HUMID TROPICS OF ASIA AND THE PACIFIC
IN BOGOR, INDONESIA
PREAMBLE
ﾷｾ＠
The Government of the Republic of Indonesia (hereinafter
referred to as "the Government") and the United Nations (hereinafter referred to as the "Organization"), taking into consideration the Government's offer to provide host facilities for the
Regional Co-ordination Centre for Research and Development of
Coarse Grains, Pulses, Roots and Tuber (CGPRT) Crops in the

Humid Tropics of Asia and the Pacific and the decision taken at
the thirty-fourth session of United Nations Economic and Social
Commission for Asia and the Pacific (hereinafter referred to as
"ESCAP") to locate the Centre at Bogar, desiring to conduct
research, to exchange information and data and to co-ordinate
the activities related to research and development of coarse
grains, pulses, roots and tuber (CGPRT) crops at the regional
level in accordance with the recommendationscontained in ESCAP
ｾｨｩｲｴｹＭｦｯｵ＠
resolution ·174 (XXXIII) and the recommendation of ESCAP at its
session, desiring to state in concrete terms the
agreement between both parties on the Government's contribution
to the Centre and the privileges and immunities pertaining
thereto, have agreed as follows:

Article I
MEMBERSHIP, LOCATION AND STATUS
OF THE CENTRE
1.
The United Nations Regional Co-ordination Centre for
Research and Development of Coarse Grains, Pulses, Roots and
ｾ＠
Tuber (CGPRT) Crops in the Humid Tropics of Asia and the Pacific
(hereinafter referred to "the Centre") shall be located at
aogor, Indonesia.
2.
Membership in the Centre shall be open to all members
and associate members of ESCAP.

3.
The Centre has the status of a subsidiary organ of the
Uni te.d Nations and its staff constitutes a part of the Secretariat
of the United Nations.
Article II
OBJECTIVES AND FUNCTIONS OF THE CENTRE
1.
The principal objective of the Centre is to provide
member and associate member countries of ESCAP with expert
technical services and facilities required for the development
of production, utilization and trade of CGPRT crops through
strengthening national research and development activities as
a means of solving food problems, increasing employment opportunities, achieving better income distribution and a balanced diet
as well as accelerating close linkages with livestock and other
industries.

In pursuance of the objective stated in article II,
paragraph 1, the Centre shall have following functions:

(a)

Management of an agricultural co-operation research
network on coarse grains, pulses, roots and tuber crops among
national institutions, international agricultural research
institutes and FAO in the humid tropics of Asia and the Pacific;
(b)
Agro-economic studies, including social aspects;
(c)
Training of national research and extension workers;
(d)
Collection, processing and dissemination of information.
Article III
ORGANIZATION AND MANAGEMENT
The Centre shall be headed by a Director to be appointed

by the Secretary-General of the United Nations after consultation
with the Governing Board of the Centre.
If the United Nations
Development Programme (UNDP) provides financial assistance for
this appointment, it will be made in consultation also with UNDP.
The Director shall administer and manage the affairs of the Centre
within the guidelines laid down by the Governing Board and shall
be responsible to the Executive Secretary of ESCAP for the implementation of the work of the Centre.
He shall supervise the
international experts as well as any other personnel assigned

to the Centre.
He shall be responsible for the control of all

equipment provided to the Centre.
Article IV
ADMINISTRATIVE, FINANCIAL AND RELATED ARRANGEMENTS
The Government agrees to make the following contribution
for the operation of the Centre:

(a)
Host facilities, including appropriate office
accommodation, office equipment, furniture and fittings and
facilities necessary to the work of the Centre; and services
of support personnel.
(b)
Any movable and immovable property and facilities
whatsoever which are provided by the Government for the sole
purpose of the Centre shall remain the property of the Government.
No structural or other alterations or additions to such property
shall be made without the prior written approval of the Government.
(c)
With respect to the Centre and all installations
provided by the Government, except in case of damage due to

wilful misconduct or gross negligence attributable to the Centre,
the Government shall be responsible for all repairs, including
without limitation by reason of this enumeration repairs of
damage resulting from fire, force majeure, structural defects
or deterioration; and for the replacement, within a reasonable
period, of any building or part thereof which may be totally or
partially destroyed.
(d)
The Government shall defray any taxes, custom duties
and other charges related to clearance of project equipment brought
ﾷ ｣ ﾷ ｾ＠

into the country by the Centre.
Such equipment, after having
been brought into the country, may be subsequently withdrawn
therefrom by ESCAP or exported to or reimported from other member
countries for purposes of training and other official uses.
(e)
The Government shall permit the import of four
vehicles by the Centre in accordance with the provisions
applicable to the import of automobiles for international
organizations.

The Government shall assist the personnel of the
Centre in finding suitable housing accommodations at reasonable
rates.
(g)
The Government shall designate a government counter-
part agency which will be directly responsible for the implementation of the Government contributions to the Centre.
2.
Additional facilities and services that may subsequently
be required for the Centre will be financed from contributions
by participating member countries or be the subject of subsequent
agreement between ESCAP and the Government.

All expenses of the Centre, including remuneration of
its staff, shall be met from voluntary contributions accepted
by the Organization, in cash or in kind, from the Government,
other Governments of the members of ESCAP, or from the specialized
agencies of the United Nations or other sources.
4.
The voluntary contributions referred to in paragraph 3
of this article shall be held as a fund-in-trust of the Organization
and shall be administered by the Executive Secretary of ESCAP in
accordance with the Financial Rules and Regulations of the United
Nations.
Article V

FACILITIES, PRIVILEGES AND IMMUNITIES
1.
The Government shall apply to the Centre as part of a
subsidiary organ of the United Nations, including the Director,
other officials, property, funds and assets of the Centre, the
provisions of the Convention on the Privileges and Immunities
of the United Nations, to which the Government became a party
on 8 March 1972.

2.
Without prejudice to the provisions of paragraph 1 above:

(a)
The Centre shall be under the control and authority
of ESCAP.
(b)
The appropriate authorities of the Government shall
exercise due diligence to ensure that the tranquility of the
Centre is not disturbed by any persons or group of persons
attempting unauthorized entry or creating any disturbance in
the immediate vicinity of the Centre.
(c)
If so requested by the Director of the Centre, the
appropriate authorities of the Government shall provide a sufficient
number of police for the preservation of law and order in the
Centre and the removal therefrom of offenders.
(d)
In case of any interruption or threatened inter-
ruption of any necessary public services, including, but not
limited to, fire protection, electricity, water, sewage, post,
telephone and telegraph, the appropriate authorities of the
Government shall consider the needs of the Centre as being of
equal importance with those of the essential agencies of the
Government and shall take steps accordingly to ensure that the
work of the Centre is not prejudiced.

The. Director of the Centre and ESCAP officials at
professional level of P4 or above assigned to or performing
services at the Centre will also be accorded by the Government
the privileges, immunities, exemptions and facilities accorded
by the Government to officials of the specialized agencies of
the United Nations.

Without prejudice to the provisions of the preced i ng
paragraphs of this article:

(a)
The Director shall be accorded by the Government
the privilege to import free of duty one automobile for his use.
This automobile to be imported is in addition to the automobiles
stipulated in article IV, paragraph l(e).
(b)
Other officials of the Centre may purchase locally
assembled cars free of duty and taxes.

The Centre shall provide the Government with the names
of personnel to whom the privileges and immunities enumerated
in this article shall apply.
Article VI
CO-OPERATION BETWEEN THE GOVERNMENT
AND THE ORGANIZATION
There shall be close co-operation between the Government
and the Organization to facilitate the operation of the Centre.
To that end, they shall consult each other as and when appropriate
and shall make available to each other all such information and
assistance as may be reasonably requested.
Article VII
ENTRY INTO FORCE AND TERMINATION
l.
This Agreement shall enter into force on the date of
its signature.
Z.
This Agreement shall remain in force until either Party
considers that the objectives of the Centre have been accomplished
or that its activities can no longer appropriately or effectively
be carried out, at which time this Agreement may be terminated
by mutual consent or by either Party serving 12 months' written
notice to the other Party.

and the United Nations respectively, have signed this agreement.

Article I
