berkeinginan untulc memperkokoh dan mempererat hubungan
persahabatan tersebut denga.n ja.lan bekerjasama secara
bermanf"aat dalam bidang ba.ntuan pembangunan,
menyadari bahwa pemeliharaan hubungan-hubungan tersebut
merupakan dasar persetujuan ini,
berkeinginan untulc membantu pembangunan ekonomi dan
sosiaJ. Republik Indonesia,
telah. menyetujui sebagai berikut :

(1) Pemerin.tab. Republik Federasi Jerman akan memungkinkan
Pemerintah Republik Indonesia, untulc mengadakan
pinjaman-pinjama.n. dari Kreditansta.lt :fur Wiederau.fbau
sampai sejumlah 100.000.000 D.M. (seratus juta D.M.)
untuk proyek-proyek yang akan ditentuka.n oleh kedua
Pemerintab., jika tern.ya.ta proyek-proyek itu dapat dikembangkan.

(2) Proyek-proyek sebagaimana dinyata.kan dalam ayat 1
tersebut diatas dapat digan.ti oleh proyek-proyek lain
atas persetujuan kedua belah pihak.

Penggunaan pinjaman.-pinjaman ini demikian pula persyaratan.persyarata.n atas man.a pinjaman.-pinjaman diberikan akan diatur oleh ketentua.n-ketentuan dalam. persetujuan-persetujuan
yang akan. dibuat antara Pemerintab. Republik Indonesia
dan
Kreditanstalt fur Wiederaufbau serta akan tunduk terhadap
ketentuan-ketentuan hukum yang berlaku di Republik Federasi
Jerman•

f'ur Wiederaufbau dari semua pajak:-pajak dan pungutan-pungu-
tan umum lainnya yang berlaku di Republik Indonesia pada
waktu persetujuan-persetujuan, sebagaimana disebut dalam
pasal. 2 dari persetujuan 1ni dibuat atau selama masa pelaksanaannya.

Mengenai penyediaan barang-barang sehubungan dengan pemberian pinjaman-pinjama.n tersebut, Pemerintab. Republik Federasi
Jerman menganggap penting sekali untuk memberikan. pilihan
pertama kepada hasil-hasil 1ndustri Land Berlin;

Terkecuali ketentuan-ketentuan yang tercantum dalam pasal 4
mengenai pengangkutan udara, Persetujuan ini berlaku pula
untuk Land Berlin dengan ketentuan bahwa Pemerintah Republik
Federasi Jerman tidak memberikan. pernyataan ya;ng berlawana.n
kepada Pemerintah Republik Indonesia dalam jangka. waktu tiga.
bulan setelah persetujuan in.i mulai berlaku.

Persetujuan ini mulai berlaku pada tanggal ditanda tanganinya.
Dibuat di Jakarta ta.nggaJ. duapuluh tujuh Oktober seribu
sembUan ratus tujuhpuluh lima masing-masing ra.ngkap dua
dalam ba.hasa Indonesia, Jerman dan Inggeris, dimana ketiga
naskah mempunyai kekuatan yang sama syahnya.

im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Bundesrepublik Deutschland und der Republik
Indo ne si en ,
in dem Wunsche, diese freundschaftlichen Beziehungen durcb
frucbtbare Zusammenarbei t auf dem Gebiet der mtwicklungshilfe zu festigen und zu vertiefen,
im Bewusstsein, daB die ttufrechterhaltung dieser Beziebungen
die Grundlage die ses Abkommens ist,
in der Absicht, zur wirtscbaftlichen und sozialen Entwicklung der Republik Indonesien beizutragen, sind wie folgt
uoereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicbt
es der Regierung der Republik Ind.onesien, bei der
Kreditanstalt flir Wiederaufbau (Frankfurt am Main) ftir
von beiden Regierungen auszuwahlende Vorhaben, wenn
nach Priliung die ForderungswUrdigkeit festgestellt
worden ist, Darlehen bis zu 100.000.000,- DM
(in Worten: Einhundert Millionen Deutsche Mark) aufzunehmen.
(2) Die gemass Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen den Vertragspartnern durch
andere Vorhaben ersetzt werden.

Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen , zu
denen sie gewahrt werden, bestimmen die zwiscben der
Regierung der Republik Indonesien und der Kreditanstalt
flir Wiederaufbau abzuschlieBenden Vertrage, die den in
der Bundesrepublik Deutschland geltenden Rechtsvorscbriften
unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt flir Wiederaufbau von samtlicben Steuern und sonstigen
offentlichen Abgaben frei, die bei Abscbluss oder Durchfilhrung der in Artikel 2 erwahnten Vertrage in der Republik
Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlasst bei den sich
aus der Darlebensgewahrung ergebenden Transporten von
Personen und. Giltern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternebmen,
trifft keine Massnahmen, welche die gleichberechtigte Betei ligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschliessen oder erschweren*
und erteilt gegebenenfalls die filr eine Beteiligung dieser
Verkehrsunternebmen erforderlicben Genehmigungen.
Artikel 5
Lieferungen und. Leistungen flir Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich
auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen
Wert darauf, dass bei den sich aus der Gewahrung der Darlehen
ergebenden Lieferungen die Erzeugnisse der Industrie des
Landes Berlin bevorzugt berticksichtigt werden .

Artikel 7
Nit ,usnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt die ses Abkommen auch flir das Land
Berlin, sofern nicht die Regierung der Bundesrepublik
Deutschland gegenilber der Regierung der Itepublik Ina.onesien
innernalb von drei Monaten nacb Inkra.fttreten des Abkommens
eine gegenteilige .Brklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in Kraft .
Geschehen zu Jakarta am Z?. Oktober 1975,
in zwei Urschriften, jede in deutscher, indonesischer und
englischer Sprache, wobei jeder Wortlaut verbindlich ist.
Bei unterschiedlicher Auslegung des deutschen und indonesischen Wortlauts ist der engliscbe Wortlaut maBgebend.

The Government of the Republic of Indonesia
and
the Government of the Federal Republic of Germany,
in the spirit of the friendly relations existing between
the Federal Republic of Germany and the Republic of
Indonesia,
desiring to strengthen and intensify those friendly
relations by fruitful co-operation in the field of
development assistance,
aware that the maintenance of those relations constitutes
the basis of the present Agreement,
intending to contribute to economic and social development
in the Republic of Indonesia,
have agreed as follows:
Article 1
(1) The Government of the Federal Republic of Germany
shall enable the Government of the Republic of
Indonesia to raise with the Kredi tanstalt fi.ir
Wiederaufbau (Development Loan Corporation),
Frankfurt/Main,loans up to a total of DM 100.000.000
(one hundred million German Marks) for projects to be
determined by both Governments if they have been
found eligible for promotion.
(2) The projects referred to in paragraph 1 above may
be replaced by other projects if the Contracting
Parties so agree.

Article 2
The utilization of the loans as well as the terms and
conditions on which they are granted shall be governed
by the provisions of the agreements to be concluded
between the Government of the Republic of Indonesia and
the Kredi tanstal t ftir Wiederaufbau, which shall be
subject to the laws and regulations applicable in the
Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt
the Kredi tanstal t ftir Wiederaufbau from all taxes and
other public charges levied in the Republic of Indonesia
at the time of the conclusion, or during the implementation, of the agreements referred to in Article 2 of the
present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow
passengers and suppliers free choice of transport enterprises for such transportation by land, sea or air of
persons and goods as results from the granting of the
loans, abstain from taking any measures that might
exclude or impair the fair and equal participation of
transport enterprises having their place of business
in the German area of application of the present Agreement, and grant permits for such participation as required.
Article 5
Supplies and services for projects financed from the
loans shall, unless otherwise provided for in individual
cases, be subject to international public tender.

Article 6
With regard to supplies resulting from the granting of
tbe loans, the Government of the Federal Republic of
Germany attaches particular importance to preference
being given to products of industries of Land Berlin.
Article 7
With the exception of those provisions of Article 4
which refer to air transport, this Agreement shall also
apply to Land Berlin, provided that t he Government of
the Federal Republic of Germany does not make a contrary
declaration to the Government of the Republic of Indonesia
wi tbin three months of the date of entry into force of
t his Agreement.
Article 8
The present Agreement shall enter into force on the date
of signature thereof.
Done at Jakarta on October 27, 1975 ,
in duplicate in the German, Indonesian and English
languages, all three texts being auth entic. In case of
divergent interpretation of t he German and Indonesian
texts, t he English text sh all prevail.

With regard to the foregoing, I have the honour to state
the following on behalf of the Government of the Federal
Kepublic of Germany:
In the interest of developing countries, the Government of
the Federal Republic of Germany supports the principle of
untied supplies in connexion with financial assistance . It
has stated this repeatedly in public and confirmed it by
the untied project aid it has granted to Indonesia since
1970. Likewise in 1975, German financial assistance is not
tied to supplies and services from the Federal Republic of
Germany.
The Government of the Federal Republic of Germany has left
no doubt that it would like to see tendering under project
aid become an internationally valid principle and that, in
untying its aid in 1970, it wanted to set an example by
taking a first step in this direction.

In statements on the occasion of bilateral and multilateral contacts, the Government of the Federal Republic
of Germany has upheld this principle and expressed its
hope that other donor countries would follow suit . It
has never left any doubt that in this matter, especially
in view of the Indonesian interest, it could not disregard
the approach of the other donor countries. Starting from
this fundamental position, the Government of the Federal
Republic of Germany reserves the right to examine what
tender modalities are appropriate for each individual
project and, if it seems necessary on substantive grounds,
to limit tendering to the Federal Republic of Germany.
I would be grateful if Your Excellency would confirm
your Government's agreement to the foregoing .

und Leistungen aus der Bundesrepublik Deutschland gebunden .

zwischen der Bundesrepublik Deutschland und der Republik

in dem Wunsche, diese freundschaftlichen Beziehungen durcb
frucbtbare Zusammenarbei t auf dem Gebiet der mtwicklungshilfe zu festigen und zu vertiefen,
im Bewusstsein, daB die ttufrechterhaltung dieser Beziebungen
die Grundlage die ses Abkommens ist,
in der Absicht, zur wirtscbaftlichen und sozialen Entwicklung der Republik Indonesien beizutragen, sind wie folgt
uoereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicbt
es der Regierung der Republik Ind.onesien, bei der
Kreditanstalt flir Wiederaufbau (Frankfurt am Main) ftir
von beiden Regierungen auszuwahlende Vorhaben, wenn
nach Priliung die ForderungswUrdigkeit festgestellt
worden ist, Darlehen bis zu 100.000.000,- DM
(in Worten: Einhundert Millionen Deutsche Mark) aufzunehmen.
(2) Die gemass Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen den Vertragspartnern durch
andere Vorhaben ersetzt werden.

Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen , zu
denen sie gewahrt werden, bestimmen die zwiscben der
Regierung der Republik Indonesien und der Kreditanstalt
flir Wiederaufbau abzuschlieBenden Vertrage, die den in
der Bundesrepublik Deutschland geltenden Rechtsvorscbriften
unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt flir Wiederaufbau von samtlicben Steuern und sonstigen
offentlichen Abgaben frei, die bei Abscbluss oder Durchfilhrung der in Artikel 2 erwahnten Vertrage in der Republik
Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlasst bei den sich
aus der Darlebensgewahrung ergebenden Transporten von
Personen und. Giltern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternebmen,
trifft keine Massnahmen, welche die gleichberechtigte Betei ligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschliessen oder erschweren*
und erteilt gegebenenfalls die filr eine Beteiligung dieser
Verkehrsunternebmen erforderlicben Genehmigungen.
Artikel 5
Lieferungen und. Leistungen flir Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich
auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen
Wert darauf, dass bei den sich aus der Gewahrung der Darlehen
ergebenden Lieferungen die Erzeugnisse der Industrie des
Landes Berlin bevorzugt berticksichtigt werden .

Artikel 7
Nit ,usnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt die ses Abkommen auch flir das Land
Berlin, sofern nicht die Regierung der Bundesrepublik
Deutschland gegenilber der Regierung der Itepublik Ina.onesien
innernalb von drei Monaten nacb Inkra.fttreten des Abkommens
eine gegenteilige .Brklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in Kraft .
Geschehen zu Jakarta am Z?. Oktober 1975,
in zwei Urschriften, jede in deutscher, indonesischer und
englischer Sprache, wobei jeder Wortlaut verbindlich ist.
Bei unterschiedlicher Auslegung des deutschen und indonesischen Wortlauts ist der engliscbe Wortlaut maBgebend.

The Government of the Republic of Indonesia
and
the Government of the Federal Republic of Germany,
in the spirit of the friendly relations existing between
the Federal Republic of Germany and the Republic of
Indonesia,
desiring to strengthen and intensify those friendly
relations by fruitful co-operation in the field of
development assistance,
aware that the maintenance of those relations constitutes
the basis of the present Agreement,
intending to contribute to economic and social development
in the Republic of Indonesia,
have agreed as follows:
Article 1
(1) The Government of the Federal Republic of Germany
shall enable the Government of the Republic of
Indonesia to raise with the Kredi tanstalt fi.ir
Wiederaufbau (Development Loan Corporation),
Frankfurt/Main,loans up to a total of DM 100.000.000
(one hundred million German Marks) for projects to be
determined by both Governments if they have been
found eligible for promotion.
(2) The projects referred to in paragraph 1 above may
be replaced by other projects if the Contracting
Parties so agree.

Article 2
The utilization of the loans as well as the terms and
conditions on which they are granted shall be governed
by the provisions of the agreements to be concluded
between the Government of the Republic of Indonesia and
the Kredi tanstal t ftir Wiederaufbau, which shall be
subject to the laws and regulations applicable in the
Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt
the Kredi tanstal t ftir Wiederaufbau from all taxes and
other public charges levied in the Republic of Indonesia
at the time of the conclusion, or during the implementation, of the agreements referred to in Article 2 of the
present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow
passengers and suppliers free choice of transport enterprises for such transportation by land, sea or air of
persons and goods as results from the granting of the
loans, abstain from taking any measures that might
exclude or impair the fair and equal participation of
transport enterprises having their place of business
in the German area of application of the present Agreement, and grant permits for such participation as required.
Article 5
Supplies and services for projects financed from the
loans shall, unless otherwise provided for in individual
cases, be subject to international public tender.

Article 6
With regard to supplies resulting from the granting of
tbe loans, the Government of the Federal Republic of
Germany attaches particular importance to preference
being given to products of industries of Land Berlin.
Article 7
With the exception of those provisions of Article 4
which refer to air transport, this Agreement shall also
apply to Land Berlin, provided that t he Government of
the Federal Republic of Germany does not make a contrary
declaration to the Government of the Republic of Indonesia
wi tbin three months of the date of entry into force of
t his Agreement.
Article 8
The present Agreement shall enter into force on the date
of signature thereof.
Done at Jakarta on October 27, 1975 ,

languages, all three texts being auth entic. In case of
divergent interpretation of t he German and Indonesian

In the interest of developing countries, the Government of
the Federal Republic of Germany supports the principle of
untied supplies in connexion with financial assistance . It
has stated this repeatedly in public and confirmed it by
the untied project aid it has granted to Indonesia since
1970. Likewise in 1975, German financial assistance is not
tied to supplies and services from the Federal Republic of
Germany.
The Government of the Federal Republic of Germany has left
no doubt that it would like to see tendering under project
aid become an internationally valid principle and that, in
untying its aid in 1970, it wanted to set an example by
taking a first step in this direction.

The Government of the Federal Republic of Germany has left no
doubt that it would like to see tendering under project aid
become an internationally valid p=inciple and that, in untying
its aid in 1970, 1 t wanted to set an example by taking a firs"t
step in this direction.
In statements on the occasion of bilateral and multilateral
contaots, the Government of the Federal Republic of Germany
has upheld this principle end expressed its hope that other
donor countries would follow suit. It has never left any doubt
that in thia matter, especially in view of the Indonesian

it could not disregard the approach of the other
donor countries. Starting from this fundamental position. the
Government of the Federal Republic of Germany reserves the
right to examine what tender modalities are appropriate for
each individual project and, if it seems necessary on
substantive grounds, to limit tendering to the Federal Republic
of Germany.
