THE GOVERNMENT OF THE REPUBLIC OF FRANCE
The Government of the Republic of Indonesia and the Government of the
Re public of France, with a view to facilitate the development of Indonesia,
agreed on the following provisions.
ARTICLE I A total amount of FIVE HUNDRED AND THIRTY NINE MILLION FRANCS (539 MF)
is put at the disposal of the Government of the Republic of Indonesia in the form
of c redits for the financing of goods and services ordered from France for
economic development projects in Indonesia :
- 239 MP for the projects mentioned in the attached annex ;
- 300 MF for projects to be defined in an exchange of letters between
both parties.
ARTICLE II The credits set in article I consist of a loan from the French Treasury
to the Ministry of Finance, acting on the account of the Indonesian Government,
of TWO HUNDRED AND THIRTY SEVEN MILLION ONE HUNDRED AND SIXTY THOUSAND FRANCS
(237,16 MF) and banker's credits guaranteed by the French Treasury coming to a
total amount of THREE HUNDRED AND ONE MILLION EIGHT HUNDRED AND FORTY THOUSAND
FRANCS (30 1,84 MF) .
ARTICLE III The loans from the Treasury and the guaranteed bankers' credits which
are ex tended in conjunction with the former will be respectively utilized in the
proportion of 44 % and 56 % of the contract allocated on the present protocol .
The rights of drawing on the Treasury loan will thus be equal to 44 %
of the value of the contract goods requirement ordered in France for each
contract .
ARTICLE IV The loans from the French Treasury mentioned in article II have a
duration of thirty three (33) years and are repayable in forty equal and
successive semi-annual instalments, the first one fall i ng due 162 months afte r
the end of the calendar half year during which drawings have been made and bear
an interest of 1,5 % per annum .
The interest due on the balance is repayable at the end of each
calendar half-year . An agreement on the implementation between the Credit
National, acting on account of the French Government, and the Ministry of Finance
of the Republic of Indonesia acting on account of the Indonesian Government, will
stipulate the terms and conditions of utilization and repayment of these loans .
ARTICLE V The guaranteed bankers' credits mentioned Ln article II will be
redeemed in ten (10) years by twenty (20) equal and successive qemi-annual
instalments, the first one falling due si x months after the completion of the
project or the delivery (ies) of equipments, or the final delivery of the
services, as stipulated in the commercial contract or in the bankers' credits
agreement. The rate of interest is the current export rate to which is added the
cost of credit insurance of COFACE .
A financial agreement between the French Institutions and the Ministry
of Finance of the Republic of Indonesia will stipulate, if neces6ary , the
modalities of utilization and reimbursement of these guaranteed banker 's
credits .
ARTICLE VI Each order is subject to a contract between the French supplier and the
Indonesian buyer, the qualification of which into the present agreement requires
a prior approval of the competent French and Indonesian authorities .
French franc will be used as currency of account and currency of
payment of the contract.
A down-payment of at least 10 % of the amount of the contract will be
paid when placing the order by drawing on the Treasury loan and the balance will
be settled between the order and its receipt in conformity with the terms a nd
conditions of the contract, by jointly and proportionally utilizing the means of
financing foreseen in article II in accordance with the modalities of article Ill
of the present agreement .
ARTICLE VII The ultimate date for the signing of the contract (s) to be financed
under the present agreement is set at December 31, 1987.
No drawing may be made from the Treasury loans allocated by the present
protocol after December 31, 1989.
ARTICLE VIII The contracts financed under the present Protocol are invoiced at
F. O. B. price . However, financing of freight and insurance may be provided through
use of the Treasu r y loans and guaranteed export-credits in the proportions
referred to in Article II supra, when :
- transport is executed under a bill of lading issued by a French
shipowner and supported by a certification issued by French Board of Merchant
Marine ;
- the insurance is contracted with a French firm .
ARTICLE I X -
The present agreement enters into force on the date of its s ignature .
IN WITNESS THERETO, the undersigned, duly authorised
for this purpose by their respective Governments,
have signed this AgreemPnt and have affixed hereto
their seal.

Le Gouvernement de la Republique de l'Indonesie et le Gouvernement de
la Republique ｆｲ｡ｮｾｩｳ･＠
sont convenus des dispositions s uivantes en vue de
faciliter le developpement economique de l'Indonesie .
ARTICLE I Une somme globale de CINQ CENT TRENTE NEUF MILLIONS DE FRANCS (539 MF)
est mise a la disposition du Gouvernement de la Republique de l'Indonesie sous
forme de credits, pour le financement de biens et services commandes en France
pour des projets de developpement economique de l'Indonesie
- 239 MF pour les projets mentionnes en annexe ;
- 300 MF pour les projets dont la liste sera arr@tee par echange de
lettres entre les signataires du present protocole .
ARTICLE Il Les concours financiers prevus a l'article I ci-dessus soot constitues
d'un pr@t du Tresor ｦｲ｡ｮｾｩｳ＠
au ｍ ｩｮｳｴｾｲ･＠
des Finances de la Republique
d'Indooesie, agissant pour lecompte de l'Etat indonesien, d'un montant maximum
de DEUX CENT TRENTE SEPT MILLIONS CENT SOIXANTE HILLE FRANCS (237 , 16 MF) et de
credits bancaires garantis par le Tresor ｆｲ｡ｮｾｩｳ＠
d'un montant maximum de
TROIS CENT UN MILL IONS HUIT CENT QUARANTE HILLE FRANCS (301,84 MF) .
ARTICLE III Les prets du Tresor et les credits bancaires garantis qui les
accompagnent seront utilises dans les proportions de 44 % et 56 % respectivement
pour chaque contrat impute s ur le present protocole.
Les droits de tirage sur les prets du Tresor seront done egaux a 44 %
de la valeur des biens commandes en France au titre de chacun de ces contrats .
ARTICLE IV Les prets du Tresor ｆｲ｡ｮｾｬｳ＠
mentionnes A !'article II ci-dessus ont
une duree de trente trois (33) ans et soot amortissables en quarante (40)
semestrialites egales et successives, la ｰｲ ･ｭｩｾｲ＠

du semestre civil au coors duquel auront ete effectue les tirages . Ils portent
interet au taux de L,S% l'an .
Les interets s ur le solde dO soot payables a la fin de chaque semestre
civil . Une convention d'application entre le ｍｩｮｳｴｾｲ･＠
des Finances de la
Republique d'Indonesie, agissant pour lecompte du Gouvernement Indonesien et le
Credit National, agissant pour lecompte du Gouvernement ｆｲ｡ｮｾｩｳ
Ｌ＠ precisera les
modalites d'utilisation et de remboursement de ces prets .
ARTICLE V Les credits bancaires garantis mentionnes A !'article II ci-dessus sont
amortissables en dix ans par semestrialites egales et successives , la premiere
echeant six mois apres l'achevement du projet ou la (les) date(s) de livraison
des equipements, ou la fin des prestations de services , selon les stipulations du
contrat commercial ou de la convention de credit bancaire . Leur taux ､Ｇｩｮｴ･ｲｾ＠
est le taux usuel des credits A !'exportation auquel s 'ajout e le coa t de
!'assurance-credit de la COFACE.
Un accord financier entre les etablissements bancaires ｆｲ｡ｮｾｩｳ＠
et le
Ministere des Finances de la Republique d'Indonesie precisera , si necessaire, les
modalites de !' utilisation et du remboursement de ces credits bancaires
garantis .
ARTICLE VI Chaque commande fait l'objet entre le fo urnisseur ｦｲ｡ｮｾｩｳ＠
et
l'acheteur indonesien d'un contrat dont ! 'admission sur le present protocole doit
ｾｴｲ･＠
prealablement approuvee par les autorites ｦｲ｡ｮｾｩｳ･＠

La monnaie de compte et la monnaie de paiement des cont rats est le

Un acompte egal a 10 % au moins du montant du contrat est paye a la
