
three vessels for oceanologic and hydrographic research
The Government of the Republic of Indonesia and the Government of the
French Republic, with a view to facilitate the development efforts of
Indonesia, agreed on following provisions.
ARTICLE l
a) A maximum amount of 1WO HUNDRED AND SIXTY MILLION FRENCH FRANCS
(260 MF) is put at the disposal of the Indonesian Government in the form of
credits for the financing of three vessels for oceanologic and hydrographic
research, referred to as "the PROJECT''.
b) The above mentioned credits will be used for the financing of the
imported equipment, engineering and services (including frei ght) of French
origin for the realization of the Project.
ARTICLE
2
The credits set in Article 1 consist of a loan from the French Treasury
to the Ministry of Finance, acting on behalf of the Indonesian Government, of
a maximum amount of ONE HUNDRED FOURTEEN MILLION AND FOUR HUNDRED TI-DUSAND
FRENCH FRANCS (114,4 MF) and banker's credits guaranteed by the French
Treasury of a maximtun amount of ONE 1-UNDRED FOURTYFIVE MILLION AND SIXHJNDRED
TI-DUSAND FRENCH FRANCS (145,6 MF) for financing the goods and services
mentioned in article 1.
ARTICLE
3
The loan from the Treasury and tl1e guaranteed banker ' s credits which are
extended in conjunction lvith the former will be respectively used in the
proportion of 44 % and 56 % of the contract.
The rights of drawing of the Treasury loan will thus be equal to 44 %
of the value of the contract.
ARTICLE 4
The loan from the French Treasury mentioned in Article 2 is repayable
in thirtythree (33) years including a grace period of thirteen (13) years, by
equal and successive semi-annual instalments which are calculated from the
date of each drawing and bear an interest rate of 1,5 %per annum .
The interests due on the balance are repayable at the end of each halfyear. An agreement on the implementation between the Credit National , acting on
behalf of the French Government and the Ministry of Finance, acting on behalf
of tlle Indonesian Government, will stipulate tlle terms and conditions of utilization and repayment of this loan.
ARTICLE
5
The guaranteed banker ' s credits mentioned in Article 2 wi ll be redeemed
in ten (10) years by twenty (20) equal and successive semi -annual instalments,
the first one fa l ling due six months after commissioning of the project or the
date of the delivery as stipulated in the commercial contract or in the banker's
credits agreement . The rate of interest is the current export credit rate to
which is added the cost of credit insurance of OOFACE.
A financial agreement between the French Institutions and the Indonesian
Ministry of Finance will stipulate, if necessary, the modalities of utilization
and reimbursement of these guaranteed banker's credits.
The agreement relating to the banker's credits will be approved by the
Ministry of Finance in case they are not directly signed by the same.
ARTICLE
6
The credits shall be used for the financing of the contract concluded
between the French suppliers and the buyer subject to approval of the competent
French and Indonesian authorities.
French franc will be used as currency of account and currency of payment
of the contract
A dmm-payment equal to at least 10 % of the amount of the contract as a
minimum , will be paid when placing the order by drawing under the Treasury loan
and the balance will be settled betweem the order and the commissioning or the
deliveries, in conformity with the terms and conditions of the contract, by
jointly and proportionally using the means of financing foreseen in article 2
in accordance with tl1e modalities of Article 3 of the present agreement.
ARTICLE 7
The ultimate date for the signature of the contract to be financed under
the present agreement is set at decembre 31st, 1983 unless otherwise agreed
upon by both governments.
No drawing may be made from the Treasury loan allocated under the
present protocol after decembre 31st, 1985 .
Any amount which \¥ill not be used for financing the project according to
the provisions of the present protocol will be cancelled .
ARTICLE 8
The present agreement enters into force on the date of its signing .
IN \HTNESS THERETO, the tmdersigned, duly authorised for this
purpose by their respective Governments , have signed this
Agreement and have affixed thereto their seals.

relatif aux credits francais destines au financement
de trois navires de recherche oceanologique et hydrographique
Le Gouvernement de la Republique de l'Indonesie et le Gouvernement de
la Republique Francaise sont convenus des dispositions sui vantes en vue de
faciliter !'effort de developpement economique de l'lndonesie.
ARTICLE 1
a) Une somme maximum de DEUX CENT SOIXANTE MILLIONS DE FRANCS (260 MF)
est mise a la disposition du Gouvernement Indonesien pour financer trois
navires de recherche oceanologique et hydrographique qui seront designes
ci-apres comme "le projet".
b) Les moyens de financement mentionnes ci-dessus seront utilises pour
le financemcnt des equipements , de l'ingenierie et des services francais, y
compris le fret, necessaires a la realisation du projet.
ARTICLE 2
Les concours financiers prevus a l'art1cle 1 ci -dessus sont constitues
d'un pret du Tresor francais au Ministere des Finances, agissant pour le
compte de l'Etat Indonesien, d'un montant maximum de CENT QJATORZE MILLIONS
QJATRE CENT MILLE FRANCS ( 114,4 MF) et de credits bancai res garantis par le
Tresor francais d' un montant maximum de CENT QJARANTE CINQ MILLIONS SIX CENT
MILLE FRANCS (145,6 ｾＩ＠
destines a financer les biens et services mentionnes a
!'article 1 du present protocole.
ARTICLE 3
Le pret du Tresor et les credits bancaires garantis qui l'accompagnent
seront utilises respectivement dans les proportions de 44 %et 56 %du contrat.
Les droits de tirage sur le pret du Tresor seront done egaux a 44 % de
la valeur des biens commandes en France au titre du contrat.
ARTICLE 4
Le pret du Tresor francais mentionne a !'article 2 ci-dessus est amortissable en 33 ans par semestrialites egales et successives a compter de la date
du premier tirage, et porte interet au taux de 1,5% l'an . Cette duree inclut
un differe d'amortissement de 13 ans .
Les interets sur le solde du sont payables a la fin de chaque semestre.
Une convention d'application entre le ｾｴｩｮｳ･ｲ＠
des Finances, agissant pour le
compte du Gouvernement Indonesien et le Credit National, agissant pour le compte
du Gouvernement francais, precisera les modalites d'utilisation et de remboursement de ce pret.
ARTICLE
5
Les credits bancai res garantis mentionnes a 1' article 2 ci -des sus sont
amortissables en dix (10) ans par vingt (20) semestrialites egales et succes sives, la premiere echeant six mois apres la reception provisoire du projet ou
les dates de livraison, selon les stipulations du ou des contrat (s) commerciaux ou de la convention de credit bancaire. Leur taux d'interet est le taux
usuel des credits a !'exportation auquel s'ajoute le cout de !'assurance-credit
de la COFACE.
Un accord financier entre le Ministere indonesien des Finances et les
etablissements bancaires francais precisera, si necessaire, les modali tes de
!'utilisation et du remboursement de ces credits bancaires garantis.
Les accords relatifs aux credits bancaires seront approuves par le
Ministere des Finances s'ils ne sont pas signes directement par lui.
ARTICLE
6
Les credits seront utilises pour financer le contrat passe entre le
fournisseur francais et le client apres approbation par les autorites
francaises et indonesiennes competentes.
La monnaie de compte et la monnaie de paiement du contrat sont le franc
francais .
Un acompte egal a 10% du montant du contrat est paye a la
commande par tirage sur pret du Tresor. Le solde du prix est regle entre la
commande et la reception conformement a l'echeancier prevu au contrat le tout
par utilisation conjointe et proportionnelle des moyens de financement prevus a
!'Article 2 selon les modalites definies a !'Article 3 du present protocole.
ARTICLE 7
La date limite de passation du contrat finance en application du present
protocole est fixee au 31 decembre 1983 a moins qu 1 une nouvelle date limite
n 1 ai t ete fi xee d 1 un commun accord entre les deux Gouvernemen ts. Aucun ti rage
ne pourra etre effectue sur le pret du Tresor ouvert par le present protocole
apres le 31 decembre 1985
Les montants qui n 1 auront pas ete utilises pour le financement du projet
conformement aux disposltions du present protocole seront annules.
ARTICLE 8
Le present protocole entre en vigueur a la date de sa signature.
EN FOI DE QUOI, les representants des deux Gouvernements,
dument autorises a cet effet, ont signe le present accord
et y ont appose leur sceau.
