The Government of t he Republic of Indonesia and
the Government of the Federal Rep·ublic of Germany,
in the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany,
desiring to strengthen ｡ｾ､＠
intensify those friendly relations
by fruitful co-operation in the field of development assistance,
aware that the maintenance of these relations constitutes the
basis for the provisions of the present Agre ement,
intending to promote the development of the Indonesian
economy,

Article 1
T.h e Government of the Federal Republic of· Germany shall
enable the Government of the Republic of Indonesia t .h at
the Bank Negara Indonesia takes up loans up to a total
of DM 50 (fifty) million with the Kreditanstalt ftir Wiederaufbau, Frankfurt am Main, for the stabilisation
and rehabilitation of the Indonesian economy.
Article 2
(1) The utilization of these loans and the terms and
conditions on w.h ich they s .h all be granted shall be governed
by the loan agreements to be ｣ｯｮｾｵ､･＠
between t he Bank
Negara Indonesia and the Kreditanstalt ftir Wiederaufbau
which shall be subject to the legal provisions applicable
in the Federal Republic of Germany.
(2) The Government of the Republic of Indonesia shall
guarantee to the Kreditanstalt ftir Wiederaufbau all
payments and the resultant transfer to be made in
fulfilment of the borrower's liabilities under the loan
agreements to be concluded.

Article 3
The Government of the Republic of Indonesia s .h all exempt the
Kreditanstalt fur Wiederaufbau from all taxes and other publ ic
charges levied in the Republic of Indonesia at the time of the
conclusion, or during ｴｾ･＠
execution, of the loan agre ements
mentioned in Article 2 of the present Agreement.

Article 4
T.h e Government of t .h e Republic of Indonesia s .h all, subject
to the provisions of Article 5 of the present Agreement,
allow passengers and suppliers free choice of means of
transport for such transportation by sea or air of persons
and goods as results fr om the granting of the loans, and
shall abstain from taking any meas·u res t .h at might exclude
or impair t .h e participation of German transport enterprises ,
and shall grant the necessary permits as required.
Article 5
'
Supplies and services to be paid out of the loans shall be
procrired from the Federal Republic of Germany. Supplies
shall only be carried by means of transport of the Federal'
Republic of Germany, the Republic of Indonesia or third
states m·utually agreed upon by the two Governments .
Article 6
.
T.h e Government of the Federal Republic of Germany is
anxious that for deliveries res·ul ting f r .om the granting
of the loans , preference should be given to ｰｲｯ､ｾ｣ｴｳ＠
of
industries of Land Berlin .

With the exception of those provisions of Article 4 which
refer to air transport , this Agreement shall also apply
to Land Berlin , provided that tb.e Government of the
Federal Republic of Germany has not made a contrary declaration
to the Government of the Republic of Indonesia. within three
months from the entry into force of the present Agreement .
