Arrangement
Between
Ministry of Manpower and Transmigration of the Republic of Indonesia
and
Department of Education, Employment and Workplace Relations
of the Government of the Commonwealth of Australia
concerning Labour and Social Protection
This Arrangement, mutually determined by the Department of Education, Employment and
Workplace Relations of the Commonwealth of Australia (DEEWR) and Ministry of
Manpower and Transmigration of the Republic Indonesia (MoMT) (hereinafter referred to
as "the Participants") embodies the understandings of the Participants and is established
under Paragraph 4 (a) (1) of the Memorandum of Understanding between the Government
of the Commonwealth of Australia and the Government of the Republic of Indonesia
relating to Cooperation in Social Protection Policies and Programs (the Memorandum of
Understanding) signed on April 4th, 2005.
1.
General Objectives
1.1
The objective of this Arrangement is to develop cooperation in social protection
policies and programs for workers and other labour matters, jointly determined by
the Participants on the basis of partnership, equality, reciprocity and mutual benefit.
1.2
The 'designated representatives' of each Participant responsible for matters relating
to the operation of this Arrangement are the Branch Manager of the Multilateral,
Middle East, South and South East Asia Branch, Department of Education,
Employment and Workplace Relations; and the Head Center for International
Cooperation Administration Ministry of Manpower and Transmigration, Republic of
Indonesia.
2.
Framework
2.1
The Participants will endeavour to encourage and facilitate the development of
appropriate contacts and cooperation between relevant government agencies,
organizations, the private sector and other entities of the two countries in order to
develop social protection measures for workers.
2.2
With respect to the cooperative activities, each Participant commits to use its best
efforts to facilitate entry and exit from its territory of equipment and personnel of the
other Participants and also to facilitate access to relevant institutions, data and
material, pursuant to the prevailing laws, regulations and policies of their respective
countries.
3.
3.1
Forms of Cooperation
Any cooperation under this Arrangement will prioritize activities within the portfolio
responsibilities of each Participant as proposed annually, and may include:
•
Exchange of information on program and systems;
•
Development of collaborative training, technical support concerning research
and development, assistance with planning and implementation of program and
projects; and
•
Other forms of cooperation, such as: workshops, study tours and symposiums;
within the framework of this Arrangement as mutually determined by the
Participants.
4.
Fields of Cooperation
4.1.
The fields of cooperation identified as priority areas include the following:
Social protection policies and programs aimed at improving the welfare of workers
•
in both the formal and informal sector and, as appropriate, job seeker;
•
Strengthening administrative and service delivery system to provide social
protection for workers and, as appropriate, job seekers;
•
Labour market policy and programs targeting job creation and increasing
workforce participation;
•
Management of industrial relations;
•
Policies and principles of competency-based training relevant to instructors and
training providers, competency/skills standardization and certification of workers;
and
•
Other areas of cooperation as mutually determined by the Participants.
5.
Funding arrangements
5.1.
Each Participant will be responsible for any costs it may incur undertaking activities
under this Arrangement, unless otherwise jointly determined by both Participants.
6.
Joint Working Group
6.1.
In order to execute this Arrangement, and to verify the state of its application, the
Participants will report to the Joint Working Group for Social Security, established
under the Australia-Indonesia Ministerial Forum.
6.2.
The Joint Working Group will note the implementation and progress of cooperation
under this Arrangement.
7.
Other Participants
7.1.
The designated representatives of each Participant may invite representatives from
other government agencies and non-governmental institutions to participate in activities
under the framework of this Arrangement, as appropriate.
7.2.
Each Participant will coordinate and facilitate the participation of third party
participants in activities under the framework of this Arrangement.
8.
Implementation
8.1.
Activities undertaken under this Arrangement will be implemented through the
development of specific action plans, programs or projects mutually determined
between the Participants.
8.2.
Such arrangements, programs or projects should specify, inter alia, the objectives,
financial arrangements and other details relating to the specific commitments of all
parties involved.
8.3.
All personnel engaged in activities related to this Arrangement will observe, respect
and comply with the laws and regulations of the Host country and will avoid any
activities inconsistent with the purpose and objectives of this Arrangement.
9.
9.1 .
Intellectual Property Rights
Any result of research activities performed under this Arrangement together with the
results of previous research conducted by the Participants and used in the context
of this Arrangement, will be subject to the laws and regulations concerning the
protection of intellectual property rights in the respective territories of the
Participants, insofar as these are not covered by general agreements of an
international character.
10.
Settlement of Dispute
10.1
Any dispute between the Participants concerning the interpretation or the
implementation of this Arrangement will be settled amicably through consultations or
negotiations.
11.
Amendment
11.1
This Arrangement can be reviewed or amended at any time by the mutual written
consent by the Participants. Such revisions or amendments will come into effect on
a date mutually determined by the Participants, and they will form an integral part of
this Arrangement.
12.
Effective Date, Termination
12.1.
This Arrangement will take effect on the date of its signing.
12.2. This Arrangement will remain in effect for the period of 3 (three) years, unless
terminated by either Participant, giving 60 days notice in writing to the other
Participant of its intention to terminate.
12.3. Should the Arrangement be terminated, activities or project already commenced
under the Arrangement will continue unless otherwise mutually determined between
the participants.
12.4.
By no later than the end of the three year period, the Participants will review the
operation of the Arrangement and a further Arrangement may be considered. A
further Arrangement may also be negotiated within the context of renewal of the
Memorandum of Understanding, if appropriate.
