NOTA KESEPAHAMAN
MENGENAI BANTUAN HIBAH YANG BERKENAAN DENGAN
KERJASAMA EKONOMI DAN TEKNIK
. ANTARA
PEMERINTAH REPUBLIK INDONESIA DAN
PEMERINTAH REPUBLIK RAKYAT CHINA
Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat China
dengan
maksud
untuk
mengembangkan
lebih
jauh
hubungan
persahabatan dan kerjasama ekonomi dan teknik antara kedua Negara,
telah menyepakati hal-hal sebagai berikut:
PASAL I
Sesuai dengan kebutuhan Pemerintah Republik Indonesia, Pemerintah
Republik Rakyat China memberikan bantuan hibah kepada Pemerintah
Republik Indonesia senilai -RMB Yuan 30.000.000.00 (Renminbi 30 juta
Yuan saja).
PASAL II
Bantuan hibah di atas akan digunakan untuk membiayai proyek-proyek
yang akan dibahas dan diputuskan oleh kedua Pemerintah. Mengenai
hal-hal yang rinci, akan ditentukan di persetujuan terpisah yang akan
ditandatangani oleh kedua belah pihak.
PASAL Ill
Prosedur akuntansi yang rinci untuk pelaksanaan kesepakatan ini akan
dibahas dan ditentukan bersama antara Sadan Keuangan yang
ditunjuk oleh Pemerintah Indonesia dan Bank of China.
PASAL IV
Nota kesepahaman ini akan berlaku sejak tanggal penandatanganan
dan akan berlaku terus hingga saat kedua belah pihak telah memenuhi
seluruh kewajiban masing-masing.
Dibuat dalam rangkap tiga di Jakarta, Indonesia, pada tanggal 25 April
2005, dalam bahasa Indonesia, China, dan lnggris, masing-masing
pihak menyimpan satu dokumen asli dan semua naskah mempunyai
kekuatan hukum yang sama. Jika terdapat perbedaan mengenai
penafsiran , maka naskah dalam bahasa lnggris harus berlaku.

MEMORANDUM OF UNDERSTANDING
ON GRANT ASSISTANCE IN RELATION TO ECONOMIC AND
TECHNICAL COOPERATION
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA
The Government of the Republic of Indonesia and the Government of
the People's Republic of China with a view to further developing friendly
relations and economic and technical cooperation between the two
countries, have agreed as follows:
ARTICLE I
In accordance with the needs of the Government of the Republic of
Indonesia, the Government of the People's Republic of China provides
the Government of the Republic of Indonesia with a grant of RMB Yuan
30,000,000.00 (Renminbi Yuan Thirty Million only).
ARTICLE II
The above-mentioned grant shall be used for the implementation of the
project to be discussed and agreed upon by the two Government of
Indonesia and China. The specific matters shall be stipulated in a
separate agreement to be signed between the two sides.
ARTICLE Ill
The detailed accounting procedures for the implementation of this MOU
shall be signed between the financial institutions designated by the
Indonesian Government and the Bank of China.
ARTICLE IV
This MOU shall enter into force on the date of signature and shall
remain in force until the day when the two sides have fulfilled all their
respective obligations thereof.
Done in duplicate in Jakarta, Indonesia on April 25, 2005 in the
Indonesian, Chinese and English languages, each side keeping one
original and all texts being equally authentic. In case of divergence the
English text shall prevail.
