Dear Mr. Koentarso,
I have the honour to refer to the Loan Agreement signed on
the 27th day of March, 1986 between the Government of Canada and
the Government of Indonesia, as amended June 1, 1987, with respect to
the Nusa Tenggara Timur Water Resources Development Project.
As certain modifications have been agreed upon concerning
the construction of housing and in relation to procurement and
payment procedures referred to in Annexes 'A' and 'B' respectively of

the said Loan Agreement, I have the honour to propose the following
amendments to those Annexes :

1.

Sub-section 1.1, and 1.3 of Annex 'A' of the Loan Agreement arc
deleted and the following substituted therefore:
"1.1

The full rupiah (local) cost for the remaining or as yet
unfinanced, portions of the construction works of the
necessary office space and office buildings required in
Kupang for the Water Resources Development Services
(WRDS) and the construction and equipping of houses in
Kupang or elsewhere provided that such costs shall not
exceed the rupiah equivalent of five hundred thousand
Canadian dollars (Cdn. $ 500,000) and shall be exclusive of
any taxes and VAT.

Up to one hundred (100) percent of the costs of eligible
equipment, spare parts and technical support for the
commissioning of the equipment, to a maximum of one
million, seven hundred and ninety-six thousand Canadian
dollars (Canadian $ 1,796,000.00), for equipment and spare
parts required for the project."

Section 1.2 of Annex A of the Loan Agreement is amended as
hereinafter.
Delete ..... "seven million five hundred and seventy nine thousand
Canadian dollars (Canadian $ 7,579,000).
Substitute therefore ..... "seven million four hundred
thousand Canadian dollars (Canadian$ 7,404,000)".

Sections 3.0 to 3.4 inclusive of Annex 'B' of the said Loan
Agreement are deleted and the following substituted therefore:
"3.0

Payment Procedures for Indonesia Sourced Equipment.
Construction Services and Materials

3.1

A "Special Account" will be opened by the Directorate
General of Budget and established at Bank Indonesia (B. 1.).
The "Special Account" shall be established in rupiah and
shall be non-interest bearing.

"Special Account", the Directorate General of Budget will
submit an initial request to the Canadian Embassy for a
monthly deposit to the "Special Account" utilizing the first
three month's forecasted expenditure for construction and
spares procurement covering Canada's share of the

outstanding advances to the "Special Account" under this

1.0 million and individual advances may not exceed an
amount equivalent to Cdn $ 500,000.

3.2

Payments for spare parts and construction services will be

effected through the afore-mentioned "Special Account".
Invoices
origmating from
suppliers and
construction
contractors will be sent to the Project Manager or DGWRD
for review and approval according to the regulation
established by GOI.
Invoices will be cosigned by the
Canadian Executing Agency (CEA) before processing and
shall clearly indicate Canada's and GOl's portion of the
payment.
The Project Manager will submit a S.P.P.
(Payment Request) from the Special Account in accordance
with the process outlined in the joint BAPPENAS/Budget
Affairs directive No. S-30/N1987/1678/D.IV/4/1987 dated
April 28, 1987.

3.3

The Directorate General of Budget will submit evidence of
detailed drawdown thereof to the Canadian Embassy on a
monthly or more frequent basis.
On the basis of the
evidence and Embassy of Canada's analysis, the Embassy will
issue a cheque in favour of the Director General of Budget,
Department of Finance for deposit to the "Special Account"
to cover the next months expected expenditures.

4.

Sections 4.0 to 4.5 inclusive of Annex 'B' of the said Loan
Agreement are deleted.


Except as otherwise provided herein, the Loan Agreement dated
the 27th of March, 1986 as amended June 1, 1987, shall remain in
full force and effect.
If the foregoing amendments to Annexes 'A' and 'B' of the said

Loan Agreement are acceptable to the Government of Indonesia,

amendment shall become effective from the date of
your affumative reply, and this letter together with your letter in
reply, shall constitute an amending Agreement between the two
Governments.
