MEMORANDUM OF UNDERSTANDING

GENERAL

1.

THIS MEMORANDUM expresses t he understandings
of the Government of the Republic of Indonesia
and the Government of Australia concern i ng the
responsibilities and contributions respec t ively of the t wo Governments in regard to the

co-operation pro j ect in support of the Design
Unit of the Water Resources Division of the
West Java Provincial Public Works (hereinafter
referred to as t he Project) located in Bandung
and which is intended tp upgrade the capability of the Design Unit of the Water Resources
Division of the West Java Provincial Public
Works as further described and detailed in
Annex 1 to th is Memorandum .

AUTIIORITIES

2.

The Executing Authorities for this Project
will be :
f-or the Indonesian Government: Direk t orat
Jenderal Pengairan , Departemen Pekerjaan
Umum (The Directorate General of Water
Resources Development of the Ministry of
PubJic Works) .

For the Australian Government : The Austra l ian
Development Assistance Bureau of the
Departmen t of Foreign Affairs .
The Australian Developmen t Assistance Bureau
may nominate suitably qualified agents to
undertake any part of its functions on its
behalf .

DURATION

3.

This Memorandum will t ake effect from the
date of its signature and the Project will
be deemed to have commenced from that da t e .

The Australian contribution to the Project
and all undertakings given herein will
cease 2 years after the date of signature
of this Memorandum or on such other date
as may subsequently be agreed between the
two Governments.
PROJECT
ORCANTSATTON

4.

Responsibility for development and
direction of the Project will be vested

in a Project Co-ordinating Board, whose
chairman will be appointed by the
Indonesian Government. Membership of the
Board will include the Australian Team
Leader, who is to be appointed by the
Australian Co-ordinating Authority and
agreed upon by the Indonesian Government.
Membership of the Board will also include
representatives of the Indonesian
Government Ministry referred to in Clause
2 above, or nominated at the discretion
of the Indonesian Government, as well as
a nominee designated by the Australian
Embassy accredited to Indonesia . The
Board will meet not less than twice per
year of as required.

5.

Functions of the Project Co-ordinating

Board will include :
(a)

co-ordinating policy for the Project;
reviewing, evaluating and reporting
on progress to the tlvo Governments;
and
recommending to the two Governments
changes in program , budget .and.
future development.

RESPONSIBILITY

6.


Overall responsibility for this Project
will rest with the Government of
Indonesia. The final authority for
decisions on implementation of the agreed
works program shall rest with the
Directorate General of Water Resources
Development after considering consultations between the Indonesian Project
Manager and the Australian Team Leader.
The respective responsibilities of the
Indonesian Project Manager and the
Australian Team Leader are further
described in Annex II.

CONTRIBUTIONS

7.

The contributions o£ the Indonesian and
Australian Governments are detailed in
Annex I and are estimated to value

Rp.350,000,000 and $A 1.3 million
respectively. Disbursement of the
Indonesian and Australian Governments'
contributions will be subject to the
normal annual Parliamentary approval of
Appropriations.

EVALUATION

8.

An evaluation of progress of the Project
may be made at times arranged between
and mutually convenient to, the
Indonesian and Australian Governments .
Such an evaluation would be undertaken
by a joint investigation team appointed
by the two governments and independent
of staff involved in the Project .

PERSONNEL

10.

For the purposes of this Project, the
Indonesian Government will, in
accordance with existing laws and
regulations, facilitate the employment
by the Australian Government or its
agent of personnel as required for the
Project and established between the two
Governments by:
(a)

granting exemption from income or
other taxes on Project salaries

and allowances;

(b)

gTanting exemption from import and
other duties on personal and
household effects;

(c)

granting to Australian Project
personnel all rights and entitlements
accorded to the aid personnel of any
other donor country;

(d)

expediting the issue of all
documentation required for the entry
of, and performance of work by,

Project personnel, including work
permits or certificates and drivers'
licences for eligible persons; and

(e)

granting exemption from import duties
on one commercial motor vehicle per
expert on condition that it either be

or sold to a person duty
paid on its assessed value at time of
sale within Indonesia, or granting
exemption from taxes and duties on
the purchase in Indonesia of one
locally assembled motor vehicle per
expert.

SUPPLIES

10.

(a)

The Indonesian Government will in
accordance with Indonesian laws
and regulations: exempt from
import duties and other taxes (or
pay such duties thereon) all goods
supplied for the established
purposes of the Project as set out
in Annex 1;

(b)

The Indonesian Government wUl
facilitate movement of Project
equipment and supplies by providing
appropriate customs and wharfage
facilities in the port closest to
the Project site and will be
responsible for the expeditious
transport of such equipment and
supplies to the site; and

(c)

Project equipment and supplies
provided by Australia shall be
available for the unrestricted
use of the Project and shall not
be withdrawn from such use without
the consent of the Project Coordinating Board. The Australian
Team Leader in consultation with
the Indonesian Project Manager
shall exercise administrative
control over such supplies for the
duration of the Project .

LIABILITY

11.

The Indonesian Government shall be
responsible for dealing with any claims
which may be brought by third parties
against Australia and its experts,
agents or Australian personnel and
shall hold harmless Australia and its
experts, agents and personnel in case
of any claims or liabilities resulting
from operations under this Memorandum .
This provision shall not relieve any
person from liability for any criminal,
grossly negligent or fraudulent act .

SECURITY

12 .

The Indonesian Government will arrange
for any protection deemed necessary to
ensure the safety of Australian
personnel, Project and personnel
equipment both at the Project location,
in transit and on any other official
representational activity in Indonesia .
The Australian Goverrunent will take
reasonable precautions to ensure that
Australian personnel have due regard
for local traditions and customs .

SETTLEMENT OF
DIFFERENCES

13 .

Any disputes arising out of the
interpretation of implementation of the
Memorandum shall be settled amicably by
consultation or negotiation between the
two Governments .

AMENDMENTS

14.

Amendments to this Memorandum may be
made at any time by an Exchange of
Letters between the two governments.

OF THE WEST JAVA PROVI NC lAL PUBLT C WORKS.

A.

OBJECTIVES

The objective of this project is to establish an
efficient and effective Design Unit within the 1\'ater Resources
Oivision of the Publ1c Works Department.
The ProJect area is the southern セ・」エッイ@
of the West
.1:lva Province and it is the Indonesian Government ' s intention to
develop this section of the Province by exploiting the water
resources of the river basins by the implementation of small to
medium sized irrigation schemes. Although the project area is
the southern sector of the Province, this should not restrict the
Team from assisting in other parts of the Pro vi nee, if req11es ted
under the direction of the Project Manager, at the discretion of
t11e Team Leader.
The project will upgrade the technical and professional
capabilities of the Design Unit to enable it to develop an overall
plan for the efficient use of |セ。エ・イ@
resources in the Province
including an inventory of those water resources and to effectively
administer water resource projects involving irrigation, flood
mitigation, and swamps drainage etc. The prime and long term
objective of the Design Unit is to provide for services which
will lead to improved ウエ。ョ、イセ@
of living in the area through
jncreased rice production and improved cropping patterns of the
upland and dryland regions.
The proposed Australian assistanLe to the Design Unit
will take the form of the provision ot a team of design experts
and equipment ッカ・イセ@
two yedr period . The form of aid from the

nesign Team will primarily be training th e staff of the Planning and
Design Unit by novice, involvement and on-the-job training using a
counterpart arrangement. The team will also collate data and
undertake studies to enabl c 1·ecommenda tions to he made on the future
courses of action necessary to develop the project area to its full
potential , in both irrigation anti rainfcJ agriculture. The scope of
work will involve preliminary studies and project ゥ、」ョエセ。ッL@
the preparation of a pre-feasibility report for one of the proposed
development areas (the Cikaso River Project Area) and general investigation, planning, design and operations nnd maintcnnnce advice.

B.

AUSTRAL I AN CONTRJ BUTl ON

(a)

The Australian Government will provide:

professional and technical staff (including tge
payment of their salaries, allowances and travel
between Australia and Bandung, Indonesia) as
listed in Attachment "A";
accommodation, including basic furniture, for
the long term expatriate staff ;
equipment and vehicles as listed in Attachment
"C" or suitable equivalents;
aircraft hire for reconnaissance purposes;
provision of field accommodation. Bedding ,
cooking and ancillary equipment for field
accommodation'will be the respobslhility of the
Indonesian Government;
training awards for practical training in
Australia for key Indonesian staff associated
with the Project .
