MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
(IN ITS CAPACITY AS ONE OF THE FIVE MEMBERS OF ASEAN)
AND
THE GOVERNMENT OF AUSTRALIA
CONCERNING
SPECIAL EDUCATION SUB- PROJECT OF
THE ASEAN DEVELOPMENT EDUCATION PROJECT (ADEP)

The Gove rnment of the Republic of Indonesia , and the

Government of Australia;
Desiri ng to promote the friendly relations between ASEAN

and the Government of Australia and having re gard to the
fact that the strengthening of cooperation in the field
of education will further that objective

For the purpose of this Memorandum of

1.

"ADAB" shall mean the Australian Development Assistance

Bureau ;
2.

"ADEP " shall mean the ASEAN Deve lopment Education
Project ;

"ASEAN I! shall mean the Association of Southeast Asian
Nations;

4.

"Funds" shall mean money provided by the Australian
Government in the form of accountab Ie cash grants to

ASEAN Government under ASEAN - Australia Cooperat ion
Program in the field of development education;

5.

The Government of the Republic of Indonesia shall
mean the Department of Education and Culture ;

6.

"NADEC II shall mean the National Development Education

Center of Indonesia;
7.


" ReG " shall mean the ASEAN Regional Coordinating Com-

mittee;
8.

"Sub-Proj ect" shall mean the sub - proj ect on Special

Education of the ADEP.
ARTICLE

AUTHORITIES

1.

The Government of the Republic of Indonesia
hereinafter refered to as Indonesian Government shall
designate NADEC as the agent for the Sub - Project and


the Governme nt of Aus tralia shall designate ADAB as
its executing agent for the Sub - Project .
2.

Each Party may nominate suitable qualified agents by
mutual consent to undertake any part of its functions
on its behalf.

3.

Arrangement for the transfer of funds from Australia
to the Indonesian Government in accordance with
requirements determined by the

Ree , shall be agreed

upon by Australian Government and the Indonesian
Government .

ARRANGEMENT

1.

To assist the Indonesian Government in implementing
the Sub - Project, the Australian Government at the
request of the

Ree will provide funds to Department

of Education and Culture .

The funds will be provided to Department of Education
and Culture in advance, and on annual basis the funds


will be used for the following items associated with
the Sub - Proj ect which have been assessed and aproved
by the RGG :

Staff salaries and allowances

2.2.

Economy class fares and per diems for

international travel
2 . 3.

Domestic cost of travel , per diems , etc .

2.4 .

Books and journals


2.5.

Hire of room and other essential expenditures
fo r the Sub - Proj ect workshop , meetings , confer-

ences , seminars and other activi t ies

Publication of reports and other relevant
materials

Other expenditures approved by t he Rec

The cost of trai ning in Aust r a l ia may be paid by ADAB
from the Sub - Project budget .


4.

The Department of Education a n d Cul ture will establish
an identifiable bank account int o which the funds will
be paid by the Austra lian Mission in Indonesia .

5.

The NADEC will submit to the RCC financia l statements
duly 1 July to 31 December and 1 January to 30 June
each year and as otherwise requested from time to time
by the RGG .

Such financia l stat ements wi ll i n clude sub - totals of expen -

diture on the following items

: salaries , eqUipme n t

training , miscellaneous and contingency funds .
The acceptance by the RCC of the audited or certifi ed
statements will constitute an receptance of such statement
by the Australian Government .

The NADEC will return to the Australian Mission in

Indonesia any unexpended balance of funds on completion of the Sub - Project , which will be determined

by the ReC in consultation with ADAB.

The NADEC will be responsible for the Administrative

arrangements required for carrying out all activities
for which funds are paid by the Australian Government

and which are set out in paras 2 and 3 above .

TENDERING AND PROCUREMENT
1.

The agencies nominated by the NADEC will prepare

specifications for equipment to be purchased for ADEP
and issue purchase orders .

Thes e prosedures will be

in accordance with agencies purchasing regulations
in the respective ASEAN country .
2.

As far as possible preference will be given to
suppliers of equipment manufactured in one of the
ASEAN country in Australia .

ARTICLE
1.

The Indonesian Government will , in accordance wi th
the existing laws and regulations, exempt from import
duties and other taxes (or pay such duties thereon)
all good imported for the Proj ect.

2.

Assest purchased for the ADEP with funds provided by
Australia will become the property of the RCC or such
other body determined by the ReC .

ARTICLE 6
FINAL CLAUSES
Amendments to this Memorandum may be made at the request
of the RCG , or the Australian Government by Exchange of
Letters between the signatories .

Any dispute arising out of the interpretation or imple mentation of this Memorandum shall be settled amicably

by consultation or negotiation.

ARTICLE

8

This Memorandum shall take effect on the date of its
signature and shall remain effective for a period of 3

years . It may be extended or terminated by mutual
consent .
In witness whereof J the undersigned being duly authorized
by their respective Government , have signed th i s Memorandum .
