GENERAL

1.

THIS MEMORANOOM expresses the understandings of
the Cbverrunent of the Reµililic of Indonesia and
the Cbvemment of Australia oonceming the

resp:>nsibilities and oontrihltions respectively
of the tw:J Governments in re:Jard to implementation

of a pJ'."0rities for this Project will be :
For the Indonesian Government : The National Institute
of Mrninistration (IAN) •
For the Australian Cbvernment : The Australian
Developnent Assistance Bureau of the Department of
Foreign Affairs (ADAB).
The Australian Developnent Assistance B.lreau may
naninate suitably qualified agents to urrlertake any
part of its functions on its behalf.

This Merrorandum will take effect frcm the date of its
signature and the Project will be deemed to have
cx:mnenced fran that date.

The Australian contril::ution to the Project and
all undertakings given herein will cease three
years after the date of signature of this
Merrorandum or on such other date as may subsequently
be arranged between the セ@
Governments.
Pro.JECT

4.

Resp:>nsibility for developnent and direction of
the Project will be vested in the Training
Developnent Crnuuittee, whose chainnan will be
appointed by the Indonesian Goverrurent fran arrong
the staff of IAN. Membership of the Ccmnittee
will include the Senior Australian Adviser who is

to be appointed by the Australian Government and
agreed by the Indonesian Government, and the Project
Manager who will be appointed by the Chainnan of LAN.
Manbers of the Training Developnent Ccmnittee for
the Indonesian side will be app:>inted by the Indonesian Government. The Training Developnent Ccmnittee
will meet not less than twice each year.

5.

Functions of the Training Developnent Canmittee
will include :

the courses outlined in Annex l;

6.

overall resp::msibility for this Project will rest
with the Government of Indonesia.
Resµ:>nsibility for day to day operation and
direction of the Project will rest jointly with
the Senior Australian Adviser and Project Manager
as ootlined in Annex 3.

a::Nl'RIBUI'IONS

7 • The oontrihltions of the Indonesian and Australian
Governments are detailed in Annex 2 and are estimated

to value Rp. 97 million and A$. 608, 650 respectively.
Disbursement of the Indonesian and Australian
Governments' contributions will be subject to the
nonnal parliamentary approval of annual appropriations.

regulations, facilitate the employment by the
Australian Government or its agent of personnel as

granting exemption frcm incane or other taxes
on project salaries and allowances;

(b)

granting exemption fran im:i;:ort and other
duties on personal and h:Juseh::>ld effects
subject to their re-ex:i;:ortation after cx:mpletion

of the a ssignment;

10.

(c)

granting to Australian project personnel all
rights and entitlanents accorde:i to the aid
personnel of any other donor country; and

(d)


expediting the issue of all doetnnentation
require:i for the entry of, and perfonnance
of w::>rk by, project personnel.

(a)

The Indonesian Goverrnnent will, in accordance
with existing laws and regulations either
exempt f ran imp::>rt duties and other taxes or
pay such duties on all goods supplie:i by
Australia for the Project as set out in
Annex 2;

(b)

The Indonesian Government will facilitate

movement of project equipnent and supplies
by providing appropriate custans and wharfage
facilities in the p::>rt closest to the project

site and will be resp:msible for the expeditious
clearance and tranSp::>rt of such equipnnet and
supplies to the site; and
(c)

LIABILITY

11.

The Senior Australian Adviser in consultation
with the Indonesian Project Manager shall
exercise administrative control over such
supplies for the duration of the Project.

The Indonesian GDvernment will be reSp::>nsible for
dealing with any claims which may be brought by
third parties against Australia and its experts,
agents or Australian personnel and will hold
hannless Australia and its experts, agents and
personnel in case of any claims or liabilities

resulting fran operations under this Mercorandum.
This provision will not relieve any person f ran
liability for any criminal, grossly negligent or
fraudulent act.

SEXlJRITY

12. The Indonesian Government will arrange for any
protection deaned necessary to ensure the safety
of Australian personnel, project and personnel
equipnent l::x:>th at the project location, in transit
and on any other official representational activity
in Indonesia. The Australian Government will take
reasonable precautions to ensure that Australian
personnel have due regard for local traditions and
custans.

13. Pmy disµites arising out of the interpretation or
irnplenentation of the Me.Irorandum shall be settled

The Adviser will have appropriate qualifications in the areas of
education and p.lblic administration and have extensive experience in
training and the management of training in the p.lblic sector.
