the Republic of Indonesia , and for the a ccept ance in India of raw
cotton of the value of U.S . $.1 ,200,000 in partial payment (55%) for
the cott on textiles so exported (the: balance (45%) t o be paid in
st erling ) have concl uded an arrangement as set f orth below.

This Arr ang ement was made in t he k:nowled ge that the Government

of the Unit ed States of Ame rica have agr eed to issue to the
Government of the Republi c of Indonesia a purchase authori zation

( hereinaft er called PA) f or r aw cotton pursuant to Ti tle I, Unit ed
States Fublic Law 480- 83r d Con.?ress (herein.a ft e r re:' erred to as
PL 480) , and have agr eed that t he Government of the Republic of
Indone sia may tr a.ns f er, as needed , t o the Government of India the
authority t o sub-authoris e t he pA .
For the purpose of this Arrangement the rate of conversi on
betwee n the U.S . dollo.r and t he Pound Sterling ui ll be

in Indi a , at competi t ive prices and ac cording to agreed
qualit i e s;
B. will ar range for the a cc eptance of raw cotton made
available to the G- overnment of the Republic of Indonesi a
by the United States uhd:er the PL 480 in partial payment

for the FOB value of the cotton textiles exported to
importers in Indonesia under this r.rrangement;
C.will arrange for the contr a cting for the raw cotton
under the PA prior to November 30, 1963, and for the
shipment prior to De cember 31, 1963, with the 1'Uderstanding that these terminal contr acting and shipping
dates may be extended by agr eement between the
Government of the

of Indonesia and the
Government of the Unit ed States;
D. will arrange that t '-.e raw cot t on under the PA shall
be i mp orted under ' the applicable re gulations of the
United · tates Department of .Ag riculture, and agree
that the raw cot t on shall not be imported into India
unless r e spective Lett ers of Credit for cotton textiles
have been opened, and further, on the understanding that
the i mp ort of r aw cot ·!-; on will only amount to 55% of the
FOB value of Letters of Credit so opened ;
E . will inform the Government of the · Republi c of Ind one sia
fr om time to time of the net values of shipments of
cott on textiles, of credits opened for raw cot ton, and
of the net value s of actual shipments of raw cotton
received;
F. r e cognis.es that the raw cott on i mported from t he ·united
States of America to India under t his Arrangement wi l l
.be in addition to raw cot ton that ·would otherwise be
imported from the United St ates of Ame rica and
countries friendly to the United States of Ame rica;
G. acc epts that cl aims in respect of def iciency in quality

or quantity of cotton ·t extiles shall be settled by
negotiations between exporters in India and importers
in Indonesia in accordance with n ormal commercial
practice, and that any deficiency in quality and quantity
will be made good by additional supplies of cotton
textiles, or, failing which, by remittance in pound
sterling in favour of i mp orters in Indonesia;
H. (1) if, after one month from the date of tr ansfer of the
authority to sub-authorise the PA for raw cot t on,
commer·cial contracts for the supply of cotton textiles
have not been concl uded between exporters in India
and importers in Indonesia to a mini mum of onethird of the total quantity of textiles to -be
supplied accep.t s that t he Government of. the
Republ ic of Indonesia may after informing the
Government of India, be rele ased from its undertaking
unde r paragraph II B below in respect of the balance
of the t ot al spe cified in that paragraph;
(2) in the event that the Government of the Republic of
Indonesia i$ prepared to suspend its right under
the preceding sub-paragr aph for an add itional period
of one month, a ccepts that the .overnment of the
Republi c of I ndones ia may spe cify a further minimum
value of contracts, whi ch shall be con cluded with
the additional one month.
II.
The Government of the Republic of Indonesia
A. ·will tr r nsfer t o the Governrnc'ii.t of India the authority
to sub- authorise the PA for raw cotton equivalent to
the value of U.S . $1,200 , 000 as soon as possible; after

B. will ar r ange for the i mport of cotton textiles from
India and will i s s ue licence s and/ or make

to i mp or ters in Indones i a a s soon a s poss ible afte r
the coming into effect of t hi s Ar r angement, provided
that fifty- f ive (55) ner cent of the t otal FOB value
of the exp orted cot t on te xt iles shall be equivalent
to U . s . t1 , 200 , ooo worth of r aw cotton.
Such li cence s shall be valid only for Indi a and
shall be di st ingu ished f rom ordina ry i mp ort authoris at ions
by not at ion:

will generally be recognised as cases of

over rhich the Government of India and the exporters
have no control;

III. General Stipulati ons:
A. Any residual amount qf sub- authorisati on against the PA
in the neighbourhood of U.s . $ 1, 000 for whi ch the
United State s cannot r aas onably be expect ed to make
shipment, shall be s ettled, wi thout delay , by the
Government of the Republic of Indones i a to the State
Bank of India in cash.
B. Commerc ial contr acts for the delivery of the cott on
textiles shall be made on terms to be ne gotiated
bet·ween exporters in Indi a and i mp ort ers in Indonesia.
C. The
