dan Republik Federasi Jerman,
berkeinginan untuk memperkokoh dan mempererat hubungan persahabatan
tersebut dengan jalan bekerjasama secara bermanfaat dalam bidang bantuan
pembangunan,
menyadari bahwa pemeliharaan hubungan - hubungan tersebut merupakan
dasar persetujuan ini,

berkeinginan untuk membantu pembangunan ekonomi dan sosial Republik
Indonesia,
telah menyetujui sebagai berikut

(1) Pemerintah Republik Federasi Jerman akan memungkinkan Pemerintah
Republik Indonesia, untuk mengadakan pinjaman-pinjaman dari Kreditanstalt fur Wiederaufbau sampai sejumlah 100.000.000 D.M. (seratus juta
D.M.) untuk proyek-proyek yang akan ditentukan oleh kedua Pemerintah,
jika ternyata proyek-proyek itu dapat dikembangkan.
(2) Proyek-proyek sebagaimana dinyatakan dalam ayat 1 tersebut diatas
dapat diganti oleh proyek-proyek lain atas persetujuan kedua belah
pihak.

Penggunaan pinjaman-pinjaman ini demikian pula persyaratan-persyaratan atas mana peminjam-peminjam diberikan akan diatur oleh ketentuanketentuan dalam persetujuan-persetujuan yang akan dibuat antara Pemerintah Republik Indonesia dan Kreditanstalt fur Wiederaufbau serta
akan tunduk terhadap ketentuan-ketentuan hukum yang berlaku di Republ ik Federasi Jerman.

Pemerintah Republik Indonesia akan membebaskan Kreditanstalt fur
Wiederaufbau dari semua pajak-pajak dan pungutan-pungutan umum lainnya
yang berlaku di Republik Indonesia pada waktu persetujuan-persetujuan,
sebagaimana disebut dalam pasal 2 dari persetujuan ini dibuat atau
selama masa pelaksanaannya.

Pemerintah Republik Indonesia akan mengizinkan penumpang-penumpang
dan supplier-supplier untuk secara bebas memilih perusahaan-perusahaan
pengangkutan darat, laut ataupun udara yang digunakan untuk mengangkut
orang-orang atau barang-barang dalam rangka pinjaman ini dan tidak
akan mengambil tindakan-tindakan untuk menolak atau mempersulit ikut
sertanya secara wajar dan adil
perusahaan-perusahaan pengangkutan

yang berkedudukan diwilayah Jerman dalam persetujuan ini, dan memberikan izin-izin yang diperlukan dalam mengikut sertakan perusahaan-perusahaan itu.

Penyediaan barang-barang dan jasa-jasa untuk proyek-proyek yang dibiayai
dari pinjaman-pinjaman tersebut akan diadakan atas dasar penawaran
umum internasional, kecuali jika ditentukan lain dalam hal-hal tertentu.

Mengenai penyediaan barang-barang sehubungan dengan pemberian pinjamanpinjaman tersebut, Pemerintah Republik Federasi Jerman menganggap
penting sekali untuk memberikan pilihan pertama kepada hasil-hasil industri Land Berlin.

Terkecuali ketentuan- ketentuan yang tercantum dal am pasal 4 mengenai
pengangkutan udara, Persetujuan ini berlaku pula untuk Land Berlin
dengan ketentuan bahwa Pemerintah Republik Federasi Jerman tidak memberikan pernyataan yang berlawanan kepada Pemerintah Republik Indonesia dalam jangka waktu tiga bulan setelah persetujuan ini mulai
laku.

Persetujuan ini mulai berlaku pada tanggal ditanda tanganinya.
Dibuat di Jakarta tanggal enam belas September seribu sembilan ratus
tujuh puluh enam masing-masing rangka dua dalam bahasa Indonesia,
Jerman dan Inggris, dimana ketiga naskah mempunyai kekuatan yang
sama syahnya.
Dalam hal penafsiran terhadap naskah Jerman dan Indonesia berbeda,
maka naskah Inggrislah yang menentukan.

Uber Kapitalhilfe

Die Regierung der Republik Indonesien
und
die Regierung der Bundesrepublik Deutschland,
im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
in dem Wunsche, diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen
die Grundlage dieses Abkommens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung
der Republik Indonesien beizutragen,
sind wie folgt Ubereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicht
es der Regierung der Republik Indonesien, bei der Kreditanstalt flir Wiederaufbau, Frankfurt am Main, flir von
beiden Regierungen auszuwahlende Vorhaben, wenn nach
Prlifung die Forderungswtirdigkeit festgestellt worden ist,
Darlehen bis zu insgesamt 100.000.000,-- DM (in Worten:
Einhundert Millionen Deutsche Mark) aufzunehmen.
(2) Die gemaB Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen den Vertragspartnern durch andere
Vorhaben ersetzt werden.

Artikel 2

Die Verwendung dieser Darlehen sowie die Bedingungen, zu
denen sie gewahrt werden, bestimmen die zwischen der
Regierung der Republik Indonesien und der Kreditanstalt
ftir Wiederaufbau abzuschlieBenden Vertrage, die den in der
Bundesrepublik Deutschland geltenden Rechtsvorschriften
unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt ftir Wiederaufbau von samtlichen Steuern und sonstigen
offentlichen Abgaben frei, die bei AbschluB oder Durchfilhrung der in Artikel 2 erwa.hnten Vertrage in der Republik
Indonesian erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlaBt bei den sich 1
aus der Darlehensgewahrung ergebenden Transporten von Personen und Giltern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternehmen,
trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschlieBen oder erschweren,
und erteilt gegebenenfalls die ftir eine Beteiligung dieser
Verkehrsunternehmen erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen ftir Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich auszuschrei ben, soweit nicht im Einzelfall etwas Abweichendes
festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung
der Darlehen ergebenden Lieferungen die Erzeugnisse der
Industrie des Landes Berlin bevorzugt berlicksichtigt werden.

Artikel 7
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt dieses Abkommen auch flir das Land
Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland der Regierung der Republik Indonesien innerhalb von
drei Monaten nach Inkrafttreten des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in Kraft.
Geschehen in Jakarta am 16. September 1976
in zwei Unterschriften, jede in deutscher, indonesischer und
englischer Sprache, wobei jeder Wortlaut verbindlich ist. Bei
unterschiedlicher Auslegung des deutschen und des indonesischen Wortlauts ist der englische Wortlaut maBgebend.

concerning Financial Assistance

The Government of the Republic of Indonesia
and
the Government of the Federal Republic of Germany
in the spirit of the friendly relations existing between the
I
Republic of Indonesia and the Federal Republic of Germany,
desiring to strengthen and intensify those friendly relations
by fruitful cooperation in the field of development assistance,
aware that the maintenance of these relations constitutes the
basis of the present Agreement,
I
intending to contribute to the economic and social development
in the Republic of Indonesia,
have agreed as follows:
Article l
(1) The Government of the Federal Republic of Germany
shall enable the Government of the Republic of
Indonesia to raise with the Kreditanstalt ftir
Wiederaufbau (Development Loan Corporation),
Frankfurt/Main, loans up to a total of DM 100.000.000
(one hundred million German Marks) for projects to
be determined by both Governments if they have been
found eligible for promotion.
(2) The projects referred to in paragraph 1 above may
be replaced by other projects if the Contracting
Parties so agree.

Article 2
The utilization of the loans as well as the terms and
conditions on which they are granted shall be governed
by the provisions of the agreements to be concluded
between the Government of the Republic of Indonesia and
the Kreditanstalt ftir Wiederaufbau which shall be
subject to the laws and regulations applicable in the
Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt
the Kreditanstalt flir Wiederaufbau from all taxes and
other public charges levied in the Republic of Indonesia
at the time of the conclusion, or during the implementation, of the agreements referred to in Article 2 of the
present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow
passangers and suppliers free choice of transport enterprises for such transportation by land, sea or air of
persons and goods as results from the granting of the
loans, abstain from taking any measures that might
exclude or impair the fair and equal participation of
transport enterprises having their place of business
in the German area of application of the present Agreement, and grant permits for such participation as required.
Article 5
Supplies and services for projects financed from the
loans shall, unless otherwise provided for in individual
cases, be subject to international public tender.

Article 6
With regard to supplies resulting from the granting of
the loans, the Government of the Federal Republic of Germany
attaches particular importance to preference being given
to products of industries of Land Berlin.
Article 7
With the exception of those provisions of Article 4 which
refer to air transport, this Agreement shall also apply to
Land Berlin, provided that the Government of the Federal
Republic of Germany does not make a contrary declaration
to the Government of the Republic of Indonesia within three
months of the date of entry into force of this Agreement.
Article 8
The present Agreement shall enter into force on the date
of signature thereof.
Done at Jakarta on September 16, 1976
in duplicate in the German, Indonesian and English languages,
all three texts being authentic. In case of divergent interpretation of the German and Indonesian texts, the English
text shall prevail.

unterzeichneten Abkommens zwischen der Regierung der Bundesrepublik Deutschland und der Regierung der Republik Indonesien
Uber Kapitalhilfe, der wie folgt lautet:
"Lieferungen und Leistungen fiir Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich
auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes
festgelegt wird."
Ich beehre mich, Eurer Exzellenz im Namen der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Regierung der Bundesrepublik Deutschland befilrwortet im
Interesse der Entwicklungslander das Prinzip der Lieferungebundenhei t bei der Kapitalhilfe. Sie hat dies wiederholt offentlich
erklart und durch die Aufbindung der Projekthilfe flir Indonesien
seit 1970 bekraftigt. Auch 1976 ist die deutsche Kapitalhilfe nicht
an Lieferungen und Leistungen aus der Bundesrepublik Deutschland
gebunden.
Die Regierung der Bundesrepublik Deutschland hat keinen Zweifel
daran gelassen, daB sie die internationale offentliche Ausschreibung
der Lieferungen und Leistungen als ein weltweit gliltiges Prinzip
anstrebe und mit ihrer Aufbindung 1970 einen beispielgebenden
ersten Schritt in dieser Richtung habe tun wollen.

In entsprechenden Erklarungen anlaBlich bilateraler und
multilateraler Kontakte hat sich die Regierung der Bundesrepublik Deutschland zu diesem Prinzip bekannt und ihrer
Hoffnung Ausdruck verliehen, daB sich andere Geberlander dem
deutschen Beispiel anschlieBen wUrden. Sie hat auch nie einen
Zweifel daran gelassen, daB sie in dieser Frage - insbesondere
im Hinblick auf das indonesische Interesse - das Vorgehen der
librigen Geberlander nicht auBer acht lassen konne. Ausgehend
von diesem grundsatzlichen Standpunkt behalt sich die Regierung
der Bundesrepublik Deutschland vor, von Fall zu Fall zu prlifen,
welche Ausschreibungsmodalitaten dem einzelnen Projekt angemessen sind und, soweit dies sachlich geboten erscheint, im
Einzelfall eine auf die Bundesrepublik Deutschland beschrankte
Ausschreibung festzulegen.

obigen Ausflihrungen bestatigen zu wollen.

to supplies and services from the Federal Republic of
Germany.
The Government of the Federal Republic of Germany has left
no doubt that it would like to see tendering under project
aid become an internationally valid principle and that, in
untying its aid in 1970, it wanted to set an example by
taking a first step in this direction.

of Germany has upheld this principle and expressed its
hope that other donor countries would follow suit. It
has never left any doubt that in this matter, especially
in view of the Indonesian interest, it could not disregard
the approach of the other donor countries. Starting from
this fundamental position, the Government of the Federal
Republic of Germany reserves the right to examine what
tender modalities are appropriate for each individual
project and, if it seems necessary on substantive grounds,
to limit tendering to the Federal Republic of Germany.

barang-barang dan jasa-jasa dari Republik Federasi Jerman.
Pemerintah Republik Federasi Jerman tidak ragu-ragu lagi untuk
ingin melihat bahwa prinsip penyediaan barang-barang dan jasa-jasa secara penawaran umum internasional diterima baik diseluruh dunia, dan dengan pemberian

Penggunaan pinjaman-pinjaman ini demikian pula persyaratan-persyaratan atas mana peminjam-peminjam diberikan akan diatur oleh ketentuanketentuan dalam persetujuan-persetujuan yang akan dibuat antara Pemerintah Republik Indonesia dan Kreditanstalt fur Wiederaufbau serta
akan tunduk terhadap ketentuan-ketentuan hukum yang berlaku di Republ ik Federasi Jerman.

Pemerintah Republik Indonesia akan membebaskan Kreditanstalt fur
Wiederaufbau dari semua pajak-pajak dan pungutan-pungutan umum lainnya
yang berlaku di Republik Indonesia pada waktu persetujuan-persetujuan,
sebagaimana disebut dalam pasal 2 dari persetujuan ini dibuat atau
selama masa pelaksanaannya.

Pemerintah Republik Indonesia akan mengizinkan penumpang-penumpang
dan supplier-supplier untuk secara bebas memilih perusahaan-perusahaan
pengangkutan darat, laut ataupun udara yang digunakan untuk mengangkut
orang-orang atau barang-barang dalam rangka pinjaman ini dan tidak
akan mengambil tindakan-tindakan untuk menolak atau mempersulit ikut
sertanya secara wajar dan adil

Penyediaan barang-barang dan jasa-jasa untuk proyek-proyek yang dibiayai
dari pinjaman-pinjaman tersebut akan diadakan atas dasar penawaran
umum internasional, kecuali jika ditentukan lain dalam hal-hal tertentu.

Mengenai penyediaan barang-barang sehubungan dengan pemberian pinjamanpinjaman tersebut, Pemerintah Republik Federasi Jerman menganggap
penting sekali untuk memberikan pilihan pertama kepada hasil-hasil industri Land Berlin.

Terkecuali ketentuan- ketentuan yang tercantum dal am pasal 4 mengenai
pengangkutan udara, Persetujuan ini berlaku pula untuk Land Berlin
dengan ketentuan bahwa Pemerintah Republik Federasi Jerman tidak memberikan pernyataan yang berlawanan kepada Pemerintah Republik Indonesia dalam jangka waktu tiga bulan setelah persetujuan ini mulai

Dibuat di Jakarta tanggal enam belas September seribu sembilan ratus

sama syahnya.
Dalam hal penafsiran terhadap naskah Jerman dan Indonesia berbeda,
maka naskah Inggrislah yang menentukan.

Die Regierung der Republik Indonesien
und
die Regierung der Bundesrepublik Deutschland,
im Geiste der bestehenden freundschaftlichen Beziehungen
zwischen der Republik Indonesien und der Bundesrepublik
Deutschland,
in dem Wunsche, diese freundschaftlichen Beziehungen durch
fruchtbare Zusammenarbeit auf dem Gebiet der Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen
die Grundlage dieses Abkommens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung
der Republik Indonesien beizutragen,
sind wie folgt Ubereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicht
es der Regierung der Republik Indonesien, bei der Kreditanstalt flir Wiederaufbau, Frankfurt am Main, flir von
beiden Regierungen auszuwahlende Vorhaben, wenn nach
Prlifung die Forderungswtirdigkeit festgestellt worden ist,
Darlehen bis zu insgesamt 100.000.000,-- DM (in Worten:
Einhundert Millionen Deutsche Mark) aufzunehmen.
(2) Die gemaB Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen den Vertragspartnern durch andere
Vorhaben ersetzt werden.

Artikel 2

Die Verwendung dieser Darlehen sowie die Bedingungen, zu
denen sie gewahrt werden, bestimmen die zwischen der
Regierung der Republik Indonesien und der Kreditanstalt
ftir Wiederaufbau abzuschlieBenden Vertrage, die den in der
Bundesrepublik Deutschland geltenden Rechtsvorschriften
unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt ftir Wiederaufbau von samtlichen Steuern und sonstigen
offentlichen Abgaben frei, die bei AbschluB oder Durchfilhrung der in Artikel 2 erwa.hnten Vertrage in der Republik
Indonesian erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien tiberlaBt bei den sich 1
aus der Darlehensgewahrung ergebenden Transporten von Personen und Giltern im See- und Luftverkehr den Passagieren
und Lieferanten die freie Wahl der Verkehrsunternehmen,
trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz in dem deutschen
Geltungsbereich dieses Abkommens ausschlieBen oder erschweren,
und erteilt gegebenenfalls die ftir eine Beteiligung dieser
Verkehrsunternehmen erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen ftir Vorhaben, die aus den Darlehen finanziert werden, sind international offentlich auszuschrei ben, soweit nicht im Einzelfall etwas Abweichendes
festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung
der Darlehen ergebenden Lieferungen die Erzeugnisse der
Industrie des Landes Berlin bevorzugt berlicksichtigt werden.

Artikel 7
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich
des Luftverkehrs gilt dieses Abkommen auch flir das Land
Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland der Regierung der Republik Indonesien innerhalb von
drei Monaten nach Inkrafttreten des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in Kraft.
Geschehen in Jakarta am 16. September 1976
in zwei Unterschriften, jede in deutscher, indonesischer und
englischer Sprache, wobei jeder Wortlaut verbindlich ist. Bei
unterschiedlicher Auslegung des deutschen und des indonesischen Wortlauts ist der englische Wortlaut maBgebend.

in the spirit of the friendly relations existing between the

Republic of Indonesia and the Federal Republic of Germany,
desiring to strengthen and intensify those friendly relations
by fruitful cooperation in the field of development assistance,
aware that the maintenance of these relations constitutes the
basis of the present Agreement,
I
intending to contribute to the economic and social development
in the Republic of Indonesia,
have agreed as follows:
Article l
(1) The Government of the Federal Republic of Germany
shall enable the Government of the Republic of
Indonesia to raise with the Kreditanstalt ftir
Wiederaufbau (Development Loan Corporation),
Frankfurt/Main, loans up to a total of DM 100.000.000
(one hundred million German Marks) for projects to
be determined by both Governments if they have been
found eligible for promotion.
(2) The projects referred to in paragraph 1 above may
be replaced by other projects if the Contracting
Parties so agree.

Article 2
The utilization of the loans as well as the terms and
conditions on which they are granted shall be governed
by the provisions of the agreements to be concluded
between the Government of the Republic of Indonesia and
the Kreditanstalt ftir Wiederaufbau which shall be
subject to the laws and regulations applicable in the
Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt
the Kreditanstalt flir Wiederaufbau from all taxes and
other public charges levied in the Republic of Indonesia
at the time of the conclusion, or during the implementation, of the agreements referred to in Article 2 of the
present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow
passangers and suppliers free choice of transport enterprises for such transportation by land, sea or air of
persons and goods as results from the granting of the
loans, abstain from taking any measures that might
exclude or impair the fair and equal participation of
transport enterprises having their place of business
in the German area of application of the present Agreement, and grant permits for such participation as required.
Article 5
Supplies and services for projects financed from the
loans shall, unless otherwise provided for in individual
cases, be subject to international public tender.

Article 6
With regard to supplies resulting from the granting of
the loans, the Government of the Federal Republic of Germany
attaches particular importance to preference being given
to products of industries of Land Berlin.
Article 7
With the exception of those provisions of Article 4 which
refer to air transport, this Agreement shall also apply to
Land Berlin, provided that the Government of the Federal
Republic of Germany does not make a contrary declaration
to the Government of the Republic of Indonesia within three
months of the date of entry into force of this Agreement.
Article 8
The present Agreement shall enter into force on the date
of signature thereof.
Done at Jakarta on September 16, 1976
in duplicate in the German, Indonesian and English languages,
all three texts being authentic. In case of divergent interpretation of the German and Indonesian texts, the English
text shall prevail.

Ich beehre mich, Eurer Exzellenz im Namen der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Regierung der Bundesrepublik Deutschland befilrwortet im
Interesse der Entwicklungslander das Prinzip der Lieferungebundenhei t bei der Kapitalhilfe. Sie hat dies wiederholt offentlich
erklart und durch die Aufbindung der Projekthilfe flir Indonesien
seit 1970 bekraftigt. Auch 1976 ist die deutsche Kapitalhilfe nicht
an Lieferungen und Leistungen aus der Bundesrepublik Deutschland
gebunden.
Die Regierung der Bundesrepublik Deutschland hat keinen Zweifel
daran gelassen, daB sie die internationale offentliche Ausschreibung
der Lieferungen und Leistungen als ein weltweit gliltiges Prinzip
anstrebe und mit ihrer Aufbindung 1970 einen beispielgebenden
ersten Schritt in dieser Richtung habe tun wollen.

In entsprechenden Erklarungen anlaBlich bilateraler und
multilateraler Kontakte hat sich die Regierung der Bundesrepublik Deutschland zu diesem Prinzip bekannt und ihrer
Hoffnung Ausdruck verliehen, daB sich andere Geberlander dem
deutschen Beispiel anschlieBen wUrden. Sie hat auch nie einen
Zweifel daran gelassen, daB sie in dieser Frage - insbesondere
im Hinblick auf das indonesische Interesse - das Vorgehen der
librigen Geberlander nicht auBer acht lassen konne. Ausgehend
von diesem grundsatzlichen Standpunkt behalt sich die Regierung
der Bundesrepublik Deutschland vor, von Fall zu Fall zu prlifen,
welche Ausschreibungsmodalitaten dem einzelnen Projekt angemessen sind und, soweit dies sachlich geboten erscheint, im
Einzelfall eine auf die Bundesrepublik Deutschland beschrankte
Ausschreibung festzulegen.

obigen Ausflihrungen bestatigen zu wollen.

In the interest of developing countries, the Government of
the Federal Republic of Germany supports the principle of
untied supplies in connection with financial assistance. It
has stated this repeatedly in public and confirmed it by
the untied project aid it has granted to Indonesia since 1970.
Likewise in 1976, German financial assistance is not tied
to supplies and services from the Federal Republic of
Germany.
The Government of the Federal Republic of Germany has left
no doubt that it would like to see tendering under project
aid become an internationally valid principle and that, in
untying its aid in 1970, it wanted to set an example by
taking a first step in this direction.

In statements on the occasion of bilateral and multilateral contacts, the Government of the Federal Republic
of Germany has upheld this principle and expressed its
hope that other donor countries would follow suit. It
has never left any doubt that in this matter, especially
in view of the Indonesian interest, it could not disregard
the approach of the other donor countries. Starting from
this fundamental position, the Government of the Federal
Republic of Germany reserves the right to examine what
tender modalities are appropriate for each individual
project and, if it seems necessary on substantive grounds,
to limit tendering to the Federal Republic of Germany.

Supplies and services for projects financed from the loans shall,
unless otherwise provided for in indi vidual cases, subject to
international public tender.

With regard to the foregoing, I have the honour to state the following on
behalf of the Government of t he Federal Republic of Germany:
In the interest of developing countries , the Government of the Federal
Republic of Germany supports the principle of united supplies in connection
with f inancial assistance. It has stated this repeatedly in public and
confirmed it by the

project aid it has granted to Indonesia since
1970, Likewise in 1976, German financial assistance is not tied to supplies
and services from the Federal Republic of Germany.
The Government of the Federal Republic of Germany has left no doubt that it
would like to see tendering under project aid become an internatio nally
valid principle and that, in untying its aid in 1970, it wanted to set an
example by taking a first step in this direction.

In statements on the occasion of bilateral and multilateral contacts, the
Government of the Federal Republic of Germany has upheld this principle and
expressed its hope that other donor countries would follow suit. It has never
left any doubt that in this matter, especially in view of the Indonesian
interest, it could not disregard the approach of the other donor countries.
Starting from this fundamental position, the Government of the Federal
Republic of Germany reserves the right to examine what tender modalities are
appropriate for each individual project and, if it seems necessary on
substantive grounds, to limit tendering to the Federal Republic of Germany.
I would be grateful if Your Excellency would confirm your Government's
agreement to the foregoing.
I have the honour to confirm Your Excellency that I agree with the
content of the above mentioned Note.

1976 unterzeichneten Abkommens zwischen der Regierung der Bundesrepublik Deutschland und der Republik Indonesien, Uber Kapitalhilfe, der wie folgt lautet:

(1) Die Regierung der Bundesrepublik Deutschland ermoglicht es
der Regierung der Republik Indonesien, bei der Kreditanstalt
ftir Wiederaufbau, Frankfurt am Main, ftir von beiden
Regierungen auszuwahlende Vorhaben, wenn nach Prtifung die
Forderungswtirdigkeit festgestellt worden ist, Darlehen bis
zu insgesamt 100.000.000,-- DM (in Worten: Einhundert
Millionen Deutsche Mark) aufzunehmen."
Ich beehre mich, Herr Minister, im Namen der Regierung der
Bundesrepublik Deutschland hierzu folgendes darzulegen:
Die Regierung der Bundesrepublik Deutschland betrachtet
hinsichtlich der zwischen ihr und der Regierung der Republik
Indonesien zu vereinbarenden Vorhaben die Ergebnisse der
Delegationsverhandlungen in Bonn vom 14. - 16. Juni 1976 als
Grundlage. Sie wird bei den weiteren Gesprachen hiervon ausgehen.
Ich bitte Sie, mir das Einverstandnis Ihrer Regierung mit den
obigen Ausftihrungen bestatigen zu wollen .

September 16, 1976, between the Government of the
Federal Republic of Germany and the Government of the
Republic of Indonesia concerning Financial Assistance,

shall enable the Government of the Republic of
Indonesia to raise with the Kreditanstalt ftir
Wiederaufbau (Development Loan Corporation),
Frankfurt/Main, loans up to a total of DM
100.000.000 (one hundred million German Marks)
for projects to be determined by both Governments
if they have been found eligible for promotion."
The Government of the Federal Republic of Germany regards
the results of the inter-delegation negotiations of
June 14 to 16, 1976, in Bonn as the basis for the projects
to be agreed upon between it and the Government of the
Republic of Indonesia. It will proceed on this basis in any
further talks.
I would appreciate it if you would confirm your Government's
agreement with the foregoing.
