ANTARA
PEMERINTAH REPUBLIK INDONESIA
DAN
PEIVIERINTAH REPUBLIK DEMOKRATIK TIMOR-LESTE
TENTANG
KERJASAMA DALAM BIDANG PEMBERDAYAAN PEREMPUAN
DAN PENINGKATAN KESETARAAN GENDER
Pemerintah Republik Indonesia dan Pemerintah Republik Demokratik Timor-Leste
(selanjutnya secara sendiri disebut sebagai "Pihak" dan secara bersama-sama disebut
sebagai "Para Pihak");
MENGAKUI pentingnya pemberdayaan perempuan dan peningkatan
kesetaraan
gender dalam pembangunan nasional;
MENYADARI pertukaran pengalaman dan informasi dapat membangun kapasitas
pemerintah,
meningkatkan
pelaksanaan
berbagai
pengetahuan
kebijakan
dan
dan
program
mendorong
untuk
keberhasilan
mencapai
dalam
pemberdayaan
perem pua n da n keseta raan gender;
BERMAKSUD
untuk
memperkuat
dan
memperluas
kerjasama
yang
saling
menguntungkan di bidang peningkatan kapasitas dan penguatan kebijakan di masingmasing Negara;
MEMPERCAYAI
bahwa
kerjasama
di
bidang
pemberdayaan
perempuan
dan
peningkatan kesetaraan gender akan menguntungkan kedua negara;
MEMPERHATIKAN
Kesepakatan
Bersama
tentang
Hubungan
Diplomatik
antara
Republik Indonesia dan Republik Demokratik Timor-Leste yang ditandatangani di
Jakarta, pada tanggal 2 Juli 2002;
SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di masing-
masing negara;
TELAH MEMUTUSKAN sebagai berikut:
Pasal I
TUJUAN
Para Pihak akan berupaya mengambil tindakan yang diperlukan untuk meningkatkan
dan
mengembangkan
kerjasama
di
bidang
pemberdayaan
perempuan
dan
peningkatan kesetaraan gender. Para Pihak memutuskan untuk membentuk suatu
kera ngka bagi program peningkata n ka pasitas da n i ntera ksi professiona I a ntara Para
Pihak yang akan dipertimbangkan secara bersama-sama atas dasar asas timbal-balik
dan saling menguntungkan.
Pasal II
RUANG LINGKUP KERJASAMA
Para
Pihak akan
berupaya
mengambil
langkah-langkah
yang
diperlukan
untuk
mendorong dan meningkatkan kerjasama pada bidang-bidang sebagai berikut:
a.
Membangun kapasitas kelembagaan;
b.
Perencanaan program dan pengembangan terkait pemberdayaan perempuan
dan kesetaraan gender;
c.
Pengarusutamaan gender dan penganggaran yang responsif gender;
d.
Setiap bidang kerjasama lainnya yang akan diputuskan bersama oleh Para
Pihak.
Pasal Ill
LEMBAGA PELAKSANA
Lembaga pelaksana yang bertanggung jawab atas pelaksanaan Memorandum Saling
ini
Pengertian
atas
nama
Pemerintah
Republik
Indonesia
adalah
Kementerian
Pemberdayaan Perempuan dan Perlindungan Anak serta atas nama Pemerintah
Republik
Demokratik Timor-Leste
adalah
Sekretaris
l\Jegara
untuk
Peningkatan
Kesetaraan.
Pasal IV
PELAKSANAAN
1.
Memorandum Saling Pengertian ini akan dilaksanakan sesuai hukum, undangundang, peraturan dan kebijakan nasional masing-masing negara serta kewajiban
internasional yang berlaku di masing-masing Pihak.
2.
Rincian dari Pengaturan, Program atau Proyek yang dilaksanakan di bawah
Memorandum Saling Pengertian ini akan diatur kasus per-kasus melalui jalur
diplomatik khususnya yang mengatur antara lain tujuan, program dan kegiatan,
lokasi proyek atau program, jangka waktu, lembaga yang terlibat, ketentuan
keuangan dan rincian
lainnya yang terkait dengan tindakan tertentu yang
dilakukan oleh semua pihak yang terlibat dalam Memorandum Saling Pengertian
ini. Rincian tersebut di atas merupakan bagian yang tidak terpisahkan dari
Memorandum Saling Pengertian ini.
Pasal V
PEMBENTUKAN KELOMPOK KERJA BERSAMA
1.
Para Pihak dapat membentuk Kelompok Kerja Bersama yang terdiri dari para
peja bat da ri i nstitusi terka it ked ua nega ra untuk memfasilitasi pela ksanaan
Memorandum Saling Pengertian ini. Tingkat partisipasi, jumlah anggota dalam
Kelompok Kerja Bersama akan dibahas dan diputuskan oleh Para Pihak.
2.
Kelompok
Kerja
pelaksanaan
Bersama
dari
akan
Memorandum
memantau,
Saling
mengevaluasi
Pengertian
ini
dan
secara
meninjau
rutin
serta
melaporkan kepada Lembaga Pelaksana dan Komisi Bersama untuk Kerjasama
Bilateral antara Republik Indonesia dan Republik Demokratik Timor-Leste.
3.
Kelompok Kerja Bersama akan diketuai bersama oleh wakil dari Kementerian
Pemberdayaan
Perempuan
Indonesia
Sekretaris
dan
dan
Perlindungan
Negara
untuk
Anak
Peningkatan
Pemerintah
Republik
Kesetaraan
Republik
Demokratik Timor-Leste.
4.
Kelompok Kerja Bersama akan menetapkan prosedur, perencanaan dan program
yang direkomendasikan bagi kerjasama untuk mencapai tujuan melalui Lembaga
Pelaksana sebagaimana dimaksud dalam Pasal Ill.
5.
Kelompok Kerja Bersama akan bertemu setiap tahun, antar sesi, secara bergantian
di Indonesia atau Timor-Leste. Bilamana Para Pihak tidak dapat melakukan
pertemuan,
dokumen
akan
dipertukarkan
melalui jalur diplomatik sebagai
pengganti pertemuan tersebut.
Pasal VI
PENGATURAN KEUANGAN
Pengaturan pembiayaan kegiatan dalam rangka pelaksanaan Memorandum Saling
Pengertian ini akan diputuskan bersama oleh Para Pihak didasarkan pada ketersediaan
anggaran, personil dan sumberdaya Para pihak.
Pasal VII
HAK ATAS KEKAYAAN INTELEKTUAL
1.
Perlindungan Hak atas Kekayaan lntelektual akan dilaksanakan sesuai hukum,
undang-undang, peraturan dan kebijakan nasional masing-masing negara serta
kewajiban internasional yang berlaku di masing-masing Pihak.
2.
Penggunaan nama, logo, dan/atau lambang resmi dari salah satu Pihak pada
setiap
publikasi,
dokumen
dan/atau
naskah
tidak
diperkenankan
tanpa
persetujuan tertulis sebelumnya dari Pihak lainnya.
3.
Tanpa mengabaikan ayat (1) di atas, Hak Atas Kekayaan lntelektual terkait
pengembangan
teknologi
dan
produk
serta
pengembangan
layanan
akan
dilaksanakan:
a.
Kepemilikan bersama oleh Para Pihak atau hasil penelitian yang diperoleh
melalui upaya kegiatan bersama akan dimiliki bersama oleh Para Pihak
sesuai ketentuan yang akan disepakati bersama; dan
b.
Secara sendiri dan terpisah hasil penelitian yang diperoleh oleh salah satu
Pihak melalui usaha sendiri, akan dimiliki oleh Pihak tersebut.
Pasal VIII
PEMBATASAN KEGIATAN PERSONIL
1.
Para
Pihak akan menjamin personilnya yang terlibat dalam kegiatan yang
berhubungan dengan Memorandum Saling Pengertian ini akan menghormati
kebebasan politik, kedaulatan, dan integritas wilayah negara tuan rumah, serta
tidak mencampuri urusan internal negara tuan rumah dan akan menghindari
kegiatan yang tidak sejalan dengan maksud dan tujuan Memorandum Saling
Pengertia n ini.
2.
Pelanggaran terhadap ayat 1 di atas akan mengakibatkan pencabutan semua izin
dari personil yang bersangkutan dan tindakan lain yang diperlukan sesuai dengan
hukum dan peraturan perundang-undangan yang berlaku di negara tuan rumah.
Pasal IX
KERAHASIAAN
1.
Para Pihak akan menjaga kerahasiaan dokumen, informasi, dan data lainnya yang
diterima, atau diberikan oleh Pihak lainnya selama pelaksanaan Memorandum
Saling
Pengertian
ini
atau
persetujuan
lainnya
yang
dibuat
berdasarkan
Memorandum Saling Pengertian ini.
2.
Kedua Pihak menyetujui bahwa ketentuan-ketentuan pada pasal ini akan terus
mengikat Para Pihak meskipun Memorandum Saling Pengertian ini telah berakhir.
PasalX
PENUNDAAN
Setiap Pihak berhak, dengan alasan keamanan nasional, kepentingan
ketertiban
sementara,
umum
secara
atau
kesehatan
keseluruhan
masyarakat,
atau
sebagian,
untuk
melakukan
terhadap
nasional,
penundaan
pelaksanaan
dari
Memorandum Saling Pengertian ini, dimana penundaan tersebut berlaku serta merta
setelah pemberitahuan diberikan pada Pihak lain melalui saluran diplomatik.
Pasal XI
PERUBAHAN
Memorandum Saling Pengertian ini dapat diubah setiap saat dengan persetujuan
tertulis dari kedua Pih a k. Peruba ha n terse but mu la i berla ku pad a tangga I yang
ditetapkan oleh Para Pihak dan menjadi bagian tidak terpisahkan dari Memorandum
Saling Pengertian ini.
Pasal XII
PENYELESAIAN PERSELISI HAN
Setiap perbedaan yang timbul dari penafsiran dan/atau
pelaksanaan dan/atau
penerapan setiap ketentuan dari Memorandum Saling Pengertian ini akan diselesaikan
secara damai oleh Para Pihak melalui konsultasi tanpa campur tangan dari pihak ketiga
atau pengadilan internasional.
Pasa l XIII
MULAI BERLAKU, JANGKA WAKTU DAN PEMBATALAN
1.
Memora ndum Sa ling Pengertian ini mu lai berlaku pada tanggal penandatanganan
untuk jangka waktu tiga tahun. Memorandum Saling Pengertian ini akan
diperpa njang secara otomatis untuk j angka waktu dua tahun.
2.
Memorandum Saling Pengertian ini dapat diakhiri setiap saat oleh salah satu Pihak
dengan memberikan pemberitahuan tiga (3) bulan sebelumnya kepada Pihak lain
melalui saluran diplomatik mengenai keinginannya tersebut.
3.
Pembatalan Memorandum Saling Pengertian ini tidak akan mempengaruhi
pelaksanaan
dari
pengaturan,
kegiatan
dan/atau
program
yang
sedang
berlangsung yang telah diputuskan sebelum tanggal pembatalan dimaksud.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah diberi kuasa oleh Pemerintah
masing-masing, menandatangani Memorandum Saling Pengertian ini.
DITANDATANGANI dalam rangkap dua di Jakarta pada tanggal Lima bulan Oktober
tahun Duaribu Duabelas dalam ba hasa Indonesia dan lnggris, semua naskah memiliki
kekuatan hukum yang sama . Da lam hal terjadi perbedaan penafsiran, maka naskah
dalam ba hasa lnggris yang akan berlaku.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE
ON
COOPERATION IN THE FIELD OF WOMEN'S EMPOWERMENT
AND PROMOTION OF GENDER EQUALITY
The Government of the Republic of Indonesia and the Government of the Democratic
Republic of Timor-Leste (hereinafter referred to singularly as the Party and collectively
as the Parties);
RECOGNIZING the importance of women's empowerment and the promotion of
gender equality in national development;
REALIZING sharing experiences and exchanging information can build government
capacity, increase knowledge and promote success in the implementation of policies
and programs to achieve the above mentioned goals;
DESIRING to strengthen and broaden mutual cooperation in the areas of capacity
building and policy strengthening in their respective countries;
BELIEVING that cooperation_ in the area of women's empowerment and the promotion
of gender equality would benefit both countries;
TAKING INTO ACCOUNT the Joint Communique concerning Diplomatic Relations
between the Republic of Indonesia and the Democratic Republic of Timor-Leste, signed
atJakarta, on 2nd of July 2002;
PURSUANT TO the prevailing laws and regulations in their respective countries;
HAVE DECIDED as follows:
Article I
OBJECTIVE
The Parties shall endeavor to take all necessary measures to promote and develop
cooperation in the field of women's empowerment and promotion of gender equality.
The Parties decide to provide a framework within which proposals for capacity building
programs and professional interaction between the Parties are to be jointly considered
on the basis of reciprocity and mutual benefit.
Article II
AREAS OF COOPERATION
The Parties will endeavor to take necessary steps to encourage and promote
cooperation in the following areas:
a.
Institutional capacity building;
b.
Program design and development in relation to women empowerment and
gender equality;
c.
Gender mainstreaming and gender responsive budgeting;
d.
Any other areas of cooperation to be mutually decided upon by the Parties.
Article Ill
EXECUTING AGENCY
The executing agencies responsible for the implementation of this Memorandum of
Understanding on behalf of the Government of the Republic of Indonesia shall be the
Ministry of Women's Empowerment and Child Protection and on behalf of the
Government of the Democratic Republic of Timor-Leste shall be the Secretary of State
for the Promotion of Equality.
Article IV
IMPLEMENTATION
1.
The Memorandum of Understanding will be implemented in accordance with the
laws, rules, regulations and national policies in each country and in accordance
with their respective international obligations.
2.
The details of the Arrangement, Programs or Projects conducted under this
Memorandum of Understanding will be regulated on a case by case basis through
diplomatic channels, which will be specified, inter alia the objectives, programmes
and activities, location of the project or program, duration, the agencies involved,
financial provisions and other details related to the specific action conducted by
all participants involved under this Memorandum of Understanding. The aforesaid
details shall form an integral part of this Memorandum of Understanding.
Article V
ESTABLISHMENT OF A JOINT WORKING GROUP
1.
The Parties may establish a Joint Working Group comprising officials from related
institutions of the two countries to facilitate the implementation of this
Memorandum of Understanding. The level of participation, number of members
in the Joint Working Group will be discussed and decided by the Parties.
2.
The Joint Working Group will monitor, evaluate and review the implementation of
this Memorandum of Understanding regularly and submit the report to the
Executing Agencies and Joint Commission for Bilateral Cooperation between the
Republic of Indonesia and the Republic Democratic of Timor-Leste.
3.
The Joint Working Groups will be co-chaired by representatives of the Ministry of
Women's Empowerment and Child Protection of the Government of the Republic
of Indonesia and the Secretary of State for the Promotion of Equality of the
Government of the Democratic Republic of Timor-Leste.
4.
The Joint Working Group will establish the procedures, plans and recommended
programs of the cooperation toward achieving its aim through the Executing
Agencies as mentioned in Article Ill.
5.
The Joint Working Group will meet annually, intersessionally, alternately in
Indonesia or Timor-Leste. In circumstances where the Parties are unable to meet,
documents will be exchanged in lieu of such meeting through diplomatic channels.
Article VI
FINANCIAL ARRANGEMENTS
The financial
arrangements
to
cover expenses
for the
cooperative
activities
undertaken within the framework of this Memorandum of Understanding shall be
mutually decided upon by the respective Parties and shall be subject to the availability
of funds, personnels and resources of the Parties.
Article VII
INTELLECTUAL PROPERTY RIGHTS
1.
The protection of Intellectual Property Rights shall be enforced in conformity with
the respective national laws, rules and regulations of the Parties and with other
international agreements ratified by both Countries.
2.
The use of the name, logo, and/or official emblem of any of the Parties on any
publication, document and/or paper is prohibited without the prior written
approval of either Party.
3.
Notwithstanding anything in paragraph 1 above, the Intellectual Property Rights in
respect of any technological development and any products and services
development carried outa.
Jointly owned by the Parties or research results obtained through the joint
activity effort of the Parties shall be jointly owned by the Parties in
accordance with the terms to be mutually agreed upon; and
b.
Solely and separately by the Party of the research results obtained through
the sole and separate effort of the Party, shall be solely owned by the
Party concerned.
Article VIII
LIMITATION OF THE ACTIVITES OF PERSONNEL
1.
Each Party shall assure that its personnel involved in the activities related to this
Memorandum of Understanding shall respect political independence, sovereignty,
and territorial integrity of the host country, shall have a duty not to interfere in
internal affairs of the host country and shall avoid any activities inconsistent with
the purpose and objective of this Memorandum of Understanding .
2.
The violation of the paragraph 1 of this Article may result in revocation of all
permits of the personnel concerned and other necessary measures in accordance
with the prevailing laws and regulations of the host country.
Article IX
CONFIDENTIALITY
1.
Each Party shall undertake the confidentiality and secrecy of documents,
information, and other data received from, or supplied to, the other Party during
the implementation of this Memorandum of Understanding or any other
agreements made pursuant to this Memorandum of Understanding.
2.
Both Parties agreed that the provisions of this article shall continue to be binding
between the Parties notwithstanding the termination of this Memorandum of
Understanding.
Article X
SUSPENSION
Each Party reserves the right for reasons of national security, national interest, public
order or public health to suspend temporarily, either in whole or in part, the
implementation of this Memorandum of Understanding which suspension shall take
effect immediately after notification has been given to the other Party through
diplomatic channels.
Article XI
CHANGES
This Memorandum of Understanding may be changed at any time by mutual written
consent of both Parties. Such changes will enter into effect on such a date as may be
determined by the Parties and shall form an integral part of this Memorandum of
Understanding.
Article XII
SETTLEMENT OF DIFFERENCES
Any differences arising out of the interpretation and/or implementation and/or
application of any of the provisions of this Memorandum of Understanding shall be
settled amicably by the Parties through consultations, without reference to any third
party or international tribunal.
Article XIII
ENTRY INTO FORCE, DURATION AND TERMINATION
1.
This Memorandum of Understanding shall enter into force on the date of signing
and shall remain in effect for a period of three years. It shall be automatically
extended for a further period of two years.
2.
This Memorandum of Understanding may be te rminated by either Party at any
t ime by giving three (3) months prior notice to the other Party t hrough diplomatic
channels of its intention to terminate it.
3.
The termi nation of this Memorandum of Understanding shall not affect the
implementation of on-going arrangements, activities and/or programmes which
have been decided prior to the da te of the termination of this Memorandum of
Understanding.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their
respective Governments, have signed this Memorand um of Understanding.
SIGNED in duplicate in Jakarta on this Fifth day of the month of October in the year of
Two Thousand and Twelve in the Indonesian and English languages, all text being
equally authentic. In the event of divergences of interpretation between any of the
texts, the English language te xt shall prevail.

Pasal Ill

untuk

Kesetaraan.
Pasal IV
PELAKSANAAN
1.
Memorandum Saling Pengertian ini akan dilaksanakan sesuai hukum, undangundang, peraturan dan kebijakan nasional masing-masing negara serta kewajiban

Pasal V
PEMBENTUKAN KELOMPOK KERJA BERSAMA
1.
Para Pihak dapat membentuk Kelompok Kerja Bersama yang terdiri dari para

Pemberdayaan
Perempuan
Indonesia
Sekretaris
dan
dan
Perlindungan
Negara
untuk
Anak
Peningkatan
Pemerintah
Republik
Kesetaraan
Republik
Demokratik Timor-Leste.
4.
Kelompok Kerja Bersama akan menetapkan prosedur, perencanaan dan program
yang direkomendasikan bagi kerjasama untuk mencapai tujuan melalui Lembaga
Pelaksana sebagaimana dimaksud dalam Pasal Ill.
5.
Kelompok Kerja Bersama akan bertemu setiap tahun, antar sesi, secara bergantian
di Indonesia atau Timor-Leste. Bilamana Para Pihak tidak dapat melakukan
pertemuan,
dokumen
akan
dipertukarkan
melalui jalur diplomatik sebagai
pengganti pertemuan tersebut.
Pasal VI
PENGATURAN KEUANGAN
Pengaturan pembiayaan kegiatan dalam rangka pelaksanaan Memorandum Saling
Pengertian ini akan diputuskan bersama oleh Para Pihak didasarkan pada ketersediaan
anggaran, personil dan sumberdaya Para pihak.
Pasal VII
HAK ATAS KEKAYAAN INTELEKTUAL
1.
Perlindungan Hak atas Kekayaan lntelektual akan dilaksanakan sesuai hukum,
undang-undang, peraturan dan kebijakan nasional masing-masing negara serta
kewajiban internasional yang berlaku di masing-masing Pihak.
2.
Penggunaan nama, logo, dan/atau lambang resmi dari salah satu Pihak pada
setiap
publikasi,
dokumen
dan/atau
naskah
tidak
diperkenankan
tanpa
persetujuan tertulis sebelumnya dari Pihak lainnya.
3.
Tanpa mengabaikan ayat (1) di atas, Hak Atas Kekayaan lntelektual terkait
pengembangan
teknologi
dan
produk
serta
pengembangan
layanan
akan
dilaksanakan:
a.
Kepemilikan bersama oleh Para Pihak atau hasil penelitian yang diperoleh
melalui upaya kegiatan bersama akan dimiliki bersama oleh Para Pihak
sesuai ketentuan yang akan disepakati bersama; dan
b.
Secara sendiri dan terpisah hasil penelitian yang diperoleh oleh salah satu
Pihak melalui usaha sendiri, akan dimiliki oleh Pihak tersebut.
Pasal VIII
PEMBATASAN KEGIATAN PERSONIL
1.
Para
Pihak akan menjamin personilnya yang terlibat dalam kegiatan yang
berhubungan dengan Memorandum Saling Pengertian ini akan menghormati
kebebasan politik, kedaulatan, dan integritas wilayah negara tuan rumah, serta
tidak mencampuri urusan internal negara tuan rumah dan akan menghindari
kegiatan yang tidak sejalan dengan maksud dan tujuan Memorandum Saling
Pengertia n ini.
2.
Pelanggaran terhadap ayat 1 di atas akan mengakibatkan pencabutan semua izin
dari personil yang bersangkutan dan tindakan lain yang diperlukan sesuai dengan
hukum dan peraturan perundang-undangan yang berlaku di negara tuan rumah.
Pasal IX
KERAHASIAAN
1.
Para Pihak akan menjaga kerahasiaan dokumen, informasi, dan data lainnya yang
diterima, atau diberikan oleh Pihak lainnya selama pelaksanaan Memorandum
Saling
Pengertian
ini
atau
persetujuan
lainnya
yang
dibuat
berdasarkan
Memorandum Saling Pengertian ini.
2.
Kedua Pihak menyetujui bahwa ketentuan-ketentuan pada pasal ini akan terus
mengikat Para Pihak meskipun Memorandum Saling Pengertian ini telah berakhir.
PasalX
PENUNDAAN
Setiap Pihak berhak, dengan alasan keamanan nasional, kepentingan
ketertiban
sementara,
umum
secara
atau
kesehatan
keseluruhan
masyarakat,
atau
sebagian,
untuk
melakukan
terhadap
nasional,
penundaan
pelaksanaan
dari
Memorandum Saling Pengertian ini, dimana penundaan tersebut berlaku serta merta
setelah pemberitahuan diberikan pada Pihak lain melalui saluran diplomatik.
Pasal XI
PERUBAHAN
Memorandum Saling Pengertian ini dapat diubah setiap saat dengan persetujuan
tertulis dari kedua Pih a k. Peruba ha n terse but mu la i berla ku pad a tangga I yang
ditetapkan oleh Para Pihak dan menjadi bagian tidak terpisahkan dari Memorandum
Saling Pengertian ini.
Pasal XII
PENYELESAIAN PERSELISI HAN
Setiap perbedaan yang timbul dari penafsiran dan/atau
pelaksanaan dan/atau
penerapan setiap ketentuan dari Memorandum Saling Pengertian ini akan diselesaikan
secara damai oleh Para Pihak melalui konsultasi tanpa campur tangan dari pihak ketiga
atau pengadilan internasional.
Pasa l XIII
MULAI BERLAKU, JANGKA WAKTU DAN PEMBATALAN
1.
Memora ndum Sa ling Pengertian ini mu lai berlaku pada tanggal penandatanganan
untuk jangka waktu tiga tahun. Memorandum Saling Pengertian ini akan
diperpa njang secara otomatis untuk j angka waktu dua tahun.
2.
Memorandum Saling Pengertian ini dapat diakhiri setiap saat oleh salah satu Pihak
dengan memberikan pemberitahuan tiga (3) bulan sebelumnya kepada Pihak lain
melalui saluran diplomatik mengenai keinginannya tersebut.
3.
Pembatalan Memorandum Saling Pengertian ini tidak akan mempengaruhi
pelaksanaan
dari
pengaturan,
kegiatan
dan/atau
program
yang
sedang
berlangsung yang telah diputuskan sebelum tanggal pembatalan dimaksud.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah diberi kuasa oleh Pemerintah
masing-masing, menandatangani Memorandum Saling Pengertian ini.
DITANDATANGANI dalam rangkap dua di Jakarta pada tanggal Lima bulan Oktober
tahun Duaribu Duabelas dalam ba hasa Indonesia dan lnggris, semua naskah memiliki
kekuatan hukum yang sama . Da lam hal terjadi perbedaan penafsiran, maka naskah
dalam ba hasa lnggris yang akan berlaku.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA
AND
THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE
ON
COOPERATION IN THE FIELD OF WOMEN'S EMPOWERMENT
AND PROMOTION OF GENDER EQUALITY
The Government of the Republic of Indonesia and the Government of the Democratic
Republic of Timor-Leste (hereinafter referred to singularly as the Party and collectively
as the Parties);
RECOGNIZING the importance of women's empowerment and the promotion of
gender equality in national development;
REALIZING sharing experiences and exchanging information can build government
capacity, increase knowledge and promote success in the implementation of policies
and programs to achieve the above mentioned goals;
DESIRING to strengthen and broaden mutual cooperation in the areas of capacity
building and policy strengthening in their respective countries;
BELIEVING that cooperation_ in the area of women's empowerment and the promotion
of gender equality would benefit both countries;
TAKING INTO ACCOUNT the Joint Communique concerning Diplomatic Relations
between the Republic of Indonesia and the Democratic Republic of Timor-Leste, signed
atJakarta, on 2nd of July 2002;
PURSUANT TO the prevailing laws and regulations in their respective countries;
HAVE DECIDED as follows:
Article I
OBJECTIVE
The Parties shall endeavor to take all necessary measures to promote and develop
cooperation in the field of women's empowerment and promotion of gender equality.
The Parties decide to provide a framework within which proposals for capacity building
programs and professional interaction between the Parties are to be jointly considered
on the basis of reciprocity and mutual benefit.
Article II
AREAS OF COOPERATION
The Parties will endeavor to take necessary steps to encourage and promote
cooperation in the following areas:
a.
Institutional capacity building;
b.
Program design and development in relation to women empowerment and
gender equality;
c.
Gender mainstreaming and gender responsive budgeting;
d.
Any other areas of cooperation to be mutually decided upon by the Parties.
Article Ill
EXECUTING AGENCY
The executing agencies responsible for the implementation of this Memorandum of
Understanding on behalf of the Government of the Republic of Indonesia shall be the
Ministry of Women's Empowerment and Child Protection and on behalf of the
Government of the Democratic Republic of Timor-Leste shall be the Secretary of State
for the Promotion of Equality.
Article IV
IMPLEMENTATION
1.
The Memorandum of Understanding will be implemented in accordance with the
laws, rules, regulations and national policies in each country and in accordance
with their respective international obligations.
2.
The details of the Arrangement, Programs or Projects conducted under this
Memorandum of Understanding will be regulated on a case by case basis through
diplomatic channels, which will be specified, inter alia the objectives, programmes
and activities, location of the project or program, duration, the agencies involved,
financial provisions and other details related to the specific action conducted by
all participants involved under this Memorandum of Understanding. The aforesaid
details shall form an integral part of this Memorandum of Understanding.
Article V
ESTABLISHMENT OF A JOINT WORKING GROUP
1.
The Parties may establish a Joint Working Group comprising officials from related
institutions of the two countries to facilitate the implementation of this
Memorandum of Understanding. The level of participation, number of members
in the Joint Working Group will be discussed and decided by the Parties.
2.
The Joint Working Group will monitor, evaluate and review the implementation of
this Memorandum of Understanding regularly and submit the report to the
Executing Agencies and Joint Commission for Bilateral Cooperation between the
Republic of Indonesia and the Republic Democratic of Timor-Leste.
3.
The Joint Working Groups will be co-chaired by representatives of the Ministry of
Women's Empowerment and Child Protection of the Government of the Republic
of Indonesia and the Secretary of State for the Promotion of Equality of the
Government of the Democratic Republic of Timor-Leste.
4.
The Joint Working Group will establish the procedures, plans and recommended
programs of the cooperation toward achieving its aim through the Executing
Agencies as mentioned in Article Ill.
5.
The Joint Working Group will meet annually, intersessionally, alternately in
Indonesia or Timor-Leste. In circumstances where the Parties are unable to meet,
documents will be exchanged in lieu of such meeting through diplomatic channels.
Article VI
FINANCIAL ARRANGEMENTS
The financial
arrangements
to
cover expenses
for the
cooperative
activities
undertaken within the framework of this Memorandum of Understanding shall be
mutually decided upon by the respective Parties and shall be subject to the availability
of funds, personnels and resources of the Parties.
Article VII
INTELLECTUAL PROPERTY RIGHTS
1.
The protection of Intellectual Property Rights shall be enforced in conformity with
the respective national laws, rules and regulations of the Parties and with other
international agreements ratified by both Countries.
2.
The use of the name, logo, and/or official emblem of any of the Parties on any
publication, document and/or paper is prohibited without the prior written
approval of either Party.
3.
Notwithstanding anything in paragraph 1 above, the Intellectual Property Rights in
respect of any technological development and any products and services
development carried outa.
Jointly owned by the Parties or research results obtained through the joint
activity effort of the Parties shall be jointly owned by the Parties in
accordance with the terms to be mutually agreed upon; and
b.
Solely and separately by the Party of the research results obtained through
the sole and separate effort of the Party, shall be solely owned by the
Party concerned.
Article VIII
LIMITATION OF THE ACTIVITES OF PERSONNEL
1.
Each Party shall assure that its personnel involved in the activities related to this
Memorandum of Understanding shall respect political independence, sovereignty,
and territorial integrity of the host country, shall have a duty not to interfere in
internal affairs of the host country and shall avoid any activities inconsistent with
the purpose and objective of this Memorandum of Understanding .
2.
The violation of the paragraph 1 of this Article may result in revocation of all
permits of the personnel concerned and other necessary measures in accordance
with the prevailing laws and regulations of the host country.
Article IX
CONFIDENTIALITY
1.
Each Party shall undertake the confidentiality and secrecy of documents,
information, and other data received from, or supplied to, the other Party during
the implementation of this Memorandum of Understanding or any other
agreements made pursuant to this Memorandum of Understanding.
2.
Both Parties agreed that the provisions of this article shall continue to be binding
between the Parties notwithstanding the termination of this Memorandum of
Understanding.
Article X
SUSPENSION
Each Party reserves the right for reasons of national security, national interest, public
order or public health to suspend temporarily, either in whole or in part, the
implementation of this Memorandum of Understanding which suspension shall take
effect immediately after notification has been given to the other Party through
diplomatic channels.
Article XI
CHANGES
This Memorandum of Understanding may be changed at any time by mutual written
consent of both Parties. Such changes will enter into effect on such a date as may be
determined by the Parties and shall form an integral part of this Memorandum of
Understanding.
Article XII
SETTLEMENT OF DIFFERENCES
Any differences arising out of the interpretation and/or implementation and/or
application of any of the provisions of this Memorandum of Understanding shall be
settled amicably by the Parties through consultations, without reference to any third
party or international tribunal.
Article XIII
ENTRY INTO FORCE, DURATION AND TERMINATION
1.
This Memorandum of Understanding shall enter into force on the date of signing
and shall remain in effect for a period of three years. It shall be automatically
extended for a further period of two years.
2.
This Memorandum of Understanding may be te rminated by either Party at any
t ime by giving three (3) months prior notice to the other Party t hrough diplomatic
channels of its intention to terminate it.
3.
The termi nation of this Memorandum of Understanding shall not affect the
implementation of on-going arrangements, activities and/or programmes which
have been decided prior to the da te of the termination of this Memorandum of
Understanding.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their
respective Governments, have signed this Memorand um of Understanding.
SIGNED in duplicate in Jakarta on this Fifth day of the month of October in the year of
Two Thousand and Twelve in the Indonesian and English languages, all text being
equally authentic. In the event of divergences of interpretation between any of the
texts, the English language te xt shall prevail.
