AGREEMENT BETWEEN INDONESIA AND PORTUGAL
ON THE ESTABLISHMENT OF INTERESTS SECTIONS
For the purpose of promoting mutual confidence and understanding and to facilitate
mutual exchanges, the Governments of Indonesia and Portugal hereby agree, as of the
date hereof, to the establishment of Interests Sections in their respective capitals which
shall have the following functions, personnel, privileges and immunities on the basis of
full reciprocity:
1.
Each Interests Section shall be headed by a senior diplomatic agent and shall have
a maximum of two additional diplomatic agents.
2.
Each Interests Section may carry out routine diplomatic and consular functions as
set out in the 1961and1963 Vienna Conventions on Diplomatic and Consular
Relations, respectively, and make its own financial transactions.
3.
Each Interests Section shall be able to employ, on a reciprocal basis, a reasonable
number of non-diplomatic support staff.
4.
The Indonesian Interests Section shall be considered to be part of the premises of
the Royal Thai Embassy in Lisbon.
5.
The Portuguese Interests Section shall be considered to be part of the premises of
the Royal Netherlands Embassy in Jakarta.
6.
The premises of each Interests Section shall be inviolable. No official authorities
shall enter either Interests Section without the express consent of the Head of such
Interests Section, without prejudice to the right of the Head of Mission of the
Royal Netherlands Embassy in Jakarta or the Royal Thai Embassy in Lisbon,
respectively, not to admit any such authority to the premises of such Embassy.
7.
Subject to paragraphs 4 and 5 hereto, each Interests Section may be located in
premises either leased or purchased by Indonesia or Portugal, respectively,
including the existing Portuguese building that was formerly the
Embassy/Consulate-General of Portugal in Jakarta.
8.
Diplomatic agents of the Indonesian Interests Section and the Portuguese Interests
Section, respectively, shaU enjoy the same privileges and immunities granted to
diplomatic agents of the Royal Thai Embassy in Lisbon and the Royal Netherlands
Embassy in Jakarta, respectively.

9.
Signs on the exterior of the premises occupied by the Interests Sections shall
indicate respectively: "Royal Netherlands Embassy, Portuguese Interests Section;"
and "Royal Thai Embassy, Indonesian Interests Section." The official stationary
of each Interests Section shall be so lettered with the exception of that used for
internal communications.
10.
Automobiles and other means of transport used by the Interests Sections or their
members shall be licensed in the diplomatic series assigned to the automobiles
belonging to the Royal Netherlands Embassy in Jakarta and the Royal Thai
Embassy in Lisbon, respectively.
11.
No flags or national seals of either country shall be displayed on the outside of the
aforementioned premises or means of transport.
12.
Access by diplomatic agents of the Portuguese Interests Section to officials of the
Ministry of Foreign Affairs of Indonesia and diplomatic agents of the Indonesian
Interests Section to officials of the Ministry of Foreign Affairs of Portugal shall be
at a corresponding level.
13.
Each Interests Section shall have the right of free communication for all official
purposes, using open or encrypted diplomatic mail or communications. Official
correspondence and diplomatic pouches shall be inviolable, in accordance with
international law and practice. Each Interests Section may operate radio satellite
equipment with the consent of the receiving State.
14.
Freedom of movement and travel of diplomatic agents of each Interests Section in
the territory of the receiving State shall be ensured in accordance with the
established international practice for diplomatic agents. Diplomatic agents of the
Portuguese Interests Section shall have the freedom to visit and to travel to and
throughout East Timor without hindrance, taking into account the practice applied
to other diplomatic agents.
15.
The Head of each Interests Section shall rank one level below the rank of Head of
Mission in diplomatic precedence.
16.
The names of the diplomatic agents of each Interests Section will appear in the
Diplomatic List immediately following those of the diplomatic agents of the Royal
Netherlands Government in the case of Portugal and of the Royal Thai
Government in the case of Indonesia.

17.
Both countries reconfirm their commitments under the applicable international
legal instruments governing diplomatic and consular relations to which both are
Parties. Diplomatic agents of each Interests Section and their families shall enjoy
the privileges and immunities provided by those legal instruments.
18.
The Government of Portugal shall obtain the concurrence of the Royal Netherlands
Government and the Government of Indonesia shall obtain the concurrence of the
Royal Thai Government to these arrangements.
19.
Subject to the preceding paragraph, the opening of the Interests Sections shall take
place simultaneously in both capitals prior to 31 January 1999 on a date to be
mutually agreed by the Parties hereto.
