DAMPAK ATURAN YANG DITERAPKAN TIONGKOK TERKAIT TIONGKOK AIR DEFENSE IDENTIFICATION ZONE (ADIZ) TERHADAP HUKUM INTERNASIONAL.

ABSTRACT

Air Defense Identification Zone (ADIZ) is an identification zone of civil
or military aircraft with attempt to fly from the outside of national flight zone of
a state into the flight zone of the state that implements ADIZ. The legal basis
of ADIZ determination is that a nation possesses the right to assign certain
conditions for an aircraft that is about to enter the territory of a state. State
practice is also a factor in the development of this zone.

People’s Republic of China (PRC) assigns Air Defense Identification
Zone in East China Sea, of which the zone overlaps with the Japan’s ADIZ
including the Diaoyu/Senkaku Island of which China is in a dispute with
Japan.

PRC regulates that :

1. An aircraft entering ADIZ is supposed to report the flight information to
the authority of PRC even when the aircraft is not headed to national
air zone of PRC.
2. PRC will implement defensive emergency measure to respond
uncooperative aircraft in identification.


The practice of states that has determined ADIZ shows difference with
the ADIZ of PRC, one of which can be seen in USA’s ADIZ regulation. USA
does not implement its ADIZ rules to foreign aircraft that are not headed to
the national air zone of USA.
