MEMORANDUM SALING PENGERTIAN
ANTARA
PEMERINTAH REPUBLIK INDONESIA
DAN
PEMERINTAH KANADA
MENGENAI
KERJASAMA KEBUDAYAAN
Pemerintah Rcpublik Indonesia dan Pcmcrintah Kanada , selanjutnya disebut "Para
Pihak";
DIDORONG oleb keinginan bersama untuk meningkatkan dan mcngembangkan
kerjasama di bidang kebudayaan dan olabraga;
DIYAKINI bahwa kerjasama tersebut akan memberikan sumbangan untuk mcmajukan
saling pcngcrtian dan persahabatan;
Telah mcncapai pengertian sebagai berikut:

PASAL 1
RUANG LINGKUP KERJASAMA
1.
Para Pihak akan berusaba untuk memudabkan dan mendorong wargancgaranya
masing-masing dalam pertukaran scniman, olahragawan, kalangan budaya ,
lembaga profesi dan akademis, dan mereka yang berkecimpung dalam kcgiatankegiatan kcbudayaan dan olahraga scrta mcndorong penampilan, kehadiran dan
keikut-sertaan pada penyelenggaraan-penyelenggaraan kesenian, kcbudayaan
dan olahraga, baik di Indonesia maupun di Kanada.
2.
Para Pihak akan berusaha mendorong organisasi-organisasi yang bcrgerak di
bidang kesenian, kebudayaan dan olahraga bagi pembentukan hubunganhubungan dan program-program scrta pengembangan kerjasama lebih lanjut dan
proyek-proyek bersama di bidang-bidang kepentingan bersama, yang
memberikan sumbangan bagi pcningkatan bubungan kebudayaan dan olahraga
antara Para Pihak.
3.
Setiap Pihak akan berusaha mendorong pengembangan pengajaran, penelitian
dan penerbitan yang berkaitan dengan kescnian, kebudayaan dan olahraga oleh
lembaga pcmerintah maupun swasta terkait dari Pihak lainnya.
4.
Setiap Pihak akan berusaha mcmberikan kepada pengunjung-pengunjung dari
Pihak lainnya dengan fasilitas yang mcmadai untuk kemudahan bagi sanggarsanggar seni, musium-musium, perpustakaan-perpustakaan dan lembagalembaga lainnya yang berkaitan dengan kcbudayaan.
PASAL2
BIDANG-BIDANG KEGIATAN
1.
Setiap Pihak akan, sampai scjauh mungkin, meningkatkan dan memberikan
pclayanan pcrtukaran kcbudayaan dan intelektual antara badan-badan terkait
dengan maksud untuk menjamin suatu pengertian yang Iebib baik di bidang
kebudayaan kepada Pihak lainnya k.hususnya melalui cara-cara:
(a)
Bahan-bahan pendidikan dan pengajaran ;
(b)
Buku-buku, penerbitan bcrkala dan penerbitan-penerbilan lainnya;
(c)
Program-program radio dan televisi;
(d)
Films, tapes, discs dan bahan-bahan audio-visual lainnya;
(c)
Pamcran seni, kerajinan tangan dan pameran-pamcran kebudayaan
lainnya;
2.
(f)
Ceramah, seminar, konpercnsi dan simposium;
(g)
Pcnyclenggaraan konscr, ta rian dan pcnyclcnggaraan-pcnyelenggaraan
teater panggung lainnya;
(b)
Festival kebudayaan dan perJombaan yang bersifat kebudayaan; dan
(i)
Cara-cara lain yang diputuskan olch Para Pihak.
Para Pihak akan berusaba untuk mendorong pcrtukaran-pertukaran di bidang
sincmat ografi , penyiaran (radio dan tclcvisi), serta pencrbitan buku , tcrmasuk
pcnerbitan-penerbitan berkala.
PASAL 3
PELAK.SANAAN
Kcgiatan-kegiatan yang diatur dalam Memorandum Saling Pcngertian ini dilaksanakan
mclalui pcngembangan program-program yang spesifik dan proyek-proyek antar
lcmbaga-lembaga, badan-badan atau organisasi-organisasi pemerintah maupun swasta
tcrkait dari masi ng-masing Pihak. Program-program dan proyek-proyck tersebut
harus mcrinci, antara lain, mengcnai tujuan , pcngaturan keuangan dan rincian lainnya
yang bcrkaitan dengan kegiatan tertentu dari semua pcscrta yang terlibat, baik
pcmcriotah maupun swasta .
PASAL4
PENYELESAIAN SENGKETA
Setiap sengkcta yang timbul dalam penafsiran dan pelaksanaan Memorandum Saling
Pengcrtian ini harus diselesaikan secara bcrsababat melalui konsultasi-konsultasi atau
pcrundingan-perundingan antara Para Pihak.
PASAL 5
PERUBAHAN-PERUBAHAN
Memorandum Saling Pengcrtian ini dapat diubah bila hal ini dianggap pcrlu
berdasarkan kesepakatan bersama secara tcrtulis antara Para Pihak.
PASAL 6
MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN
Memorandum Saling Pengertian ini mulai bcrlaku sejak saat penanda-tanganan.
Memorandum Saling Pengertian ini dapat diakhiri dengan pemberitahuan 6 (enam)
bulan oleh salah satu Pihak kepada Pihak lainnya secara tertulis tentang keinginannya
itu . Pengakhiran Memorandum Saling Pengertian ini tidak akan mcmpengaruhi
selesainya sctiap program-program dan proyek-proyek berjalan yang dibuat
berdasarkan Memorandum Saling Pengertian ini.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF CANADA
ON
CULTURAL CO-OPERATION
The Government of the Republic of Indonesia and the Government of Canada,
hereinafter referred to as the "Parties";
INSPIRED by a common desire to promote and develop co-operation in the fields of
culture and sp011s; and
CONVINCED that such co-operation will contribute to the furtherance of mutual
understanding and friendship;
Have reached the following understanding:
ARTICLE 1
SCOPES OF CO-OPERATION
1.
The Parties will endeavour to facilitate and encourage nationals of the other
Party in exchanges of artists, athletes, members of cultural, academic and
professional institutions, and other persons engaged in cultural or sports
activities and to encourage their performance, attendance and participation at
arts, culture and sporting events, in Indonesia and Canada , as the case may be.
2.
The Parties will endeavour to encourage organizations involved in arts, culture
and sports to establish links and programs and to develop further co-operation
and joint projects in fields of common interest, contributing to the
strengthening of cultural and sporting relations between the two Parties.
3.
Each Party will endeavour to encourage the development of teaching, research
and publication in relation to its own arts, culture and sports by the relevant
public and private institutions of the other Party.
4.
Each Party will endeavour to provide visitors from the other Party with every
reasonable facility for access to art galleries, museums, libraries and other
establishments of a cultural nature.
ARTICLE 2
AREAS OF ACTIVITY
1.
Each Party will, to the extent possible, promote and facilitate cultural and
intellectual exchange between appropriate organizations so as to ensure a better
understanding of the culture of the other Party especially by means of:
(a)
Educational and teaching materials;
(b)
Books, periodicals and other publications;
(c)
Radio and television programs;
(d)
Films, tapes, discs and other audio-visual materials;
(e)
Fine arts, crafts and other cultural exhibitions;
(f)
Lectures, seminars, conferences and symposia;
2.
(g)
Concerts, dance and theatrical performances;
(h)
Festivals and international competitions of a cultural nature; and
(i)
Any other means upon which the Parties may decide.
The Parties will endeavour to encourage exchanges in the fields of
cinematography, broadcasting (television and radio), and book publishing,
including periodicals.
ARTICLE 3
IMPLEMENTATION
Activities described in this Memorandum of Understanding may be implemented
through the development of specific programs and projects between the appropriate
governmental and private entities, institUJtions or organizations of each Party. Such
programs and projects should specify, inter alia, the objectives, financial arrangements
and other details relating to specific undertakings of all the participants involved,
whether governmental or private.
ARTICLE 4
SETTLEMENT OF DISPUTES
Any disputes arising out of the interpretation or implementation of the Memorandum
of Understanding
between the Parties.
will be settled amicably through consultation or negotiations
ARTICLE 5
AMENDMENTS
This Memorandum of Understanding may be amended if it is deemed necessary by
mutual consent in writing between the Parties.
ARTICLE 6
COMING INTO EFFECT, DURATION AND TERMINATION
This Memorandum of Understanding will take effect upon signature.
This
Memorandum of Understanding may be terminated on six months notice by either
Party notifying the other in writing of its intention to do so. The termination of this
Memorandum of Understanding will not prejudice to the completion of any ongoing
programs and projects made under this Memorandum of Understanding.

domaines artistiquc, culture] et sportif a ctablir des liens et des programmes,

a dcvcloppcr
Ia cooperation ct des projets conjoints dans des domaincs
d'interet commun, qui contribuent au renforcement des relations culturelles et
sportivcs cntrc les deux Parties.
3.
Chaque Partie cherchera
a
encourager l'essor de l'cnseignement, de la
recherchc ct de la publication d'ouvrages, dans lcs domaincs des arts, de la
culture et des sports qui lui sont proprcs, par les institutions publiqucs et
privees conccroccs de l'autre Partic.
4.
Chaquc Partic cherchera
a offrir
aux visiteurs de l 'autrc Partie toutes lcs
possibilitcs d'acces raisonnab lcs aux galeries d·arts, aux musees, aux
bibliothcqucs ct aux autres etablisscmcnts
a vocation culturcllc.
ARTICLE 2
DOMAINES D' ACTIVITE
1.
Dans la mcsure du possible, chaquc Partie favorisera ct facilitera lcs echanges
culturels ct intcllcctucls entre Jes organisati ons compctcntcs de fagon
a assurer
une meillcurc comprehension de la culture de l'autre P artic, surtout par le
rccours:
a)
aux materiels cducatifs ct pcdagogiques;
b)
aux livrcs, periodiques et autrcs publications;
c)
aux emissions de radio et de telCvision;
d)
aux films, bandcs, disques ct autrcs materiels audio-visucls;

l'artisanat ct aux autres expositions

c)
aux beaux-arts,
culture];
caracterc
1)
aux exposes, seminaires, conferences et symposiums;
g)
aux concerts, spectacles de danse et representations theatrales;
h)
aux festivals et concours intcrnationaux

a tout autres moyens dont pourront convcnir les Parties .

Les Parties s'efforceront d'cncourager Jes cchangcs dans les domaincs de la
cinematographic, de la radiodiffusion (television et radio) ct de I'edition, y
compris les periodiques.
ARTICLE 3
APPLICATION
Les activitcs dccritcs dans le present Memorandum d'cntentc pourront etre mises en
oe uvre au moycn de programmes ct de projets spccifiques entrc les entites
go uvcrncmentales et privees , lcs institutions ou lcs organisations competentes de
chaq uc Partic. Lcsdits programmes et projcts dcvraient notammcnl preciser Jes
objcctifs, lcs modalites financieres et lcs autrcs details relatifs aux engagements de
tous Jes intcrvcnants, gouvernementaux on prives.
ARTICLE 4
REGLEMENT DES DIFFERENDS

Le present Memorandum d'cntente entrera en vigucur a la date de sa signature. L 'unc

l'avance, son intention de le faire. La denonciation du present Memorandum d'ententc
n'aura aucune incidence sur lcs projets ou programmes en cours dans le cadre du
Memorandum.

PORTEE DE LA COOPERATION

Les Parties chcrchcront a faciliter et a encourager la participation des nationaux
de l'autrc Partie a des echanges d' a11istes, d'atbletes, de membrcs d'institutions
culturelles, acadcmiqucs ct profcssionnellcs, et d'autres personnes qui
participent
a
des activites culturelles

sportives, Ct
a
favoriscr leur
participation et leur presence a des cvenements artistiques, culturels et sportifs'
en Indonesie et au Canada, sclon l e cas.
2.
Les Parties s'efforceront d'cncourager lcs organisations ocuvrant dans lcs
domaines artistiquc, culture] et sportif a ctablir des liens et des programmes,
et
a dcvcloppcr
Ia cooperation ct des projets conjoints dans des domaincs
d'interet commun, qui contribuent au renforcement des relations culturelles et
sportivcs cntrc les deux Parties.
3.
Chaque Partie cherchera
a
encourager l'essor de l'cnseignement, de la
recherchc ct de la publication d'ouvrages, dans lcs domaincs des arts, de la
culture et des sports qui lui sont proprcs, par les institutions publiqucs et
privees conccroccs de l'autre Partic.
4.
Chaquc Partic cherchera
a offrir
aux visiteurs de l 'autrc Partie toutes lcs
possibilitcs d'acces raisonnab lcs aux galeries d·arts, aux musees, aux
bibliothcqucs ct aux autres etablisscmcnts
a vocation culturcllc.
ARTICLE 2
DOMAINES D' ACTIVITE

Dans la mcsure du possible, chaquc Partie favorisera ct facilitera lcs echanges
culturels ct intcllcctucls entre Jes organisati ons compctcntcs de fagon
a assurer
une meillcurc comprehension de la culture de l'autre P artic, surtout par le
rccours:
a)
aux materiels cducatifs ct pcdagogiques;
b)
aux livrcs, periodiques et autrcs publications;
c)
aux emissions de radio et de telCvision;
d)
aux films, bandcs, disques ct autrcs materiels audio-visucls;

a
l'artisanat ct aux autres expositions
a
c)
aux beaux-arts,
culture];
caracterc
1)
aux exposes, seminaires, conferences et symposiums;
g)
aux concerts, spectacles de danse et representations theatrales;
h)
aux festivals et concours intcrnationaux

a tout autres moyens dont pourront convcnir les Parties .

Les Parties s'efforceront d'cncourager Jes cchangcs dans les domaincs de la
cinematographic, de la radiodiffusion (television et radio) ct de I'edition, y
compris les periodiques.
ARTICLE 3
APPLICATION
Les activitcs dccritcs dans le present Memorandum d'cntentc pourront etre mises en
oe uvre au moycn de programmes ct de projets spccifiques entrc les entites
go uvcrncmentales et privees , lcs institutions ou lcs organisations competentes de
chaq uc Partic. Lcsdits programmes et projcts dcvraient notammcnl preciser Jes
objcctifs, lcs modalites financieres et lcs autrcs details relatifs aux engagements de
tous Jes intcrvcnants, gouvernementaux on prives.
ARTICLE 4
REGLEMENT DES DIFFERENDS
Tout diffcrcnd conccrnant I'interpretation ou J'application du present Memorandum
d'ententC doit etre regJC

ARTICLE 5
MODIFICATION
Le present Memorandum d'entente pourra etre modific si les Parties le jugent
neccssaire et y consentent mutuellcmcnt par ecrit.
ARTICLE 6
ENTREE EN VIGUEUR, DUREE ET DENONCIATION
Le present Memorandum d'cntente entrera en vigucur a la date de sa signature. L 'unc

l'autre Partie pourra le dcnoncer en indiquant par notification ecrite, six mois
l'avance, son intention de le faire. La denonciation du present Memorandum d'ententc
n'aura aucune incidence sur lcs projets ou programmes en cours dans le cadre du
Memorandum.
