FINANCIAL AGREEMENT
-------------------relating to french credits for the
economic development of INDONESIA.

The Government of the Republic of Indonesia and the Government of the French Republic , with a view to facilitate the economic rehabilitation and development efforts ©f Indonesia, agreed on following provilsions.
ARTICLE 1 A total amount of ONE HUNDRED NINETY TWO MILLION AND FIVE HUNDRED
THOUSAND FRENCH FRANCS (192.500.000 F.) is put at the disposal of the
Indonesian Government in the form of credits to finance the purchase of
French heavy equipments and services by Indonesia.
ARTICLE 2 The credits set in article 1 consist of a loan from the French
Treasury to Bank Indonesia, acting on the account of the Indonesian Governｭ･ｮｴ
ｾ＠ of SEVENTY SEVEN MILLION FRENCH FRANC S (77.000.000 F.) and bankers'
credits guaranteed by French Treasury
coming to a totai amount of ONE
HUNDRED FIFTEEN MILLION AND FIVE HUNDRED THOUSAND FRENCH FRANCS
(115 .500. 000 F.) to finance the importation of heavy equipments and services in accordance with the provisions mentioned in article 4 of the present agreement.
ARTICLE 3 -

The loan from the Treasury and the guaranteed bankers' credits
which are extended in conjunction with the former will be respectively
utilized in the proportion of 40 %and 60 %for each contract allocated
under article 2 of the present protocol.
The rights of drawing on the Treasury loan will thus be equal to
the value of the go ods requirement ordered in France for each
contract.

ARTICLE 4 The means of financing provided for in article 2 are earmarked
in totality for the financing of the importation of heavy equipments and
services as mentioned in the priority list of the economic development plan
of Indonesia.
ARTICLE 5 The loans from the French Treasury mentioned in article 2 are
repayable in twenty six years (26) by equal and successive semi-annual
instalments which are calculated from the date of each drawing and bear
an interest rate of 3 %per annum, allowing a grace period of ten (10) years.
The interests due on the balance are repayable at the end of each
half-year. An ｡ｧｲ･ｭｾｴ＠
on the implementation between Bank ｾｮ､ｯ･ｩ｡Ｌ＠
acting on account of the Indonesian Government , and the Credit National,
acting on account of the French Government will stipulate the terms and
conditions of utilization and repayment of these loans.

ARTICLE 6 The guaranteed bankers' credits mention.ad in !'-fticle 2
will be redeemed in 20 (twenty) equal and ｳｵ｣ｾ＿Ｇｴｩ｡ｬｭ･ｮＬ＠
the first one falling due six months after the completion of the
project or the delivery (ies) of equipments, o: the final ､･ｬｩｾｲｹ＠
of the services, as stipulated in each commercial contract or in
the bankers' credit agreement. The rate of interest is the current
export rate, to which is added the cost of credit insurance of
COFACE.
A financial agreement between Bank Indonesia and the
French Institution will stipulate, if necessary, the modalities
of utilization and reimbursement of these guaranteed bankers'
credits.
The agreements relating to the bankers' credit will be
a pproved by Bank Indonesia in case they are not directly signed
by this bank.
ARTICLE 7 Each order is subject to a contract between the French
supplier and the Indonesian buyer, the qualification of which into
the present agreement requires a prior approval of the competent
Indonesian and French authorities.
French franc will be used as currency of account and
currency of payment for the contract.
A down-payment equal to 10 %of the amount of the contract will be paid when placing the order and the balance will be
settled between the order and its receipt in conformity with the
terms and conditions of each contract, by successively utilizing
the means of financing foreseen in article 2 in accordance with
the modalities of article 3 of the present agreement.
ARTICLE 8 The ultimate date for the drawing up of contracts to be
financed under the preaent agreement is set at December 31 st, 1980.
The ultimate da te for the drawing up of the contra cts to
be signed relating to the credits remaining available under the
former governmental agreements is set at March 31 st, 1980.

Le Gouvernement de la Republique de 1 1 Indonesie et le Gouvernement de la Republique Frangaise sont convenus des dispositions suivantes en
vue de facil iter l'effort de redressement et de developpement economique de
l'Indonesie.
ARTICLE 1 Une somme globale de CENT QUATRE VINGT DOUZE MILLIONS CINQ CENT
MI LLE Francs (192.500.000 F.) est mise a la disposition du Gouvernement
indonesien sous forme de credits, pour financer l 1 achat par l'Indone sie
d'equipements lourds et de services frangais.
ARTICLE 2 Les concours financiers prevus a l'article 1 ci-dessus sont constitues d'un pret du Tresor frangais a la Banque d'Indonesie, agissant pour
le compte de l'Etat indonesien, de SOIXANTE DIX SEPT MILLIONS de francs
(77.000.000 F.) et de credits bancaires garantis par le Tresor frangais de
CENT QUINZE MILLIONS CINQ CENT MILLE Francs (115.500.000 F.), destines a
financer l'importation d'equipements lourds et de services selon les modalites
definies a l'article 4 du present texte.
ARTICLE 3 Les prets du Tresor et les credits bancaires garantis qui les
accompagnent seront utilises dans les proportions de 40 %et 60 %respectivement pour chaque contrat impute au titre de l 1 article 2 du present
protocole.
Les droits de tirage sur les prets du Tre sor seront done egaux a
40 %de la valeur des biens ｣ｯｭｾｮ､･ｳ＠
en France au titre de chacun de ces
contra ts.
ARTICLE 4 Les moyens de financement prevus a l'article 2 ci-dessus sont
affectes en totalite ｾｵ＠

de services tels qu'ils sent definis par la liste des priorites du plan de
developpement economique de l'Indonesie.
ARTICLE 5 Les prets du Tresor ｦｲｾｮｱｩｳ＠

sont arnortissables en vingt-six ｾＲＶＩ＠
ans par sernestrialites egales et
successives a compter de la date de chaque tirage, et portent ｩｮｴ･ｲｾ＠
au

d'arnortissement de DIX (lO)ans.
Les interets sur le solde du sont payables a la fin de chaque
semestre. Une convention d'application entre la Banque ｾ ﾷｾｮ

agissant pour le compte du Gouvernement indonesien, et 1: Credit National ! ,
agissant pour le compte du Gouvernement frangais, precisera les modalites
d'utilisation et de remboursement de ces prets .

de chaque
contrat commercial ou de la convention de credit bancaire. Leur

est le taux usuel des credits a l'exportation,
auquel s'ajoute le ｣ｯｾｴ＠
de l'assurance-credit de la COFACE.
Un accord financier entre les etablissements bancaires
fran9ais et la Banque d'Indonesie precisera si necessaire, les
modalites de l'utilisation et du remboursement de ces credits
bancaires garantis.
Les accords relatifs aux credits bancaires seront approuves
par la Banque d'Indonesie s'ils ne sont pas signes ､ｩｲ･｣ｴｭｮｾ＠

ARTICLE 7 Chaque commande fait 1 1 objet entre l'acheteur indonesien
et le fournisseur frangais d'un contrat dont l'admission sur le
present protocole doit ｾｴｲ･＠
prealablement approuvee par les autorites indonesiennes et fran9aises competentes.
La monnaie de compte et la monnaie de paiement des contra ts sont le franc fran9ais.

Un acompte egal a 10 %du montant du contrat est paye a
la commande et le solde du prix est regle entre la commande et la
reception conformement a l'echeancier prevu au contrat, le tout
par utilisation successive des moyens de financement prevus a
l'article 2 selon les modalites definies a l'article 3 du present
ARTICLE 8 La date limite de passation des contnats finances en
application du present protocole est fixee au 31 decembre 1980.
La date limite applicable aux contrats restant a signer
au titre des credits demeurant disponibles sur les precedents
protocoles gouvernementaux est fixee au 31 mars 1980.

Le Gouverne Ment de la Republique frangaise se chargera

la disposition de la Republique d 1 Indonesie
dans un port frangais a compter du 1er janvier 1979.

du ble des son chargement et assumera la r e sponsabilite du tran sport jusqu'au lieu de destination, en reservant par priorite ses
charge ments a un armement fran9ais, et les services d 1 assurance
a une compagnie d'assurance fran9aise.
Ce ble panifiable sera conforme au "standard europeen
de qualite " et s a valeur marchande sera estimee, pour 1 1 application du present Accord, a six cent quinze ( 615) francs frangais
la to nn e metrique.
Selon l'usag e, la contrevaleur, en roupies indonesiennes,
de cette fourniture de ble sera affectee, sous forme de pret ou
de don, au financement de projets figurant sur la liste des priorites du plan de developpement econornique de l'Indonesie, et de
preference au financement de ceux de ces projets qui seront realisei
au moyen de l'aide fran9aise.
Cette contrevaleur sera calculee sur la base de
six cent quinze (615) francs frangais la tonne a la date du
connaissement quel que soit le prix de cession ulterieur du ble sur
le marche interieur indonesien, ou ce dernier prix s 1 il est superieur.
Le Gouvernement de l'Indonesie voudra bien fournir toutes
les informations qui pourraient etre necessaires a l'application
du present echange de lettres avant l'expiration d'une peridde d'un
an a compter d e sa signature.
Le Gouvernement de l'Indonesie prendra toutes les mesures
pour eviter la reexportation, non seulement du produit
re9u mais des sous-produits et des produits similaires.

Les interets sur le solde du sont payables a la fin de chaque

agissant pour le compte du Gouvernement frangais, precisera les modalites
d'utilisation et de remboursement de ces prets .

Un accord financier entre les etablissements bancaires

modalites de l'utilisation et du remboursement de ces credits
bancaires garantis.
Les accords relatifs aux credits bancaires seront approuves
par la Banque d'Indonesie s'ils ne sont pas signes ､ｩｲ･｣ｴｭｮｾ＠

ARTICLE 7 Chaque commande fait 1 1 objet entre l'acheteur indonesien
et le fournisseur frangais d'un contrat dont l'admission sur le
present protocole doit ｾｴｲ･＠
prealablement approuvee par les autorites indonesiennes et fran9aises competentes.
La monnaie de compte et la monnaie de paiement des contra ts sont le franc fran9ais.

Un acompte egal a 10 %du montant du contrat est paye a
la commande et le solde du prix est regle entre la commande et la
reception conformement a l'echeancier prevu au contrat, le tout
par utilisation successive des moyens de financement prevus a
l'article 2 selon les modalites definies a l'article 3 du present
ARTICLE 8 La date limite de passation des contnats finances en
application du present protocole est fixee au 31 decembre 1980.
La date limite applicable aux contrats restant a signer
au titre des credits demeurant disponibles sur les precedents

Le Gouverne Ment de la Republique frangaise se chargera
de toutes les op e rations prealables a la livraison F.O.B. de ce
ble , qui sera mis
la disposition de la Republique d 1 Indonesie
dans un port frangais a compter du 1er janvier 1979.

Le Gouvernement de l'Indonesie deviendra proprietaire
du ble des son chargement et assumera la r e sponsabilite du tran sport jusqu'au lieu de destination, en reservant par priorite ses
charge ments a un armement fran9ais, et les services d 1 assurance
a une compagnie d'assurance fran9aise.
Ce ble panifiable sera conforme au "standard europeen
de qualite " et s a valeur marchande sera estimee, pour 1 1 application du present Accord, a six cent quinze ( 615) francs frangais
la to nn e metrique.
Selon l'usag e, la contrevaleur, en roupies indonesiennes,
de cette fourniture de ble sera affectee, sous forme de pret ou
de don, au financement de projets figurant sur la liste des priorites du plan de developpement econornique de l'Indonesie, et de
preference au financement de ceux de ces projets qui seront realisei
au moyen de l'aide fran9aise.
Cette contrevaleur sera calculee sur la base de
six cent quinze (615) francs frangais la tonne a la date du
connaissement quel que soit le prix de cession ulterieur du ble sur
le marche interieur indonesien, ou ce dernier prix s 1 il est superieur.
Le Gouvernement de l'Indonesie voudra bien fournir toutes
les informations qui pourraient etre necessaires a l'application
du present echange de lettres avant l'expiration d'une peridde d'un
an a compter d e sa signature.
Le Gouvernement de l'Indonesie prendra toutes les mesures
pour eviter la reexportation, non seulement du produit
re9u mais des sous-produits et des produits similaires.
