MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE REPUBLIC OF YEMEN
ON
HUMAN RIGHTS COOPERATION

The Government of the Republic of Indonesia and the Government of the Republic of
Yemen hereinafter referred to as the "Parties";
RECOGNIZING the historical and cultural ties that bind the people of the Republic of
Indonesia and the people of the Republic of Yemen;
RECALLING the fruitful visit by the Yemeni Minister of Human Rights to Indonesia
upon the invitation of the Indonesian Minister of Law and Human Rights and the joint
agreement to work together towards strengthening future human rights cooperation
between the two countries;
RECOGNIZING the importance of human rights cooperation for the strengthening· of
bilateral relations between both countries;
DESIRING to continue taking practical steps to enhance each country's
understanding of the other country's human rights systems, including approaches to
strengthen human rights institutions, legislation, and human rights education with a

view to promoting mutual respect;
REFERRING TO the Ah reement between the Government of the Republic of
Indonesia and the Government of the Republic of Yemen on Economic, Trade,
Scientific and Technical Cooperation signed in Sana'a, 24 January 1994;
PURSUANT TO the prevailing laws and regulations in their respective countries;
HAVE AGREED on the following understanding:

Article 1
OBJECTIVES

The Parties will cooperate on issues pertinent to the development of their human
rights system in manner which would mutually benefit both countries, with a view in
particular to:
a. Developing a firm foundation for future relations between the two countries;
b. Promoting greater understanding of each other's human rights promotion and
protection system;

c. Developing a bilateral framework from benefiting each other's technical and
institutional expertise.


Article 2
AREAS OF COOPERATION

a.

Noting the existence of understandings between Indonesia and Yemen, priority
will be given to activities aimed at fostering cooperation in the development of
human rights promotion and protection pertinent to :
1) Human rights institutional development (both governmental and nongovernmental organization);
2) The development and implementation of national plan of action on human
rights;

b.

The Parties may at any time agree to extend the areas of human rights
cooperation covered by this Memorandum.

Article 3
FORMS OF COOPERATION


a.

Forms of human rights cooperation include:
1) The exchange of human rights materials;
2) The exchange of visits between relevant personnel, including officials
academies;
3) Collaboration on education, training, research, development and publication
on human rights between appropriate authorities and institutions;
4) Interaction through meetings, conferences, and symposia; and
5) Facilitation and fostering cooperation between professional bodies,
universities and related civil society organizations.

b.

The Parties may at any time" agree to alter the possible forms of cooperation
covered by this Memorandum .

Article 4
EXECUTING AGENCIES


a. The agencies with responsibility for the implementation of this Memorandum will
be:
1) For the Government of the Republic of Indonesia : the Directorate General of
Human Rights Protection, Department of Law and Human Rights, or its
alternative designate and/or successor; and

2) For the Government of the Republic of Yemen: the Directorate General of
International Cooperation, the Ministry of Human Rights or its alternative
designate and/or successor.
b. In addition to the above mentioned agencies, the Parties may by mutual consent
promote human rights cooperation between other government and nongovernment institutions.

Article 5
WORKING GROUP

a.

The Parties agree to establish a Working Group to facilitate the implementation
of this Memorandum . The Working Group will be co-chaired by the Executing
Agencies and consist of representatives of relevant Governmental Institutions

as well as Civil Societies.

b.

The Working Group shall set down the procedure, plans and recommend
programs of cooperation as well as provide joint Working Reports on Human
Rights cooperation to meetings of the Indonesia-Yemen Joint Ministerial
Commission.

c.

The Working Group shall meet regularly alternatively in Indonesia or Yemen. If it
could not be held due to certain a circumstance, documents shall be exchanged
in lieu of such meeting.

Article 6
FUNDING

a.


The costs of cooperative activities will be funded as mutually determined by the
agencies involved in those activities.

b.

All cooperative activities under this Memorandum will be subject to the
availability of funds.

Article 7
SETTLEMENT OF DIFFERENCES

Differences arising out of the interpretation, operation and implementation of this
Memorandum will be settled amicably through consultation or negotiation between
the Parties.

Article 8
REVIEW AND AMENDMENT
a.

The operation and implementation of this Memorandum wi ll be SLlbject to

periodic review at times arranged between the Parties.

b.

Any written amendment agreed to by the Parties will form part of this
Memorandum and such amendment wi ll come into effect on such a date as may
be determined by the Parties.

Art icle 9
COMMENCEMENT AND TERMINATION
a.

This Memorandum will come into effect on the date of its signing.

b.

This Memorandum will be in force for a period of three years and shall be
autom2tically reviewed to a!lother three years period each , unless either Party
terminates it by giving written notification through diplomatic channel six months
in advance.


c.

The termination of this Memorandum will not prejudice the completion, in
accordance with their terms, of any ongoing projects or activities under this
Memorandum.

IN WITNESS WHEREOF, the undersigned have signed this Memorandum of
Understanding.
SIGNED in duplicate at Yogyakarta on the 101h day of August in the year two
thousand and five in the English language.
