Dijiwai oleh hubungan persahabatan yang ada antara Republik
Indonesia dan Republik Federasi Jerman ,
berkeinginan untuk memperkokoh dan mempererat hubungan persahabatan
tersebut dengan jalan bekerjasama secara bermanfaat dalam bidang
bantuan pembangunan ,
menyadari bahwa pemeliharaan hubungan-hubungan tersebut merupakan
dasar persetujuan ini ,
berkeinginan untuk membantu pembangunan ekonomi dan sosial
Republik Indonesia ,
telah menyetujui sebagai berikut

Pemerintah Republik Indonesia untuk mengadakan pinjaman pinjaman dari Kreditanstalt fur Wiederaufbau sampai sejumlah
OM. 115.000.000. (seratus lima belas juta Deutsche Mark)
untuk proyek-proyek yang akan ditentukan bersama oleh kedua
Pemerintah, jika, setelah diteliti, kedua Pemerintah
berpendapat bahwa proyek-proyek itu dapat dikembangkan.

Proyek-proyek sebagaimana dinyatakan dalam ayat l tersebut
diatas dapat diganti oleh proyek-proyek lain jika Pemerintah
Republik Indonesia dan Pemerintah Republik Federasi Jerman
menyetujui.

Penggunaan pinjaman-pinjaman ini demikian pula persyaratanpersyaratan atas mana pinjaman-pinjaman yang diberikan tersebut
akan diatur oleh ketentuan-ketentuan dalam persetujuan-persetujuan
yang akan dibuat antara Pemerintah Republik Indonesia dan
Kreditanstalt fur Wiederaufbau serta akan tunduk terhadap
ketentuan-ketentuan hukum yang berlaku di Republik Federasi Jerman.

Pemerintah Republik Indonesia akan membebaskan Kreditanstalt
fur Wiederaufbau dari semua pajak-pajak dan pungutan-pungutan
umum lainnya yang berlaku di Republik Indonesia pada waktu
persetujuan-persetujuan, sebagaimana disebut menurut pasal 2
dari persetujuan ini dibuat atau selama masa pelaksanaannya.

Pemerintah Republik Indones ia akan mengizinkan penumpangpenumpang dan s upplier-supplier untuk secara bebas memilih
perusahaan- perusahaan pengangkutan, l aut ataupun udara yang

digunakan untuk mengangkut orang-orang dan barang-barang dalam
rangka pemberian pinjaman-pinjaman ini dan tidak akan mengambil
tindakan-tindakan untuk menolak atau mempersulit ikut sertanya
secara wajar dan adil perusahaan-perusahaan pengangkutan yang
berkedudukan diwilayah Jerman dalam persetujuan ini, dan memberikan
izin-izin yang di perlukan dalam mengikut sertakan perusahaanperusahaan itu.

5.
Penyediaan barang-barang dan jasa-jasa untuk proyek-proyek yang
dibiayai dari pinjaman-pinjaman tersebut akan diadakan atas
dasar penawaran umum internasional kecuali jika ditentukan lain
dalam hal-hal tertentu.

6.
Mengenai penyediaan barang-barang dan jasa-jasa sehubungan dengan
pemberian pinjaman-pinjaman tersebut, Pemerintah Republik
Federasi Jerman menganggap penting sekali untuk memberikan
pilihan pertama kepada hasil-hasil industri Land Berlin.

7.
Terkecuali ketentuan-ketentuan yang tercantum dalam pasal 4
mengenai pengangkutan udara, Persetujuan ini berlaku pula untuk
Land Berlin, dengan ketentuan bahwa Pemerintah Republik Federasi

Jerman tidak memberikan pernyataan yang berlawanan kepada
Pemerintah Republik Indonesia dalam jangka waktu tiga bulan
setelah persetujuan ini mulai berlaku.

8.
Persetujuan ini mulai berlaku pada tanggal ditanda-tanganinya.
Dibuat di Jakarta tanggal e,mpat belas Agustus tahun Seribu
Sembilan ratus tujuh puluh del apan.
Masing-masing rangkap dua dalam bahasa Indonesia, Jerman dan
Inggris, dimana ketiga naskah mempunyai kekuatan yang sama syahnya.
Dalam hal penafsiran terhadap naskah Indonesia dan Jennan
berbeda, maka naskah Inggrislah yang menentukan.

der Regierung der Bundesrepublik Deutschland
liber Finanzielle Zusammenarbeit
Die Regierung der Republik Indonesien
und
die Regierung der Bundesrepublik Deutschland,
im Geiste der bestehenden freundschaftlichen Beziehungen zwischen der Republik Indonesien und der Bundesrepublik Deutschland,
in dem Wunsche, diese freundschaftlichen Beziehungen
durch fruchtbare Zusammenarbeit auf dem Gebiet der
Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen die Grundlage dieses Abkommens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung der Republik Indonesien beizutragen,
sind wie folgt Ubereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicht es der Regierung der Republik Indonesien,
bei der Kreditanstalt ftir Wiederaufbau, Frankfurt/
Main, ftir von beiden Regierungen auszuwahlende Vorhaben, wenn nach Prilfung die Forderungswilrdigkeit
festgestellt worden ist, Darlehen bis zu insgesamt
115.000.000,00 DM (in Worten: Einhundertflinfzehn
Millionen Deutsche Mark) aufzunehmen.
(2) Die gemaB Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen der Regierung der Republik
Indonesien und der Regierung der Bundesrepublik
Deutschland durch andere Vorhaben ersetzt werden.
Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen,
zu denen sie gewahrt werden, bestimmen die zwischen der

fUr Wiederaufbau abzuschlieBenden Vertrage, die den in
der Bundesrepublik Deutschland geltenden Rechtsvorschriften unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt fUr Wiederaufbau von samtlichen Steuern und
sonstigen offentlichen Abgaben frei, die bei AbschluB
oder Durchfilhrung der in Artikel 2 erwahnten Vertrage
in der Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien UberlaBt bei den
sich aus der Darlehensgewahrung ergebenden Transporten
von Personen und Gtitern im See- und Luftverkehr den
Passagieren und Lieferanten die freie Wahl der Verkehrsunternehmen, trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz
in dem deutschen Geltungsbereich dieses Abkommens ausschlieBen oder erschweren, und erteilt gegebenenfalls
die ftir eine Beteiligung dieser Verkehrsunternehmen erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen fUr Vorhaben, die aus Darlehen finanziert werden, sind international offentlich
auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung
der Darlehen ergebenden Lieferungen und Leistungen die

- 3 wirtschaftlichen Moglichkeiten des Landes Berlin bevorzugt genutzt werden.
Artikel 7
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich des Luftverkehrs gilt dieses Abkommen auch flir das
Land Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland der Regierung der Republik Indonesien
innerhalb von drei Monaten nach Inkrafttreten des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.
Geschehen in Jakarta am
14 August
1978
in zwei Urschriften, jede in indonesischer, deutscher
und englischer Sprache, wobei jeder Wortlaut verbindlich
ist. Bei unterschiedlicher Auslegung des indonesischen
und des deutschen Wortlauts ist der englische Wortlaut
maBgebend.

the Government of the Republic of Indonesia
and
the Government of the Federal Republic of Germany
concerning Financial Co-operation
The Government of the Republic of Indonesia ,
and
the Government of the Federal Republic of Germany
in the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany ,
desiring to strengthen and intensify those friendly relations
by fruitful co-operation in the field of development assistance ,
aware that the maintenance of those relations constitutes the
basis of the present Agreement ,
intending to contribute to economic and social development in
the Republic of Indonesia ,
have agreed as follows
Article 1
(1)
The Government of the Federal Republic of Germany shall
enable the Government of the Republic of Indonesia to raise

with the Kreditanstalt fur Wiederaufbau (Development Loan
Corporation), Frankfurt/Main, loans up to a total of
OM. 115,000,000 (one hundred and fifteen million Deutsche
Mark) for projects to be determined jointly by both
Governments, if, after examination, they have been found
eligible for promotion.

The projects determined in accordance with paragraph l
above may be replaced by other projects if the Government
of the Republic of Indonesia and the Government of the
Federal Republic of Germany so agree.
Article 2
The utilization of the loans as well as the terms and conditions
on which they are granted shall be governed by the provisions of
the agreements to be concluded between the Government of the

Republic of Indonesia and the Kreditanstalt fur Wiederaufbau ,
which shall be subject to the laws and regulations applicable
in the Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt the

Kreditanstalt fur Wiederaufbau from all taxes and other public
charges levied in the Republic of Indonesia at the time of the
conclusion or during the implementation of the agreements referred
to in Article 2 of the present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow passengers
and suppliers free choice of transport enterprises for such
transportation by sea or air of persons and goods as results from

the granting of the loans, abstain from taking any measures that
might exclude or impair the participation on equal terms of
transport enterprises having their place of business in the
German area of application of the present Agreement, and grant
the relevant permits for the participation of such enterprises
as required.
Article 5
Supplies and services for projects financed from the loans shall,
unless otherwise provided for in individual cases, be subject
to international public tender.
Article 6
With regard to supplies and services from the granting of the
loans, the Government of the Federal Republic of Germany
attaches particular importance to preferential use being made
of the economic potential of Land Berlin.
Article 7
With the exception of those provisions of Article 4 which refer
to air transport, this Agreement shall also apply to Land Berlin,
provided that the Government of the Federal Republic of Germany
does not make a contrary declaration to the Government of the

Republic of Indonesia within three months of the date of entry
into force of this Agreement.
Article 8
The present Agreement shall enter into force on the date of
signature thereof.
Done at J a k a r t a on the fourteenth August nineteen hundred
and seventy eight in duplicate in the Indonesian, German and English
languages, all three texts being authentic.
In case of divergent interpretations of the Indonesian and Gennan
texts, the English text shall prevail.

durch fruchtbare Zusammenarbeit auf dem Gebiet der
Entwicklungshilfe zu festigen und zu vertiefen,
im BewuBtsein, daB die Aufrechterhaltung dieser Beziehungen die Grundlage dieses Abkommens ist,
in der Absicht, zur wirtschaftlichen und sozialen Entwicklung der Republik Indonesien beizutragen,
sind wie folgt Ubereingekommen:
Artikel 1
(1) Die Regierung der Bundesrepublik Deutschland ermoglicht es der Regierung der Republik Indonesien,
bei der Kreditanstalt ftir Wiederaufbau, Frankfurt/
Main, ftir von beiden Regierungen auszuwahlende Vorhaben, wenn nach Prilfung die Forderungswilrdigkeit
festgestellt worden ist, Darlehen bis zu insgesamt
115.000.000,00 DM (in Worten: Einhundertflinfzehn
Millionen Deutsche Mark) aufzunehmen.
(2) Die gemaB Absatz 1 ausgewahlten Vorhaben konnen im
Einvernehmen zwischen der Regierung der Republik
Indonesien und der Regierung der Bundesrepublik
Deutschland durch andere Vorhaben ersetzt werden.
Artikel 2
Die Verwendung dieser Darlehen sowie die Bedingungen,
zu denen sie gewahrt werden, bestimmen die zwischen der

Regierung der Republik Indonesien und der Kreditanstalt
fUr Wiederaufbau abzuschlieBenden Vertrage, die den in
der Bundesrepublik Deutschland geltenden Rechtsvorschriften unterliegen.
Artikel 3
Die Regierung der Republik Indonesien stellt die Kreditanstalt fUr Wiederaufbau von samtlichen Steuern und
sonstigen offentlichen Abgaben frei, die bei AbschluB
oder Durchfilhrung der in Artikel 2 erwahnten Vertrage
in der Republik Indonesien erhoben werden.
Artikel 4
Die Regierung der Republik Indonesien UberlaBt bei den
sich aus der Darlehensgewahrung ergebenden Transporten
von Personen und Gtitern im See- und Luftverkehr den
Passagieren und Lieferanten die freie Wahl der Verkehrsunternehmen, trifft keine MaBnahmen, welche die gleichberechtigte Beteiligung der Verkehrsunternehmen mit Sitz
in dem deutschen Geltungsbereich dieses Abkommens ausschlieBen oder erschweren, und erteilt gegebenenfalls
die ftir eine Beteiligung dieser Verkehrsunternehmen erforderlichen Genehmigungen.
Artikel 5
Lieferungen und Leistungen fUr Vorhaben, die aus Darlehen finanziert werden, sind international offentlich
auszuschreiben, soweit nicht im Einzelfall etwas Abweichendes festgelegt wird.

Artikel 6
Die Regierung der Bundesrepublik Deutschland legt besonderen Wert darauf, daB bei den sich aus der Gewahrung
der Darlehen ergebenden Lieferungen und Leistungen die

- 3 wirtschaftlichen Moglichkeiten des Landes Berlin bevorzugt genutzt werden.
Artikel 7
Mit Ausnahme der Bestimmungen des Artikels 4 hinsichtlich des Luftverkehrs gilt dieses Abkommen auch flir das
Land Berlin, sofern nicht die Regierung der Bundesrepublik Deutschland der Regierung der Republik Indonesien
innerhalb von drei Monaten nach Inkrafttreten des Abkommens eine gegenteilige Erklarung abgibt.
Artikel 8
Dieses Abkommen tritt am Tage seiner Unterzeichnung in
Kraft.

1978
in zwei Urschriften, jede in indonesischer, deutscher
und englischer Sprache, wobei jeder Wortlaut verbindlich
ist. Bei unterschiedlicher Auslegung des indonesischen
und des deutschen Wortlauts ist der englische Wortlaut
maBgebend.

and
the Government of the Federal Republic of Germany
concerning Financial Co-operation
The Government of the Republic of Indonesia ,
and
the Government of the Federal Republic of Germany
in the spirit of the friendly relations existing between the
Republic of Indonesia and the Federal Republic of Germany ,
desiring to strengthen and intensify those friendly relations
by fruitful co-operation in the field of development assistance ,
aware that the maintenance of those relations constitutes the
basis of the present Agreement ,
intending to contribute to economic and social development in
the Republic of Indonesia ,
have agreed as follows
Article 1
(1)
The Government of the Federal Republic of Germany shall
enable the Government of the Republic of Indonesia to raise

with the Kreditanstalt fur Wiederaufbau (Development Loan
Corporation), Frankfurt/Main, loans up to a total of
OM. 115,000,000 (one hundred and fifteen million Deutsche
Mark) for projects to be determined jointly by both
Governments, if, after examination, they have been found
eligible for promotion.

The projects determined in accordance with paragraph l
above may be replaced by other projects if the Government
of the Republic of Indonesia and the Government of the
Federal Republic of Germany so agree.
Article 2
The utilization of the loans as well as the terms and conditions
on which they are granted shall be governed by the provisions of
the agreements to be concluded between the Government of the

Republic of Indonesia and the Kreditanstalt fur Wiederaufbau ,
which shall be subject to the laws and regulations applicable
in the Federal Republic of Germany.
Article 3
The Government of the Republic of Indonesia shall exempt the

Kreditanstalt fur Wiederaufbau from all taxes and other public
charges levied in the Republic of Indonesia at the time of the
conclusion or during the implementation of the agreements referred
to in Article 2 of the present Agreement.
Article 4
The Government of the Republic of Indonesia shall allow passengers
and suppliers free choice of transport enterprises for such
transportation by sea or air of persons and goods as results from

the granting of the loans, abstain from taking any measures that
might exclude or impair the participation on equal terms of
transport enterprises having their place of business in the
German area of application of the present Agreement, and grant
the relevant permits for the participation of such enterprises
as required.
Article 5
Supplies and services for projects financed from the loans shall,
unless otherwise provided for in individual cases, be subject
to international public tender.
Article 6
With regard to supplies and services from the granting of the
loans, the Government of the Federal Republic of Germany
attaches particular importance to preferential use being made
of the economic potential of Land Berlin.
Article 7
With the exception of those provisions of Article 4 which refer
to air transport, this Agreement shall also apply to Land Berlin,
provided that the Government of the Federal Republic of Germany
does not make a contrary declaration to the Government of the

Republic of Indonesia within three months of the date of entry
into force of this Agreement.
Article 8
The present Agreement shall enter into force on the date of
signature thereof.
Done at J a k a r t a on the fourteenth August nineteen hundred
and seventy eight in duplicate in the Indonesian, German and English
languages, all three texts being authentic.
In case of divergent interpretations of the Indonesian and Gennan
texts, the English text shall prevail.

Pemerintah Republik Indonesia.
Hal ini akan dilanjutkan atas dasar tersebut pada setiap pembicaraanpembicaraan yang akan datang.
