Excellency,
I have the honour to acknowledge the receipt of Your
Excellency's Note of today's date, which reads as follows:
"I have the honour to refer to the "Contract for
Loan of Japanese Government's Rice between the Food
Agency, Ministry of Agriculture, Forestry and
Fisheries of Japan and the National Logistics Agency
of the Republic of Indonesia" (hereinafter referred to
as "the Contract") signed on June 23, 1998, in Tokyo.
The Contract was concluded at the request of the
Government of the Republic of Indonesia for Japanese
cooperation in relieving the shortage of food supply
in the Republic of Indonesia, which has become serious
with the recent drought and the financial and economic
crisis.
The Contract provides, inter alia, for the
following:
(a)
The Food Agency, Ministry of Agriculture,
Forestry and Fisheries of Japan (hereinafter
referred to as "the Lender") shall loan to the
Nati onal Logistics Agency of the Republic of
Indonesia (hereinafter referred to as "the
Borrower") a total of five hundred thousand
(500,000) metric tons net of Japanese
Government's rice which consists of three hundred
thousand (300 ,000 ) metric tons net of Japanese
non-glutinous brown rice and two hundred thousand
(200 ,000 ) metric tons net brown rice worth of
imported non - glutinous brown rice, milled rice
and others;
(b)
The Borrower shall return to the Lender each
year during the period from 2009 to 2028
twenty-five thousand (25,000 ) metric tons net of
Indonesian non-glutinous brown rice;

(c)
By way of charges, the Borrower shall:
(i)
(ii)
supply to the Lender ten thousand
(10 , 000) metric tons net of Indonesian
non-glutinous brown rice each year
during the period from 1999 to 2008;
supply to the Lender each year during
the period from 2009 to 2028 a quantity
of Indonesian non-glutinous brown rice
corresponding to three (3) per cent of
the balance of the rice for return
carried forward as of December 31 of
the year prior the respective year;
(d)
Rice for loan shall be transferred at
warehouses at Japanese ports, while rice for
return shall be delivered on the basis of C.I.F.
at the Japanese ports that shall be designated by
the Lender each year;
(e)
The Borrower shall use the loaned rice not
for export but only for domestic civil
consumption in the Republic of Indonesia.
I wish to inform Your Excellency that the
Government of the Republic of Indonesia is highly
satisfied with the conclusion of the Contract and to
confirm on behalf of the Government of the Republic of
Indonesia the following understanding relating to the
Contract:
1.
The two Governments will, within the scope of
laws and regulations in force in their respective
countries , facilitate smooth and timely implementation
of the Contract and take necessary measures to this
end .
2.
The two Governments recognize that the principle
to avoid harmful interference with normal patterns of
production and international cormnercial trade should
govern the loan of Japanese Government ' s rice under
the Contract . The Government of the Republic of
Indonesia will , therefore, in due consultation with
the Government of Japan, take all appropriate measures
for the observance of the said principle in connection
with the loan of the said Japanese Government ' s rice.
3.
Nationals of the Republic of Indonesia and of
Japan will be granted, within the scope of laws and
regulations in force in the other country, facilities
necessary for entry into and stay in such other
country for the purpose of activities related to the
export and import of rice under the Contract.
4.
The two Governments will consult with each other
on any problems that may arise out of this
understanding or in connection therewith.
I should be grateful if Your Excellency would
confirm on behalf of the Government of Japan that this
is also the understanding of the Government of Japan . "
I have further the honour to confirm on behalf of the
Government of Japan that the foregoing is also the
understanding of the Government of Japan .
