BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE REPUBLIC OF FRANCE
(Mixed Credit)
•
The Government of the Republic of Indonesia and the
Government of the Republic of France, with a view to facilitate
the economic development of Indonesia, agreed on the following
provisions
ARTICLE 1
A total amount of TWO HUNDRED AND FORTY TWO MILLION EIGHT
HUNDRED THOUSAND FRENCH FRANCS (242,8 MF) is provided to the
Government of the Republic of Indonesia in the form of credits
for financing the implementation of the projects in the annex
attached hereto.
These credits are meant for financing
Indonesia of French goods and services.

ARTICLE 2
The credits set in article 1 consist of a loan from French
Treasury to the Ministry of Finance, acting on the account of
Indonesian Government, of ONE HUNDRED AND TWENTY SIX MILLION TWO
HUNDRED AND FIFTY SIX THOUSAND FRENCH FRANCS (126,256 MF) and
bankers ' credits guaranteed by the Compagnie frarn;:aise d 'assurance
pour le commerce exterieur (COFACE) coming to a total amount of
ONE HUNDRED AND SIXTEEN MILLION FIVE HUNDRED AND FORTY FOUR
THOUSAND FRENCH FRANCS (116,544 MF) .
ARTICLE 3
The
loans
from
the
Treasury
and
the
guaranteed
bankers' credits which are extended in conjunction with the former
will be respectively utilized in the proportion of 52 % and
48 % of the contracts allocated on the present protocol .
The rights of drawing on the Treasury loan will thus be
equal to 52 % of the value of the goods ordered in France for
each contract.
ARTICLE 4
The loans from the French Treasury mentioned in article 2
have a duration of 30 years and are repayable in 40 equal and
successive semi-annual instalments, the first one falling due 126
months after the end of the calendar half year during which
drawings have been made and bear an interest rate of 2 % per
annum. The interest due on the balance is repayable at the end
of each calendar half-year.

The guaranteed bankers'credits mentioned in article 2 will
be redeemed in 10 years by 20 equal and successive semi-annual
instalments, the first one falling due six months after the
completion of the project or the deliveries of equipment, or the
final delivery of the services, as stipulated in the commercial
contract or in the Banker ' s
Credit Agreement. The rate of
interest is the current export rate, according to the Consensus .
The premium of credit insurance of Coface will be financed by
means of an increase of the principal of the Banker ' s credit .
An implementation agreement between the Ministry of Finance
of the Republic of Indonesia, on the one hand, and credit
National acting on account of the French Government on the other
hand,
will stipulate the modalities of utilization and
reimbursement of the French Treasury loan. A credit agreement
between the Ministry of Finance of the Republic of Indonesia on
the one hand and approved banks on the French market, acting
under the supervision of AFB Export, on the other hand, will
stipulate the modalities of utilization and reimbursement of the
bankers'credit.
ARTICLE 5
Each order is subject to a contract between the French
supplier and the Indonesian buyer, the qualification of which
into the present agreement requires a prior approval of the
competent French and Indonesian authorities. In case of arrears
related to French Treasury loans, no final positive decision may
occur until these arrears are totally paid out.
French franc will be used as currency of account and
c urrency of payment of contract.
A down-payment of at least 10 % of the amount of the
contract will be paid when placing the order by drawing on the
Treasury loan and the balance will be settled between the order
and its receipt in conformity with the terms and conditions of
the contract, by jointly and proportionaly utilizing the means
of financing foreseen in article 2 in accordance with the
modalities of article 2 of the present agreement.
ARTICLE 6
The Indonesian authorities will provide additional financing
to
those
mentioned
in
this
protocol
to
complete
the
implementation of the project mentioned in article 1 .

ARTICLE 7
The last date for the signi ng of the contract to be financed
under the present agreement is set at December 31, 1992 .
No drawing may be made from the Treasury loans allocated by
the present protocol after October 30, 1995 . This date cannot be
extended but in case of exceptional event, and with agreement of
both governments .
ARTICLE 8
Freight and insurance are considered as French services
when
- freight is provided under a bill of lading issued by a
French shipping company or under an airway bill issued by a
French air freight company, and is certified by the French
appropriate authorities as being a French service.
- insurance is taken out with approved companies on the
French market .

ARTICLE 9
Any party may proceed to undertake post evaluation of the
projects financed under this protocol provided the existence of
prior information formalised by an exchange of letters between
the French Econ omic and Commercial Counsellor to the French
Embassy in Indonesia and BAPPENAS. Evaluation results will be
forwarded to the other party.
ARTICLE 10
The present agreement enters in force on the date of its
signature .

Le Gouvernement de la Republique d'Indonesie et le
Gouvernement de la Republique Fran9aise sent convenus des
dispositions suivantes en vue de faciliter le developpement
economique de l'Indonesie .
ARTICLE 1
Une somme globale de DEUX CENT QUARANTE DEUX MILLIONS HUIT
CENT MILLE FRANCS FRANCAIS (242,8 MF) est mise a la disposition
du Gouvernement de la Republique d ' Indonesie pour financer divers
projets mentionnes en annexe. Ces credits serviront a financer
l'achat par l'Indonesie de biens et services fran9ais.
ARTICLE 2
Les concours financiers prevus a l'article 1 ci-dessus sent
constitues d'un pret du Tresor fran9ais au Ministere des Finances
de la Republique d ' Indonesie, agissant pour le compte de l'Etat
indonesien, d ' un montant maximum de CENT VINGT SIX MILLIONS DEUX
CENT CINQUANTE SIX MILLE FRANCS FRANCAIS (126,256 MF) et de
credits bancaires garantis par la Compagnie fran9aise d 'assurance
pour le commerce exterieur (COFACE) d ' un montant maximum de CENT
SEIZE MILLIONS CINQ CENT QUARANTE QUATRE MILLE FRANCS FRANCAIS
(116, 544 MF).
ARTICLE 3
Les prets du Tresor et les credits bancaires garantis qui
les accompagnent seront utilises dans les proportions de 52 % et
48 % respectivement pour chaque contrat impute sur le present
protocole .
Les droits de tirage sur les prets du Tresor seront done
egaux a 52 % de la valeur des biens commandes en France au titre
de chacun de ces contrats.
ARTICLE 4
Les prets du Tresor fran9ais mentionnes a l ' article 2 cidessus ont une duree de 30 ans et sent amortissables en 40
semestrialites egales et successives, la premiere echeant 126
mois apres la fin du semestre civil au cours duquel auront ete
effectues les tirages . Ils portent interet au taux de 2 % l'an .
Les interets sur le solde du sent payables a la fin de chaque
semestre civil.

Les credits bancaires garantis mentionnes a l ' article 2 cidessus sont amortissables e n 10 ans par 20 semestrialites egales
et successives, la premiere echeant six mois apres l ' ache vement
du projet OU la date de livraison des equipements, OU la f i n des
prestations de services, selon les stipulations d u c ontrat
commercial ou de la convention de credit bancaire . Le s t a ux
d ' i n teret sont les taux usuels des credits a l ' exporta t ion, en
vigueur a la date de signature de chaque contrat, con formement
au Consensus . Les primes d ' assurance-credit de la Coface seront
financees par augmentation du principal des credits bancaires .
Une convention d ' application entre d ' une part le Ministere
des Finances de la Republique d ' Indonesie et d ' autre part le
Credit National, agissant pour le compte du Gouvernement fra n 9ais
precisera les modalites d ' utilisation et de remboursement du pret
du Tresor fran9ais . Une convention de credit entre le Ministere
des Finances de la Republique d'Indonesie et les banques agreees
sur le marche fran9ais, sous l'egide d ' AFB Export precisera les
modalites d'utilisation et de
remboursement des
credits
bancaires.
ARTICLE 5
Chaque commande fait l'objet entre le fournisseur fran9ais
et l ' acheteur i ndonesien d ' un contrat dent !'admission sur le
present protocole doit etre prealablement approuvee par les
autorites fran9aises et indonesiennes competentes .
Aucune
imputation sur protocole n •est possible en cas d ' arrieres sur
pret du Tresor fran9ais .
La monnaie de compte et la monnaie de paiement des contrats
est le franc fran9ais .
Un acompte egal a 10 % au moins du montant du contrat est
paye a la commande par tirage sur le pret du Tresor. Le solde du
prix est regle entre la commande et la reception conformement a
l ' echeancier prevu au contrat par utilisation conjointe et
proportionnelle des moyens de financement prevus a l ' article 3
du present protocole .
ARTICLE 6
Les autorites indonesiennes s 1 engagent a mettre en place les
financements complementaires a ceux prevus au present protocole,
necessaires a la realisation des projets vises a l ' article 1 .

ARTICLE 7
La date limite de passation des contrats finances en
application du present protocole est fixee au 31 decembre 1992.
Aucun tirage ne pourra etre effectue sur les prets du Tresor
ouverts par le present protocole apres le 30 octobre 1995. Cette
date ne pourra etre prorogee sauf exceptionnellement , et apres
accord des deux gouvernements.
ARTICLE 8
Les services de fret et d'assurance sent consideres comme
fran9ais lorsque :
- le transport est ef fectue sous connaissement emis par un
armement fran9ais ou une lettre de transport aerien emise par une
compagnie fran9aise de fret aerien et est certifie comme service
fran9ais par les services fran9ais competents.

ARTICLE 9
L ' une OU l'autre des parties peut proceder a !'evaluation
a posteriori du projet finance par ce protocole sous reserve
d ' une information prealable, formalisee par un echange de lettres

France en Indonesie et le BAPPENAS . Les resultats seront
communiques a l 'autre partie .
