Herr Minister,
ich beziehe mich auf Artikel 1 des am 10. Juni 1977 unterzeichneten Abkommens zwischen der Regierung der Bundesrepublik
Deutschland und der Republik Indonesien, Uber Kapitalhilfe,
der wie folgt lautet:
"Die Regierung der Bundesrepublik Deutschland ermoglicht
es der Regierung der Republik Indonesien, bei der
Kreditanstalt filr Wiederaufbau, Frankfurt/Main, filr von
beiden Regierungen gemeinsam zu bestimmende Vorhaben
Darlehen bis zu insgesamt 110.000.000,-- DM (in Worten:
Einhundertzehnmillionen Deutsche Mark) aufzunehmen. 11
Ich beehrte mich, Herr Minister, im Namen der Regierung der
Bundesrepublik Deutschland hierzu folgendes mitzuteilen:
Die Regierung der Bundesrepublik Deutschland betrachtet
hinsichtlich der zwischen ihr und der Regierung der Republik
Indonesien zu vereinbarenden Vorhaben die Ergebnisse der
Delegationsverhandlungen im Juni 1977 als Grundlage. Sie
wird bei den weiteren Gesprachen hiervon ausgehen.
Ich bitte Sie, mir das Einverstandnis Ihrer Regierung mit
den obigen Ausfilhrungen bestatigen zu wollen.

Saya mendapat kehormatan untuk memberitahukan bahwa saya telah
menerima Nata Yang Mulia tertanggal hari ini, yang berbunyi sebagai berikut

Saya menunjuk kepada Pasal I dari persetujuan yang ditanda tangani
pada tanggal sepuluh Juni seribu sembilan ratus tujuh puluh tujuh antara
Pemerintah Republik Federasi Jerman dan Pemerintah Republik Indonesia mengenai
Bantuan Keuangan, yang berbunyi sebagai berikut :
"{l) Pemerintah Republik Federasi Jerman akan memungkinkan
Pemerintah Republik Indonesia untuk mengadakan pinjaman-pinjaman dari Kreditanstalt fur Wiederaufbau {Development Loan
Corporation) Frankfurt/Main, sampai sejumlah 110 . 000.000 OM .
{seratus sepuluh juta OM) untuk proyek-proyek yang akan disetujui oleh kedua Pemerintah.
Berhubung dengan hal tersebut diatas, saya atas nama Pemerintah
Republik Federasi Jerman mendapat kehormatan untuk menyampaikan sebagai berikut
Pemerintah Republik Federasi Jerman memandang hasil perundinganperundingan antar delegasi pada bulan Juni 1977.
sebagai dasar untuk proyek-proyek yang akan disetujui antara Pemerintah
Republik Federasi Jerman dan Pemerintah Republik Indonesia.
Proyek-proyek ini akan dilaksanakan berdasarkan pembicaraan-pembicaraan yang
akan diadakan kemudian.

between the Government of the Federal Republic of Germany
and the Government of the Republic of Indonesia concerning
Financial Assistance, which reads as follows:
"The Government of the Federal Republic of Germany
shall enable the Government of the Republic of
Indonesia to raise with the Kreditanstalt ftir Wiederaufbau (Development Loan Corporation), Frankfurt/Main,
loans up to a total of DM 110,000,000 (one hundred and
ten million German Marks) for projects to be agreed
upon by the two Governments."
With regard to the foregoing, I have the honour to communicate the following on behalf of the Government of the
Federal Republic of Germany:
The Government of the Federal Republic of Germany regards
the results cf the inter-delegation negotiations of June 1977
as the basis for the projects to be agreed upon between it
and the Government of the Republic of Indonesia. It will
proceed on this basis in any further talks.

Lieferungen und Leistungen ftir Vorhaben, die aus
den Darlehen finanziert werden, sind international
offentlich auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes festgelegt wird. 11

!ch beehre mich, Eurer Exzellenz im Namen der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Regierung der Bundesrepublik Deutschland beftirwortet im
Interesse der Entwicklungslander das Prinzip der Liefer-Ungebundenhei t bei der Kapitalhilfe. Sie hat dies Wiederholt offentlich erklart und durch die Aufbindtulg der Projekthilfe ftir
Indonesien seit 1970 bekraftigt. Auch 1977 ist die deutsche
Kapitalhilfe nicht an Liefertulgen und Leistwigen aus der
Bundesrepublik Deutschland gebunden.
Die Regierung der Bundesrepublik Deutschland hat keinen Zweifel
daran gelassen, daB sie die internationale offentliche Ausschreibung der Liefertulgen und Leistungen als ein weltweit
gtiltiges Prinzip anstrebe und mit ihrer Aufbindung 1970
einen beispielgebenden ersten Schritt in dieser Richttulg
habe tun wollen.

In entsprechenden Erklarungen anlaBlich bilateraler und
multilateraler Kontakte hat sich die Regierung der Bundesrepublik Deutschland zu diesem Prinzip bekannt und ihrer
Hoffnung Ausdruck verliehen, daB sich andere Geberlander
dem deutschen Beispiel anschlieBen wtirden. Sie hat auch
nie einen Zweifel daran gelassen, daB sie in dieser Frage insbesondere im Hinblick auf das indonesische Interesse das Vorgehen der ilbrigen Geberlander nicht auBer acht
lassen konne. Ausgehend von diesem grundsatzlichen Standpunkt behalt sich die Regierung der Bundesrepublik Deutschland vor, von Fall zu Fall zu prilfen, welche Ausschreibungsmodali taten dem einzelnen Projekt angemessen sind und, soweit
dies sachlich geboten erscheint, im Einzelfall eine auf die
Bundesrepublik Deutschland beschrankte Ausschreibung festzulegen.
Ich bitte Sie, mir das Einverstandnis Ihrer Regierung mit den
obigen Ausftihrungen bestatigen zu wollen.

Federasi Jerman iebih menyukai untuk memberikan bantuan keuangan yang tidak
mengikat. Pemerintah Republik Federasi Jerman telah berulangkali
menyatakan
hal tersebut dihadapan umum dan telah menegaskan kebijaksanaan ini dengan
pemberian bantuan proyek yang tiaak mengikat kepada Inaonesia sejak tahun 1970.

Demikian pula pada tahun 1977, bantuan Jerman tidak terikat pada pemasanan
barang-barang dan jasa-jasa dari Repubiik federasi Jerman.

Repubiik Federasi Jerman tidak ragu-ragu lagi untuk
ingin melihat bahwa prinsip penyediaan barang-barang dan jasa-jasa secara
penawaran umum internasional diterima baik diseluruh dunia, dan dengan pemberian bantuan secara tidak mengikat sejak tahun 1970, Pemerintah Republik
Federasi Jerman berkeinginan memberi contoh untuk merintis jalan kearah itu .
Dalam pernyataan-pernyataan yang dibuat dalam rangka hubungan-hubungan
bilateral dan multilateral, Pemerintah Republik Federasi Jerman telah mempertahankan prinsip tersebut dan menyatakan harapan bahwa negara-negara donor
lainnya hendaknya akan mengikuti jejak Jerman.
Pemerintah Republik Federasi Jerman tidak pernah ragu-ragu lagi
bahwa dalam hal ini, terutama sehubungan dengan kepentingan Indonesia,
Pemerintah Republik Federasi Jerman tidak dapat mengabaikan pendekatan-pendekatan dari negara-negara donor lainnya.
Bertitik tolak dari pertimbangan pokok ini, Pemerintah Republik Federasi
Jerman berhak untuk mempertimbangkan prosedure penawaran yang sebaiknya untuk
masing-masing proyek dan jika dianggap perlu berdasarkan alasan-alasan yang
penting, membatasi penawaran-penawaran pada Republik Federasi Jerman .
Saya akan berterima kasih bilamana Yang Mulia sudi menegaskan

In the interest of developing countries, the Government of
the Federal Republic of Germany supports the principle of
untied supplies in connexion with financial assistance. It
has stated this repeatedly in public and confirmed it by
the untied project aid it has granted to Indonesia since
1970. Likewise in 1977, German financial assistance is
not tied to supplies and services from the Federal Republic
of Germany.
The Government of the Federal Republic of Germany has left
no doubt that it would like to see international tendering

and that, in untying its aid in 1970, it wanted to set an

donor countries would follow suit. It has never left any
doubt that in this matter, especially in view of the
Indonesian interest, it could not disregard the approach
of the other donor countries. Starting from this fundamental position, the Government of the Federal Republic of
Germany reserves the right to examine what tender modalities are appropriate for each individual project and, if
it seems necessary on substantive grounds, to limit
tendering to the Federal Republic of Germany.
I would appreciate it if you would confirm your Government's

Dijiwai oleh hubungan persahabatan yang ada antara Republik
Indonesia dan Republik Federasi Jerman,
berkeinginan untuk memperkokoh dan mempererat hubungan persahabatan
tersebut dengan jalan bekerjasama secara bermanfaat dalam bidang
bantuan pembangunan,
menyadari bahwa pemeliharaan hubungan-hubungan tersebut merupakan
dasar persetujuan ini,
berkeinginan untuk membantu pembangunan ekonomi dan sosial Republik
Indonesia,
telah menyetujui sebagai berikut
PASAL
1.
Pemerintah Republik Federasi Jerman akan memungkinkan Pemerintah
Republik Indonesia untuk mengadakan pinjaman-pinjaman dari
Kreditanstalt fur Wiederaufbau sampai sejumlah 110.000.000,ｃｾ＠
(seratus sepul uh ju ta Deutsche Mark) .untuk proyek-proyek yang akan
disetujui oleh kedua Pemerintah,

Penggunaan pinjaman-pinjaman ini demikian pula persyaratan-persyaratan
atas mana pinjaman-pinjaman diberikan akan diatur oleh ketentuan-ketentuan dalam persetujuan-persetujuan yang akan dibuat antara Pemerintah
Republik Indonesia dan Kreditanstalt ftlr Wiederaufbau serta akan tunduk
terhadap ketentuan-ketentuan hukum yang berlaku di Republik
Federasi
Jerman.

Pemerintah Republik Indonesia akan membebaskan
Kreditanstalt fUr Wie-
deraufbau dari semua pajak-pajak dan pungutan-pungutan umum lainnya
yang berlaku di Republik Indonesia pada waktu
persetujuan-persetujuan,
sebagaimana disebut menurut pasal 2 dari persetujuan ini
dibuat atau
selama masa pelaksanaannya .

Pemerintah Republik Indonesia akan mengizinkan penumpang - penumpang
dan supplier-supplier untuk secara bebas memilih perusahaan-perusahaan
pengangkutan , laut ataupun udara yang digunakan untuk
mengangkut
orang-orang atau barang-barang dalam rangka pemberian pinjaman

dan tidak akan me.ngambil tindakan-tindakan untuk menolak atau mempersul it ikut sertanya secara wajar dan adil perusahaan-perusahaan
penga.ngkutan yang berkedudukan diwilayah Jerman dalam persetujuan
ini, dan memberikan izin-izin yang diperlukan dalam mengikut sertakan perusahaan-perusahaan itu.

5.
Penyediaan barang-barang dan jasa-jasa untuk proyek-proyek yang
dibiayai dari pinjaman-pinjaman tersebut akan diadakan atas dasar
penawaran umum internasional kecuali jika ditentukan lain dalam
hal-hal tertentu.

Mengenai penyediaan barang-barang sehubungan dengan pemberian
pinjaman-pinjaman tersebut, Pemerintah Republik Federasi Jerman
menganggap penting sekali untuk memberikan pilihan pertama kepada
hasil-hasil industri Land Berlin.

Terkecuali ketentuan-ketentuan yang tercantum dalam pasal 4 mengenai pengangkutan udara, Persetujuan ini berlaku pula untuk
Land Berlin dengan ketentuan bahwa

Pemerintah Republik Federasi Jerman tidak memberikan pernyataan
yang berlawanan kepada Pemerintah Republik Indonesia dalam jangka
waktu tiga bulan setelah persetujuan ini mulai berlaku.

Persetujuan ini mulai berlaku pada tanggal ditanda tanganinya.
Dibuat di Jakarta tanggal sepuluh bulan Juni tahun seribu sembilan
ratus tujuh puluh tujuh.
Masing-masing rangkap dua dalam bahasa Indonesia, Jerman dan
Inggris, dimana ketiga naskah mempunyai kekuatan yang sama
syahnya.
Dalam hai penafsiran terhadap naskah Jerman dan Indonesia berbeda, maka naskah Inggrislah yang menentukan.

im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
I
in dem Wunsche, diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen
die Grundlage dieses Abkomm.ens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung
der Republik Indonesien beizutragen sind wie folgt Ubereingekommen:
Artikel 1
Die Regierung der Bundesrepublik Deutschland ermoglicht es
der Regierung der Republik Indonesien, bei der K.reditanstalt ftir Wiederaufbau, Frankfurt am Main, fUr von beiden
Regierungen gemeinsam zu bestimmende Vorhaben, Darlehen
bis zu insgesamt 110.000.000,-- DM (in Worten: Einhundertzehn Millionen Deutsche Mark) aufzunehmen.
Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen, zu denen sie gewahrt werden, bestimmen die zwischen der Regierung
der Republik Indonesien und der Kreditanstalt fUr Wiederaufbau zu schlieBenden Vertrage, die den in der Bundesrepublik
Deutschland geltenden Rechtsvorschriften unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt filr Wiederaufbau von satmlichen Steuern und sonstigen offentlichen Abgaben frei, die bei AbschluB oder Durchfilhrung der nach Artikel 2 zu schlieBenden Vertrage in der
Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlaBt bei den sich
aus der Darlehensgewahrung ergebenden Transporten von Personen und GUtern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternehmen,
trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschlieBen oder erschweren, und erteilt gegebenenfalls die filr eine Beteiligung
dieses Verkehrsunternehmens erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen filr Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich ausｺｾｳ｣ｨｲ･ｩ＠
ben, soweit nicht im Einzelfall etwas Abweichendes
festgelegt wird.
Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung der Darlehen ergebenden Lief erungen die Erzeugnisse der Industrie de
Landes Berlin bevorzugt berticksichtigt werden.
Artikel 7
I
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt dieses Abkommen auch fUr das Land
Berlin, sofern nicht die Regierung der Bundesrepublik
Deutschland der Regierung der Republik Indonesien innerhalb von drei Monaten nach Inkrafttreten des Abkommens
eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.
Geschehen in Jakarta am 10. Juni 1977,
in zwei Unterschriften, jede in deutscher, indonesischer
und englischer Sprache, wobei jeder Wortlaut verbindlich
ist. Bei unterschiedlicher Auslegung des deutschen und
des indonesischen Wortlauts ist der englische Wortlaut
maBgebend.

in the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany ,
desiring to strengthen and intensify those friendly relations ,
by fruitful cooperation in the field of development assistance ,
aware that the maintenance of those relations constitutes the
basis of the present Agreement ,
intendi ng to contribute to economic and social development
in the Republic of Indonesia ,
have agreed as follows :
Article
1
The Government of the Federal Republic of Germany shall
enable the Government of the Republic of Indonesia to

raise with the Kredi tanstal t fur 'diederaufbau (Development
Loan Corporation) , Frankfurt/Main , loans up to a total of
110. 000 . 000 . DH (one hundred and ten million German Mqrks)
for projects to be agreed upon by the two Governments .
Article
2
The utilization of the loans as well as the terms and conditions on with they are grnnted shall be governed by the
provisions of the agreements to be concluded between the
Government of the Republic of Indonesia and the Kreditanstalt

fur Wiederaufbau, which shall be subject to the laws and regulations applicable in the Federal Republic of Germany .
Article
3
The Government of the Republic of Indonesia shall exempt the

Kreditanstalt fur Wiederaufbau from all taxes and other public
char ,·es levied in the Republic of In: onesia at the time of
the conclusion, or during the implementation, of the agreements to be concluded pursuRnt to Article 2 of the present
Agreement .
Article
4
The Government of the Republic of Inc1onesia shall allow
passengers and suppliers free choice of transport enterprises
for such transportation by sea or air of persons and goods as
result from the granting of the loans, abstain from taking
any measures that might exclude or i mpair the participation
on equal terms of transport enterprises having their place
of business in the German area of application of the present
Agreement, and grant the relevant permits as required for
the participation of such enterprises.
Article
5
Supplies and services for projects financed from the loans
shall, unless otherwise provided for in individual cases,
be subject to international public tender.
Article
6
With regard to su ;Jplies resulting from the granting of the
loans, the Governi.1ent of the Federal Republic of Gerrr.any
attaches particular importance to preference being given
to products of industries of Land Berlin.
Article
7
With the exception of those provisions of Article 4 which
refer to air transport, this Agreement shall also apply to
Land Berlin, provided that the Government of the Federal
Republic o:t' Germany does not make a contrary declaration
to the Government of the Republic of Indonesia within three
months o_' the date of entry into force of this Agreement .
Article
8
The present Agreement shall enter into force on the date of
si6nature thereof.

Die Regierung der Bundesrepublik Deutschland beftirwortet im
Interesse der Entwicklungslander das Prinzip der Liefer-Ungebundenhei t bei der Kapitalhilfe. Sie hat dies Wiederholt offentlich erklart und durch die Aufbindtulg der Projekthilfe ftir
Indonesien seit 1970 bekraftigt. Auch 1977 ist die deutsche
Kapitalhilfe nicht an Liefertulgen und Leistwigen aus der
Bundesrepublik Deutschland gebunden.
Die Regierung der Bundesrepublik Deutschland hat keinen Zweifel
daran gelassen, daB sie die internationale offentliche Ausschreibung der Liefertulgen und Leistungen als ein weltweit
gtiltiges Prinzip anstrebe und mit ihrer Aufbindung 1970
einen beispielgebenden ersten Schritt in dieser Richttulg
habe tun wollen.

In entsprechenden Erklarungen anlaBlich bilateraler und
multilateraler Kontakte hat sich die Regierung der Bundesrepublik Deutschland zu diesem Prinzip bekannt und ihrer
Hoffnung Ausdruck verliehen, daB sich andere Geberlander
dem deutschen Beispiel anschlieBen wtirden. Sie hat auch
nie einen Zweifel daran gelassen, daB sie in dieser Frage insbesondere im Hinblick auf das indonesische Interesse das Vorgehen der ilbrigen Geberlander nicht auBer acht
lassen konne. Ausgehend von diesem grundsatzlichen Standpunkt behalt sich die Regierung der Bundesrepublik Deutschland vor, von Fall zu Fall zu prilfen, welche Ausschreibungsmodali taten dem einzelnen Projekt angemessen sind und, soweit

tendering to the Federal Republic of Germany.

Pemerintah Republik Indonesia akan mengizinkan penumpang - penumpang
dan supplier-supplier untuk secara bebas memilih perusahaan-perusahaan
pengangkutan , laut ataupun udara yang digunakan untuk

orang-orang atau barang-barang dalam rangka pemberian pinjaman

dan tidak akan me.ngambil tindakan-tindakan untuk menolak atau mempersul it ikut sertanya secara wajar dan adil perusahaan-perusahaan
penga.ngkutan yang berkedudukan diwilayah Jerman dalam persetujuan
ini, dan memberikan izin-izin yang diperlukan dalam mengikut sertakan perusahaan-perusahaan itu.

Penyediaan barang-barang dan jasa-jasa untuk proyek-proyek yang
dibiayai dari pinjaman-pinjaman tersebut akan diadakan atas dasar
penawaran umum internasional kecuali jika ditentukan lain dalam
hal-hal tertentu.

Mengenai penyediaan barang-barang sehubungan dengan pemberian
pinjaman-pinjaman tersebut, Pemerintah Republik Federasi Jerman
menganggap penting sekali untuk memberikan pilihan pertama kepada
hasil-hasil industri Land Berlin.

Terkecuali ketentuan-ketentuan yang tercantum dalam pasal 4 mengenai pengangkutan udara, Persetujuan ini berlaku pula untuk
Land Berlin dengan ketentuan bahwa

Pemerintah Republik Federasi Jerman tidak memberikan pernyataan
yang berlawanan kepada Pemerintah Republik Indonesia dalam jangka
waktu tiga bulan setelah persetujuan ini mulai berlaku.

Persetujuan ini mulai berlaku pada tanggal ditanda tanganinya.
Dibuat di Jakarta tanggal sepuluh bulan Juni tahun seribu sembilan
ratus tujuh puluh tujuh.
Masing-masing rangkap dua dalam bahasa Indonesia, Jerman dan
Inggris, dimana ketiga naskah mempunyai kekuatan yang sama
syahnya.
Dalam hai penafsiran terhadap naskah Jerman dan Indonesia berbeda, maka naskah Inggrislah yang menentukan.

Die Regierung der Republik Indonesien
und
die Regierung der Bundesrepublik Deutschland
im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
I
in dem Wunsche, diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen
die Grundlage dieses Abkomm.ens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung
der Republik Indonesien beizutragen sind wie folgt Ubereingekommen:
Artikel 1
Die Regierung der Bundesrepublik Deutschland ermoglicht es
der Regierung der Republik Indonesien, bei der K.reditanstalt ftir Wiederaufbau, Frankfurt am Main, fUr von beiden
Regierungen gemeinsam zu bestimmende Vorhaben, Darlehen
bis zu insgesamt 110.000.000,-- DM (in Worten: Einhundertzehn Millionen Deutsche Mark) aufzunehmen.
Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen, zu denen sie gewahrt werden, bestimmen die zwischen der Regierung
der Republik Indonesien und der Kreditanstalt fUr Wiederaufbau zu schlieBenden Vertrage, die den in der Bundesrepublik
Deutschland geltenden Rechtsvorschriften unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt filr Wiederaufbau von satmlichen Steuern und sonstigen offentlichen Abgaben frei, die bei AbschluB oder Durchfilhrung der nach Artikel 2 zu schlieBenden Vertrage in der
Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlaBt bei den sich
aus der Darlehensgewahrung ergebenden Transporten von Personen und GUtern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternehmen,
trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschlieBen oder erschweren, und erteilt gegebenenfalls die filr eine Beteiligung
dieses Verkehrsunternehmens erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen filr Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich ausｺｾｳ｣ｨｲ･ｩ＠
ben, soweit nicht im Einzelfall etwas Abweichendes
festgelegt wird.
Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung der Darlehen ergebenden Lief erungen die Erzeugnisse der Industrie de
Landes Berlin bevorzugt berticksichtigt werden.
Artikel 7
I
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt dieses Abkommen auch fUr das Land
Berlin, sofern nicht die Regierung der Bundesrepublik
Deutschland der Regierung der Republik Indonesien innerhalb von drei Monaten nach Inkrafttreten des Abkommens
eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.
Geschehen in Jakarta am 10. Juni 1977,
in zwei Unterschriften, jede in deutscher, indonesischer
und englischer Sprache, wobei jeder Wortlaut verbindlich
ist. Bei unterschiedlicher Auslegung des deutschen und
des indonesischen Wortlauts ist der englische Wortlaut
maBgebend.

AND

in the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany ,
desiring to strengthen and intensify those friendly relations ,
by fruitful cooperation in the field of development assistance ,
aware that the maintenance of those relations constitutes the
basis of the present Agreement ,
intendi ng to contribute to economic and social development
in the Republic of Indonesia ,
have agreed as follows :
Article
1
The Government of the Federal Republic of Germany shall
enable the Government of the Republic of Indonesia to

raise with the Kredi tanstal t fur 'diederaufbau (Development
Loan Corporation) , Frankfurt/Main , loans up to a total of
110. 000 . 000 . DH (one hundred and ten million German Mqrks)
for projects to be agreed upon by the two Governments .
Article
2
The utilization of the loans as well as the terms and conditions on with they are grnnted shall be governed by the
provisions of the agreements to be concluded between the
Government of the Republic of Indonesia and the Kreditanstalt

fur Wiederaufbau, which shall be subject to the laws and regulations applicable in the Federal Republic of Germany .
Article
3
The Government of the Republic of Indonesia shall exempt the

Kreditanstalt fur Wiederaufbau from all taxes and other public
char ,·es levied in the Republic of In: onesia at the time of
the conclusion, or during the implementation, of the agreements to be concluded pursuRnt to Article 2 of the present
Agreement .
Article
4
The Government of the Republic of Inc1onesia shall allow
passengers and suppliers free choice of transport enterprises
for such transportation by sea or air of persons and goods as
result from the granting of the loans, abstain from taking
any measures that might exclude or i mpair the participation
on equal terms of transport enterprises having their place
of business in the German area of application of the present
Agreement, and grant the relevant permits as required for
the participation of such enterprises.
Article
5
Supplies and services for projects financed from the loans
shall, unless otherwise provided for in individual cases,
be subject to international public tender.
Article
6
With regard to su ;Jplies resulting from the granting of the
loans, the Governi.1ent of the Federal Republic of Gerrr.any
attaches particular importance to preference being given
to products of industries of Land Berlin.
Article
7
With the exception of those provisions of Article 4 which
refer to air transport, this Agreement shall also apply to
Land Berlin, provided that the Government of the Federal
Republic o:t' Germany does not make a contrary declaration
to the Government of the Republic of Indonesia within three
months o_' the date of entry into force of this Agreement .
Article
8
The present Agreement shall enter into force on the date of
si6nature thereof.
DONE at Ja:rnrta on June 10, 1977
in duplicate in the Indone._, ian, German and Bnglish languages,
all three texts being authentic. In case of divergent interpretations of the Indonesian and German texts, the Eng.Lish
text shall prevail .
