da l am Pa sal 4 mengenai pengangkutan udara , maka Persetu djuan ini akan berlaku djuga Land Berlin , asalkan Pemerintah Republik Federasi Djerman tidak memberikan pernj a taan
jang bertentangan kepada Pemerintah Republik Indonesia
dalam djangka waktu 3 bulan terhitung mulai berlakunja

Die Regierung der Republik Indonesien
und
die Regierung der Bundesrepublik Deutschland
im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
in dem Wunsche , diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,

im Bewusstsein, dass die Aufrechterhaltung dieser Beziehun- I
gen die Grundlage dieses Abkommens ist,
in der Absicht, die Entwicklung der indonesischen Wirtschaf"'
zu fordern,
sind wie folgt libereingekommen:
Artikel 1

(1) Die Regierung der Bundesrepublik Deutschland ermoglicht
es der Regierung der Republik Indonesien, dass die Bank
Indonesia, mit Vollmacht und im Auftrag der Regierung
der Republik Indonesien handelnd, bei der Kreditanstalt
flir Wiederaufbau , Frankfurt am Main, zur Stabilisierung
und zum Wiederaufbau der indonesischen Wirtschaft Dar- I
lehen bis zur Hohe von insgesamt einhundertflinfunddreis

sig Millionen Deutsche Mark gemass Absatz 2 bis 5 au.f- ,

nimmt.
(2) Ein Betrag bis zur Hohe von sechzig Millionen Deutsche '
Mark ist ftir den Einkauf von Waren aus der Bundesrepublik Deutschland zur Abdeckung des laufenden notwendigen zivilen Einfuhrbedarfs (Commodity Aid) vorgesehen.

(5) Die in den Absatzen 3 und 4 bezeichneten Vorhaben kormen
im Einvernehmen zwischen der Regierung der Republik ｉｮ､ｯｾ＠
nesien und der Regierung der Bundesrepublik Deutschland I
durch andere Vorhaben ersetzt werden ; ferner kormen .Anderungen der vorgesehenen Einzelbetrage im Rahmen der in
den Absatzen 3 und 4 bestimmten Gesamtsummen vorgenommen
werden.

Artikel 2
(1) Die Verwendung dieser Darlehen-sowie die Bedingungen, zu
denen sie gewahrt werden, bestimmen die zwischen der

Bank Indonesia, mit Vollmacht und im Auftrag der Regierung der Republik Indonesien handelnd, und der Kreditanstalt filr Wiederaufbau abzuschliessenden Darlehensvertrage, die den in der Bundesrepublik Deutschland geltenden Rechtsvorschriften unterliegen.
(2) Die Regierung der Republik Indonesien garantiert gegenUber der Kreditanstalt filr Wiederaufbau alle Zahlungen
und den sich daraus ergebenden Transfer in Erfilllung vor
Verbindlichkeiten des Darlehensnehmers auf Grund der abzuschliessenden Darlehensvertrage.
Artikel 3
I
Die Regierung der Republik Indonesien stellt die Kredit
anstalt filr Wiederaufbau von samtlichen Steuern und sonj
stigen offentlichen Abgaben frei, die bei Abschluss ode!
Durchfilhrung der in Artikel 2 erwahnten Darlehensvertrage in der Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien Uberlasst bei den
sich aus der Darlehensgewahrung ergebenden Transporten
von Personen und GUtern im See- und Luftverkehr den Passagi eren und Lieferanten die freie Wahl der Transportunternehmen vorbehaltlich des Artikel 5, trifft keine MaBnahmen, welche die Beteiligung deutscher Verkehrsunter1
nehmen ausschliessen oder erschweren, und erteilt gegebenenfalls die erf orderlichen Genehmigungen.
Artikel 5
(1) Die in Artikel 1 dieses Abkommens genannten Darlehen

dilrf en nur zur Finanzierung von Lieferungen und Leistungen aus Landern und Gebieten verwandt werden, auf die

sich die Regierung der Republik Indonesien und die Regierung der Bundesrepublik Deutschland geeinigt haben.
Das Gleiche gilt flir den Ursprung der Lieferungen.
(2) Die sich aus der Gewahrung der Darlehen ergebenden ｔｲ｡ｮｳｾ＠
porte werden auf Verkehrsmitteln der Republik Indonesien
der Bundesrepublik Deutschland oder dritter Staaten,liber
die sich beide Regierungen gesondert einigen, durchgeftihrt.
Erfolgen die Transporte auf Verkehrsmitteln anderer Staa •
ten, so schliesst dies die Finanzierung auch der betreffenden Lieferungen aus.
Artikel 6
Lieferungen und Leistungen flir Vorhaben, die aus den
Darlehen gemass Artikel 1 Absatz 3 und 4 bezahlt werden,
sind international offentlich auszuschreiben, soweit
nicht nach Prtifung der einzelnen Vorhaben von Fall zu
Fall etwas Abweichendes f estgelegt wird.
Artikel 7 .
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, dass bei den sich aus der Gewahrung der Darlehen ergebenden Lieferungen die Erzeugnisse der Industrie des Landes Berlin bevorzugt berUcksichtigt werden.
Artikel 8
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich des Luftverkehrs gilt dieses Abkommen auch flir das
Land Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland gegenliber der Regierung der Republik
Indonesien innerhalb von drei Monaten nach Inkrafttreten

des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 9
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.

Geschehen zu Djakarta am siebenten Januar neunzehnhundertzweiundsiebzig in sechs Urschriften, je zwei in indonesischer, deutscher und englischer Sprache. Der indonesische
und der deutsche Wortlaut sind gleichermassen verbindlich;
bei unterschiedlicher Auslegung des indonesischen und
deutschen Wortlauts soll der englische Wortlaut massgebend
sein.

the Government of the Federal Republic of Germany
IN the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany,
DESIRING to strengthen and intensify those friendly relations
by fruitful cooperation in the field of development assistance,
AWARE that the maintenance of those relations constitutes the
basis of the present Agreement,
INT:ENDING to promote the development of the Indonesian
economy,
HAVE agreed as follows:
Article 1
(1) The Government of the Federal Republic of Germany shall
provide the Government of the Republic of Indonesia with
the possibility of the Bank Indonesia, acting for and on
behalf of the Government of the Republic of Indonesia,
taking up loans up to a total of one hundred and thirtyfive million German Marks according to paragraphs 2 to 5
with the Kreditanstalt f'U.r Wiederaufbau, Frankfurt am
Main, for the stabilization and rehabilitation of the
Indonesian economy.
(2) An amount not exceeding sixty million German Marks shall
be envisaged for the purchase of goods in the Federal
Republic of Germany to cover the current necessary
demand for civil imports (commodity aid).

(3) An amount not exceeding fifteen million three hundred
thousand German Marks shall be envisaged as maintenance
support for the financing of
a) Rehabilitation of Diesel locomotives
b) Increase in the number of Diesel
locomotives
c) Sub-supplies for city buses
d) Rehabilitation of sea dredgers
e) Referral hospitals

(5) The projects mentioned in paragraphs 3 and 4 may be replaced
by other projects if the Government of the Republic of
Indonesia and the Government of the Federal Republic of
Germany so agree; moreover, within the framework of the
totals specified under paragraphs 3 and 4, adjustments may
be made of the envisaged sub-totals.
Article 2
(1) The utilization of these loans and the terms and conditions
on which they will be granted shall be governed by the
provisions of the loan agreements which shall be subject to
the legal provisions applicable in the Federal Republic of

Germany and which are to be concluded between the Bank
Indonesia, acting for and on behalf of the Government of
the Republic of Indonesia, and the Kreditanstalt ftir Wiederaufbau.
(2) The Government of the Republic of Indonesia shall guarantee
to the Kreditanstalt ftir Wiederaufbau all payments and the
resultant transfer to be made in fulfilment of the borrower's
ｬｩ｡｢

under the loan agreements to be concluded.
· Article 3
The Government of the Republic of Indonesia shall exempt the
Kreditanstalt ftir ｗｩ･､ｾ｡ｵｦ｢＠
from all taxes and other public
charges levied in the Republic of Indonesia at the time of the
conclusion, or during the execution, of the loan agreements
mentioned in Article 2.
Article 4

The Government of the Republic of Indonesia shall, subject to
the provisions of Article 5, allow ｰ｡ｳｾｧ･ｲ＠
and suppliers
free choice of means of transport for such transportation by
sea and air of persons and goods as results from the granting
of the loans, and shall abstain from taking any measures that
might exclude or impair the participation of German transport
enterprises, and shall grant the necessary permits as required.

Article 5
(1) The loans mentioned in Article 1 of the present Agreement may
only be used to finance supplies and services from countries
and regions agreed upon by the Government of the Republic of
Indonesia and the Government of the Federal Republic of
Germany. The same applies to the origin of such supplies .

(2) Transports arising from the granting of the loans shall be
executed by means of transport of the Republic of Indonesia,
the Federal Republic of Germany ｾ ｯｲ＠
third states which shall
be separatly agreed upon by the two Governments.
If transports are executed by means of transport of states
other than those mentioned above, the financing of the
supplies concerned shall also be excluded.
Article 6
Supplies and services for projects which shall be paid from the
loans according to paragraphs 3 and 4 of Article 1 shall be
subject to international public bidding unless otherwise
provided on a case by case basis after examination of individual
projects.
Article 7
With regard to the supplies resulting from the loans granted,
the Government of the Federal Republic of Germany attaches
particular importance to preference being given to products
of industries of Land Berlin.
Article 8
With the exception of the provisions of Article 4 which refer
to air transport, the present Agreement shall also apply to
Land Berlin, provided that the Government of the Federal Republic
of Germany does not make a contrary declaration to the Government of the Republic of Indonesia within three months of the
entry into force of the present Agreement.

The present Agreement shall enter into force on the day of
signature thereof.

equally authentic; in case of divergent interpretations of
the Indonesian and German texts the English text shall prevail .

Pengangkutan jang diperoleh dari hasil pemberian
pindjaman2 akan dilakukan dengan alat2 pengangkutan dari Republik Federasi Djerman, Republik
Indonesia atau negara2 ketiga jang disetudjui
setjara tersendiri oleh kedua Pemerintah.
Apabila pengangkutan2 dilakukan dengan alat2
pengangkutan dari negara2 lainnja daripada
negara2 jang tersebut diatas, maka pembiajaan
dari penjediaan barang2 jang bersangkutan adalah
diluar persetudjuan ini."

Pasal 5 tidak mempengaruhi lalu-lintas antara Land
Berlin dan daerah2 lainnja dalam lingkungan Djerman dimana ketentuan2 dal am Persetudjuan ini dapat dilaksanakan.
Daftar ini dapat dirobah dengan pengaturan2 selandjutnja antara Pemerintah Republik Federasi Djerman dan
Pemerintah Republik Indonesia.
Bersama ini saja mengusulkan bahwa surat ini dan surat
djawaban Jang Mulia akan mendjadi suatu pengaturan
antara kedua Pemerintah kita, dan mulai berlaku bersamaan dengan Persetudjuan tersebut diatas.

ich beziehe mich auf Artikel 5 des am 7. Januar 1972
unterzeichneten Abkommens zwischen der Regierung der
Bundesrepublik Deutschland und der Regierung der Republik
Indonesian Uber ｋ｡ｰｩｴｬｾｦ･Ｌ＠
der wie folgt lautet:
"(1) Die in Artikel 1 dieses Abkommens genannten
Darlehen dtirfen nur zur Finanzierung von Lieferungen
und Leistungen aus Llindern und Gebieten verwandt
werden, auf die sich die Regierung der Bundesrepublik
Deutschland und die Regierung der Republik Indonesian
geeinigt haben. Das Gleiche gilt ftir den Ursprung
der Lieferunge·n .
(2) Die sich aus der Gewahrung der Darlehen ergebenden
Transporte werden auf Verkehrsmitteln der Bundesrepublik Deutschland, der Republik Indonesien oder
dritter Staaten, Uber die sich beide Regierungen

durchgeftihrt.
Erfolgen die Transporte auf Verkehrsmitteln anderer
Staaten, so schlieBt dies die Finanzierung auch der
betreffenden Lieferungen aus."

Lander und Gebiete zu Uberreichen. Gleichzeitig darf ich
darauf hinweisen, daB Artikel 5 den Verkehr zwischen dem

Abkommens nicht bertihrt.

Diese Liste kann durch spatere Vereinbarungen zwischen
der Regierung der Bundesrepublik Deutschland und der
Regierung der Republik Indonesien geandert werden.
Ich schlage vor, daB dieses Schreiben und !hr Antwortschreiben
eine Vereinbarung zwischen unseren beiden Regierungen bilden
sollen, die gleichzeitig mit dem genannten Abkommen in
Kraft tritt.
Ich bitte Sie, Exzellenz, den Empfang dieses Schreibens
zu bestatigen.

I ref er to Article 5 of the Agreement signed on
7 January, 1972, between the Government of the Federal
Republic of Germany and the Government of the Republic
of Indonesia concerning Financial Assistance, which reads

(1) The loans mentioned in Article 5 of the present Agreement may only be used to finance supplies and services
from countries and regions agreed upon by the Government of the Federal Republic of Germany and the
Government of the Republic of Indonesia. The same
applies to the origin of such supplies.
(2) Transports arising from the granting of the loans
shall be executed by means of transport of the
Federal Republic of Germany, the Republic of Indonesia
or third states which shall be separately agreed
upon by the two Governments.
If transports are executed by means of transport of
states other than those mentioned above, the

Pemerintah Republik Federasi Djerman telah menjatakan hal
ini setjara umum berulang kali dan ditegaskan dalam bentuk
bantuan projek tanpa ikatan kepada Indonesia dalam tahun
1970 .
Walaupun demikian, ini tidak menimb ulkan kechawatiran terhadap usaha2- nja agar penawaran dalam rangka bantuan projek
merupakan suatu prinsip jang berlaku setjara i nternasional
dan didalam memberi bantuan setjara tak terikat dalam tahun
1970, bermaksud untuk memberikan t jontoh dengan mengambil
langkah2 pertama dalam djurusan tersebut . Dalam pernjataan2
jang menjangkut hal ini dala m hubungan2 setjara bil ateral

dan multilateral, Pemerintah Republik Federasi Djerman
telah menegaskan l agi prinsip ini dan menjatakan harapannja bahwa negara2 donor lainnja akan segera mengikutin ja.

pernah r agu2 chususnja dalam hal untuk kepentingan Indonesia dan akan memperhatikan tjara2 pendekatan daripada
negara2 donor lainnja. Berdasarkan pokok pandangan ini
Pemerintah Republik Federasi Djerman akan membatasi haknja untuk meneliti setjara persoalan demi persoalan seperti tjara2 penawaran mana jang sesuai untuk masing2 projek dan , dalam hal jang chusus , menentukan suatu penawaran

"Lieferungen und Leistungen f'Ur Vorhaben, die aus den

sind international offentlich auszuschreiben, soweit
nicht nach Prilfung der einzelnen Vorhaben von Fall zu
Fall etwas Abweichendes festgelegt wird."
Ich beehre mich, Eurer Exzellenz namens der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Bundesregierung befUrwortet im Interesse der Entwicklungslander das Prinzip der Lieferungebundenheit bei der Projekthilfe. Sie hat dies Wiederholt offentlich erklart und durch
die ungebundene Projekthilfe 1970 filr Indonesien bekraftigt.
Sie hat jedoch keinen Zweifel daran gelassen, daB sie
die Ausschreibung filr die Projekthilfe als ein international
allgemein gilltiges Prinzip anstrebe und mit ihrer Aufbindung 1970
einen beispielgebenden ersten Schritt in dieser Richtung habe
tun wollen. In entsprechenden Erklarungen anlaBlich bilateraler
und multilateraler Kontakte hat sich die Bundesregierung
erneut zu diesem Prinzip bekannt und ihrer Hoffnung Ausdruck
verliehen, daB sich andere Geberlander dem deutschen Beispiel
anschlieBen wlirden. Sie hat auch nie einen Zweifel daran

Bundesregierung vor, von Fall zu Fall zu prUfen, welche
Ausschreibungsmodalitaten dem einzelnen Projekt angemessen
sind und im Einzelfall eine auf die Bundesrepublik Deutschland
beschrankte Ausschreibung festzulegen.

im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
in dem Wunsche , diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,

im Bewusstsein, dass die Aufrechterhaltung dieser Beziehun- I
gen die Grundlage dieses Abkommens ist,
in der Absicht, die Entwicklung der indonesischen Wirtschaf"'
zu fordern,
sind wie folgt libereingekommen:
Artikel 1

(1) Die Regierung der Bundesrepublik Deutschland ermoglicht
es der Regierung der Republik Indonesien, dass die Bank
Indonesia, mit Vollmacht und im Auftrag der Regierung
der Republik Indonesien handelnd, bei der Kreditanstalt
flir Wiederaufbau , Frankfurt am Main, zur Stabilisierung
und zum Wiederaufbau der indonesischen Wirtschaft Dar- I
lehen bis zur Hohe von insgesamt einhundertflinfunddreis

sig Millionen Deutsche Mark gemass Absatz 2 bis 5 au.f- ,

nimmt.
(2) Ein Betrag bis zur Hohe von sechzig Millionen Deutsche '
Mark ist ftir den Einkauf von Waren aus der Bundesrepublik Deutschland zur Abdeckung des laufenden notwendigen zivilen Einfuhrbedarfs (Commodity Aid) vorgesehen.

(5) Die in den Absatzen 3 und 4 bezeichneten Vorhaben kormen

durch andere Vorhaben ersetzt werden ; ferner kormen .Anderungen der vorgesehenen Einzelbetrage im Rahmen der in
den Absatzen 3 und 4 bestimmten Gesamtsummen vorgenommen
werden.

Artikel 2
(1) Die Verwendung dieser Darlehen-sowie die Bedingungen, zu
denen sie gewahrt werden, bestimmen die zwischen der

Bank Indonesia, mit Vollmacht und im Auftrag der Regierung der Republik Indonesien handelnd, und der Kreditanstalt filr Wiederaufbau abzuschliessenden Darlehensvertrage, die den in der Bundesrepublik Deutschland geltenden Rechtsvorschriften unterliegen.
(2) Die Regierung der Republik Indonesien garantiert gegenUber der Kreditanstalt filr Wiederaufbau alle Zahlungen
und den sich daraus ergebenden Transfer in Erfilllung vor
Verbindlichkeiten des Darlehensnehmers auf Grund der abzuschliessenden Darlehensvertrage.
Artikel 3
I
Die Regierung der Republik Indonesien stellt die Kredit
anstalt filr Wiederaufbau von samtlichen Steuern und sonj
stigen offentlichen Abgaben frei, die bei Abschluss ode!
Durchfilhrung der in Artikel 2 erwahnten Darlehensvertrage in der Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien Uberlasst bei den
sich aus der Darlehensgewahrung ergebenden Transporten
von Personen und GUtern im See- und Luftverkehr den Passagi eren und Lieferanten die freie Wahl der Transportunternehmen vorbehaltlich des Artikel 5, trifft keine MaBnahmen, welche die Beteiligung deutscher Verkehrsunter1
nehmen ausschliessen oder erschweren, und erteilt gegebenenfalls die erf orderlichen Genehmigungen.
Artikel 5
(1) Die in Artikel 1 dieses Abkommens genannten Darlehen

sich die Regierung der Republik Indonesien und die Regierung der Bundesrepublik Deutschland geeinigt haben.
Das Gleiche gilt flir den Ursprung der Lieferungen.
(2) Die sich aus der Gewahrung der Darlehen ergebenden ｔｲ｡ｮｳｾ＠
porte werden auf Verkehrsmitteln der Republik Indonesien
der Bundesrepublik Deutschland oder dritter Staaten,liber
die sich beide Regierungen gesondert einigen, durchgeftihrt.
Erfolgen die Transporte auf Verkehrsmitteln anderer Staa •
ten, so schliesst dies die Finanzierung auch der betreffenden Lieferungen aus.
Artikel 6
Lieferungen und Leistungen flir Vorhaben, die aus den
Darlehen gemass Artikel 1 Absatz 3 und 4 bezahlt werden,
sind international offentlich auszuschreiben, soweit
nicht nach Prtifung der einzelnen Vorhaben von Fall zu
Fall etwas Abweichendes f estgelegt wird.
Artikel 7 .
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, dass bei den sich aus der Gewahrung der Darlehen ergebenden Lieferungen die Erzeugnisse der Industrie des Landes Berlin bevorzugt berUcksichtigt werden.
Artikel 8
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich des Luftverkehrs gilt dieses Abkommen auch flir das
Land Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland gegenliber der Regierung der Republik
Indonesien innerhalb von drei Monaten nach Inkrafttreten

des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 9
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.

Geschehen zu Djakarta am siebenten Januar neunzehnhundertzweiundsiebzig in sechs Urschriften, je zwei in indonesischer, deutscher und englischer Sprache. Der indonesische
und der deutsche Wortlaut sind gleichermassen verbindlich;

IN the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany,
DESIRING to strengthen and intensify those friendly relations
by fruitful cooperation in the field of development assistance,
AWARE that the maintenance of those relations constitutes the
basis of the present Agreement,
INT:ENDING to promote the development of the Indonesian
economy,
HAVE agreed as follows:
Article 1
(1) The Government of the Federal Republic of Germany shall
provide the Government of the Republic of Indonesia with
the possibility of the Bank Indonesia, acting for and on
behalf of the Government of the Republic of Indonesia,
taking up loans up to a total of one hundred and thirtyfive million German Marks according to paragraphs 2 to 5
with the Kreditanstalt f'U.r Wiederaufbau, Frankfurt am
Main, for the stabilization and rehabilitation of the
Indonesian economy.
(2) An amount not exceeding sixty million German Marks shall
be envisaged for the purchase of goods in the Federal
Republic of Germany to cover the current necessary
demand for civil imports (commodity aid).

thousand German Marks shall be envisaged as maintenance
support for the financing of

b) Increase in the number of Diesel

(5) The projects mentioned in paragraphs 3 and 4 may be replaced
by other projects if the Government of the Republic of
Indonesia and the Government of the Federal Republic of
Germany so agree; moreover, within the framework of the
totals specified under paragraphs 3 and 4, adjustments may
be made of the envisaged sub-totals.
Article 2
(1) The utilization of these loans and the terms and conditions
on which they will be granted shall be governed by the
provisions of the loan agreements which shall be subject to
the legal provisions applicable in the Federal Republic of

Germany and which are to be concluded between the Bank
Indonesia, acting for and on behalf of the Government of
the Republic of Indonesia, and the Kreditanstalt ftir Wiederaufbau.
(2) The Government of the Republic of Indonesia shall guarantee
to the Kreditanstalt ftir Wiederaufbau all payments and the
resultant transfer to be made in fulfilment of the borrower's
ｬｩ｡｢
ｾ ｩｴ･ｳ＠
under the loan agreements to be concluded.
· Article 3
The Government of the Republic of Indonesia shall exempt the
Kreditanstalt ftir ｗｩ･､ｾ｡ｵｦ｢＠
from all taxes and other public
charges levied in the Republic of Indonesia at the time of the
conclusion, or during the execution, of the loan agreements
mentioned in Article 2.
Article 4

The Government of the Republic of Indonesia shall, subject to
the provisions of Article 5, allow ｰ｡ｳｾｧ･ｲ＠
and suppliers
free choice of means of transport for such transportation by
sea and air of persons and goods as results from the granting
of the loans, and shall abstain from taking any measures that
might exclude or impair the participation of German transport
enterprises, and shall grant the necessary permits as required.

Article 5
(1) The loans mentioned in Article 1 of the present Agreement may
only be used to finance supplies and services from countries
and regions agreed upon by the Government of the Republic of
Indonesia and the Government of the Federal Republic of
Germany. The same applies to the origin of such supplies .

(2) Transports arising from the granting of the loans shall be
executed by means of transport of the Republic of Indonesia,
the Federal Republic of Germany ｾ ｯｲ＠
third states which shall
be separatly agreed upon by the two Governments.
If transports are executed by means of transport of states
other than those mentioned above, the financing of the
supplies concerned shall also be excluded.
Article 6
Supplies and services for projects which shall be paid from the
loans according to paragraphs 3 and 4 of Article 1 shall be
subject to international public bidding unless otherwise
provided on a case by case basis after examination of individual
projects.
Article 7
With regard to the supplies resulting from the loans granted,
the Government of the Federal Republic of Germany attaches
particular importance to preference being given to products
of industries of Land Berlin.
Article 8
With the exception of the provisions of Article 4 which refer
to air transport, the present Agreement shall also apply to
Land Berlin, provided that the Government of the Federal Republic
of Germany does not make a contrary declaration to the Government of the Republic of Indonesia within three months of the
entry into force of the present Agreement.

signature thereof.

djawaban Jang Mulia akan mendjadi suatu pengaturan
antara kedua Pemerintah kita, dan mulai berlaku bersamaan dengan Persetudjuan tersebut diatas.

Diese Liste kann durch spatere Vereinbarungen zwischen
der Regierung der Bundesrepublik Deutschland und der
Regierung der Republik Indonesien geandert werden.

eine Vereinbarung zwischen unseren beiden Regierungen bilden
sollen, die gleichzeitig mit dem genannten Abkommen in
Kraft tritt.

affect transport between Land Berlin and the remaining
German scope of application of the present Agreement.
This lis t may be modified by subsequent arrangements
between the Government of the Federal Republic of
Germany and the Government of the Republic of Indonesia.
I propose that this letter and your letter in repl y
thereto shall constitute an Arrangement between our two
Governments, to enter into force simultaneously with
the Agreement mentioned above.

umum setjara internasional , ketjuali djika dal am beberapa hal telah diadakan atas dasar persoalan demi persoalan sesudah penel itian dari

Untuk kepentingan negara2 berkembang Pemerintah Republik
Federasi Djer man menjokong prinsip penjediaan barang2 jang
tidak terikat pembeliannja pada suatu negara tertentu dalam hubungan nja dengan bantuan projek.
Pemerintah Republik Federasi Djerman telah menjatakan hal
ini setjara umum berulang kali dan ditegaskan dalam bentuk
bantuan projek tanpa ikatan kepada Indonesia dalam tahun
1970 .
Walaupun demikian, ini tidak menimb ulkan kechawatiran terhadap usaha2- nja agar penawaran dalam rangka bantuan projek
merupakan suatu prinsip jang berlaku setjara i nternasional
dan didalam memberi bantuan setjara tak terikat dalam tahun
1970, bermaksud untuk memberikan t jontoh dengan mengambil
langkah2 pertama dalam djurusan tersebut . Dalam pernjataan2
jang menjangkut hal ini dala m hubungan2 setjara bil ateral

dan multilateral, Pemerintah Republik Federasi Djerman
telah menegaskan l agi prinsip ini dan menjatakan harapannja bahwa negara2 donor lainnja akan segera mengikutin ja.
Dal am hal ini Pemerintah Republik Federasi Djerman tidak
pernah r agu2 chususnja dalam hal untuk kepentingan Indonesia dan akan memperhatikan tjara2 pendekatan daripada
negara2 donor lainnja. Berdasarkan pokok pandangan ini
Pemerintah Republik Federasi Djerman akan membatasi haknja untuk meneliti setjara persoalan demi persoalan seperti tjara2 penawaran mana jang sesuai untuk masing2 projek dan , dalam hal jang chusus , menentukan suatu penawaran
terbatas kepada Republik Federasi Djerman .

ich beziehe mich auf Artikel 6 des am 7. Januar 1972
unterzeichneten Abkommens zwischen der Regierung der
Bundesrepublik Deutschland und der Regierung der Republik
Indonesien Uber Kapitalhilfe, der wie folgt lautet:
"Lieferungen und Leistungen f'Ur Vorhaben, die aus den
Darlehen gemaB Artikel 1 Absatz 3 und 4 bezahlt werden,
sind international offentlich auszuschreiben, soweit
nicht nach Prilfung der einzelnen Vorhaben von Fall zu
Fall etwas Abweichendes festgelegt wird."
Ich beehre mich, Eurer Exzellenz namens der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Bundesregierung befUrwortet im Interesse der Entwicklungslander das Prinzip der Lieferungebundenheit bei der Projekthilfe. Sie hat dies Wiederholt offentlich erklart und durch
die ungebundene Projekthilfe 1970 filr Indonesien bekraftigt.
Sie hat jedoch keinen Zweifel daran gelassen, daB sie
die Ausschreibung filr die Projekthilfe als ein international
allgemein gilltiges Prinzip anstrebe und mit ihrer Aufbindung 1970
einen beispielgebenden ersten Schritt in dieser Richtung habe
tun wollen. In entsprechenden Erklarungen anlaBlich bilateraler
und multilateraler Kontakte hat sich die Bundesregierung
erneut zu diesem Prinzip bekannt und ihrer Hoffnung Ausdruck
verliehen, daB sich andere Geberlander dem deutschen Beispiel
anschlieBen wlirden. Sie hat auch nie einen Zweifel daran

gelassen, daB sie in dieser Frage -insbesondere im Hinblick
auf das indonesische Interesse- das Vorgehen der Ubrigen
Geberlander nicht auBer acht lassen konne. Ausgehend von
diesem grundsatzlichen Standpunkt behlilt sich die
Bundesregierung vor, von Fall zu Fall zu prUfen, welche
Ausschreibungsmodalitaten dem einzelnen Projekt angemessen
sind und im Einzelfall eine auf die Bundesrepublik Deutschland
beschrankte Ausschreibung festzulegen.
Ich bitte Sie, Exzellenz, den Empfang dieses Schreibens zu
bestatigen.

Excellency,
I refer to Articl e 6 of the Agreement signed on 7 January, 1972
between the Government of the Federal Republic of Germany and
the Government of the Republic of Indonesia concerning Financial
Assistance , which reads as follows:
"Supplies and services for projects which shall be
paid from the loans according to paragraphs 3 and
4 of Article 1 shall be subject to international
public bidding , unless otherwise provided in
individual cases after examination of individual
projects ."
To this , I have the honour, Excellency, to state the following
on behalf of the Government of the Federal Republic of Germany :
In the interest of developing countries the Federal Government
supports the principl e of untied supplies in connection with
project aid . It has stated this repeatedly in public and
confirmed it by the untied project aid to Indonesia in 1970.
However, it has left no doubt as to its endeavour to have
bidding under project aid become an internationally valid
princi pl e and that, i n untying its aid in 1970, it wanted to
get an example by taking a first step in this direction. In
corresponding statements on the occasion of bil ateral and
multilateral contacts , the Federal Government has again
acknowledged thi s principle and expressed its hope that other
donor countries would follow suit . It has never left any doubts

that in this matter - particularly in view of the Indonesian
interest - it could not disregard the approach of the other

for the individual project and , in the individual case, to
decide on a bidding l imited to the Federal Republic of Germany .
