TERORGANISASI SPANYOL (CITCO)
TENTANG PEMBERANTASAN TERORISME INTERNASIONAL
Sadan Nasional Penanggulangan Terorisme (BNPT) dan Pusat lntelijen
Melawan Terorisme dan Kejahatan Yang Terorganisasi Spanyol (CITCO) yang
selanjutnya disebut "Lembaga",
Mempertimbangkan kebutuhan untuk membangun kerangka kerja untuk
memfasilitasi kerja sama antara kedua negara untuk mengatasi ancaman
keamanan dan kejahatan lintas negara yang terjadi di dalam wilayah masingmasing negara.
Mempertimbangkan
internasional
di
juga
semua
kebutuhan
tingkatan
untuk
memperkuat
kerja
dalam memerangi terorisme
sama
secara
komprehensif.
Berhasrat untuk meningkatkan kerja sama penanggulangan terorisme antara
instansi terkait dari kedua negara, sesuai dengan hukum dan peraturan
perundangan di masing-masing negara.
Telah mencapai kesepahaman sebagai berikut:
I.
Tujuan
Nota Kesepahaman ini akan menjadi kerangka kerja sama dalam
mencegah dan memerangi terorisme internasional dalam segala bentuk
serta membangun peningkatan kapasitas atas dasar saling menghormati
kedaulatan , kesetaraan dan saling menguntungkan.
II.
Bentuk Kerja Sama
Kedua Lembaga akan mengimplementasikan Nota Kesepahaman ini
sesuai hukum nasional masing-masing, dalam salah satu atau seluruh
kegiatan berikut:
1. Berbagi informasi tentang peraturan perundangan, kebijakan nasional
dan strategi;
2. Pertukaran pandangan, pengalaman dan praktik terbaik;
3. Mendorong kerja sama antar lembaga penegak hukum kedua
negara;
4. Memperkuat pembangunan kapasitas dan kemampuan melalui
jaringan dan program pelatihan dan pendidikan;
5. Pertukaran kunjungan pejabat tinggi, analis dan operator lapangan;
6. Seminar, lokakarya dan konferensi, yang sesuai;
7. Kerja sama lainnya yang dapat disepakati oleh kedua Lembaga.
Ill.
Pendanaan
1. Pelaksanaan
Nata
Kesepahaman
ini
akan
bergantung
pada
ketersed iaan dana dan pejabat dari masing-masing Lembaga.
2. Kecuali disepakati lain secara tertulis, setiap Lembaga akan
menanggung biaya dan pengeluaran untuk partisipasi dalam setiap
keg iatan di bawah Nota Kesepahaman ini. Biaya akan masuk pada
anggaran
rutin
tah unan
perundangan yang berlaku.
Lembaga,
sesuai
dengan
peraturan
IV.
Penyelesaian Perselisihan
Setiap perselisihan yang timbul dari penafsiran atau pelaksanaan Nota
Kesepahaman ini akan diselesaikan secara damai melalui konsultasi
atau negosiasi antara kedua Lembaga melalui saluran diplomatik.
V.
Kerahasian
Setiap informasi rahasia yang diberikan oleh salah satu Lembaga
berdasarkan Nota Kesepahaman ini, akan tunduk pada peraturan
perundangan nasional masing-masing negara.
VI.
Perubahan
Nota Kesepahaman ini dapat diubah atau direvisi, apabila dianggap
perlu, dengan persetujuan tertulis dari dua Lembaga. Perubahan atau
revisi tersebut akan berlaku pada tanggal sebagaimana dapat ditentukan
oleh kedua Lembaga.
VII.
Jangka Waktu dan Pengakhiran
1. Nota Kesepahaman akan berlaku pada tanggal penandatanganan.
2. Nota Kesepahaman ini akan diterapkan selama tiga (3) tahun dan
setelah berakhir akan secara otomatis diperpanjang selama tiga (3)
tahun berikutnya.
3. Salah satu Lembaga dapat setiap saat menghentikan berlakunya
Nota
Kesepahaman
ini dengan menyampaikan pemberitahuan
tertulis terlebih dahulu tiga bulan sebelumnya kepada Lembaga
lainnya.
4. Dokumen ini tidak mengikat secara hukum atau tunduk pada hukum
internasional.
SEBAGAI BUKTI , yang bertanda tangan di bawah ini diberi kewenangan
oleh Pemerintah masing-masing telah menandatangani Nota Kesepahaman ini.
DITANDATANGANI di Madrid pad a tanggal 20 bu Ian Oktober 2015,
dalam rangkap tiga (3) masing-masing dalam bahasa Indonesia, Spanyol dan
lnggris, semua naskah memiliki keabsahan yang sama. Dalam hal terjadi
perbedaan penafsiran, maka naskah dalam bahasa lnggris yang berlaku.

LA AGENCIA NACIONAL DE INDONESIA CONTRA EL TERRORISMO (BNPT)
y
LA AGENCIA ESPANOLA, CENTRO DE INTELIGENCIA CONTRA EL
TERRORISMO Y EL CRIMEN ORGANIZADO (CITCO)
EN LA LUCHA CONTRA EL TERRORISMO INTERNACIONAL
La Agencia Nacional de Indonesia contra el Terrorismo (BNPT) y el Centro de
lnteligencia contra el Terrorismo y el Crimen Organizado (CITGO), en lo
sucesivo, «Firmantes»,
Considerando la necesidad de establecer un marco que facilite la cooperaci6n
entre los dos paises para hacer frente a amenazas de seguridad y los delitos
transnacionales que ocurren en el territorio de cualquiera de los paises;
Teniendo en cuenta tambien la necesidad de fortalecer la cooperaci6n
internacional en todos los niveles en la lucha contra el terrorismo de manera
integral;
Deseando
mejorar la
cooperaci6n
antiterrorista entre
los organismos
competentes de los dos paises, de conformidad con sus respectivas leyes y
reglamentos vigentes;
Han acordado lo siguiente:
I.
Objetivo
Este Memorando de Entendimiento proporcionara un marco para la
cooperaci6n en la prevenci6n y la lucha contra el terrorismo internacional en
todas sus formas y la creaci6n de capacidad sabre la base del respeto
mutuo de la soberania, la igualdad y el beneficio mutuo.
II.
Formas de cooperaci6n
Ambas lnstituciones pondran en marcha este Memoranda de Entendimiento,
de conformidad con sus respectivas legislaciones internas, en cualquiera o
todos los siguientes actividades:
1. lntercambio de informaci6n sabre la legislaci6n, las politicas y estrategias
nacionales ;
2. lntercambio de puntos de vista, experiencias y mejores practicas;
3. Promover la cooperaci6n entre las fuerzas de seguridad de ambos paises;
4. Fortalecimiento de la creaci6n de capacidades y habilidades a traves de
redes y programas de formaci6n y educaci6n;
5. El intercambio de visitas de altos funcionarios , analistas y operadores de
cam po;
6. Seminaries, talleres y conferencias, segun corresponda;
7. Otras areas que se acuerden por los Firrnantes .
Ill.
Financiaci6n
1. La implementaci6n de este Memoranda de Entendimiento estara sujeta a
la disponibilidad de fondos y de los funcionarios de cada Firmante.
2. A menos que se acuerde lo contrario por escrito, cada Parte correra con
los gastos derivados de su participaci6n en las actividades del presente
Memoranda de Entendimiento. Los gastos estaran condicionados a los
presupuestos
anuales
legislaci6n vigente.

Soluci6n de Diferencias
Cualquier disputa que surja de la interpretaci6n o aplicaci6n del presente
Memorando de Entendimiento se solucionara amistosamente mediante

V.
Confidencialidad
Cualquier informaci6n confidencial proporcionada por una Parte en virtud del
presente Memoranda de Entendimiento quedara sujeta a las respectivas
legislaciones nacionales.
Modificaciones
VI.
El presente Memorandum de Entendimiento podra ser modificado o
revisado, segun se considere necesario, por consentimiento mutuo por
escrito de ambas lnstituciones. Esta modificaci6n o revision sera aplicable en
una fecha que se determine por las lnstituciones.
VII.
Duraci6n y Terminaci6n
1. El Memorando de Entendimiento sera aplicable en la fecha de su firma.
2. Este Memorandum de Entendimiento se aplicara durante tres (3) afios, al
termino del mismo se renovara automaticamente por otros tres (3) anos.
3. Cualquiera de las lnstituciones podra en todo momenta poner fin el
presente Memorandum de Entendimiento con tres meses de antelaci6n
por escrito a la otra Parte.
4. Este documento no es juridicamente vinculante ni esta sometido a
Derecho Internacional.
EN FE DE LO CUAL, los abajo firmantes , debidamente autorizados por sus
respectivos Gobiernos, firman el presente Memoranda de Entendimiento.
FIRMADO por duplicado en Madrid el dia 20 de octubre de 2015, cada uno en
idioma indonesio, espanol e Ingles, siendo todos los textos igualmente validos.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE INDONESIAN NATIONAL COUNTER TERRORISM AGENCY (BNPT)
AND
THE SPANISH INTELLIGENCE CENTER AGAINST TERRORISM AND
ORGANIZED CRIME (CITCO)
ON COMBATING INTERNATIONAL TERRORISM
The Indonesian National Counter Terrorism Agency (BNPT) and the Spanish
Intelligence Centre against Terrorism and Organized Crime (CITCO) hereinafter
referred to as "Institutions",
Consideri ng the need to establish a framework to facilitate cooperation
between the two countries to address security threat and transnational crimes
occurring within the territory of either country;
Considering also the need to strengthen international cooperation at all levels
in combating terrorism in a comprehensive manner;
Desiring to enhance counter-terrorism cooperation between relevant agencies
of the two countries, pursuant to their respective prevailing laws and
regulations;
Have reached the following understanding:
I.
Objective
This Memorandum of Understanding will provide a framework for
cooperation in preventing and combating international terrorism in all its
forms and capacity building on the basis of mutual respect for
sovereignty, equality and mutual benefit.
II.
Forms of Cooperation
Both Institutions will implement this Memorandum of Understanding, in
accordance with their respective domestic laws, in any or all of following
activities:
1. Sharing of information on legislation, national policies and strategies;
2. Exchange of views, experience and best practices;
3. Promoting cooperation between the two countries' law enforcement
agencies;
4. Strengthening capacity building and capabilities through networking
and programs of training and education;
5. Exchange of visits of high officials, analysts and field operators;
6. Seminars, workshop and conferences, as appropriate;
7. Other areas that may be agreed by the Institutions.
Ill.
Funding
1. The implementation of this Memorandum of Understanding will be
subject to the availability of funding and officials of each Institution.
2. Unless otherwise agreed in writing, each Institution will bear the cost
and
expenses
for
its
participation
in
activities
under this
Memorandum of Understanding. The expenses will be subject to the
Institutions' annual regular budgets, pursuant to the legislation in
force.
IV.
Solution of Disputes
Any dispute arising out of the interpretation or implementation of this
Memorandum of Understanding will be solved amicably through
consultations or negotiations between the two Institutions through
diplomatic channels.
V.
Confidentiality
Any confidential information provided by one Institution pursuant to this
Memorandum of Understanding will be subject to the respective national
legislation.
VI.
Modifications
This Memorandum of Understanding may be amended or revised , as
deemed necessary, by mutual written consent of the two Institutions.
Such amendment or revision will be applicable on such a date as may be
determined by the Institutions.
VII. Duration and Termination
1. The Memorandum of Understanding will be applicable on the date of
its signature.
2. This Memorandum of Understanding will be applied for three (3)
years and upon the expiry thereof will be automatically renewed for
another three (3) years.
3. Either Institution may terminate this Memorandum of Understanding
at any time by giving three months advance written notice to the
other Institution .
4. This document is not legally binding or subject to international law.
IN WITNESS WHEREOF, the undersigned being duly authorized by their
respective Governments have signed this Memorandum of Understanding.
SIGNED in duplicate in Madrid on the day 20 of October 2015, each in
Indonesian, Spanish and English language, all texts being equally valid . In case
of any divergence of interpretation, the English text shall prevail.

THE SPANISH INTELLIGENCE CENTER AGAINST TERRORISM AND
ORGANIZED CRIME (CITCO)
ON COMBATING INTERNATIONAL TERRORISM
The Indonesian National Counter Terrorism Agency (BNPT) and the Spanish
Intelligence Centre against Terrorism and Organized Crime (CITCO) hereinafter
referred to as "Institutions",
Consideri ng the need to establish a framework to facilitate cooperation
between the two countries to address security threat and transnational crimes
occurring within the territory of either country;
Considering also the need to strengthen international cooperation at all levels
in combating terrorism in a comprehensive manner;
Desiring to enhance counter-terrorism cooperation between relevant agencies
of the two countries, pursuant to their respective prevailing laws and
regulations;
Have reached the following understanding:
I.
Objective
This Memorandum of Understanding will provide a framework for
cooperation in preventing and combating international terrorism in all its
forms and capacity building on the basis of mutual respect for
sovereignty, equality and mutual benefit.
II.
Forms of Cooperation
Both Institutions will implement this Memorandum of Understanding, in
accordance with their respective domestic laws, in any or all of following
activities:
1. Sharing of information on legislation, national policies and strategies;
2. Exchange of views, experience and best practices;
3. Promoting cooperation between the two countries' law enforcement
agencies;
4. Strengthening capacity building and capabilities through networking
and programs of training and education;
5. Exchange of visits of high officials, analysts and field operators;
6. Seminars, workshop and conferences, as appropriate;
7. Other areas that may be agreed by the Institutions.
Ill.
Funding
1. The implementation of this Memorandum of Understanding will be
subject to the availability of funding and officials of each Institution.
2. Unless otherwise agreed in writing, each Institution will bear the cost
and
expenses
for
its
participation
in
activities
under this
Memorandum of Understanding. The expenses will be subject to the
Institutions' annual regular budgets, pursuant to the legislation in
force.
IV.
Solution of Disputes
Any dispute arising out of the interpretation or implementation of this
Memorandum of Understanding will be solved amicably through
consultations or negotiations between the two Institutions through
diplomatic channels.
V.
Confidentiality
Any confidential information provided by one Institution pursuant to this
Memorandum of Understanding will be subject to the respective national
legislation.
VI.
Modifications
This Memorandum of Understanding may be amended or revised , as
deemed necessary, by mutual written consent of the two Institutions.
Such amendment or revision will be applicable on such a date as may be
determined by the Institutions.
VII. Duration and Termination
1. The Memorandum of Understanding will be applicable on the date of
its signature.
2. This Memorandum of Understanding will be applied for three (3)
years and upon the expiry thereof will be automatically renewed for
another three (3) years.
3. Either Institution may terminate this Memorandum of Understanding
at any time by giving three months advance written notice to the
other Institution .
4. This document is not legally binding or subject to international law.
IN WITNESS WHEREOF, the undersigned being duly authorized by their
respective Governments have signed this Memorandum of Understanding.
SIGNED in duplicate in Madrid on the day 20 of October 2015, each in
Indonesian, Spanish and English language, all texts being equally valid . In case
of any divergence of interpretation, the English text shall prevail.
